West Orange Avenue Library Auditorium. The meeting was called to order by Mayor Damonte at 7:34 PM. The Pledge of Allegiance to the Flag was recited. Present: Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Abs en t: Non e. The City Clerk requested the addition of a resolution entitled, A RESOLUTION PROVIDING FOR THE HOLDING OF A GENERAL MUNICIPAL ELECTION IN THE CITY OF SOUTH SAN FRANCISCO ON THE 7TH DAY OF MARCH, 1978, DESIGNATING AND CONSOLIDATING PRECINCTS, DESIGNATING POLLING PLACES, APPOINTING PRECINCT ELECTION OFFICERS AND OTHER RELATED MATTERS. He stated that the information needed had been received from the County Election Department on Monday, and if this resolution was adopted this evening it would not be necessary for an adjourned meeting on Wednesday, January 25, 1978. There being no objections, it was so ordered. The City Clerk read the following items on the Consent Calendar: City Council Minutes of the Special Meeting of December 16, 1977; and the Regular Meeting of December 21, 1977 - Motion to approve. 2. Award the Bid for Filing Equipment for the Police Department - Motion to award. Claim filed by Neil D. Eisenberg, Esq., on behalf of Dexter Puccio, alleging personal injuries sustained as a result of the actions of the South San Francisco Police Department - Motion to deny and refer to the City's insurance carrier and to the Office of the City Attorney. 445 CONSENT CALENDAR APPROVAL OF BILLS JANUARY 18, 1978 Councilman Padreddii moved, seconded by Councilman Battaglia and regularly carried that the Consent Calendar be approved as presented. Mayor Damonte asked if there was a motion approving the Regular Bills of January 18, 1978. Councilman Borba stated, "Before the motion is made I would like to refrain on voting on the following due to the fact that I do business with the following companies." Councilman Battaglia moved, seconded by Councilman Padreddii and regularly carried. Councilman Borba stated, "Mr. Mayor, I want the record to show that I did not participate in the vote." Mayor Damonte ordered the claims amended to delete the claims listed by Councilman Borba and called for a motion to approve the claims as amended. Continued Public Hearing -- Precise Plan of Design/ Design Criteria/Design Review Board. Staff Report, dated January 18, 1978, recommending that Council continue this item to a date certain. AN ORDINANCE AMENDING ORDINANCE NO. 353, AS AMENDED, ENTITLED, "ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO," ESTABLISHING A DESIGN REVIEW PROCEDURE AND DESIGN REVIEW BOARD, AND REPEALING SECTION 5.5 ENTITLED "ARCHITECTURAL CONTROL." The City Manager requested that both this item and the one following be continued to a date certain suggesting 30 days. Mayor Damonte declared the public hearing opened and asked if anyone present wished to speak in favor of or in opposition to the matter. There being no one to speak and there being no objections, Mayor Damonte continued the public hearing to the regular meeting of February 15, 1978. Continued Public Hearing --ZA-77-7/Zoning Amendment - Additional Parking Provisions. Staff Report, dated January 18, 1978, recommending that Council continue this item to a date certain. AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO, ORDINANCE NO. 353, AS AMENDED (SECTION 4.131). Mayor Damunte declared the public hearing opened and asked if there was anyone present who wished to speak in favor of or in opposition to the matter. There being no one to speak and there being no objections, Mayor Damonte continued the public hearing to the regular meeting of February 15, 1978. 1118/78 Page 3 447 CITY MANAGER ORD. NO. 756-78 AMENDING ZONING ORD 353 - HOUSING AUTH SITE 2nd Reading/Adoption 7 RESO. NO. 6-78 AUTH SUBMITTAL OF SECTION 701 COMPREHENSIVE PLANNING ASSISTANCE GRANT ? Staff Report, dated January 4, 1978, recommending that Council read for the second time and adopt an ordinance amending the General Plan from Low Density to Medium- High Density Residential and rezoning from R-1 Single- Family Residential to R-P-D-10 Residential Planned Unit Development on the Housing Authority property located at the southerly terminus of "A", "B" and "C" Streets. Mayor Damonte ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for adoption and passage. Councilman Battaglia moved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Padreddii and passed by unanimous vote. Councilman Battaglia moved that the ordinance entitled, AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO AMENDING ORDINANCE NO. 353, AS AMENDED, ENTITLED "ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO" AND ESTABLISHING RESIDENTIAL PLANNED UNIT DEVELOPMENT (R-P-D-10) - HOUSING AUTHORITY SITE, the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Padreddii and passed by the following roll call vote. Roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Noes, none. Absent, none. Staff Report, dated January 18, 1978, recommending that Council review the 701 Comprehensive Planning Assistance Grant Application and adopt a resolution authorizing the City Manager to file the application. The City Planner explained the application for the revitalization of the Downtown area and the grant which was to be received for this purpose. Discussion followed between Council and staff relative to obtaining the signed approval of the Downtown property owners, studies made in the past for this program and the recently held meetings with the property owners and merchants during which ti~e this program was discussed. 1/18/78 Page 4 CITY MANAGER RESO. NO. 757-78 ADOPTING UNIFORM PLUMBING CODE, 1976 EDITION, AND 1977 AMENDMENTS 2nd Reading/Adoption Councilman Padreddii then introduced a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING THE SUBMITTAL OF A SECTION 701 COMPREHENSIVE PLANNING ASSISTANCE GRANT. Roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Noes, none. Absent, none. Staff Report, dated January 18, 1978, recommending that Council approve the selection of D'Amico & Associates to prepare preliminary architectural plans; Ecomonics Research Associates to prepare a preliminary market analysis; and Fitzgerald, Berg & Edgar to perform legal services as needed for the Downtown Revitalization Project. Discussion followed concerning the bids received. After a brief explanation by the City Planner, Councilman Padreddii moved, seconded by Councilman Battaglia and regularly carried that the recommendation of the City Planner be approved and accepted. Staff Report, dated January 18, 1978, recommending that Council, by motion, approve continuance of the $5.00 fine for the parking meter violations as initially approved by City Council on January 21, 1976. The Police Chief explained the reasons for the recommendation to continue with the $5.00 fine and then reviewed his Staff Report in detail. Discussion followed, after which Councilman Padreddii moved, seconded by Councilman Borba that the parking meter violation fines be reduced to $3.00. After further discussion motion as made and seconded was regularly carried. Public Hearing -- Adoption of Uniform Plumbing Code, 1976 Edition, and 1977 Amendments. Staff Report, dated January 18, 1978, recommending that Council read for the second time and adopt the ordinance adopting the Uniform Plumbing Code, 1976 Edition, and 1977 Amendments. The Director of Public Services briefly explained the .matter, after which Mayor Damonte declared the public hearing opened and asked if there was anyone present who wished to speak in favor of or in opposition to the ordinance. NO. 758-78 ADOPTING UNIFORM MECHANICAL CODE, 1976 EDITION 2nd Reading/Adoption The Director of Public Services called Council's attention to a correction in the ordinance, after which Mayor Damonte ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for adoption and passage. Councilman Battagliamoved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Battaglia and passed by unanimous vote. ITEMS FROM STAFF LEAGUE OF CALIFORNIA CITIES SEMINAR Councilman Borba moved that the ordinance entitled, AN ORDINANCE ESTABLISHING MINIMUM REGULATIONS FOR INSTALLATION AND MAINTENANCE OF HEATING, VENTILATING, COOLING AND REFRIGERATION SYSTEMS; ADOPTING BY REFERENCE THE UNIFORM MECHANICAL CODE, 1976 EDITION; AND REPEALING ORDINANCE 572, the entire reading of which has been waived, be passed and adopted, seconded by Councilman Battaglia and passed by the following roll call vote. Councilman Padreddii introduced a resolution entitled: A RESOLUTION ACCEPTING A DEED OF DEDICATION OF EASEMENT FROM BRUNO FANUCCHI, MILDRED FANUCCHI, ARTHUR ROYCE AND VIRGINIA ROYCE - DRAINAGE EASEMENT (CAMARITAS AND ARROYO). Letter, dated December 28, 1977 from Alfred L. Bertetta, appealing the decision of the Planning Commission on Condition No. 4 of Parcel Map 77-152. At the request of staff and there being no objections, Mayor Damonte set the public hearing for February 15, 1978. Letter, dated December 21, 1977 from the Law Offices of Martin, Ryan and Martin, appea2ing the decision ~of the Planning Commission on DP-77-212/Challenge Development, Inc. At the request of staff and there being no objections, Mayor Dam~nte set the public hearing for February 15, 1978. The City Manager requested and received permission to attend the League of California Cities Seminar on Friday in San Diego as a moderator on Labor Relations. l/l 8/78 Page 7 451 ITEMS FROM COUNCIL USE OF PARKING DISTRICT LOTS BY RENTERS TREATMENT PLANT UPGRADING RELOCATION OF BADEN SCHOOL ?01 12 MILE HOUSE INSPECTION COST OF RELOCATING POLICE FACILITY TO VALUE GIANT BUILDING PAVING AROUND MANHOLE COVERS BINGO ORDINANCE LIGHTING IN WEST ORANGE AVENUE LIBRARY PARKING LOT Councilman Borba expressed concern regarding the development of apartment buildings in the downtown area with the Parking District lots being utilized for parking purposes. He suggested ordinance changes to curb this activity. Discussion followed during which time the City Manager and City Planner explained what was to be done and being done in this regard. In answer to Councilman Borba's inquiry the Director of Public Services gave an update report on the action of the Water Quality Control Board. He further stated that bids were to be opened and declared on January 24, 1978 for additional work to be done at the Sewage Treatment Plant. Councilman Padreddii commented on the recent article in the newspaper concerning the closing of certain schools by the Unified School District. He suggested that these schools be utilized by the Baden School and that the portable classrooms be removed to provide additional parking at the Magnolia site. Mayor Damonte requested staff to contact the School District by letter in this regard. In answer to Councilman Battaglia's inquiry, the City Planner gave Council an oral report on the recent inspection made of the 12 Mile House with the thought of restoring it as a historical landmark. He also commented on the structural condition of the building and the alternatives which were being explored. Councilman Mirri requested a report on the cost of relocating the Police facility if the ballot proposition were approved. He stated that the report should include the cost of moving the furniture and buying new furniture. In answer to Mayor Damonte's inquiry, the Director of Public Services reported to Council what was to be done with regard to the paving around certain Public Utility manhole covers which had not been completed since the City completed its repaying work on the streets. In answer to the Mayor's inquiry, the Police Chief gave an update report on the Bingo Ordinance. Mayor Damonte brought to Council's attention the darkness in the library parking lot after the last Council meeting. The Director of Public Services stated that it might have been that the automatic timer was not set for the right time and that he would bring this to the attention of Building Maintenance for correction. 1118178 Page 8 ADJOURNMENT There being nothing further, Mayor Damonte asked if anyone present had anything they wished to offer under Good and Welfare.
