80¸ ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD JUNE 15, 1978 TIME: PLACE: CALL TO ORDER:. PLEDGE OF ALLEGIANCE TO FLAG: ROLL CALL: AGENDA REVIEW CONSENT CALENDAR 3:30 PM. Council Conference Room, City Hall. The meeting was called to order by Mayor Borba at 3:40 PM. The Pledge of Allegiance to the Flag was recited. Present: Councilmen Ronald G. Acosta, William A. Borba and Terry J. Mirri, Councilwoman Roberta Cerri Teglia. Absent: Councilman Emanuele N. Damonte. Councilman Dam~nte appeared present at 3:45 PM and remained for the duration of the meeting. The City Manager stated that since the agenda for the June 21, 1978 Council meeting contained only a few items and the fact that two Councilmembers would be absent and one of the remaining Councilmembers would not be able to consider the Elmore appeal due to a conflict of interest, Council might consider taking up that agenda this evening. After a brief discussion and there being no objections, it was so ordered. The Deputy City Clerk read the following items on the Consent Calendar: me City Council Minutes of the Regular Meeting of May 17, 1978; the Adjourned Regular Meeting of May 23, 1978; the Special Meeting of May 23, 1978; the Adjourned Regular Meeting of May 31, 1978; and the Adjourned Regular Meeting of June 5, 1978 - Motion to approve. Claim filed by Gertrude Eberle alleging property damages resulting from a sanitary sewer backup - Motion to deny and refer to the City's insurance carrier and to the Office of the City Attorney. CONSENT CALENDAR (CONT' D. ) FINANCE RESO. N©. 76-78 AUTH EXPENDITURES PENDING ADOPTION OF OPERATING BUDGET FOR 1978-79 Claim filed by Arthur D. Dempsey, Esq., on behalf of Robert Rosa, alleging false imprisonment by the South San Francisco Police Department and physical injuries sustained during a strike at Pellegrini Wine Company - Motion to deny and refer to the City's insurance carrier and to the Office of the City Attorney. o Claim filed by Richard E. Peritz, Esq., on behalf of William Dykstra, alleging false imprisonment by the South San Francisco Police Department and physical injuries sustained during a strike at Pellegrini Wine Company - Motion to deny and refer to the City's insurance carrier and to the Office of the City Attorney. Se Claim filed by Michael J. McLaughlin, Esq., on behalf of Freight Checkers, Clerical Employees and Helpers Local No. 856, alleging loss of services of two business representatives who were engaged in union picketing at Pellegrini Wine Company and were falsely imprisoned by the South San Francisco Police Department - Motion to deny and refer to the City's insurance carrier and to the Office of the City Attorney. 6. Award of bid for laundry rental and service - Motion to award. 7. Award of bid for liquid chlorine for use at Wast,water Treatment Plant - Motion to award. Councilwoman Teglia moved, seconded by Councilman Acosta and regularly carried that the Consent Calendar be approved as presented. Staff Report, dated June 21, 1978, recommending that Council adopt a resolution authorizing the expenditure of funds pending adoption of the 1978-79 Operating Budget and Capital Improvement Budget. After an explanation by the Director of Finance and brief discussion, Councilwoman Teglia moved, seconded by Councilman Acosta and regularly carried that expenditures to the San Mateo County Convention and Visitors Bureau and Chamber of Commerce be excluded from this resolution. Councilwoman Teglia then introduced a resolution entitled: A RESOLUTION AUTHORIZING EXPENDITURES AND APPROPRIATIONS PENDING ADOPTION OF THE OPERATING BUDGET FOR 1978-79. 6/15/78 Page 2 FINANCE RESO. Staff Report, dated June 21, 1978, recommending that Council uphold the action of the Planning Commission and deny the appeal of UP-78-428 of James C. Elmore. At the reqUest of staff and there being no objections, Mayor Borba ordered the matter continued to the regular meeting of July 19, 1978. Public Hearing -- Abandonment of a 15 Foot Wide Portion of East Grand Avenue, South of the Railroad Tracks, East of Haskins Way. Staff Report, dated June 21, 1978, recommending that Council conduct a public hearing and then adopt a resolution ordering vacation of a portion of East Grand Avenue, south of the Southern Pacific Transportation Company tracks, from Haskins Way to 347 east of Haskins Way. A RESOLUTION ORDERING THE VACATION OF A PORTION OF EAST GRAND AVENUE. At the request of staff and there being no objections, Mayor Borba ordered the matter continued to the regular meeting of July 19, 1978. Council then interviewed the following applicants for appointment to the pOsition of City Clerk: Leticia Juarez Robert Peterson Phyllis Townsend Mayor Borba declared a recess at 4:45 PM The meeting was recalled to order by Mayor Borba at 4:50 PM with all Council present. MASS FOR DECEASED CITY EMPLOYEES Margaret Pettigrew Gloria Taormina Letter, dated May 9, 1978, from Remi J. Muyllaert resigning from the Colma Creek Advisory Board. Council accepted Mr. Muyllaert's resignation from the Colma Creek Advisory Board. Councilman Damonte then introduced a resolution entitled: A RESOLUTION EXPRESSING APPRECIATION TO REMI J. MUYLLAERT. Roll call vote was as follows: Ayes, Councilmen Ronald G. Acosta, William A. Borba, Emanuele N. Damonte and Terry J. Mirri, Councilwoman Roberta Cerri Teglia. Noes, none. Absent, none. Councilman Damonte informed Council that Mrs. Elva Dinning, who had been employed as a teacher with the South San Francisco School District for 33 years, is retiring. Mayor Borba requested that the City Attorney prepare a resolution commending Mrs. Dinning. The City Manager stated that he had received an Inter- Office Memorandum from Communications requesting that a six month leave of absence be granted to Shirley Ortega, Communications Dispatcher. Discussion followed between Council and staff concerning a reinstatement policy which is being considered as an addition to the proposed Personnel Rules and Regulations. Councilman Damonte then moved, seconded by Councilwoman Teglia and regularly carried to deny the leave of absence but in turn offer this person a replacement position providing that there is a position open. Councilman Mirri moved that the motion include the that the reinstatement question is being taken at this point on a case to case basis and is intended soley for this person. Councilman Damonte so amended his motion. Councilwoman Teglia seconded the amended motion as made, amended and seconded. In answer to Councilwoman Teglia's inquiry, Council instructed her to contact Father Durkin of Ail Souls Church and advise him that the City was still interested in continuing the practice of celebrating a Mass for deceased City employees. 6/15/78 Page 4 ITEMS FROM COUNCIL (CONT ' D. ) CONTRACT WITH SAN MATEO COUNTY CONVENTION & VISITORS BUREAU TRANSIENT OCCUPANCY TAX MARGARET PETTIGREW APPOINTED AS CITY CLERK DRIVEWAY REPAIR RECESS: RECALL TO ORDER: EXECUTIVE PERSONNEL SESSION Councilwoman Teglia stated that she was interested in determining if Council wished to authorize the City Attorney to investigate the possibility of cancelling the contract with the San Mateo County Convention and Visitors Bureau. The City Attorney suggested that Council give notice to the Convention and Visitors Bureau of the possible contract cancellation. Discussion followed concerning the proposed increase in the transient occupancy tax. Council then took up the matter of the appointment to the position of City Clerk. After a brief discussion of the applicants, Councilman Damonte moved, seconded by Councilman Mirri and regularly carried to appoint Mrs. Margaret Pettigrew as City Clerk. Further discussion followed concerning the salary which should be established for this position, after which Councilman Damonte moved, seconded by Councilwoman Teglia and regularly carried that the person who performs the duties of City Clerk receive $300 per month in addition to their present salary for those duties, that this be increased by $50 at the termination of six months of duty and then increased another $50 after an additional six months, bringing the increase to $400 per month which would continue to the end of the two years. City Clerk Pro Tempore Teglia then administered the Oath of Office to Mrs. Margaret Pettigrew, City Clerk. Councilman Damonte stated that he had received a complaint from Gordon Capurro concerning a repair that needed to be made in his driveway by the City. The City Manager replied that Mr. Capurro would have to meet with the City Engineer before the work could be performed. He also advised Council that staff would submit a report in this regard. Mayor Borba recessed the meeting at 6:50 PM to an Executive Personnel Session. The meeting was recalled to order at 6:58 PM with all Council present. Mayor Borba announced that Council met in Executive Personnel Session to consider a personnel matter with no action or roll call vote having been taken. 6115178 Page 5 ADJOURNMENT There being nothing further to come before Council, Councilman Acosta moved, seconded by Councilman Damonte and regularly carried that the meeting be adjourned.
