MINUTES CITY COUNCIL CITY OF SOUTH SAN FRANCISCO REGULAR MEETING DECEMBER 11, 2002 MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE CALL TO ORDER: 7:30 p.m. (Cassette Tape No. 1) ROLL CALL: Present: Councilmembers Fernekes and Green, Mayor Pro Tem Matsumoto and Mayor Gonzalez Absent: None PLEDGE OF ALLEGIANCE: Led by Mayor Gonzalez INVOCATION: Reverend John Cantley, Grace Covenant Church PRESENTATION Action for Better Cities - Rebecca Elliot, League of California Cities, gave an overview of the non-profit agency, and presented a video on the legislative vote of SB905 that was carded on CSPAN on August 31, 2002. She stated that SB905 was a bill to stop the League from collecting funds for "Save Our Services" (refer to Agenda Item No. 7). AGENDA REVIEW Mayor Gonzalez announced that Agenda Item Nos. 13 and 14 would be considered after the Consent Calendar. PUBLIC COMMENTS Mr. Joel Guerrero, 144 Ramona Avenue, informed Council of a complaint that was filed against him regarding his fence not complying with City codes. Mayor Gonzalez directed staff to meet with Mr. Guerrero. Mrs. Sophie Mason, 10 Arlington Drive, stated support for an appointment to Council rather than an election. She stated that Council should look at the candidate who came in fourth in the November 6, 2001 election and to take into consideration how the voters voted. ITEMS FROM COUNCIL · Community Forum · Subcommittee Reports Councilman Femekes stated he participated in the Thanksgiving Fun Run and attended St. Veronica' s retirement celebration for Father Smith. He stated that the budget subcommittee (Fernekes/Green) met to discuss budget proposals that will be recommended to Council. Councilman Green reported that he attended the League of California Cities' Peninsula Division meeting and Councilman Fernekes was elected president for 2003. He stated that he is serving on the CDBG subcommittee with Mayor Pro Tem Matsumoto regarding the allocation of funds, and that he participated in the Thanksgiving Fun Run, and attended Santa Comes to Town, and the Friend of Parks and Recreation mixer at Terrabay. He stated that he attended Assemblyman Mullin's swearing in ceremony in Sacramento on December 2 and wrote a letter to Reader's Digest correcting a reference that South San Francisco is Genentech's home base and not San Francisco. Mayor Pro Tem Matsumoto thanked the Chamber for participating in Santa Comes to Town and the Mr. and Mrs. Ng for sponsoring their annual Thanksgiving breakfast at McDonald's, and recognized Maria Martinucci for graduating from the Citizens' Police Academy. Mayor Gonzalez thanked code enforcement staff for attending the Old Town Homeowners Association meeting to discuss the Community Task Force, and police department staff for offering the Citizens' Police Academy. He advised the community to be prepared for another series of rainstorms this coming weekend and announced that the fire and police departments are accepting toys and canned good donations for needy families. CONSENT CALENDAR Motion to approve the minutes of the November 13 and 20, 2002 special meetings and November 6 and 13, 2002 regular meetings o Motion to confirm expense claims of December 11, 2002 in the amount of $3,371,544.28 o Resolution No. 103-2002, approving the City of South San Francisco's Disadvantage Business Enterprise (DBE) Program through September 30, 2003 Resolution No. 104-2002, authorizing execution of an agreement with the County of San Mateo for the reconstruction of Dorado Way and Constitution Way Resolution of Intention No. 105-2002 and amendment to the contract with the Board of Administration, California Public Employees' Retirement System (PERS) to provide Section 21548 Pre-retirement Optional Settlement 2 Death Benefits for Local Safety Fire Members o Resolution 106-2002, adopting the PARS retirement enhancement plan for the City Manager Resolution establishing a voluntary payroll contribution program for City employees to protect local govemment services Item pulled from the Consent Calendar. REGULAR CITY COUNCIL MEETING MINUTES DECEMBER 11, 2002 PAGE 2 8. Motion to cancel regular meeting of December 25, 2002 9. Acknowledgement of proclamation issued: Medical Center Day, November 21, 2002 Mayor Pro Tem Matsumoto requested Item No. 7 be pulled from the Consent Calendar. Mayor Gonzalez announced a speaker's card was received for Item No. 7. Motion-Fernekes/Second-Matsumoto: To approve the Consent Calendar with the exception of Item No. 7. Unanimously approved by voice vote. Item No. 7: Staff report presented by Finance Director Steele. Ms. Kathleen Beebe, AFSCME business agent, 144 Brentwood Drive, stated her concern that this type of PAC (political activities committee) is an anti-agency shop. She requested the item be tabled until the union has a chance to talk with Council. Motion-Femekes/Second-Green: To table a resolution establishing a voluntary payroll contribution program for City employees to a date uncertain. Unanimously approved by voice vote. 14. Informational report on investment oversight services Mayor Pro Tern Matsumoto requested the item be referred back to the subcommittee for a recommendation before Council takes action and requested a replacement for former Councilmember Mullin. Councilman Femekes concurred with the referral back to the subcommittee and volunteered to serve on the subcommittee. City Treasurer Bonalanza-Ford recommended that Council hear the staff report and consider the item this evening. Mayor Pro Tem Matsumoto stated the information being provided was not what she requested and that there are other issues to address. Mayor Gonzalez appointed Councilman Fernekes to the Finance subcommittee. Motion-Matsumoto/Second-Femekes: To refer the item back to the Finance subcommittee. Unanimously approved by voice vote. 13. Consideration of resolution amending Sections 2 and 9 of Resolution No. 105-01, adopting a military leave policy for non-career National Guard or military reserve personnel Staff report presented by Human Services Director Bower. Mr. Frank C. Deering, VFW, 2595 Sherwood Drive, San Bruno, spoke in favor of extending the military leave benefits for an additional twelve months. REGULAR CITY COUNCIL MEETING DECEMBER 11, 2002 MINUTES PAGE 3 Mr. Mike Krause, SSF Professional Firefighters Union, spoke in favor of extending the military leave benefits for another year for Firefighter Gary Kibbee. Mr. Steve Van Zant, AFSCME Local 1569 President, 1120 Park Pacifica Avenue, Pacifica, spoke in favor of extending the military leave benefits for an additional twelve months. Mr. Lou Paulson, 4th District Vice President, California Professional Firefighters, 1780 Creekside Oaks, Sacramento, spoke in favor of extending the military leave benefits for an additional twelve months for Firefighter Gary Kibbee. Mr. Shelley Kessler, Executive Secretary-Treasurer, San Mateo County Central Labor Council, 1153 Chess Drive, #200, Foster City, spoke in favor of extending the military leave benefits for an additional twelve months. Mr. Darby Reid, 249 Alta Mesa Drive, spoke in favor of extending the military leave benefits for an additional twelve months. City Attorney Mattas clarified the difference between the two recommended resolutions is that the first resolution pertains to events of 9-11 and that the second resolution includes 9-11 and any potential military conflict with Iraq. He stated that both resolutions sunset on December 31, 2003. Councilman Fernekes stated support for continuing the military leave benefits for an additional year and recognized Firefighter Gary Kibbee for his contributions to the fire department that were related to his military training. Councilman Green stated his support for extending the military leave benefits for an additional year and urged Council to continue its commitment that was demonstrated after the events of 9-11. Mayor Pro Tem Matsumoto questioned how the vacancy has been addressed by the fire department. She suggested that Congressman Lantos' office or State officials be contacted for assistance, lessening the burden at the City level, or consideration be given to offering the Kibbee family an interest free loan. She stated her previous support for public safety issues, but has fiduciary responsibilities and cannot support a single focus issue. Mayor Gonzalez stated that when the request for an extension was first presented to Council on November 6 he was not able to fully understand the City's financial situation or the magnitude of potential vacancies that would leave the City understaffed. He stated he will support the extension that will end on December 31, 2003, and directed staff to write letters to Congressman Lantos and Congresswoman Pelosi as recommended by Mayor Pro Tem Matsumoto. Motion-Femekes/Second-Green: To approve Resolution 107-2002, amending Sections 2 and 9 of Resolution No. 105-01 adopting a military leave policy for non-career National Guard or military reserve personnel and to direct staff to prepare letters to REGULAR CITY COUNCIL MEETING DECEMBER 11, 2002 MINUTES PAGE 4 /ol Congressman Lantos, Congresswoman Pelosi, and U.S. Senators Feinstein and Boxer. Approved by the following roll call vote: AYES: Councilmembers Fernekes and Green and Mayor Gonzalez. NOES: Mayor Pro Tem Matsumoto. ABSTAIN: None. ABSENT: None. (Cassette Tape No. 2) PUBLIC HEARINGS 10. Consideration of resolution approving General Plan Housing Element Update (P02- 0021) and Negative Declaration (ND02-0021); Applicant: City of South San Francisco Staff report and visual presentation given by Chief Planner Sparks. He recognized Senior Planner Mike Lappen for his work on the update. Mayor Gonzalez asked for an explanation of AB 1866, allowing second units be handled ministerially. Chief Planner Sparks stated that the Planning Commission will be looking at the issue and will prepare appropriate standards for Council's review and adoption. It is anticipated that the recommendation will be brought to Council in Spring 2003, and will be in place before the bill goes into effect in July 2003. Public heating opened and closed. Motion-Fernekes/Second-Matsumoto: To approve Resolution 108-2002, adopting Negative Declaration ND02-0021 and adopting South San Francisco General Plan Housing Element Update GP-02-0021 affecting the City of South San Francisco Planning Area. Unanimously approved by voice vote. 11. Consideration of an ordinance amending Municipal Code Chapter 20.63, Terrabay Specific Plan District, to modify and clarify the setback and height requirements for accessory structures in Mandalay Point and Mandalay Heights; waive reading and introduce an ordinance Staff report and visual presentation given by Project Planner Knapp. Public heating opened and closed. Mayor Pro Tem Matsumoto expressed concern that property owners may convert subterranean unfinished areas into living units. In response to Councilman Green, staff stated that the requirements are comparable to City-wide requirements, but garden structures will only be allowed a maximum of 6' high. The homeowners association will be approving construction materials. Councilman Femekes confirmed with staff that Terrabay has CC&Rs and questioned the process to assure that residents follow the CC&Rs. City Attorney Mattas stated that there are provisions in the CC&Rs that allows the City to enforce them if the homeowners' association does not. Councilman Fernekes reiterated the concern that unfinished areas may be converted into living units. Project Planner Knapp responded that this issue has been addressed in numerous documents, including deed restrictions. REGULAR CITY COUNCIL MEETING DECEMBER 11, 2002 MINUTES PAGE 5 Motion-Green/Second-Matsumoto: To waive reading and introduce an ordinance amending Municipal Code Chapter 20.63 (Terrabay Specific Plan District). Unanimously approved by voice vote. 12. Consideration of resolution authorizing a ground lease between the City of South San Francisco and A.R.E. East Jamie Court, LLC of bayfront land for bay trail improvements; Applicant A.R.E East Jamie Court; Owner: Richard Haskins City Manager Wilson requested the public hearing be opened and testimony continue to January 8, 2003. Motion- Fernekes/Second-Green: To continue to the meeting of January 8, 2003, consideration of a resolution authorizing a ground lease between the City of South San Francisco and A.R.E. East Jamie Court, LLC, of bayfront land for bay trail improvements. Unanimously approved by voice vote. ADMINISTRATIVE BUSINESS 15. Resolution authorizing an increase in the penalty for parking violations as defined by the California Vehicle Code and the South San Francisco Municipal Code Staff report presented by Police Chief Raffaelli. Mayor Pro Tem Matsumoto asked for clarification on the reduction of abandoned vehicle fees, which Chief Raffaelli explained will be brought into alignment with other cities by lowering the fine to $100 and having the court add $171 in assessments. Motion-Fernekes/Second-Matsumoto: To approve Resolution No 109-2002, authorizing an increase in the penalty for parking violations as defined by the California Vehicle Code and the South San Francisco Municipal Code. Unanimously approved by voice vote. 16. Resolution changing the names of the private streets shown on the Terrabay Woods East and Woods West Subdivisions from Bay Street to Bayview Drive and Woods Street to Woods Circle Staff report presented by Public Works Director Gibbs. In response to Mayor Gonzalez's concern that residents were notified of the change, Director Gibbs confirmed that the affected streets are currently unoccupied. Motion-Green/Second-Fernekes: To approve Resolution No. 110-2002, changing the names of the private streets shown on the Terrabay Woods East and Woods West Subdivision Maps from Bay Street to Bayview Drive and from Woods Street to Woods Circle 17. Resolution approving personnel changes, including classification descriptions, salary ranges and unit designations for Fire Marshal and City Building Official REGULAR CITY COUNCIL MEETING DECEMBER 11, 2002 MINUTES PAGE 6 Staff report presented by Human Resources Director Bower. City Manager Wilson informed Council that the action being taken is part of the fire department reorganization, and staff will be coming back with recommendations regarding safety inspectors. Motion-Green/Second-Matsumoto: To approve Resolution 111-2002, approving classification descriptions, adjustments to salary schedules and/or unit designations. Unanimously approved by voice vote. LEGISLATIVE BUSINESS 18. Waive reading and introduce an ordinance amending SSFMC Chapter 3.12 to implement Council approved position title additions related to Fire Marshal and City Building Official Motion-Fernekes/Second-Matsumoto: To waive reading and introduce an ordinance amending Section 3.12.010 of the South San Francisco Municipal Code.
