RESOLUTION NO. 3315
A RESOLUTION ACCEPTING DEED CONVEYING FEE TO
RIGHT-OF-WAY FOR EAST HARRIS AVENUE AND A
PORTION OF HARBOR WAY
WHEREAS UTAH CONSTRUCTION & MINING CO. (Xormerly Utah
Construction Company, a corporation), a Delaware corporation (herein-
after, for purposes of convenience, referred to as "Corporation"),
is willing to convey to the City of South San Francisco the fee title
to the right-of-way for that certain public street known as "East
Harris Avenue" and also the fee title to a portion of the right-of-way
for the public street known as "Harbor Way" in return for said City's
paying to Corporation a reasonable sum therefor; and
WHEREAS it is in the best interests and welfare of the
City of South San Francisco that the fee title to the aforesaid
rights-of-way be acquired, provided that the same can be purchased
for a reasonable sum; and
WHEREAS it appears that the reasonable value of the afore-
said rights-of-way is Twelve Thousand One Hundred Dollars ($12,100.00),
as determined by the appraisal made by Ralph F. Clark, a duly licensed
and qualified appraiser of land,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
said City that said City shall, and it hereby does, accept that
certain duly executed and acknow±edged Grant Deed dated the 6th day
of November 1961, whereby Corporation does convey to said City fee
title to the rights-of-way mentioned in the premises hereto, and that
said City pay to Corporation in return therefor the sum of Twelve
Thousand One Hundred Dollars ($12,100.00); provided, however, that
Corporation shall, at its own expense~ furnish to the City of South
San Francisco a policy of title insurance insuring in said City
good and marketable title to said rights-of-way.
BE IT FURTHER RESOLVED that the City Clerk of said City
be, and he hereby is, directed to cause said Grant Deed, together
with a certified copy of this resolution and a draft of the City
drawn in the sum of Twelve Thousand One Hundred Dollars ($12,100.00)
(charged to the Harbor Way Assessment District's Fund) to De
iorwarded to the Redwood City Office of California Pacific Title
Insurance Company, with instructions to record said Deed and the
certified copy oi this resolution at such time as it is prepared to,
and does, issue, at the expense of Corporation, its policy of title
insurance, insuring in the City marketable title to the aforesaid
rights-of-way, whereupon said title insurance company may deliver to
Corporation said sum of Twelve Thousand One Hundred Dollars
($12,100.00).

I hereby certify that the foregoing resolution was
regularly introduced and adopted at a regular meeting of the City
Council of the City of South San Francisco held on the 6th day of
November 1961, by the following vote:
AYES, COUNCILMEN G.J. Rozzi, Patrick E. Ahern~ Emilio Cortesi,
Andrew Rocca, and Leo J. Ryan.
