CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION FINDING AND DETERMINING THE NEED FOR
CHANGES OR MODIFICATIONS TO THE CALIFORNIA BUILDING
CODE, 2001 EDITION
WHEREAS, Section 17958 of the Health & Safety Code requires the adoption by the City of
South San Francisco of regulations imposing the requirements of certain uniform industry codes as
specified in Health & Safety Code § 17922; and
WHEREAS, Health & Safety Code §17958.5 permits a city to make such changes or
modifications to the uniform codes as deemed reasonable because of local climatic, geological, or
topographical conditions; and
WHEREAS, Government Code § 50022.4 provides that when a code is adopted by reference,
penalty clauses are not deemed adopted by reference but may be enacted only if set forth in full in the
adopting ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San
Francisco that pursuant to the requirements of Health & Safety Code § 17958.7 and Government
Code §50022.4, the City Council finds and determines there is a need to adopt the following changes
or modifications to the California Building Code 2001 Edition, (Municipal Code Chapter 15.08), by
reason of local conditions:
1. Administrative Changes
Section 103.1, Violations, is restated and Section 103.2, Penalties, is added in light of
Government Code §50022.4 to conform with other Municipal Code provisions with regard to
penalties by specifying that violations are infractions rather than misdemeanors; to streamline
enforcement procedures by facilitating non-judicial enforcement, and to increase compliance
levels and encourage voluntary compliance.
Appendix Section 3311, Bonds and Insurance, is amended in accordance with local security
requirements and practices related to high local construction costs and property values.
These changes are administrative rather than technical in nature.
2. Climatic, Geological, and Topographical Changes
Modifications are made to section 1900.4.4, Minimum Slab Thickness, in an attempt to
better prevent leakage and dampness due to the City's frequently wet climate and soil
conditions, and to prevent possible foundation damage in earthquakes, due to the City's
proximity to the San Andreas Fault. The most significant change is that requiring a
waterproof membrane under the slab floor. Similarly, Section 1402.6, Weather-Resistive
Barriers, is amended due to local weather conditions, particularly rain, salt air, wind and
dampness. Section 1521 in Appendix chapter 15 is added to require spark arresters to be
installed on all chimneys when reroofing is performed. This is to help prevent spread of
embers to adjacent roof areas due to our local windy conditions.
b)
Grading and drainage requirements have been expanded. Section 1804.7.1, Foundation
Investigation, is amended due to wet conditions caused by the City's wet and rainy
climate. Appendix chapter 33, Excavation and Grading, is amended to impose specific
requirements as to hours of grading operations, transportation routes, and rainy season
restrictions, due to potential drainage problems associated with the City's rainy climate
and hilly topography. Appendix Section 3307, Hazards, and Section 3309, Grading
Permit Requirements, are modified to expand on requirements found in the Uniform
Building Code in light of local soil types such as clay strata, and local hilly terrain.
c) Matters Not Addressed in California Building Code
Since the Uniform Building Code does not address moving buildings, a provision
identified as Section 3404.1 has been added, since the City's proximity to the San
Andreas Fault and consequent earthquake risk limit the length of time before a permanent
foundation must be installed in order to ensure public safety. Section 3319, Restriction
of Work During Rainy Season, has been added to address local weather conditions,
specifically the City's frequent rainy climate.
3. California Building Code Provisions Deleted.
The fee provisions in Appendix Tables A33-A and A33-B are more appropriately covered in the
City's Master Fee Schedule and are therefore deleted.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause a copy of this
resolution, together with the ordinance making the changes or modifications to the California
Building Code and California Building Standards Code Standards, 2001 Editions, to be filed with the
State Department of Housing and Community Development and the California State Building
Standards Commission.

City Council of the City of South San Francisco at a regular meeting held on the 11th day of
February 2004 by the following vote:

Vice Mayor Raymond L. Green, and Mayor Karyl Matsumoto
