Absent: None AGENDA REVIEW Assistant City Manager Lee requested the Council consider hearing Item 2 first. PUBLIC COMMENTS Yahaira Mondragon urged the Council to allow retail cannabis clubs. ADMINISTRATIVE BUSINESS 2. Study Session: Cannabis - cultivation and distribution businesses. (Rozalynne Thompson, Associate Planner and Deborah Gill, Special Projects Manager) Special Projects Manager Gill presented a PowerPoint on cannabis cultivation and distribution businesses, summarizing the prior workshops and proposed timeline, and definitions of cannabis cultivation, cannabis distribution and cannabis retail. Associate Planner Thompson explained land use control considerations for cannabis cultivation and distribution businesses, including proposed zones for use. Special Projects Manager Gill suggested cannabis cultivation and distribution businesses adhere to the City's building codes and provide specific security requirements. She requested feedback from the Council as staff prepares ordinances for Planning Commission consideration. Councilmember Addiego requested clarification on banning delivery of marijuana. Assistant City Attorney D'Andrea clarified that the City could not ban use of roads through the City for deliveries but could ban deliveries within the City. Special Projects Manager Gill stated staff was proposing manufacturing East of 101. Councilmember Matsumoto requested Fire provide input on manufacturing. Mayor Gupta requesting allowing public comment prior to Council deliberation. Special Projects Manager Gill continued with staffs recommendations on testing, cultivation, distribution, and personal use. She presented maps of the proposed use areas. Lou Hanhan urged approval of cultivation,manufacturing and distribution of cultivation. Councilmember Matsumoto expressed confusion and indicate the Council had not had the opportunity to get feedback. She stated she was under the impression that the Council would discuss manufacturing and testing but had not received information. She asked if the other Councilmembers had gone on the tour. She stated she did not have adequate information to provide feedback. Councilmember Garbarino stated he could give his opinion but was not prepared to provide directive. Councilmember Matsumoto stated she wanted to hear from Fire and Police, and other cities throughout the County. Special Projects Manager Gill stated several other cities had made its determination but others were still deliberating. Councilmember Matsumoto asked for feedback on why decisions were made by other entities. She expressed concern about the need for additional staffing for enforcement. Councilmember Garbarino stated the Finance Department would be impacted as well. Councilmember Matsumoto questioned the various license types. Councilmember Garbarino asked if the City was covered until January. Assistant City Attorney D'Andrea clarified that the State would begin issuing licenses to locales in January 2018. She stated the moratorium could be extended for an additional ten months and 15 days, adopt a ban and continue studying. Councilmember Garbarino suggested additional study while obtaining additional data. He expressed concern about the tax revenue with a cash business. He suggested continuing looking into the questions raised by the Council. Councilmember Matsumoto expressed concern about the need for water and electricity for marijuana when the medians could not be watered. Vice Mayor Normandy asked the recommendations on delivery and distribution. Councilmember Addiego requested the reason for the staff recommendations. Councilmember Garbarino asked the difference between delivery and distribution. Special Projects Manager Gill explained that distribution as business to business and delivery only was from a business to the public. Special Projects Manager Gill explained that there were public facing businesses and delivery only. Vice Mayor Normandy suggested banning delivery businesses in South San Francisco. Mayor Gupta stated the Council could ban delivery in South San Francisco but deliveries could pass through the City. Councilmember Garbarino stated that was unenforceable. Mayor Gupta asked the justification or local for the staff's recommendations. Special Projects Manager Gill stated the basis for the recommendations were whether the use was similar to something already happening in the City and whether concerns had been expressed. Associate Planner Thompson explained the recommendation for indoor cultivation rather than outdoor cultivation. Councilmember Matsumoto asked who the staff was that was making the recommendation. Special Projects Manager Gill stated she and Associate Planner Thompson had been working with Legal, Fire, Police Department and Building. Councilmember Matsumoto requested hearing from the Fire Department and Code about risks, costs, and business requirements. Fire Marshall DaSilva explained support by the Fire Department. He stated the manufacturing process would be controlled by the Building and Fire Codes and inspected. He stated manufacturing, distribution, processing and testing could be regulated by existing codes. Councilmember Matsumoto appreciated the discretion to limit the number of manufacturers and that current codes could be utilized. Fire Marshall DaSilva stated the codes were not specific to cannabis. He stated the hope was that they would not get to Code Enforcement,rather be managed from Fire Prevention. Mayor Gupta expressed concern regarding the odor. Fire Marshall DaSilva stated that was not included in the Building or Fire Code. He stated the third-party reviewer would provide guidance. Councilmember Matsumoto asked if the City could mandate that the manufacturer pay for the third-party review. Mayor Gupta asked if cash business had been addressed. Fire Marshall DaSilva suggested the Police Department respond. Councilmember Addiego expressed concern with reporting of all cash businesses. Captain Carlino discussed safety and security regulations, similar to cash and carry businesses. He stated the long-term effects were unknown. Councilmember Matsumoto asked how long Colorado had allowed cannabis businesses. Fire Marshall DaSilva stated permitted businesses were not the problem. Assistant City Manager Lee recommended bringing the item back with more complete information, including implications, and dialogue of other cities. SPECIAL CITY COUNCIL MEETING SEPTEMBER 11,2017 MINUTES PAGE 3 Mayor Gupta stated the moratorium could go beyond January 1, 2018, to allow a more informed decision. He stated Council may be looking for facts about the legislation, other's experiences and research done by staff to make its recommendations. He stated the majority of the people had voted to allow cannabis. He stated it was necessary to eliminate incentives for people to bypass the system, do not create an ordinance that had to be redone, and be responsive. Councilmember Addiego stated the voters had voted to decriminalize the use of recreational marijuana and suggested the Council determine its position. Councilmember Matsumoto expressed concern with use of drugs and the youth. She requested information on the types of licenses. Councilmember Garbarino requested information on other city's decisions. Vice Mayor Normandy asked staff's recommendation on delivery only. Special Projects Manager Gill stated staff recommended allowing based on similar uses East of 101 and that it was not a public facing business. Vice Mayor Normandy stated additional details were necessary. She questioned why cannabis would be prohibited when testing, manufacturing and distribution were already allowed. Mayor Gupta stated the Council was looking forward to a more detailed presentation. 1. Study Session: Gateway Signage Design Discussion. (Leslie Arroyo, Communications Director) Director Arroyo stated the goal of the study session was to obtain additional direction on the gateway signage program. She presented the original concepts and three additional options. Councilmember Matsumoto stated it was necessary that the gateway signs identify the City but do not compete with the other materials. Mayor Gupta indicated support for Option 2. Councilmember Addiego discussed existing signs indicated South San Francisco and suggested it might not be necessary to have every ingress and egress indicate South San Francisco. He suggested art to go with the signs at the north and south entrance to inspire and speak to the City's history. He questioned why some of the signs were necessary. Councilmember Matsumoto agreed that ingress and egress locations should be identified. She stated she liked the vertical sign. She suggested including the incorporation date. Brian Fletcher explained efforts to provide options depending on what the site would dictate. He discussed the inclusion of art at various locations. Councilmember Matsumoto suggested including the City's flower and butterfly. Brian Fletcher stated the recommendation was developed with a committee, with Parks and Recreation and City Council over three meetings. He requested direction and input on SPECIAL CITY COUNCIL MEETING SEPTEMBER 11,2017 MINUTES PAGE 4 improvements. Mayor Gupta asked how the vertical signs could be made to be readable. Mr. Fletcher tried to minimize the number of head turns and limit the size of the lettering. Councilmember Addiego stated he could support Option 2 excluding a sign at Mission Road and McLellan. Councilmember Garbarino agreed that a sign was not necessary at Mission Road. Vice Mayor Normandy stated the Council would not be acting on signs 1-12. Director Arroyo explained the purpose to obtain direction on the proposed options. Councilmember Matsumoto stated she liked the vertical Millbrae sign. Director Arroyo summarized the Council's direction to move forward with Option 2 at Skyline at Westborough and Airport at Sister Cities. She questioned whether a vertical sign could be tested. Vice Mayor Normandy suggested not installing a vertical sign at JS and Avalon. Sam Bautista stated the sign at Skyline at Westborough would be a vertical sign. Councilmember Addiego asked what materials would be used. Mr. Fletcher stated it would be wood frame, skinned in aluminum, internally illuminated. Director Ranals stated there were landscape enhancements that would accompany the installation. Director Arroyo suggested reevaluating the other sings once the first two were installed. Mayor Gupta suggested the signs be visible at speeds cars were traveling. Sam Bautista stated he and Mr. Fletcher had been working on Noor and El Camino landscape and sign. Councilmember Addiego stated the San Bruno signs were nice but small. Brian Fletcher stated the letter was small. He explained sign width limitations and Caltrans permitting. Councilmember Addiego asked when the signs would be installed. Sam Bautista suggested combining El Camino with the two signs for a better price. Councilmember Addiego stated he wanted to see the other signs before deciding on the El Camino sign. Brian Fletcher recommended delaying two months to obtain better bids. Director Ranals suggested proceeding with obtaining Caltrans approval. Brian Fletcher stalling bids should not affect moving forward with El Camino. Director Arroyo summarized the action to approve Option 2 for a vertical sign at Skyline and Westborough and a horizontal sign at Airport and Sister Cities, while obtaining Caltrans permits.
