PRESENTATIONS · Proclamation: Older Americans Month, May 2004 - Vice Mayor Green presented proclamation to Geraldine Vickers, President of Senior Club. · Proclamation: Emergency Medical Services Week, May 16-23, 2004 - Councilman Garbarino presented proclamation to Rich Porcelli, EMC Coordinator. · Certificate of Recognition - Mayor Matsumoto presented to certificate to William Lopez, Recreation and Community Services Intern. · Summer Season Celebration at Farmers' Market, May 22, 2004 - Recreation and Community Services Director Sharon Ranals presented a visual overview of the event and invited the public to attend. AGENDA REVIEW No changes. PUBLIC COMMENTS No comments. ITEMS FROM COUNCIL · Announcements · Committee Reports Councilmembers reported on attendance at community events, announced upcoming events and fundraisers, and acknowledged members of the community for their contributions. Councilman Femekes reported that the Housing Subcommittee (Matsumoto/Femekes) met to discuss a new project at 440 Commercial Avenue. A presentation was made at the Redevelopment Agency meeting tonight and that direction was given to proceed with the project. CONSENT CALENDAR 1. Motion to approve the minutes of April 21, and 28, 2004 2. Motion to confirm expense claims of May 12, 2004 in the amount of $3,045,432.51 o Resolution No. 37-2004, awarding construction contract to G. Bortolotto & Co., Inc., for the Greendale Drive Rehabilitation Project in the amount of $367,529.49 Resolution No. 38-2004, accepting a lease agreement with Summit CFS, Inc. for temporary parking on property located at South Airport Boulevard at North Access Road o Motion to accept the 2003-04 Street Dig-Outs Program as complete in accordance with plans and specifications Resolution No. 39-2004, approving draft transportation expenditure plan for extension of Measure A Resolution No. 40-2004, approving an agreement with the State Franchise Tax Board to participate in the Local Government Information Sharing Program in an amount not to exceed $1,706 o Resolution No. 41-2004, authorizing the execution of agreement with NPT Breast Cancer 3-DAY for the use of Orange Memorial Park from October 14-17, 2004 for an overnight camp site o Acknowledgement of proclamations issued: Mike Lappen, Employee of the Year, 4/23/04; Mosquito and Vector Control & West Nile Virus Awareness Week, May 3-9, 2004; GBS Awareness Month, May, 2004 In response to Mayor Matsumoto's request, Finance Director Steele gave a brief report on Item No. 7. Mayor Matusmoto requested a report on the results of the program. Motion-Femekes/Second-Garbarino: To approve the Consent Calendar as submitted. Unanimously approved by voice vote. PUBLIC HEARINGS 10. Consideration of an ordinance rezoning property located at 116 Beacon Street from Planned Industrial (P-1) to Planned Commercial (P-C) to conform to current General Plan designation. Consider a mitigated negative declaration and issuance of a use permit that would permit a religious assembly use at 116 Beacon Street; Owner: St. George Orthodox Church of Jerusalem; Applicant: Suheil Shatara; waive reading and introduce an ordinance Public heating opened. Staff report presented by Chief Planner Sparks. REGULAR CITY COUNCIL MEETING MAY 12, 2004 MINUTES PAGE 2 Applicant, Mr. Suheil Shatara, project architect, stated his agreement with the project's conditions of approval. He stated there are no weddings during the weekdays, but parking will be monitored. Public hearing closed. Mayor Matsumoto requested the following condition be added (copies distributed to Council): For any events scheduled during weekdays (Monday through Friday) between 8 am and 5 pm, applicant shall monitor parking to assure that event patrons park only in the church parking lot or in legal street parking spaces. Church monitors shall assure that event patrons do not park in parking lots of other establishments on Beacon Street, block driveways, double park, or otherwise impede normal traffic flow or operations of other establishments on Beacon Street. Mr. Shatara stated the condition was acceptable. Mr. Anich Shamiyeh, attorney for the owner, asked that the condition be modified to include the wording "the church patrons may park on private property with consent/ permission of the property owners." Councilman Green stated his concern with the facility closure report and chemicals left behind, noting that the facility has been closed for four years. Chief Planner Sparks stated the previous owner left obsolete machinery behind that contained chemical degreasers and that the residual issue is groundwater, therefore the use of the site for a day care was precluded. Councilman Green questioned if there is a notification or inspection process when a business vacates a building and leaves behind toxic/hazardous materials. Staff stated that the City is not always informed and the site has been cleaned up to industrial standards. Mr. Shamiyeh confirmed that the equipment has been removed from the building and the site has been cleaned. Motion-Femekes/Second-Green: To waive reading and introduce an ordinance amending the City of South San Francisco Zoning Map to change the land use designation of 116 Beacon Way from Planned Industrial (P-I) to Planned Commercial (P-C) Zone District. Approved by voice vote. Absent: Councilman Gonzalez. Council concurred with the additional condition of approval, including the modification by Mr. Shamiyeh. Motion-Garbarino/Second-Green: To approve UP-02-0047, as indicated in the staff report and design review, including amendment to conditions of approval to include the following: For any events scheduled during weekdays (Monday through Friday) between 8 am and 5 pm, applicant shall monitor parking to assure that event patrons park only in the church parking lot or in legal street parking spaces or other lawful private parking spaces with the consent of that property owner. Consideration of an ordinance rezoning property located at 178 Starlite Street from Planned-Commercial (P-C-L) to Industrial (M-1) to conform to current General Plan designation. Owner/Applicant: Gregory and Jane Ofiesh (Raymond's Sourdough Bakery); waive reading and introduce an ordinance Public hearing opened. Staff report presented by Chief Planner Sparks. Mr. Suheil Shatara, project architect, stated the applicant, Gregory Ofiesh, agrees to the conditions of approval. Public hearing closed. Motion-Femekes/Second-Green: To waive reading and introduce an ordinance amending the City of South San Francisco Zoning Map to change the land use designation of 178 Starlite Street from planned commercial (P-C-L) to Mixed Industrial (M-l) Zone District. Approved by voice vote. Absent: Councilman Gonzalez. ADMINISTRATIVE BUSINESS 12. Resolution awarding construction contract to Blackbum/RTS for the removal hazardous material generated at the WQCP, Wet Weather Program Phase I in the amount of $450,000 Staffreport presented by Public Works Director Gibbs. Mayor Matsumoto verified that the intent of this action is to insure that the City is covered for the transmission of toxic material to a new location. Staff confirmed that the action is to protect the City. Motion-Green/Second-Femekes: To approve Resolution No. 42-2004, approving an amended agreement among Blackburn Construction and Management, remedial transportation solutions and the City of South San Francisco for the removal of hazardous materials encountered during construction at the Water Quality Control Plant. Approved by voice vote. Absent: Councilman Gonzalez. 13. Colma Creek Update - Public Works Director John Gibbs Director Gibbs stated that the Flood Control District is going ahead with their work in the canal and the portion will be done on schedule this year, as proposed. There will not be any delay in the construction. He stated that ducks were nesting in the construction area which are protected under the Nesting Birds Migratory Treaty Act of 1918. The eggs have hatched and work is progressing. The anticipated completion date is October REGULAR CITY COUNCIL MEETING M1NUTES MAY 12, 2004 PAGE 4 15. Staff is attending the weekly construction (Northwest Construction) meetings and monthly Flood Control District meetings. On May 22, the next local citizen's committee meeting is scheduled. Mayor Matsumoto discussed with staff the anticipated October completion date and assurances that all agencies working in the area, including CalTrain, will be completed simultaneously. Director Gibbs explained that the City's involvement is only as an intermediary between business owners and the County, and the City is not involved in any of the work. He reminded Council that the area that County is completing this year is between Spruce and Linden Avenues--the Linden Avenue to San Mateo Avenue bridgework will start next year. COUNCIL COMMUNITY FORUM CLOSED SESSION 14. Closed Session: Pursuant to Government Code Section 54956.9(a), existing litigation, California Department of Toxic Substances Control (DTSC) v. City of South San Francisco Time entered into Closed Session: Time reconvened into Open Session: Report from Closed Session: 8:21 p.m. 8:40 p.m., Councilmembers Femekes, Garbarino, Green and Matsumoto present.
