Methods of Compensation. Council compensation may be: (1) increased or diminished by the voters (Government Code 36514); (2) established by ordinance in accordance .with a population schedule (Government Code 36516); and (3) increased by ordinance or amendment if compensation is a Government Code 36516'type compensation (Government Code 36516.2). An ordinance increasing Govern- ment Code 36516 compensation cannot provide for automatic future increases (Government Code 36516.2), and the increase does not apply during the Councilmember's term of office EXCEPT when one or more members become eligible for an increase by virtue of beginning a new term of office, in which event all of the members serving staggered terms may obtain the increase (Government Code 36516.5). 2. Computing the Increase. Determine the operative date of the prior increase, that is the date when Councilmembers were installed for a new term and the prior increase was computed in accordance with Ordinance No. 700-76. Add five percent (5%) for each calendar year from the operative date of the last adjustment in eflfect up to the date when the proposed amendment is enacted. Compensation of councilmen under electorate's approval At any m~anicipal election, the question of whether city councilmen shall receive compensation for services, and the amount of ~,uch compensation, may be submitted to the electors. If a majority of the electors voting at the election favors it, all of the councilmen shall receive the compensation specified in the election call. Compensation of councilmen may be increased or diminished at any municipal --election, in the same manner as it was originally established. It is hereby declared that it was the intent of the Legislature in the repeal of this section and the enactment of other provisions relating to city councilmen's salaries at the 1965 Regular Session of the Legisla- ture not to invalidate the payment of compensation to councilmen approved by the electorate prior to September 17, 1965, pursuant to 379 -,-§ 36516. Compensation of councilmen under ordinance A city council may enact an ordinance providing that each member of the city council shall receive a salary, the amount of which shall be determined by the following schedule: (a) In cities up to and including 35,000 in population, up to and including one hundred fifty dollars ($150) per .month; Co) In ~ities over 35,000 up to and including 50,000 in population,' two hundred dollars ($200) per month; (c) In cities over 50,000 up to and including 75,000 in population, two hundred fifty dollars ($250) per month. (d) In'cities over 75,000 up to and including 150,000 in population, three hundred dollars ($3130) per month. - .'- .~ - .... - (e) Cities over 150,000 population up to and including a population of 250,000, four hundred dollars ($400) per month. (f) Cities over 250,000 population, five hundred dollars ($500) per month; For the pu~oses of this section the population shall be determined by the estimates of population made by the Department of Finance. In a city changing from a lower to a higher population group as provided in this section, the amount of compensation shall be determined by the latest estimate of population made by the Department of Finance or as provided in Section~ 2107, 2107.1 and 2107.2 of the Streets and Highways Code.. Compensation of councilmen may be increased beyond, the amount' provided in this section or decreased below such amount by an affirmative vote by the majority of the electors of the city voting at any municipal election. Any amounts paid by a city for retirement, health and welfare, and federal social'security benefits shall not be included for purposes of determining salary Under this section provided the same benefits are available and paid · by the city for its employees. .. Increased compensation of councilmen by ordinance or amendment thereto Notwithstanding the limitations contained in Section 36516 with respect to increases or decreases in councilmen's salaries, the compen- sation of councilmen may be increased beyond the amount provided in Section 36516 by an ordinance or amendment thereto enacted by the city council but the amount of such increase may not exceed an amount equal to 5 percent for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment thereto is enacted; provided that no salary ordinance shall be enacted which provides for automatic future increases in salary. ORDINANCE NO. 700-76 AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO PROVIDING FOR THE PAYMENT OF SALARIES TO MEMBERS OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO. The City Council of the City of South San Francisco does ordain as follows: SECTION 1. PURPOSE. SECTION [~. INCREASE OR DECREASE. The salaries herein provided may be increased or decreased as follows upon authorization by whichever of-the following is applicable, the adoption of an ordinance or a majority of the electors voting at any municipal election therefor~ except that the salaries as so increased or decreased shall become payable only on and after the date upon which one or more members of the Council become eligible therefor by virtue of beginning a new 'term of office following a general municipal election held in the. City of South San Francisco. 4.1. Following any new and later estimate of population made by The Department of Finance, plae- ing'-~h~ City of South San Francisco in a population group other than that set forth in Section 2 hereof, the salary hereby payable to each member of the Council may be increased or decreased accordingly ·~ to equal the sum prescribed for that population group in Section 36516 of the Government Code, as added by Chapter 1378 of the Statutes of 1974. 4.2. An amount equal to Five percent (5%) for each calendar year from the operative date of the last adjustment of the salaries in effect, in accordance with Government Code Section 36516.2. 4.3. In accordance with Government Code Sections 26514 and 26516, by a majority of the electors voting at any municipal election. SECTION 5. REIMBURSEMENT. The salaries prescribed herein are and shall be exclusive of any amounts payable to each member of the Council as reimburse- ment for actual and necessary expenses incurred by him in the performance of official duties for the City of South San Francisco. SECTION 6. OPERATIVE DATE. This Ordinance shall become operative only on and after the date upon which one 6r more members of the Council of the City of South San Yranciseo become eligible for the salary prescribed herein by virtue of beginning a new term of office following the general municipal election next succeeding its effective date, and prior to said operative date Councilmen's salaries shall be T~o hundred dollars ($200) per month. SECTION 7. SEPARABILITY. It is the intention of the City Council that this 0rdinanee and ~very provision thereof, shall be considered separable, and the invalidity of any section, clause, provision, or part or por- tion of any section~ clause or provision of this Ordinance, shall not affect the validity of any other portion of this Ordinance. SECTION 8. REPEAL OF ORDINANCE NO. 539. Ordinance No. 539, adopted November 15, 1965, entitled "An Ordinance of the City of South San Francisco providing for the payment of salaries to members of the City Council of the City of South San Francisco" is hereby repealed. SECTION 9. PUBLICATION AND EFFECTIVE DATE. This Ordinance 'shall be published once in the Enterprise- Journal, as prescribed by law, and shall take effect and be in force thirty (30) days from and after -the date of its adoption. The South San Francisco City Council has not exercised this priv- ilege since 1976. This year, they have decided to seek voter approval for such an adjustment in Council compensation. The Bay Area Consumer Price Index has increased fifty-two percent (52%) during the intervening period. Council members devote hundreds of hours annually in the performance of their duties. In addition to their attendance at City Council and Redevelopment Agency sessions, they represent the City before State, regional and subreg- ional agencies, and local organizations. If the voters approve the measure, the compensation increase will take effect ten (10) days after the canvass of the vote of this election by the City Council. /s/ Mark N. The measure, if passed, will increase the salaries of Council members a total of One Hundred Twenty-two Dollars ($122.00) per month from their current rate of compensation of Three Hundred Dollars ($300.00) per month to a total rate of compensation of Four Hundred Twenty-Two Dollars ($422.00) per month. The increase in compensation amounts to an increase of five percent (5%) per annum compounded annually for each calendar year since the operative date of the Ordinance which last increased Council members' salaries. The last increase in Council members' salaries was set forth in Ordinance No. 700~ and the effect- ive date of that increase was March 2, 1976. The measure, if passed, also would restate current law in the City of South San Francisco as set forth in Section 2.12.040 of the South San Francisco Municipal Code and Sections 36516.2 and 36516.5 of the Government Code regarding future salary increases by Ordinance adopted by the City Council. II. EFFECT OF THE MEASURE ON EXISTING-LAWS. The measure, if passed, would repeal Ordinance No. 700 and Chapter 2.12 of the South San Francisco Municipal Code, both of which set forth the current compensation to be paid City Council members at the rate of Three Hundred Dollars ($300.00) per month. Those laws would be replaced with similar legislation which would set City Council members' salaries at the rate of Four Hundred Twenty Two Dollars ($422.00) per month. The measure, if passed, would not change the current state of the law regarding how and when members of the South San Francisco City Council could, on their own motion by Ordinance, increase their own salaries and the effective date of such an increase.
