DISCUSSION/BACKGROUND
At its April 24 meeting, the Council received a request from Mr.
A1 Waters to place the subject of district elections on a future
agenda for discussion. The staff was instructed to place the
item on the agenda for May 8.
For background information, the Council is provided the following
information:
A memorandum from the city Clerk concerning municipal
elections from 1974 to 1989.
A memorandum from the Acting City Attorney concerning
the Voting Rights Act and its relationship to district
elections.

VOTING RIGHTS ACT; AT L~RGE V. SINGLE MEMBER DISTRICT
COUNCILMANIC ELECTIONS
This memo is presented to provide a review of the law and is not a legal
opinion as to whether or not there exists a violation of the Federal Voting
Rights Act. A change in the method of electing Councilmembers may be made by
ordinance, initiative, or litigation in FeOeral court.
The Voting Rights Act of 1965 amended the Federal Civil Rights Legislation
adopted in 1967 and 1960. The primary thrust of the Voting Rights Act is to
guarantee that there will be no discrimination of voting rights based on race
or color. In 1982, Section 2 of the Voting Rights Act was amended to modify
the burden of proof in a violation challenge to require an analysis of results
rather than intent from and to discrimination.
The United States Supreme Court first interpreted the amended Section 2 in
1986 in Thornburg v. Gingles, 106 S.Ct. 2752. From the outset the court made
it clear that at large schemes of voting do not necessarily violate minority
voters' rights.
Before minority rights are violated, it must be shown that a block voting
majority is usually able to defeat candidates supported by a politically
cohesive, geographically isolated minority group. There is a threshold test
to meet: first, the minority group must be large enough to form an effective
majority in a single member district; second, the minority group must
demonstrate that it is politically cohesive (ie., that the members of the
minority group have the same interests rather than that they are well
organized and turn out to vote in substantial numbers); and third, the
minorities must show that the white majority votes sufficiently as a block so
that the minority candidate is usually defeated.
The court also deemed that the race of the candidate is insignificant in that
the status of the candidate as the chosen representative of minority votes is
the determinative factor. In other words, a white or asian person may
represent black interests and vice versa. Experience shows, however, that
almost always the preferred candidate of a minority group will be a member of
that minority group.
If the three preconditions are met, to wit: political cohesiveness,
geographical compactness and racial block voting, then a voter delusion claim
and a violation of Section 2 may exist.
The court decision in the Thornburg case was a plurality in that various
judges gave individual opinions resulting in exactly how to address a legal
challenge remains vague. For instance, prior to the Thornburg decision and
development of the three part threshold test, two lower court decisions
developed the so-called Zimmer factors which include:
1. The extent of historical, official discrimination.
2. The extent of racially polarized voting.
The extent to which the State has established unusually
large election districts.
4. Availability of a candidate slating process.
5. Extent of discrimination in education, employment and health.
Whether political campaigns have been characterized by racial
appeals.
7. Extent minorities are elected.
Whether there is a lack of responsiveness on the part of
elected officials.
Whether the policy underlined the use of voting qualification
standards or practices is tenuous.
Thus, to some extent one can argue that the Zimmer factors must still be
addressed by the court in its analysis of an allegation of a violation of the
Voting Rights Act after finding that there exists a violation following
analysis of the three threshold test.
Whether or not the formation of single member districts is meaningful to a
minority in order to form one or more districts with a minority group as an
e~.~ve majority, there must be an analysis of the 1990 Census Tract Data.

Adopt resolutions which declare the date of the General Municipal Election
for 1991~-'and request election services from the County Clerk..k,~
DISCUSSION:
The attached Resolutions declare the date of the general municipal election;
state the hours during which the polls shall be open; contain the notice to be
published of the subject election; and authorize a service agreement with the
County Clerk to perform certain functions for the City in preparing for the
election, i.e., consolidation of precincts, group purchase of supplies, and the
processing of absentee ballots.
The following time table will apply: July 15, 1991 - first day to issue nomina-
tion papers; August 9, 1991 - close of nomination, and last day to request by
resolution consolidation for a ballot measure; August 14, 1991 - five day exten-
sion of nomination period if an incumbent does not file; August 15, 1991 random
alphabet to be drawn by the Secretary of State.

SERVICE AGREEMENT FOR CITY OF SOUTH SAN FRANCISCO
GENERAL MUNICIPAL ELECTION CONSOLIDATED WITH
NOVEMBER 1991 SCHOOL/UDEL/ELECTIONS
The County Clerk will perform all legal actions and services for the
conduct of the election except the following:
SPECIFIED ELECTION ACTIONS OR SERVICES TO BE PERFORMED BY CITY CLERK
Request the Board of Supervisors to allow the County Clerk to perform
specified election services in connection with the November School/Udel/
Muni Elections.
Note: Cities who are adding measure(s) to the ballot, the City is required
to request through the County Clerk that the measure(s) be con-
solidated with exact wording of measures(s) by the 88th day prior to
election.
2. Legal Publications:
All legal publications are the responsibility of the City Clerk including
but not limited to: Notice of Election, Notice to File Arguments For or
Against, List of Nominees, Election Officers and Polling Places, etc.
3. Nomination Papers/Arguments:

City Clerk is to issue, file and check all Nomination/Argument/Rebuttal
Documents.
City Clerk is to certify List of Official Candidates (including number to
be elected) exact way each name is to appear on ballot and the ballot
designation) to the County Clerk at least 81 days prior to election.
The deadline to file this certification is August 16, 1991 .
City Clerk is to prepare and deliver to the printer the ballot pamphlet
containing, if applicable, ballot measure(s), analysis of measure(s),
arguments for or against, rebuttals thereto and candidate's statements
(statements of qualifications). Due date of this material in its final
form to be to the printer by September 16 to be inserted into the Sample
Ballot Pamphlet,
City Clerk is to advise County Clerk if any Write-In Candidate officially
files a Declaration of Candidacy. Notification is required as soon as
possible, but in no case no later than the 14th day prior to the election
or October 22, 1991.
TERMS AND CONSIDERATION
This schedule shall be in effect for the performance of all services inci-
dent to the preparation and conduct of the City of South San Francisco
Municipal Election consolidated with the November School/Udel Election to
be held November 5, 1991, except services listed as required by City Clerk.
In the event the County is unable to perform services required under this
Agreement, as a result of employer/employee relation conditions, vendor
conditions or other conditions beyond the control of the County Clerk, the
County will be relieved of all obligations under this Agreement.
Consideration: In consideration of the performance of services and supplies
provided by the County Clerk, the City of South San Francisco shall pay to the
County Clerk a sum equal to the actual cost of such services, supplies and
overhead.
