Ordinance No. 1110-92 ; and

have taken off and recorded from the voting machines used at said

THE CITY COUNCIL OF THE CITY OF SOUTH SAN
FRANCISCO EN)ES ORDAIN AS FOLLOWS: SECHON 1. Section 2.36.040
Section 2.36.040, subsection B of the South San Francisco
Municipal Code is hereby amended to read as follows:
"B. To appoint, discipline and dismiss all appointed officers
and etn ptoyees of the city, excepting the members of council-ap-
pointed boards and commissions, the city attorney and city
departmenl heads:"
SECI'ION 2. Section 21.'t6.050
Section 2.36.050 of the South San Francisco Municipal Code
is hereby amended to read as lbllows:
"Neither the cily council nor any of its members shall inter-
fete with the execution by the city manager of the city man-
ager's powers and duties. Except for the purpose of inquiry, the
c~ty council ann its members shall deal with the administrative
service solely through the city manager, and neither the council
nor any m~mber thereof shall give orders to any subordinate of
the city manager, either publicly or privately. The city manager
shall take orders and instructions from the city council only

Attorney is appointed by the City Council and the City Clerk is
elected.
If the proposed ordinance is adopted, the City would return to

Ordinance 1110-92 will be effective on February 21, 1992. If the required number of voters sign this petition and if
this petition is timely presented to the Council, Ordinance 1110-92 is suspended and the City Council shall reconsider
the ordinance. If the Council does not entirely repeal the ordinance, then the Council shall submit Ordinance
1110-92 to the voters of South San Francisco and the ordinance shall not become effective unless a majority of
voters vote for it.

BACKGROUND AND DISCUSSION
In anticipation of the February 21, 1992 submittal of a
referendum petition calling for the repeal of Ordinance No. 1110-
92, we have placed the following items on your agenda:
Item ~3 - Certification of the sufficiency of the
Referendum Against Ordinance No. 1110-92, adopted
1/22/92.
Item #4 - Reconsideration of Ordinance No. 1110-92 "An
Ordinance of the City Council of South San Francisco
Amending Various Sections of Title 2 and Title 3 of the
South San Francisco Municipal Code Relating to the Power
to Appoint City Department Heads".
Item $5 - Resolution calling a Special Election to be
consolidated with the 6/2/92 Primary Election on the
Referendum Against adoption of Ordinance No. 1110-92.
-- Item $6 - Resolution calling for election services from
the County Clerk for the 6/2/92 Special Election.
Since it will take until March 4th for the City Clerk to verify
that the petition was signed by the requisite number of voters,
no action on the above-listed items is required at your February
26th meeting. The matters should be continued, however, to March
4th for action.
At the March 4th meeting, the following actions will be
