HomeMy WebLinkAboutMinutes 2005-05-11 MINUTES CITY COUNCIL CITY OF SOUTH SAN FRANCISCO REGULAR MEETING WEDNESDAY, MAY 11, 2005 MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE CALL TO ORDER: ROLL CALL: 7:33 p.m. Present: (Cassette Tape No. 1) Councilmembers Garbarino, Gonzalez and Matsumoto, Mayor Pro Tem Fernekes and Mayor Green Absent: None PLEDGE OF ALLEGIANCE: Led by Maria Martinucci INVOCATION: Pastor John Cantley, Grace Covenant Church PRESENTATIONS Report on Sustainable San Mateo County - Shelley Killday presented information on the 2005 Report Card on the County's quality of life. (Copies distributed to Council.) She reported on several indicators, including housing, education, contaminated sites and voter participation in South San Francisco. Councilwoman Matsumoto asked staff to provide further information on the indicator for leaking underground storage tanks (contaminated sites) in South San Francisco. Mayor Pro Tem Fernekes requested Ms. Killday forward information to staff on how Portola Valley accomplishes affordable housing in its community. AGENDA REVIEW No changes. PUBLIC COMMENTS None. ITEMS FROM COUNCIL · Announcements · Committee Reports City Councilmembers reported on attendance at community and regional events, announced upcoming events and fundraisers, and acknowledged members of the community for their contributions. Councilman Garbarino reported that a meeting has been scheduled with the school district to discuss a community science mobile. Mayor Pro Tem Fernekes reported on subcommittee meetings that included the budget subcommittee (Fernekes/Green) and 111 Chestnut Avenue design ad-hoc subcommittee (Fernekes/Garbarino). Mayor Green reported he recently visited Amgen Pharmaceuticals with staff and that goodwill visits are being scheduled with several other biotech companies in the city. CONSENT CALENDAR 1. Motion to approve the minutes of April 27, 2005 2. Motion to confirm expense claims of May 11, 2005 in the amount of $2,394,638.06 Motion to adopt Ordinance No. 1350-2005, amending S SFMC Chapter 3.12, adding the classification public works inspector Resolution No. 43-2005, authorizing the adoption of the Vantagecare Retirement Health Savings (RHS) program for use by employees after retirement to pay healthcare expenses Resolution No. 44-2005, accepting funds from multiple sources to support Project Read Services in the amount of $38,500 Resolution No. 45-2005, authorizing a lease agreement to obtain EMS laptop computers and equipment for the Fire Department in an amount not to exceed $136,000 Resolution No. 46-2005, authorizing a one-year extension of contract agreement with Turbo Data Systems Inc. for parking citation processing and administrative adjudication of appeals o Resolution 50-2005, rescinding the award of construction contract to CommAir Mechanical Services of Menlo Park for the General Building Air Conditioning Retrofit Project and awarding construction contract for same to O'Keefe Mechanical Co., Inc. in the amount of $64,790 Resolution No. 47-2005, authorizing the acceptance of funds from the State under the Supplemental Law Enforcement Services Fund (SLESF) program in the amount of $100,000 10. Resolution No. 48-2005, adopting the mitigated negative declaration for the Lindenville Storm Drainage Pump Station and Storm Drainage Pipe Upgrade for the Wet Weather Program, Phase V 11. Acknowledgement of proclamations issued: Police Service Volunteers and Police Reserve Officer Appreciation, April 29, 2005; National Public Works Week, May 15- 21, 2005 Motion-Fernekes/Second-Gonzalez: To approve the Consent Calendar as presented. Unanimously approved by voice vote. REGULAR CITY COUNCIL MEETING MINUTES MAY 11, 2005 PAGE 2 ADMINISTRATIVE BUSINESS 12. Resolution accepting an increase in refuse collection rates effective July 1, 2005 as submitted by the South San Francisco Scavenger Company Staff report presented by Finance Director Steel. Motion-Garbarino/Second-Fernekes: To approve Resolution No. 49-2005, authorizing an increase in refuse collection rates effective July 1, 2005. Unanimously approved by voice vote. LEGISLATIVE BUSINESS 13. Receive Traffic Engineering Survey to justify use of radar for traffic enforcement, and waive reading and introduce an ordinance amending SSFMC Chapter 11.68, Prima Facie Speed Limits on City Streets Staff report presented by Senior Civil Engineer Dennis Chuck. Councilwoman Matsumoto discussed the number of accidents at certain locations in the city and questioned if there was a correlation with cars exceeding the speed limit on those streets. Police ChiefRaffaelli responded that the reported accidents occurred at intersections and are unrelated to speed limits. Councilman Gonzalez questioned the cost for replacing signs with new speed limits and staff stated it was minimal and completed in-house. Councilman Garbarino reported a problem with the traffic signals at the intersection of Antoinette Lane and Chestnut Avenue. He and Mayor Green reported the signals are out of sync with E1 Camino Real and Chestnut causing a traffic back-up. Public Works Director White stated that Cal Trans is aware of the problem and he will re-contact their office tomorrow. Motion-Garbarino/Second-Fernekes: To waive reading and introduce an ordinance deleting Chapter 11.68 of the South San Francisco Municipal Code, "Prima Facie Speed Limit on City Street," and replacing it with a new Chapter 11.68, "Prima Facie Speed Limit on City Streets" to allow the police department to utilize radar enforcement for speeding violations. Unanimously approved by voice vote. 14. Waive reading and adopt an emergency ordinance imposing a moratorium on medical marijuana dispensing centers Staff report presented by Assistant City Manager Van Duyn. Mr. Tariq Alazraie, resident of San Bruno, speaking in favor of medical marijuana dispensaries, stated he operates a dispensary in San Francisco's Tenderloin area and that 40% of his patients live in San Mateo County. He stated that the second site, 417 Grand Avenue, was picked because of its central location in the San Mateo County. REGULAR CITY COUNCIL MEETING MINUTES MAY 11, 2005 PAGE 3 Councilwoman Matsumoto questioned Mr. Alazraie regarding the proposed location of the dispensary, the process by which patients come to the centers and are dispensed marijuana, and the negative secondary impacts. City Attorney Mattas advised Council that the 45 days will allow time for staff to prepare the regulatory framework addressing issues, that the Supreme Court is currently reviewing a challenge to the validity of California's law, and staff is anticipating that a decision will be made by the end of June. Councilman Garbarino further questioned Mr. Alazraie on the negative impacts, patients' condition upon leaving a dispensary, and driving under the influence of marijuana. Councilmembers requested that staff verify if any other cities in San Mateo County have dispensaries. Motion-Garbarino/Second-Gonzalez: To waive reading, introduce, and adopt urgency Ordinance No. 1351-2205, making findings and establishing a temporary moratorium on the establishment and operation of medical marijuana dispensaries, to become effective immediately.
