Councilmembers titles and all actions and discussions are on behalf of the Council and Successor
Agency in a joint capacity.

ADMINISTRIAVE BUSINESS
1. Presentation regarding Kilroy Oyster Point Development Project Quarterly Report 2019 Q1
(Eunejune Kim, Director of Public Works/City Engineer and Kilroy/Cummings
Representatives).
Director of Public Works Kim provided an update of the current project and introduced the
Associate Director of Construction Management Cummings to provide a project progress and an
overview of key milestone dates. He indicated that this report was being presented both to the
Successor Agency and to the City Council because the Successor Agency is partially funding this
project, and City staff is representing the Successor Agency and administering the Development
Agreement (DA) and Development and Disposition Agreement (DDA) which commits the
Successor Agency to this project.
The developer, Kilroy and their Program Manager, Cummings continue to manage the construction
project as outlined in the Agreement for Development Management Services Agreement (DMSA)
approved by the Successor Agency and City Council last year. The DMSA defines the roles and
responsibilities, and procedures for building the project. The City is not the construction manager.
Construction is ongoing at the Oyster Point Marina with current projects relating to earthwork,
grading and landfill modifications. Completed work includes approximately 90% of grading and
Title 27 work has been completed for the entire relocation effort with approximately 75% complete
with construction of the utility corridors. They continue to address public concerns including
monitoring air quality, developing a car wash plan for residents, and increased traffic control
signage and manpower.
Current work includes remaining landfill relocation and grading for the Phase 2D and Phase IC,
gabion wall construction for the Marina Parking retaining wall, design development for the public
and marina restrooms, pump station design development, and PG&E scheduled to provide
temporary power June 17, 2019 to eliminate the use of generators.
An overview of upcoming events were presented to Council including the concern of approval from
the Department of Drinking Water and permanent power design. He provided a change order
update, noting that, contingency amounts do not account for project changes such as excess refuse
off haul, cement treatment, cover soil material import and clay cap material import.
Cost implications of these issues have been estimated and are being managed closely by the project
team. He indicated that costs in this report are reflective of the figures provided by the City to the
Oversight Board on 1/14/2019. These numbers and cost estimates are presented for discussion
purposes only. The project team, in conjunction with City staff oversight, continue to drive the
project to meet the scope, schedule and cost objectives of the development.
Vice Mayor Garbarino inquired about issues of dust reaching the boats. Kilroy representative
indicated that the concerns were more prominent before the rain started and have lessened over the
last six to seven months due to increased rain.
