The City Council of the City of South San Fr~cisco do
ordain as follows:
Section 1. It shall be ~lawful for ~person, persons,
firm, co~oration or association to keep open, within the corporate
limits of the City of South San Francisco, upon any S~day or any
one of the legal holidays known as the First of J~uary, Memorial
Day, the Fourth of July, Labor Day, Th~ksgiving Day ~d Christmas
Day, ~y meat ~rket, clothing store, shoe store, dry goods store,
vegetable store, hardware store, barber shop or store where shoe
repairing is done. The word "food", as used herein, sh~l be con-
strued to me~ the kinds of food for human consumption customarily
sold in grocery stores.
Section 2. The provisions of this ordinance shall not
apply to or be construed to apply to ~y person, persons, firm
corporation or association, who, on any Sunday, or ~y other legal
holiday as herein specified, keep open bona fide hotels, boarding
houses, lodging houses, restaurants, retail drug stores, confection-
ery stores or ice cream Darlors, newspaper or periodical agencies for
the legiti~te business of each; provided however, that in case
any one or more of the excepted t~es of business.hereinbefore
mentioned is carrier on in some room with ~y business coming within
the purview of this ordinance and required to be ~pt closed on Sunday

or any other legal holiday, as herein specified, the part of the
room in which such excepted~business is carried on shall be separate an~
set apart from the business required to be closed by this ordinance,
as aforesaid, by a permanent partition or permanent screen, not
less than seven (?) feet in height, which such permanent partition
or permanent screen shall enclose and separate said place, where
said excepted business is carried on, from the remaining part of
the room wherein the business required to be closed under Section
i of this ordinance is operated.
Section 3. ~hen the First of January, ~'~emorial Day, the
Fourth of July, Labor Day, Thanksgiving Day or Christmas Day falls
on Saturday or ~onday, the places of business mentioned in Section
i of this ordinance may remain open until 12 o~clock noon on any
such Saturday or i~onday, and shall be closed at such hour°
Section ~. If any section, sentence, clause or phrase
of this ordinance, shall, for any reason, be held to be invalid
or unconstitutional, such invalidity or unconstitutionality
shall not affect the validity or unconstitutionality of the remain-
ing portions of this ordinance, it being hereby expressly declared
that this ordinance and each section, sentence, clause and phrase
thereof would have been enacted, irrespective of the fact that any.
one or more other sections, sentences, clauses or phrases be de-
clared invalid or unconstitutional.
Section 0~ Any person, persons, firm or corporation who
shall violate any portion of this ordinance shall be deemed guilty
of a misdemeanor and, upon conviction thereof, shall be punished by
a fine not e~ceeding One Hundred Dollars ($100.00), or by imprison-
ment for a period not exceeding Thlrty (30) days, or by both such
fine and imprisonment.
Section 6. Ordinance No. 164 of said City of South San
Francisco entitled "An ordinance of the Uity of South San Francisco
prohibiting the operation and conduct of Food stores, meat markets,

dry goods stores, clothing stores or stores in which shoe repair-
ing is done, within said City on any Sunday or other legal holiday",
passed August 14th, 1933, is hereby repealed.
Section ?: This ordinance shall be published once in
"The Enterprise and The South San Francisco Journal", a weekly
newspaper, published and circulated in the City of South San
,Francisco, and shall take effect and be. in force upon the expira-
tion of thirty (30) days after the date of its passage and adoption.

Passed and adopted as an ordinance of the City of South
San Francisco, at a regular meeting of the City Council of the
