and
WHEREAS, the property is designated "High Density Residential" in the 1999 General Plan;
WHEREAS, the proposed development generally complies with General Plan goals and
polices, specifically General Plan policy 2-G-6, which encourages the Inaxilnization of opportunities
for residential developlnent; and
WHEREAS, on January 20,2005 and March 17,2005 the Planning COlnlnission of the City
of South San Francisco held duly noticed public hearings and recomlnended that the City Council
adopt the proposed ordinance amendlnent; and
WHEREAS, an Enviromnental Impact Report analyzing the impacts of the General Plan
update was prepared and certified by the City Council of South San Francisco on October 13, 1999,
in accordance with the provisions of CEQA; and
and
WHEREAS, the proposed increase in density was fully addressed in the General Plan EIR;
WHEREAS, a Mitigated Negative Declaration has been prepared for the project in
accordance with the provisions of the California Environmental Quality Act (CEQA). The Mitigated
Negative Declaration No. 02-0020 identifies potential adverse ilnpacts attributable to the
development of eight (8) new residences. The ilnpacts can be reduced to a less than significant level
through the implementation of Initigation Ineasures. A mitigation Inonitoring progrmn is established
to ensure that impacts are reduced to a less than significant level. Mitigation Ineasures, including
dust suppression measures during construction, preparation and submittal of a Stormwater Pollution
Prevention Plan, retention of a qualified acoustic engineer to identify methods to achieve acceptable
noise levels, and lilnitation of construction hours, along with monitoring of these Initigation
Ineasures, have been incorporated into the project or Inade conditions of approval which will reduce
identified impacts to a less than a significant level.
NOW THEREFORE, the City Council of the City of South San Francisco does hereby
ORDAIN as follows:
SECTION 1. AMENDMENTS
The City Council hereby mnends the City of South San Francisco Zoning Map for 111 Chestnut
Avenue by changing the zoning designation frOln MediUln Density Residential (R-2-H) to Multi-
Family Residential (R-3-L).
SECTION 2. SEVERABILITY
If any provision of this Ordinance or the application thereof to any person or circulnstance is held
invalid, the remainder of this ordinance, including the application of such part or provision to other
persons or circulnstances shall not be affected thereby and shall continue in full force and effect. To
this end, provisions of this ordinance are severable. The City Council of the City of South San
Francisco hereby declares that it would have passed each section, subsection, subdivision, paragraph,
sentence, clause, or phrase hereof irrespective of the fact that anyone or more sections, subsections,
subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or
unenforceable.
SECTION 3. PUBLICATION AND EFFECTIVE DATE
This Ordinance shall be published once, with the nmnes of those City Councihnelnbers voting for or
against it, in the San Mateo Times, a newspaper of general circulation in the City of South San
Francisco, as required by law, and shall becolne effective thirty (30) days frOln and after its adoption.

Council held the 13th day of July 2005, by the following vote:
