HomeMy WebLinkAboutReso 88-2005 RESOLUTION NO. 88-2005 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE BAY AREA AIR QUALITY MANAGEMENT DISTRICT FOR FUNDS TO REDUCE EMISSIONS FROM SOLID WASTE COLLECTION VEHICLES AND AUTHORIZING THE IMPLEMENTATION OF SAME, IF THE APPLICATION IS APPROVED BY THE BAY AREA AIR QUALITY MANAGEMENT DISTRICT WHEREAS, California Air Resources Board has adopted a new regulation that applies to public and private owners of solid waste collection vehicles (SWCVs) that perform residential and cOlnlnercial solid waste collection; and WHEREAS, the regulation requires fleet owners to elnploy Best Available Control Technology (BACT) to reduce elnissions of diesel particulate Inatter (PM) frOln SWCV s; and WHEREAS, the regulation does not require any reduction of nitrogen oxides (NOx) elnissions; and WHEREAS, NOx emissions are a major cOlnponent of ozone, a colorless, odorless gas that is injurious to hUlnan health when breathed; and WHEREAS, in the absence of incentive funding, it is expected that Inost fleets subject to the regulation will cOlnply with the IninimUln baseline requirelnents to reduce PM elnissions only and will not choose to exceed the requirelnents for diesel PM reduction nor choose to reduce any NOx elnissions; and WHEREAS, Bay Area Air Quality Managelnent District ("Bay Area Air District") has allocated funding from the Transportation Fund for Clean Air to assist refuse fleets in choosing rule cOlnpliance strategies that reduce elnissions beyond the requirelnents of the rule; and WHEREAS, local govermnent agencies within the jurisdiction of the Bay Area air District are eligible to receive these funds on behalf of the SWCV fleets that they own or that they hold under contract to perfonn solid waste collection; and WHEREAS, City of South San Francisco desires to participate in the SWCV incentive prog[mn; and WHEREAS, City of South San Francisco desires to encourage SWCV fleets under contract to the City to reduce emissions beyond the requirelnents of the rule; and WHEREAS, City of South San Francisco desires to apply to the Bay Area Air District for funding in response to the opportunity provided by the Bay Area Air District; and WHEREAS, City of South San Francisco desires to enter into a contract with the Bay Area Air District to allow for expenses incuned by a contracted SWCV fleet to be reimbursed by the Bay Area Air District to the City; and WHEREAS, City of South San Francisco understands that it will need to enter into a contract with the contracted SWCV fleet in order to allow for expenses incuned by the contracted SWCV fleet to be reilnbursed by the City to the SWCV fleet; and WHEREAS, the governing body of the local govermnent agency Inust adopt a resolution to approve the sublnittal of an application for SWCV incentive funds by the agency. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council is hereby authorized to execute a funding agreelnent with the Bay Area Air Quality Management District for the purposes described above ifsaid applications is approved by the Bay Area Air Quality Managelnent District. * * * * * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 27th day of July, 2005 by the following vote: AYES: Councilmelnbers Richard A.
