J. L. De~titt, Lieutenant General, U. Army, Co~aanding Western Defens& Con,hand and Fourth Army, by vir- tue of the authority vested in him by the President of the United States and Executive Order No. 9066, dated February 19, 19~, and pursuant to Public Law 505--??th Congress, approved March ~.l, 19~, and by virtue of his powers and prerogatives as Conm~anding General of 'the ~;estern Defense Comr~and, has issue~,~Public Proclamation No. i0, dated ~ugust 5, 1942, and effective ~ug 20, 19~2 which as amended by Public Proclamation No~/12, dated 0~tober 10, 1942, and issued by virtue of the same authority, reads as follows: "t~_~2)QUARTERS WESTERN DEFE~SE "Presidio of San Francisco, Catiflrnia "PUBLIC PROCLAIdATION N0. ~ / " u ust 5, 1942 / "TO: The people within the States of Wash_ngto~' egon and Calif- ornia, and to the Public Generally: ~VHEREAS, by Public Proclamation No l, dated March 2, 1942, this tfeadqua~te~s, there were designated and established ~ilitary Areas ~'~om. i and E; and "VgHEREAS, the armed forces of the enemy have made attacks up- on vessels of the United States traveling along the Pacific Coastal waters and upon land installations within said Military Areas, and it is expected that such attacks will continue; and '~=~E.REAS, it is necessary to provide maximum protection for war utilities, war materials and war premises locate~ within the ~tates of Washington, Oregon and California against enemy attacks by sea and by air; "NOW, Ti-LEREFORE, I, J. L. DEWITT, Lieutenant General, U. $. Army, by virtue of the authority vested in me by the President of the United States and by the Secretary of ~ar and my powers and pre- rogatives as Conmmnding General of the Western Defense Command, do hereby declare that: "1. ~£he present situation requires as a matter of military necessity that a Zone of Restricted Lighting be e~:t.:abl;ished v~ith- in Military Areas Nos. i and 2, and that illtm~ination within said Z0.ne of Restricted Lighting be extinguished or controlled in such manner and to such extent as may be necessary to prevent such il- lumination from aiding the operations of the enemy. "2. Pursuant tothe determination and statement of military necessity in Paragraph i hereof, a Zone of Restricted Lighting, as particularly described in Exhibit A hereof, and as generally shown on the map made a pa.¥t hereof and marked Exhibit B, is hereby desig- nated and established. Illumination within the entire area of said ~.~one of Restricted Lighting shall be extinguished or controlled at ~ll times at night from sunset to stmrise as follows: ~(a) Signs, Co~m~ercial Floodlighting, Display Lighting and ~:~usement Places. Illuminated signs and ornamental lighting of every description which are visible out-of-doors, and floodlight- ing which illuminates buildings or signs, including but not lim- ited to all exterior advertising signs, billboards, display light- ing theatre marquee signs, building outli~e lighting, and inter- ior signs and ornamental lighting i~,mediately within unobscured window areas, shall be extinguished. This provision is not in- tended to prohibit ordinary store show-window lighting of normal intensity, except as provided for in Paragraph 3 of this Procla- ma t i o n. "(b) Ground Areas s~ud Industrial Illumination. Illumination of outdoor areas shall be controlled as follows: "~). Subject to the exceptions herei~after stated, illum- ~ ination on' all outdoor grottud areas, including but not limited to automobile service station yards, out- door parking areas, recreation areas, and entrances to buildings, shall not exceed one:~bot candle at point, and all outdoor light sOurces shall be so sh~alded that no light is emitted upward. TM fore- going sentence shall not apply to street and high- way lights nor to the ground areas illu,~inated sole- ly thereby, nor to the classes of illumination re-. ferred to in the next subparagraph hereof. "(B~ Ail light sources for industrial and protective pu~- poses, and light from industrial processes, shall shielded or revised to as great an extent as ~ay b~ practicable in order to eliminate or reduce to a imum the amount of light which is emitted upward. "(c) Traffic ~igns and ~ignals. Ail illuminated signs or sig- nals which are authorized or maintained by governmental authority for the purpose of controlling street or highway traffic shall re- main i~r operation , but shall be so shielded that no light is emit- ted upward. ~(d) i~avigation Lights and Railroad Signals. Authorized lights to facilitate air or water navigation, and authorized railroad si~ hal lights, are hereby excepted from all the provisions of~his Proc- ¸'3-- lamat i on. ~. In addition to the restrictions herei~before imposed, illumination within that part of the Zone of Restricted Light- ing which is visible from the sea, as hereinafter defired, shall be further dimirjshed or obscured at all times at night from stun- set to sunrise as follows: "(a) Street and Highway Lights. Street and highway lights in areas which are normally visible from the sea shall be so shiel- ded that they are not visible from the sea at night and so that no light is emitted upward. It is contemplated that street and h~h- way lights in other areas within the Zone of Restricted Lighting shall be governed and controlled by such subsequent orders or pro- clamations as the exigencies of military necessity may determire . ~(b) Residential, Conm~ercial and Industrial ~indows. lighting shall be per~uitted be'ai~d windows or glazed doors visi- ble from the sea uni~ss they are covered by drapes or shades. "(c) Street and Highway Traffic. ~ithin areas from which normal automobile headla~ps are visible from the sea all vehicles shall be sub ~ ~ect to the following regulations: ~(11. No vehicle shall operate d~ring the night hours between sunset and sunrise with more than two lighted driving la~ps, regardless of the direction of travel. Each such lamp shall provide a maxi- mum of not more than 250 beam candlepower. "(d) Industrial Fires. All light from industrial processes, and from industrial fires, such as li. ght from refuse burners, kilns, and furnaces, which are visible from the sea, shall be so shielded that they are not visible from the sea at night, and so t~at no light is emitted upward. "(e) Except for the lights referred to in subi~taragraPhs 2(c), and 2(dl hereof, all other li~ts visible from the sea are prohibited at night, including but not liraited to light from fires, bonfires, parKe6~ cars, flashlights and lanterns. "(f) The phrase ~visible from the sea,' as used herein, is intended and shall be construed to mean and include ~hat which is visible from the waters of the Pacific Ocean a~d from alllhe por- tion of the waters of the ~qtraits of Juan de ~uca extending inland from the Pacific 0~ean to a line running du~ north and south through the easternmost point on the easterly boundary line of the City of Port To~msend, Washington. "4. Any person violating any of the provisions of this Pro- clamation, or orders issued pursuant thereto, is subject to immediate exclusion from the territory of the ~estern Defense Cormuand, and to the criminal pe~'~alties provided in Public Law l~Io. 503, ?7th Congress, approved March 21, 1942, entitled "An Act to provide a penalty for Violation of restrictions or orders with respect to persons entering, remaining in, leaving, or co~uitting any act in military areas or zones. "5. The. l~inth Regional Civilian Defense Board is hereby de- signated as the pri~uary agency to aid in the enforcement of the f~re- going provisions. It is requested that the civil law enforcement agencies within the ~tates affected by this Proclamation assist the l{inth Regional Civilian Defense Board in the enforcement hereof. "6. Said Public Proclamation No. 12, in addition to amending Public Procla~ation I~o. l0 as hereinbefore set forth, contains the following paragraphs: "B. This proclamation shall beaome effective October 25, 1942, except those provisions of Subsection 2(b) (1) hereof, concerning street and highway lights, which Shall become effective November 12, 1942. "C. The recitals set forth in the first three paragraphs of said Public Proclamation I~o. l0 are hereby reaffirmed. Except as hereinbefore expressly amended, all the provisions and deter- minations expressed in said Public Procla~:~ation No~ l0 ~hall remain in full force and effect." Sec. 3. The City of South San Francisco hereby recognizes the civil and military necessity for the concurrent enforcement of the provisions of Public Proclamation 1~o. 10, as amended as aforesaid, by the City of South San Francisco and the federal government. Sec. 4. The City of South San Francisco is within the :~ Zone of Restricted Lighting, ,as designated and established by Sec. E of said Public Proclaniation l~o. l0 as m~ended as aforesaid. Sec. 5. ~hoever on or after October 25, 1942, shall com- mit any act in the City of South San Francisco contrary to t he pro- visions of Sections 2 or 3 of Public Proclamation No. l0 es amended as aforesaid, which amended proclamation is hereinbefore set forth in full, shall be guilty of a violation of this ordinance which violation shall constitute a misdemeanor and upon conviction there- of shall be punishable by a fine of not to exceed $300.00 or by imprison~entfor not to exceed three ~aonths, or by both s~ ch fine and imprisonment. /~y ~' ..'~ Sec'~.~,~. By reason of the i~ediate threat of enemy attack com- pliance with the provisions of Public Proclamation No. l0 as am- ended by public Proclamation No. lZ is essential for the proteCt- ion of tho lives ~d property of the people of the City ~ South San Francisco. ~c. ~. The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in The Enter- prise, a newspaper of general circulation printed and published in this city. -O-O-O-O-O-O-O.
