AN ORDINANCE PROHIBITING THE ERECTION OR MAINTENANCE

LINE OF THE RIGHT OF WAY OF THE SOUTHERN PACIFIC COM-
PANY AND THE EASTERLY LINE OF SPRUCE AVENUE,. IN THE/~

The City Council of the City of South San Francisco does
ordain as follows:
Section 1. It shall be unlawful for any person, firm or
corporation engaged in the distribution of electric energy or in
the transmission of messages by telegraph or telephone, under any
franchise whatsoever, to erect or maintain, after two (2) months
from the effective date of this ordinance, any pole or poles for
the support of any wire or wires used for the distribution of
electric energy or for the transmission of messages by telegraph
or telephone, upon any portion of Grand Avenue between the westerly
boundary line of the right of way of the Southern Pacific Company
and the easterly boundary line of Spruce Avenue in said city.
Section 2. Every person, firm or corporation that owns,
uses, maintains or operates any such pole or poles upon said
portion of Grand Avenue between the westerly boundary line of the
right of way of the Southern Pacific Company and the .easterly
boundary line of Spruce Avenue shall remove the same therefrom
within two (2) months after the effective date of this ordinance
and shall discontinue all further service of electric energy to the
public by means of overhead service wires from said portion of Grand
Avenue, but shall first give all consumers thus affected at least
thirty (30) days prior notice of such discontinuance of service.
Section. 3. Any person, firm or corporation owning, operating,
leasing or renting any property to which service of electric energy
by means of overhead service wires from Grand Avenue shall be dis-
continued pursuant to this ordinance, shall, in the event said
person, firm or corporation desires again to obtain electric service
to said property, install the necessary conduits and conductors in
said property to receive said service at such point as will meet the
requirements of the person, firm or corporation engaged in the
distribution of electric energy from their available lines con-
forming to the requirements of this ordinance.
Section 4. This ordinance shall not apply to any standards
for street lighting now or hereafter installed by authority of the
.City Council upon said portion of Grand Avenue.
Section 5. The City of South San Francisco shall remove
its police and fire alarm circuits at its own expense from all such
poles now installed upon said portion of Grand Avenue, in ample time
to enable the owner or users of such poles to remove the same within
two (2) months after the effective date of this ordinance.
Section 6. Any person, firm or corporation, who shall violate
any provision of this ordinance, shall be guilty of a misdemeanor
and, upon conviction thereof, shall be punished by a fine of not
less than one hundred dollars ($100.00) nor more than three hundred
dollars ($300.00), or by imprisonment for a period not exceeding
three (3) months, or by both such fine and imprisonment..
Each day's continuance of the maintenance or existence of said
poles on said portion of Grand Avenue in violation of this ordinance
shall be deemed a separate offense and may be punished as such under
this ordinance.
Section 7. This ordinance shall be published once in "The
Enterprise", a newspaper of general circulation, published and printed
in said City of South San Francisco and shall take effect and be in
force from and after the expiration of thirty (30) days after its
adoption.
