OLD IRON, TIN, SHEET METAL, AUTOMOBILE PARTS,
M~CHINERY ~ND IRON OR WOODEN BARRELS IN CERTAIN
The City Council of the City of South San Francisco
does ordain as follows:
Sectional. It shall be unlawful for any person,
persons, firm or corporation to permit or allow any old iron,
tin, sheet metal, automobile parts, machinery, or iron or
wooden barrels or parts thereof, to accumulate in any part of
the City of South San Francisco included in the po'rtions thereof
designated as follows:
The portion bounded by %he westerly boundary line
of Bayshore Highway and the northerly line~ of Railroad Avenue
and the easterly boundary line of E1 Camino Real and the
northerly boundary line of said city; the subdivision known as
Mayfair Village; %he subdivision known as the Baden Townsite
Tract; all portions of said city lying westerly from E1 Camino
Real. There is excepted from the foregoing any accumulation of
such materials as may be incident to the construction of any
building within any one of %he above mentioned areas and such
materials as may be securely kept in a building, with roof
thereon and lawfully maintained and enclosed on four sides.
Section 2. To keep or permit materials of the kind
and description mentioned in Section i of this ordinance to be
kept on any land in any one of the areas mentioned in said
Section 1 is hereby declared to be a public nuisance.
Section 3. It shall be the obligation of the owner
and of any tenant of the land on which the accumulation of
materials mentioned in Section i of this ordinance is prohibited,
to remove such materials from such land. In the event that such
materials may be allowed to accumulate, in violation of the
provisions of Section I hereof, it shall be the duty of
the Superintendent of Streets to give~o the owner or the
tenant of the land, on which such materials may be allowed
to accumulate, thirty (30) days' written notice of the
intention of said city to abate the nuisance caused by such
accumulation. Such notice shall be given by posting a copy
thereof on said land and by mailing a copy thereof to the
owner of said land at the address appearing on the last
assessment roll of said city and to the tenant thereof, if
any there be, at the address of such tenant, as may be known
to said Superintendent of Streets, or as may appear on any
record kept in the office of the City ~l~rk of said city.
On the expiration of the period of time provided in said
notice, said Superintendent of Streets may sell said materials
in the manner provided in the Code of Civil Procedure of the
State of California for the sale of personal property on
execution. In the event that no purchaser for such materials
may appear at a sale thereof, as herein provided, then said
Superintendent of Streets may cause the same to be deposited
on the city dump.
Section ~. Any person, persons, firm or corporation
who shall violate any provision of this ordinance shall be
deemed guilty of a misdemeanor and, upon conviction thereof,
shall be punished by a fine of not less than twenty-five
dollars ($25.00), and not exceeding three hundred dollars
($300.00), or by imprisonment for a period not exceeding
three (3) months or by both such fine and imprisonment.
Section 5. This ordinance shall be published once
in "The Enterprise", a newspaper of general circulation printed
and published in the City of South San Francisco, and shall
take effect and be in force on the expiration of thirty (30)
days after its adoption.
