HomeMy WebLinkAboutOrd 322-1951 ~ ORDINANCE NO. 322 ~ ~~ \ C ~ O~O~.-'''~ /' AN ORDINANCE REGULATING JUNK DEALERS IN THE CITY OF SOUTH SAN' FRANCISCO. ~ jr, The City Council of the City of South San Francisco does ordain as follows: Section 1. It shall be unlawfUl for any person or persons or corporation to carry on, maintain or conduct any Junk yard in the City of South San Francisco without having pre- viously obtained a permit from said City Council for that purpose. Section 2. It shall be unlawful for any person, persons or corporation to carry on, maintain or conduct any Junk yard, unless such business is carried on, maintained and conducted in compliance with the following regulations: (a) Such business shall be carried on, maintained and conducted entirely inside of an enclosed building or build- ings, unless the premises on which such business is carried on, maintained and conducted shall be entirely enclosed by a solid fence or wall not less than eight (8) feet in height and con- strutted of brick, concrete or wood. (b) Such fence or wall shall be maintained in a neat, substantial, safe and sanitary condition,. A.wooden fence shall be painted once every two (2) years. (c) No sign, picture, transperancy, advertisement or mechanical device, which is used for the purpose of, or which may be used to advertise or bring to notice of any person or persons, any article or articles of merchandise, or anything that is to be, or has been sold, bartered or given away, shall ,~be placed, or:caused to be placed or maintained upon the outer ~? ~ide of such fence or wall. ~ ~/~~,~;~,~F~~ (d) Gates for access to the premises shall swing in- wardly, and such gates shall be kept closed when the premises are not open for business. (e) Mo Ju.~k shall be piled or permitted to be piled at any level higher than the horizontal plane at an altitude of two (2) feet below the top of such fence or wall. (f) The premises, upon which such Junk yard ~a¥ be operated, shall be open to inspection of all parts of said pre- mises at any time by fire, health, police and building authorities. (g) No Junk yard shall be ~_in~ained or operated in any portion of said city situate westerly from the Bayshore High- way and north of Railroad Avenue to the westerly boundary line of maid city. (h) No permit for much business shall hereafter be issued, unless and until the chief engineer of the fire depart- ment of said city shall have reported to the City Council that the provisions of this ordinance ham been complied with. (i) Failure to car~y on, maintain and conduct such business according to the regulations herein provided, after a permit has been issued therefor, shall be good and sufficient cause for the revocation of a permit. In the event that it shall appear to said City Council that any permittee has failed to comply with the provisions of this ordinance, said City Council shall fix a date for hearing the charge of violation a.~d shall give to such permittee five (5) days' notice of such hearing. If, upon such hearing, the City Council finds that said permittee has failed to comply with the provisions of this ordinance, maid permit shall be revoked. Section 3. Any person, persons or corporation who shall violate any provision of this ordinance shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not less than fifty dollars ($50.00) and not exceeding three hundred dollars ($300.00), or by imprisonment for a period not exceeding three (~) months, or by both such fine and im- prisonment. 0 Section ~. No sentence l~posed for a violation of this ordinance ~ay be suspended. Section 5. This ordinance shall be published once in the Enterprise-South San Francisco Journal, a news- paper of general circulation published and circulated in said city, and shall take effect and be in force on the expiration of thirty (50) days after its adoption.
