ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN
FRANCISCO REGULATING THE USE OF FIRE HYDRANTS OWNED BY SAID CITY.
The City Council of the City.of South San Francisco
does ordain as follows:
Section 1. No person whosoever, except a city employee
acting within the scope of his employment or an employee or
representative of the California Water Service Company acting
within the scope of his employment, shall use or draw any water
from any fire hydrant other than in an emergency and then only
for the purpose of extinguishing a fire, without first obtaining
a written permit from the Chief of the South San Francisco Fire
Department upon written application being made therefOr. In the
absence of the Chief of said Fire Department such permit may be
granted by the Assistant Chief or the duly authorized agent of
the Chief.
Section 2. Every application for any such permit, as
mentioned in the preceding section, shall state the location of,
and the time when, the use of the fire hydrant is desired. Every
such application must be accompanied by a deposit of FIFTY DOLLARS
($50.00) for each hydrant to be used. After any hydrants have been
used, the Chief of the Fire Department shall deduct ONE DOLLAR
($1.00) for each hydrant used by the applicant and, in addition,
the Chief of the Fire Department shall deduct any and all costs
necessary to repair any damage to any such hydrant by such
applicant, or his agent or agents, and after making such
deductions, he shall return any balance of said deposit to the
permittee. If at any time such deposit is exhausted, the same
shall be renewed forthwith on demand by the Chief of the Fire
Department.

Section 3. Each permit granted by the chief of the Fire
Department shall specify the hydrant or hydrants to be used by
the applicant and the time or times within which use may be made
of such hydrant or hydrants, Also, such permit shall specify the
type of connection or connections which may be used by the
permittee and, in addition, such permit shall specify the type
of wrench which the permittee may use. No permit shall be good
for more than ~ ~_ ( ~-I?O ) days from the
date of issuance.
Section 4. It shall be the duty of any person using
any fire hydrant, who finds the same in need of repair, to forth-
with notify the Chief of the Fire Department of that fact.
Section 5. No person shall make use of any fire hydrant
unless he shall use the type of wrench and connections prescribed
by the Chief of the Fire Department. In this regard, if any
person, while using any fire hydrant, shall cause any damage to
the same, he shall ~mmediately report such damage to the Chief
of the Fire Department.
Section 6. Any person violating any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor, and
upon conviction thereof, shall be punished by a fine of not less
than ONE HUNDRED DOLLARS ($100.00) or more than FIVE HUNDRED
DOLLARS ($500.00), or by imprisonment for a period of not more
than six (6) months or by both such fine and imprisonment.
Every person continuing, committing, or permitting any violation
of any provisions of this ordinance shall be deemed guilty of a
separate offense for each and every day of said violation of this
ordinance.
Section 7. This ordinance is hereby declared to be an
emergency measure for the immediate preservation of public safety,
and the following is a statement of the facts constituting such
emergency: At times various persons have made use of fire
hydrants in the City of South San Francisco and in so doing, have
damaged the same, rendering them difficult or impossible of
operation, all of which has endangered life and property and the
health, safety, and welfare of the general-public.
Section 8. This ordinance shall be published by one (1)
insertion in the "SOUTH SAN FRANCISCO ENTERPRISE-JOURNAL", a
newspaper of general circulation, printed and published in said
City of South San Francisco, and henceforth the same shall be
in full force and effect.
