Timmons Assistant City Engineer Raymond Maxwell Building Inspector Rex Greene MINUTES OF PREVIOUS MEETING Minutes of the Planning Comndssion meeting of July 27, 1970. Commissioner Zlatunich moved that the corrected minutes of the regular meeting of the South San Francisco Planning Comndssion of July 27, 1970, be approved; seconded by Comndssioner Rosati; passed by the following roll call vote: AYES: Campredon, Boblitt, Rosati, Zlatunich and Lazzari NOES: None ABSENT: Gardner and Raffaelli ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman Lazzari announed that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission in order to be heard, but objected to having his voice recorded in this manne~, could request the Chairman to order the tape recorder turned "off" for the duration of the time that he is speaking or is heard. - 1176 - - UP-160 - August 10, 1970 UP-160, use-permit request of Charlene Fozzard to establish a second-hand store (boutique) in an existing building located at No. 315 Linden Avenue, in the C-2 District. Secretary Pass read the following reports into the record. Report and recommended"Findings" of City Planner Daniel M. Pass "The Planning Department respectfully recommends that the Planning Commission adopt the findings and action embodied in the attached, preliminary Official Action Report." FINDINGS: "1. The establishment, maintenance, operation or the use of the building or lands for which the permit is sought will, under the circumstances of the particular case, be detrimental to the health, safety, morals, comfort and general welfare of persons residing or working in the area of such proposed use, and will be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the city. "2. The approval of the requested use permi t would not meet the requirements of Section 6.23 of the Zoning Ordinance. "3. The location of additional second-hand stores in this municipality's urban core would have a deleterious effect thereon, and would tend to sp$ead the decline and blight infestation extant therein. "4. According to General Objective No. 8 of the General Plan of 1969, the urban core "should be the civic, commercial, financial, recreational, social, and cultural focus of South San Francisco." The establishment of the proposed second-hand store would be incompatible with this objective." Report, dated July 23, 1970, of Fire Chief John A. Marchi "We approve the above subject providing that they comply wi th our requirement in regard to installing two (2) fire extinguishers, to be spotted by us." Mr. Harold Silen, Attorney at Law, and agent of the applicant was present, and delivered a petition to the Corrmrission, which contained the names and addresses of six proponents for the applicant. Mrs. Charlene Fozzard, the applicant, advised the Corrmrission that her second-hand store (boutique) would not be selling used clothing or apparel. The applicant further advised the Corrmrission, that her store would be selling some new clothing, such as handmade items, leather art craft, lamps, clocks, etched glass work and some antique items. - 1177 - - UP-160 - August 10, 1970 Mr. Si1en advised the Commission, that Mrs. Fozzard is buying a home at 901 Hillside Blvd. in South San Francisco and is extremely interested in the social and cultural upgrading of the Urban Core of the City. Mr. Si1en further noted, that Mrs. Fozzard is renovating the store to make it an attractive addition to the area. The City Planner advised the COmrrUssion, that a second-hand store would be incompatible with the General Plan. Mr. Pass further noted, that the Urban Core had begun to deteriorate with the loss of John's Men's Store, Mongomery Ward's and the probable loss of J. C. Penney's Store. He further noted, that the Urban Core had seen the addition of two second- hand stores and a pawn shop. There being no comments by the public either for or against the proposed use permit Chairman Lazzari closed the public hearing thereon and solicited comments from the Commission. Upon a query by Commissioners Zlatunich and Vice Chairman Campredon, Mr. Si1en advised the Commission that the store had been open for renovation and Mrs. Fozzard had been selling only new merchandise. Commissioner Campredon expressed concern over the parking in the area, and was advised by the City Planner, that the proposed store was located in a parking district and no parking problem was anticipated. COmrrUssioner Boblitt noted that a second-hand store would have a deleterious effect to the area since a proposal for a new bank site was to be located within a block of the proposed store. Commissioner Rosati stated that he was opposed to a second-hand store, but not necessarily to one which would sell new clothing, works of art and good antiques. There being no further comments by the Commission, Commissioner Lazzari asked the Commission for a motion. vice Chairman Campredon moved, that the Planning Commission approve UP-160 upon the following conditions: CONDITIONS: 1. Used clothing or apparel shall not be sold on the subject premises. 2. The applicant shall meet the submitted requiredments of the Fire Chief. 3. The use permit is granted for a period of one year, in order to per- petuate the Planning Commission's direct control over the land use in question. The motion was seconded by Commissioner Rosati, and passed by the following roll call vote: AYES: Campredon, Rosati, Zlatunich and Lazzari NOES: Boblitt ABSENT: Gardner and Raffaelli - 1178 - - UP-16l - August 10, 1970 UP-16l, use-permit request of Bank of America to establish a drive-in bank and appurtenant off-street parking at No. 508 Linden Avenue in the C-2 and R-3 Districts. Secretary Pass read the following reports into the record. Report and recommended "Findings" and "Conditions" of City Planner Daniel M. Pass "The Planning Department respectfully recommends that the Planning Commission adopt the findings embodied in the attached, preliminary Official Action Report, and approve the instant use-permit request upon the condition that the applicant comply ftVi th the condi tions embodied therein." FINDINGS: "1. The establishment, maintenance, operation or the use of the building or lands for which the permi t is sought will not, under hhe circumstances of the particular case, be detrimental to the health, safety, morals, comfort and general welfare of persons residing or working in the area of such proposed use, and will not be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the city. "2. The approval of the requested use permit meets the require- ments of Section 6.23 of the Zoning Ordinance. "3. The proposed use would be characterized by excellent architecture, sound site planning, and a strong emphasis upon aesthetic design. "4. The proposed use would be served by ample off-street parking. CONDITIONS: "The applicant shall comply with the submitted requirements of the City's department head, and the subsequent requirements of the Planning Commission's Architectural Committee." Report, dated July 31, 1970, of Chief of Police Salvatore Rosano "Reference noted subject, this Department foresees no police problem incidental to this installation. Therefore, we have no objection at this time. /I Report, dated July 31, 1970, of Director of Public Works Louis H. Goss "It is recommended that approval of this permit be subject to the review and approval by this office of the complete improve- ment plans. Said plans should contain, but not be limited to, plot and grade plans showing drainage, sanitary sewer, and all other necessary utility connections.1I - 1179 - UP-16l August 10, 1970 Present for the applicant were Messrs. Gene T. Izuno, AIAi and Daniel Holland, agents of the applicant. Mr. Izuno advised the Commission that the proposed bank was not only a drive-in bank, but was in fact, a full service bank. There being no comments by the public, either for or against the pro- posed use permit, Chairman Lazzari closed the public hearing thereon and solicited comments from the Commission. Upon a question by Commissioner Zlatunich, City Planner Pass advised the Commission that the proposed sign was under 100 square feet in size. Commissioner Boblitt and Vice Chairman Campredon expressed concern over the traffic that would be generated in the area, and were advised by the City Planner, that the reporting city department heads had adequately studied and resolved the traffic problem. Considerable discussion ensued amongst the Commissioners, regarding the architectural design, the exterior finish materials and the land- scaping of the proposed bank. There being no further comments by the Corrmrission, Chairman Lazzari asked the Commission for a motion. Commissioner Boblitt moved, that the Planning Commission adopt the findings and conditions, as set forth in the preliminary Official Action Report, and approve uP-16l upon the condition that the appli- cant comply with the submitted requirements of the City's reporting department headsi seconded by Commissioner Zlatunichi passed by the following roll call vote: AYES: Campredon, Boblitt, Rosati, Zlatunich, and Lazzari NOES: None ABSENT: Gardner and Raffaelli - 1180 - V-85 August 10, 1970 V-85, variance request of Marie J. Schmidt to construct a swimming pool less than the required distance from the single-family dwelling at No. 317 Southcliff Avenue, in the R-l District. Report and Recommended "Findings" of City Planner Daniel M. Pass "The Planning Department respectfully recommends that the Planning Commission adopt the findings embodied in the attached, preliminary Official Action Report, and grant the requested variance." FINDINGS: "1. There are exceptions or extraordinary circumstances or conditions applying to the land or building referred to in the application, which circmmstances or conditions do not apply generally to land or buildings in the same district. "2. The granting of the applicaf:.mon is necessary for the preservation and enjoyment of substantial property rights of the petitioner. "3. That the granting of the applica..tion will not, under the circum- stances of the particular case, materially affect adversely the health or safety of persons residing or working in the neighborhood of the property of the applicant, and willnnot, under the circumstances of the particular case, be materially detrimental to the public welfare or injurious to property or improvements in said neighborhood. "4. The granting of the reques ted variance will be in harmony wi th the gene~al purpose of the Zoning Ordinance. "5. The requested variance is neff.Cessary to prevent practical diffi- culties, unnecessary hardships, and results inconsistent with the general purpose of the Zoning Ordinance. "6. The proposed structure would be subterranean, and therefore would not reduce the ventilation or sunshine on the subject building site, and would not substantially reduce the residential quality thereof. Mrs. Pearl Messer, agent of the applicant,who was on vacation, was present and advised the COmrrUssion that she would be pleased to answer any questions pertaining to V-85. Since there was no one to speak for or against the requested variance, Chairman Lazzari closed the public hearing thereon and solicited comments from the Commission. vice Chairman Campredon inquired as to the slope of the rear yard area, and was advised by the City Planner, that the proposed swimming pool site was relatively level. The City Planner further noted that the two public utility easements on the property were located adequately beyond the proposed pool. There being no further comments by the Commission, Chairman Lazzari asked the Commission for a motion. COmrrUssioner Rosati moved, that the Planning Commis- sion adopt the "Findings" embodied in the Preliminary Official Action Report and grant the requested variance. The motion was seconded by Commissioner Zlatunich, and passed by the following roll call vote: AYES: Campredon, Boblitt, Rosati, Zlatunich and Lazzari NOES: None ABSENT: Gardner and Raffaelli - 1181 - PM-66 August 10, 1970 Continued Hearing, PM-66, tentative parcel map of E. H. Edwards Company, representing the subdivision of one lot, with an aggregate area of 9.41 acres and located at the southeasterly corner of Oyster Point Boulevard and Industrial Way (498 Industrial Way), in the M-2-H District, into two lots. (Continued hearing from July 27, 1970) The Secretary read the following reports into the record. Report of City Planner Daniel M. Pass "The proposed minor subdi vision meets the requirements of the State Subdivision Map Act, and the regulatory standards embodied in the Subdivision Ordinance of the City of South San Francisco. Said sub- division would create two, well-designed industrial lots." "The Planning Department respectfully recommends that the Planning Commission adopt the above factors as its findings, and approve the instant tentative parcel map upon the condition that the subdivider comply with the submitted requirements of the City's department heads." Report, dated July 14, 1970, of Director of Public Works Louis H. Goss "P1ease be advised that this office has checked the proposed tentative parcel map of Lands of E. H. Edwards Company at the southeasterly corner of Oyster Point Boulevard and Industrial Way." "We recommend that the parcel map be approved subject to the dedica- tion of a 23'-wide strip of land adjacent to the southerly edge of Butler Road extending from the proposed westerly boundary line of Parcel 2 to the easterly boundary line of Parcel 2. This dedication is necessary to provide for the future widening and improvement of Oyster Point Boulevard to a four-lane divided arterial as shown on the General Plan of the City of South San Francisco." Report, dated July 16, 1970, of Chief Building Inspector Leonard J. Pittz "I have examined the Tentative Parcel Map PM-66 being a subdivision of the Lands of E. H. Edwards Co. at the southeast corner of Oyster Point Boulevard and Industrial Way into two parcels and recommend approval upon the following conditions: "1. Recheck the dimensions on the northerly property line of 495.47' and 360.12'. The County Assessor's map book has these dimensions shown as 491.47' and 368.12' respecti ve1y." Report, dated July 22, 1970, of Director of Public Works Louis H. Goss "This memorandum supersedes and revises the recommendations submi tted in my memorandum dated July 14, 1970." "It is recommended that the parcel map be approved subject to the dedication of an additional 9' wide strip of land for public street purposes extending from the proposed westerly boundary line of Parcel 2 to the easterly boundary line of Parcel 2. The requested additional 9' wide dedication for public street purposes is to be adjacent to the southerly edge of the existing 10' easement for public street or highw'ay. (1052 O.R 98 - 74475-B) " - 1182 - PM-66 August 10, 1970 "This will provide a total width of R/W of 44' from the existing center line of Oyster Point Boulevard which will provide one-half of the required R/W width for the future widening and improvement of Oyster Point Boulevard to a four-lane divided arterial as shown on the General Plan of the City of South San Francisco." Mr. Louis A. Arata, C.E. and agent of the subdivider, was present and advised the Commission that his clients and their board of directors wished to request a continuation on the hearing to a future meeting of the Planning Commission. Mr. Arata also advised the Corrmrission, that since the proposed street widening would be in close proximity to the E. H. Edward's Company's buildings, his clients wanted time to further study the matter with the City's Staff to see how the proposed widening would affect their total property. with the concurrence of the Commission, Chairman Lazzari ordered the hearing on PM-66 continued to the Commission's regular meeting of September 14, 1970. - 1183 - Acquisition of Right of Way August 10, 1970 Secretary Pass read the following letter and reports into the record. Letter, dated July 30, 1970, from Anna Ohlendorf, City Clerk, Daly City "Pursuant to Section 65402 of the Government Code, State of California, the City of Daly City is directing to your attention a proposed acquisi- tion per Grant Deed of property which falls within the corporate city boundaries of your city. "Copy of the Grant Deed as offered by Suburban Realty and a map indicating in yellow subject property is attached hereto for reference purposes. Please take appropriate action and direct your reply to the Office of the City Clerk. Very truly yours, /s/ Anna Ohlendorf, City Clerk" Report dated August 3, 1970, of City Planner Daniel M. Pass "1. The Suburban Realty Company recently offered to grant certain lands to the City of Daly City for the easterly extension of King Drive. While said lands will ultimately be a part of Daly City, tgey are now located within the corporate limits of the City of South San Francisco. "2. According to Section 65402 (b) of the State Planning and Zoning Law, a city cannot acquire real property situated in another municipality for street purposes until the planning agency of the latter reports on the conformity of the proposed acquisition to the adopted General Plan. "3. The Planning Department has perused the communication from the City of Daly City and is of the opinion that the proposed acquisition of land for the extension of King Drive substantially conforms to the adopted General Plan of the City of South San Francisco, and the approved General Development Plan of the Westborough-West Park No. 3 Planned Community District, as incorporated in Ordinance No. 575. "4. The Department therefore respectfully recommends that the Planning Commission instruct its secretary to report to the City Council of Daly City that the proposed acquisition substantially conforms to the General and Specific Plans of the Ci ty of South San Francisco. II Report, dated August 3, 1970, of Director of Public Works Louis H. Goss "This office has examined the proposed grant as described in the Corporation Grant Deed from Suburban Realty Company to Daly City dated June 19, 1970. Said description closes mathematically and the area shown is correct." There being no comments by the public, either for or against the pro- posal, Chairman Lazzari closed the public hearing thereon and solicited comments from the Commissioners. - 1184 - Acquisition of Right of Way August 10, 1970 Upon a question by Commissioner Boblitt, City Planner Pass, advised the Commission that this was not a transfer of lands, but was necessary under the Government Code. Mr. Pass further noted that Surburban Realty Company is ready to transfer this land to Daly City for King Drive. The City Planner noted that the street, curb, gutter and sidewalk is in, is being maintained by Daly City and they do not have the right to expend municipal funds on it because it is not dedicated for public use. There being no further discussion among the Commissioners, Chairman Lazzari asked the Corrmrission for a motion. Corrmrissioner Rosati moved that the Planning Commission instruct its secretary to report to the City Council of Daly City that the pro- posed acquisition substantially conforms to the General and Specific Plans of the City of South San Francisco; seconded ~y Commissioner Boblitt; passed by the following roll call vote: AYES: Campredon, Boblitt, Rosati, Zlatunich and Lazzari NOES: None ABSENT: Gardner and Raffaelli GOOD AND WELFARE, OTHER AND COMMUNICATIONS Commissioner Boblitt noted, and the Secretary concurred, that perhaps the Planning Commission, in the future, should require all applicants, who come before the Commission, to prepare better elevations of pro- posed buildings. There being nothing further to be considered under Good and Welfare, and there being no further communications or other matter of interest for the Planning Commission, Chairman Lazzari announced that the next regular meeting of the South San Francisco Planning Commission would be held on August 24, 1970 at 8:00 P.M. in the Council Chambers of City Hall, South San Francisco, California The meeting was adjourned at 9:07 P.M.
