ORDINANCE NO. 345
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
does ordain as follows:
Section 1. It shall be unlawful for any person,
firm, or corporation to leave on any vacant lot or outside of
any building, dwelling, or in any other place accessible to
children, including any vacant, abandoned, or unoccupied
building which is not locked at all times when not in use,
any abandoned, unattended, or discarded ice box, refrigerator,
or container of any kind which has an opening of such size
as to permit the entrance of a child or infant, which, when
closed, is airtight, or practically so, and which has a door
secured by a snap lock, or other locking device that may not
easily and readily be released for opening from the inside of
said ice box, refrigerator, or container, unless the said door,
snap lock, or other locking device has first been removed
therefrom.
Section 2. It shall be unlawful for any person, firm
or corporation to allow or permit upon his or its property,
or any property under his or its control, the existence of any
unattended well, mine shaft, cave, or other type of opening in
the ground which is of such size as to accommodate therein a
person, including both infants and adults, without first securely
closing off, or blocking, any and all entrances thereto or
exits therefrom.
Section 3. Any person violating any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor,
and upon conviction thereof, shall be punished by a fine not
in excess of FIVE HUNDRED DOLLARS ($500.00), or by imprisonment
for a period of not more than six (6) months, or by both such
fine and imprisonment. Every person continuing, committing,

or permitting any violation of any of the provisions of this
ordinance shall be deemed guilty of a separate offense for
each and every day of said violation of this ordinance.
Section A. This ordinance is hereby declared to
be an emergency measure for the immediate preservation of
public safety and the following is a statement of the facts
constituting such emergency~ Recently, there have been
instances in other cities and places where children have been
suffocated because of becoming locked in abandoned or unattended
ice boxes, refrigerators, and other containers having airtight
doors and snap catches or locks, and instances where persons have
been trapped in abandoned or unattended wells, caves, mine
shafts, and other openings in the ground~ Also, there have
been occasions when containers and openings in the ground of
the type above mentioned have been abandoned or unattended
within the City of South San Francisco. Consequently, the
city council does hereby find and determine that there is
imminent danger and possibility of such tragic accidents to
persons occurring in the City of South San Francisco and that,
therefore, a situation exists which constitutes a menace to
the health, welfare, and safety of the people of the City of
South San Francisco.
Section 5. This ordinance shall be published by
one (1) insertion in the South San Francisco ENTERPRISE-
FOURNAL, a newspaper of general circulation, printed and
published in said City of South San Francisco, and shall be
in full force and effect immediately upon its adoption°
