Vice Chairman Raffaelli moved that the minutes of the regular meeting of the South San Francisco Planning Commission of May 24, 1971 be approved; seconded by Commissioner Zlatunich; passed by the following roll call vote: AYES: Vice Chairman Raffaelli, Commissioners Boblitt, Botieff, Gardner, Zlatunich, and Chairman Campredon NOES: None ABSENT: Commissioner Lazzari ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman Campredon announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission in order to be heard, but objected to having his voice recorded in this manner, could request the Chairman to order the tape recorder turned "off" for the duration of the time that he is speaking or is heard. - 2 89 3- June 14,. 1971 UP-190,. use-permit request of the Beverly-Glenwood Corporation to establish Residential Planned unit Development "J" at the northeasterly corner of Greendale and Galway Dri ves,. in the Westborough-West Park No.3 Planned Community District. Secretary Pass read the following Staff Report into the record. "TO: The Honorable Chairman and Members of the South San Francisco Planning Commission FROM: The Undersigned Department Heads of the City of South San Francisco RE: UP-190 The undersigned department heads have indi vidually and jointly studied the subject request to establish Planned unit Development "J",. and recommend that the Commission accept the following findings and order the instant use permi t to stand approved upon the appli- cant's compliance with the following requirements. FINDINGS: 1. The establishment, maintenance, operation or the use of the buildings and lands for whi ch the use permi t is sought will not under the circumstances of the particular case, be detrimental to the health, safety, peace, morals, comfort and general welfare of persons residing or working in the neighborhood of such proposed use, and will not be detrimental or injurious to property or improvements in the neighborhood, or to the general welfare of the ci ty . 2. The applicant has filed the verified peti tion, plot plans, floor plans, building elevation plans, and common green plans required by Section 5.7l(a) of the Zoning Ordinance. 3. The proposed plans conform to the provisions of Sections 5.72 and 5.73 of the Zoning Ordinance. 4. The proposed planned-uni t development is designed to produce an orderly, stable and desirable environment. 5. The planned uni t development would comply wi th the terms of Ordinances 490 and 575, under which the Westborough-West Park No. 3 Planned Community was established and to the amended general development plan of the Westborough-West Park No. 3 Planned Community, where the latter is not in conflict with the former. 6. The planned uni t development would conform to the General Development Schedule of the Westborough-West Park No. 3 Planned Community. 7. The approval of the planned unit development would tend to effectuate the City's adopted General Plan. -2894- June 14, 1971 "8. The proposed townhouse and condorrdni um-apartment development would baarmotriously blend wi th the existing townhouses in West- borough-West Park Units No.1, No.2, and No.3. 9. The proposed lot and condomini um-uni t pattern are desi gned to minimize the adverse effects of local seismic activity. 10. That the proposed development includes provision for recrea- tion areas to meet the anticipated needs of the population or such areas as may be specified in the Master Plan or in the approved General Development Plan and Schedule for the P-C District in question. 11 . That an enforceable adequate method and program for con- struction, installation and maintenance of landscaped open areas has been developed and presented. 12. The applicant-developer's submitted plans and building elevations indicate that the proposed 800 sq. ft. condominium apartments in Planned unit Development "J" would not adversely affect the nature, character, and design of Westborough-West Park No.3, or its constituent or neighborhing areas. 13. The proposed Planned unit Development would conform to the lot, block, street, and common-green pattern established by the recorded, final map of Westborough-West Park Unit No.3C (SA-17). 14. The platting of the Westborough Hills No. 2 Condomini um Project component of Planned Uni t Development "J" was condi tion- ally approved by the Planning Commission on May 24, 1971, under PM-77. The further platting of condominium projects in this PUD will require the submittal and approval of several additional tentative parcel maps. REQUIREMENTS: 1. The applicant shall submit amended plans, specifications, and drawings which reflect the applicant's compliance with the require- ments of the Planning Commission. 2. The applicant shall convey the common greens in the subject planned-uni t development to the Ci ty of South San Francisco. Said appli cant shall J' at the time of the conveyance of the common greens, submit to the City Attorney a title insurance policy which assures the said Attorney that title to the said common greens vests in the City of South San Francisco, and that said title is free and clear of all liens, taxes, and encumbrances. 3. The applicant shall annex the subject planned-uni t develop- ment to the West Park Parkways and Maintenance District, or similar municipal district. -2895- June 14, 1971 "4. The applicant shall file with the City Planner the necessary documents providing for the construction, installation, and main- enance of the subject common greens in accordance wi th the approved plans and specifications thereof. 5. The applicant shall file wi th the said Ci ty Planner a corporate surety bond guaranteeing the construction and installation of the said common greens in accordance wi th the related plans and specifications, and pursuant to City Resolution No. 4583. 6. The applicant shall file with the City Planner an agreement under which it undertakes the maintenance of the subject common greens, from the time of their development to the time of their acceptance for maintenance by the City. This agreement shall be secured by a corporate surety bond in the principal sum approved by the City Landscape Specia;List and City Attorney. 7. The approved final map of Westborough-West Park No. 3C aiid the condominium projects therein shall be filed with the County Recorder, prior to the sale of apy involved lots or units therein. (The above, seven requirements are declaratory of Sec. V of Ordinance No. 575.) 8. Hydrants, water mains, and fire alarms shall comply, wi th respect to si ze, type, and 10catiorJ., to the requirements of the Fire Chief, as indicat~d on utili ty Plan Drawing No. WWP 3-U-l, Revision 3, January 29, 1968. Prior to the location of street trees in adjacency to fire hydrants and fire-alarm boxes, said location must be approved by the Fire Chief or Assistant Fire Chief. Said hydrants and boxes must be indi cated on the final landscape plans of the subject PUD. 9. All garages shall have minimum depts of 22'. Where swinging, overhead garage doors are employed, the distance between the face of the door and the inner edge of the sidewalk shall be a minimum of 22'. Where sliding or roll-type doors are used. the said dis- stance shall be a minimum of 19' . Where lots or units abQt upon cul-de-sac streets, the provisions of Section IX.C.2. of Ordinance No. 575 shall govern. 10. Street lights shall meet the design and location requirements of the Director of Public Works and the Chief of Police. 11. Traffic-control markings, signs, and devices shall be pro- vided by the applicant and shall meet the standards and specifica- tions of the Director of Public Works and the Chief of Police. 12. The applicant shall locate minimum 4"-high illuminated house numbers on each townhouse and condominium apartment. These numbers shall have a minimum ground clearance of 7', and be clearly visible from adjacent travel ways . -2896- June 14, 1971 13. The applicant shall provide at least one street tree for each lot, but not less than one street tree per 25' of street abutment, in Planned uni t Development "J". The applicant's street-tree selection and planting program shall comply wi th the standards and specifications of the Recrea- tion and Parks Superintendent, and the Landscape Specialist. 14. No townhouse or condomini um apartment in Planned Uni t Development "J" shall be occupied prior to the Landscape Specialist's issuance of a certificate which indicates that the adjoining common green has been constructed and planted to the City's standards. 17. All fences, partitions, and walls shall conform to the standards and specifications of the City of South San Francisco. 18. Cable TV lines are to be installed to the front of each townhouse and condominium apartment prior to the installation of any landscaping. 19. The applicant shall comply with the subsequent requirements of the Planning Commission's Architectural Committee. 20. All surface-mounted transformers and other public-utility structures shall be screen-planted to the requirements of the Landscape Specialist. 21. Separation walls between condominium-apartment garage shall be one (1) hour-fire resistant construction. 22. The developer shall construct fences along the boundary lines be- tween common greens and nonresidential territory, except where said territory is situated within dedicated public streets. 23. The grades of the proposed common greens shall not exceed 3%. (Reference: Grade Plan, Drawing No. WWP-3-G-l, Revision 4) 24. The landscaped islands in the cul-de-sac streets shall be main- tained by the West Park Parkways and Maintenance Distri ct. 25. The applicant shall submit an erosion-control plan for the off- site slopes created by the subject project to the Director of Public Works and Landscape Specialist, and shall improve said slopes to the requirements thereof." /s/ Louis H. The owner of the subject property is Beverly-Glenwood Corporation 3655 Georgetown Court, South San FEancisco, and the developer is the J. H. Secretary Pass read the following reports and letter into the record. Report and Recommendation of City Planner Daniel M. Pass "It is respectfully recommended that the Planning Commission adopt the 'findings' and action embodied in the attached, preliminary Official Action Report." FINDINGS: "1. The establishment, maintenance, operation or the use of the building or lands for which the permi t is sought, will, under the circumstances of the particular case, be detrinEntal to the health, safety, morals, comfort and general welfare of persons residing or working in the area of such proposed use, and will be detrimental or injurious to property and improvements in the neighborhood and the general welfare of the ci ty . 2. The approval of the requested use permit does not meet the requirements of Section 6.23 of the Zoning Ordinance. 3. According to Use Permit #559, approved by the Planning Commission and City Council in April, 1956, the sign in question is an appur- tenant sign--not a billboard. 4. The establishment of a new billboard in the Airport Boulevard commercial strip, where there is an existing plethora of appurtenant signs, would tend to create confusion and disorder therein, and in the adjoining urban core of South San Francisco. 5. A similar use-permit request, filed under UP-76, was denied by the Planning Commission on March 11, 1968." There will be too much weight on the building, as it is an increase in si ze of the existing si gn. This is also considering the wind factor, which is everIi/present. 2. In the event of fire it would be dangerous and would probably come through the roof. 3. In the event of a large earthquake it woul d also p rob abl y go through the roof, and therefore would be dangerous in all three instances." Hoffman .1.2899- UP-19l June 14, 1971 "The Beautification Program for the City of South San Francisco, adopted by the City Planning Commission, April 27, 1970, by resolution number 2107, and by City Council, May 4, 1970, under the heading of 'Scope and Objectives' states the goals of the Program. They are, in part, as follows:: 'To promote the beautification of South San Francisco in an effort to make the City a more pleasant and desirable communi ty in whi ch to li ve . To create an environment in the City which contains beauty. To encourage a communi tywide interest in beautifying South San Francisco. To enhance the City's environmental image. . . To upgrade the general appearance of the City.' "One of my prime responsibili ties as the City Landscape Specialist is to implement this City Beautification Program. I would, therefore, be gravely lax in my duties if I did not most urgently inform you that this subject billboard, and in fact all billboards, are detrimental to the stated goals of our City Beautification Program. "My recommendation is to deny Use Permi t number 191 for the reason that it violates the adopted City Beautification Program." In addition to our objection that this City in which we work or live is already cluttered with billboards and signs, we note that there is an inherent danger to everyone if this request is approved. Pass "The Planning Department respectfully recommends that the Planning Commission adopt the findings listed in the attached preliminary Official Action Report, and grant the requested variance upon the condition that the applicant comply with the attached requirements of the reporting department heads, and the subsequent requirements of the Archi tectural Commi ttee. " FINDINGS: "1. There are exceptions or extraordinary circumstances or condi tions appl ying to the land or building referred to in the appli cation, whi ch circumstances or conditions do not apply generally to land or buildings in the same district. 2. The granting of the application is necessary for the preservation and enjoyment of substantial property rights of the petitioner. 3. That the granting of the application will not, under the circum- stances of the particular case, materially affect adversely the health or safety of persons residing or working in the neighborhood of the property of the applicant, and will not, under the circumstances of the particular case, be materially detrimental to the public welfare or injurious to property or improvements in said neighborhood. 4. The granting of the requested variance will be in harmony wi th the general purpose of the Zoning Ordinance. 5. The requested variance is necessary to prevent practical diffi- culties, unnecessary hardships, and results inconsistent with the general purpose of the Zoning Ordinance. 6. The rear-yard requirements of the M-l-H District are designed to promote the establishment of alleys, where such establishment would be desirable and practicable. In the instant case, the establishment of an alley would be neither desirable nor practicable. 7. Several, similar variances have been granted. Secretary Pass read the following reports into the record. Report and recommendation of City Planner Daniel M. Pass "While the proposed resubdi vision meets the requirements of the State Subdi vision Map Act, it fails to fully comply wi th the lot- width regulations of Section 3.03b of the Subdivision Ordinance of the City of South San Francisco. This failure is not related to any physical properties in the parent parcel, but is the result of the subdivider's placement of a "dog leg" in the common property line of proposed Lots 1 & 2 in order to preserve a barbecue struc- ture. The Planning Department is of the opinion that the creation of a substandard, irregular lot in order to save a barbecue indicates that the proposed resubdi vision is probably "premature." The Planning Department therefore respectfully recommends that the Planning Commission approve the instant tentative map upon the condition that the 'Subdivider remove the aforementioned "dog leg," and comply with the submitted requirements of the City's Department Heads. Opponents: None Considerable discussion ensued amongst the Commission and at the con- clusion of its consideration of PM-80, the Commission adopted the followi ng fi ndi ngs : Findings: 1. A fi ve-uni t, non-conforming apartment house is si tuated on the subject parent parcel of land. 2. The said apartment house was constructed wi thout the permission or sanction of the City of South San Francisco. 3. The approval of the subdivision map would increase the net density of the apartment hosue's building site to about one dwelling uni t per 1800 square feet of land, or more than 24 dwelling uni ts per acre. 4. The subject Ai ta vis ta Dri ve-Conmur Street area is sl ated for low-density residential development under the adopted General Plan, and is classified "R-l 1''' Single Family Residential, in accordance therewith. Under these standards the said subject area is limited to a net density of 4 to 5 dwelling units per acre. 5. The subject Ai ta vista-Conmur area and adjacent terri tories are dominated land-use wise by single-family dwellings. 6. The approval of the instant map would contravene the densi ty standards and "Ci ty Plan" of South San Francisco. Commissioner Botieff moved, seconded by Commissioner Gardner that the Planning Commission deny the instant tentative parcel map. Mr. Jimmy Brusco, 635 Palm Avenue, South San Francisco, noted that a large pine tree, off of Grand Avenue, near the Kaiser Clinic, was becoming a traffic hazard and was in dire need of pruning. Sylvia Gregory, 141 Madison Avenue, San Bruno, California, member of the San Mateo County Bay Watehers-to aid BCDC - commended the Commission's attitude, for not following a strictly legal viewpoint, but for pursuing a moral attitude in their decision making. Secretary Pass noted that when when we cannot depend on the laws of the land that can be applied equally to all, there can be no order and progress for a city, a state or a nation. There being nothing further to be c?nsidered under qood and Welfare, and there being no further communications or other matters of interest for the Planning Commission, Chairman Campredon announced that the next regular meeting of the South San Francisco Planning Commission would be held on June 28, 1971 at 8:00 P.M. in the Council Chambers of City Hall, South San Francisco, California.
