Amin MINUTES OF PREVIOUS MEETING Chairman Mullin mentioned that on page 3184 of the August 14, 1973 minutes under AYES in the roll call vote it should read: "Chairman Mullin" instead of"Chairman Raffaell i" . Commissioner Lazzari moved that the minutes of the regular meeting of the South San Francisco Planning Commission of August 14, 1973 be approved, with the correction noted above. The motion was seconded by Vice Chairman Mathewson and passed by the following roll call vote: AYES: Vice Chairman Mathewson, Commissioners Hale, Lazzari, and Chairman Mullin NOES: None ABSENT: ~e~5siDners Raffaelli and Slade ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman ~fullin announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission in order to be hexrd, but objected to having his or her voice recorded in this manner, could request the Chairman to order the tape recorder turned "off" for the duration of the time that he or. she is speaking or is heard - 3193 - UP-250 August 28, 1973 UP-250, use-permit request of Wayne Taylor Raceways to operate a temporary mini- car ride concession in the parking lot of the Westborough Square Shopping Center, in the C-l District. Operational period: September 14, 1973 to September 23, 1973 (10 Days). Secretary Martin read the following report and letters into the record. Report and recommendation of Acting City Planner Neal J. Martin. "The Planning Office respectfully recommends that the Planning Commission adopt the "findings" and action indicated in the attached, preliminary Official Action Report. Notice of said public hearing was published in the Enterprise-Journal, and posted on or near the subject premises at least 10 days prior to the said public hearing. The Planning Connnission, at the close of the public hearing, adopted the following findings, and conditionally granted the reque~ted use permit upon the following conditions. FINDINGS: 1. The establishment, maintenance, operation or the use of the building or lands for which the permit is sought will not, under the circumstances of the particular case, be detrimental to the health, safety, morals, comfort and general welfare of persons residing or working in the area of such proposed use, and will not be detrimental or injurious to property and improvem~nts in the neighborhood or the general welfare of the city. 2;~ The approval of the requested use permit meets the requirements of Section 6.23 of the Zoning Ordinance. 3. The proposed concession would be constantly supervised by employees of the Wayne Taylor Raceways. 4. The proposed concession has been successfully operated in the cities of Palo Alto, Campbell, Fremont, Santa Clara, San Bruno, etc. 5. An insurance policy would protect the City from liability. 6. The proposed promotional activity would give Westborough a modicum of vitality. 7. A siooilar mini-car ride concession was granted in April, 1971. CONDITIONS: The applicant shall comply with the submitted requirements of the City's department heads." August 28, 1973 "USE PERMIT for a temporary use allowing the Mini Car Ride to operate on the parking lot of the above named Center, in the loc~tion shown on the plot plan attached, during the dates of September 14, 1973 thru September 23, 1973. The Mini Car Ride consists of 8 small gas driven cars, inclodes in anyarea 75' x 150', with safety factors that has been cleared by the National Kart Association and the State of California, this ride has operated in numerous shopping centers and has returned to ,many of them two and three times. It is a ride that ha~ Driver Education quality and attracts the parents as well as the chi ldren. I have attached a copy of the agreement with the owner, a Certificate of Insurance, covering the City, and plot plan showing the location. We request that the area be changed to that area marked in red on the accompanying sheet. Please feel free to contact this office if you have any questions." Interoffice Memorandum, dated August 15, 1973, from Acting Director of Ecological Development Hugo Stoppoloni "Reference is made to UP-250 from Wayne Taylor Raceways regarding the operation of a temporary mini-car ride concession on the parking lot of the Westborough Square Shopping Center in the C-l District for the period of September 14, 1974 to September 23, 1973. Police Department (Traffic Department) and Fire Department both have agreed that since is is on private property, meets all other requirements as set forth in the Planning Division Report, and providing that Denny's Restaurant has no obj ections, they have no obj ection to the use permit." The motion was seconded by Commissioner Hale and was passed by the following roll call vote: AYES: Vice Chairman Mathewson, Commissioners Hale, Lazzari, and Chairman Mullin NOES: None ABSENT: Commissioners Raffaelli and Slade UP-25l UP-25l, use-permit request of Maude Horn for an existing fireplace (fire drum type) which is visible at the rear elevation of 3736 Bettman Way, in Westborough- West Park Unit No.3, in the Planned Community District. Martin "The Planning Office respectfully recommends that.the Planning Commission adopt the "findingsll, action, and "conditions" indicated in the attached, tentative Official Action Report. The fireplace should be checked out by the Fire Department and Building Division for compliance with their requirements. 5. It is the opinion of the Planning Office that granting such a use would encourage further installations of similar alterations. At the same time the Planning Office recognizes that refusing this use permit would create problems for the applicant. CONDITIONS: Under the circumstances the Planning Office reluctantly recommends that the subject use permit be approved subject to compliance with the requirements of the City's officials." Interoffice Memorandum, dated August 23, 1973, from Fire Marshal William Fox "I have consul ted with the Building Department on this matter and as far as this Department is concerned all that is required is that a spark arrestor be placed on the top of the chimney." The Commission was very concerned regarding such modifications. At the conclusion of its dis- cussion Chairman :Mullin asked the Commission for a motion. Commissioner Hale moved that the Planning Commission adopt the findings and conditions as set forth in the preliminary Official Action Report" and approve UP-25l upon the condition that the applicant comply with the submitted requirements of the City's reporting department heads. The motion was seconded by Commissioner Lazzari and was passed by the following roll call vote: AYES: Vice Chairman Mathewson, Commissioners Hale, Lazzari, and Chairmml Mullin NOES: None ABSENT: Rommissioners Raffaelli and Slade - 3197 - August 28 -' 1973 Planned Community District Modifications During the discussion of UP-25l the Commission was very concerned regarding any alterations and modifications in the Planned Community District. The Commission felt that allowing such modifications would defeat the purpose of the Planned Community District and suggested that the Secretary prepare a policy statement on this matter. Vice Chairman Mathewson moved that the Planning Commission instruct the Secretary to study and prepare a policy statement regarding Planned Com- munity District modifications and alterations. The motion was seconded by Commissioner Hale and was passed by the following roll call vote. AYES: Vice Chairman Mathewson, Commissioners Hale, Lazzari and Chairman Mullin NOES: None ABSENT: Commissioners Raffaelli and Slade PM-112 PM-112-, tentative parcel map of the Cabot, Cabot & Forbes Co., representing the resubdivision of 4 lots having 7.340 AC.+ located on the southerly side of Forbes Blvd., and between Kaufmann Court and Point San Bruno Blvd., in the M-2-H District, into 2 lots. Secretary Martin read the following report and letters into the record. Report and recommendation of Acting City Planner Neal .J. Martin "The proposed subdivision meets the requirements of the State Sub- division Map Act and the regulatory standards of the Subdivision Ordinance of the City of South San Francisco. The proposed subdivision would allow the applicant to consolidate four parcels, totalling 7.340 AC.+ into two parcels of 3.30 AC.+ and 4.032 AC The Planning Office recommends that the Planning Commission approve the tentative parcel map upon the condition that the subdivider comply with the submitted requirements of the City's department and division heads, and the standards and specifications administered by the Director of the Department Develo,p;ment . The motion was seconded by Vice Chairman Mathewson and was passed by the follow- ing roll call vote: AYES: Vice Chairman Mathewson, Commissioners Hale, Lazzari" and Chairman Mullin NOES: None ABSENT: Commissioners Raffaelli and Slade PM-113 PM-113, tentative parcel map of Cabot" Cabot & Forbes Co., representing the subdivision of a parcel of land, being 25.620 AC.+, located on the northerly side of Oyster Point Blvd., and opposite the extension of Eccles Avenue, in the M-2-H District, into 2 lots. Secretary Martin read the following report and letters into the record. Report and recommendation of Acting City Planner Neal J. Martin "The proposed subdivision ,meets the requirements of the State Sub- division Map Act and th,e regulatory standards of the Subdivision Ordinance of the City of South San Francis co . The proposed subdivision would allow the applicant to divide a 25.620 AC.~parcel into two separate parcels of 9.372 AC.+ and 16.248 AC.+. The applicant has indicated on the proposed tentative parcel map that the proposed parcel 2, having 16.248 AC.+, is to be offered for conveyance to the City of South San Francisco for Tnclusion in the Shoreline Regional Park. Although not specifically stated on the parcel map or in the appli- cation, it is assumed that parcel 2 .may be offered for conveyance, con- ditioned upon completion of negotiations for purchase of the property between the land owner and the City. It is felt that any recommendation concerning acquisition or purchase of this property should be subsequent to receipt and acceptance of a report on the marina and vicinity being prepared for the City by William-Kuebelbeck & Associates. - 3199 - PM-113 Contd. August 28, 1973 "It is recommended that the Planning Commission approve the tentative parcel map with the following conditions: 1. That the subdivider comply with the submitted requirements of the City's department and division heads,. and the standards and specifications administered by the Director of the Depart- ment of Ecological Development. 2. Subdivider shall provide for an access easement along the entire length of the east property line of Parcell, or a width equal to the existing driveway at that location. Said easement shall be conveyed to the owner of Parcel 2 upon sale of said parcel. Form of the easement shall be to the satisfaction of the City Attorney, description of said easement shall be to the satisfaction of the City Engineer." Secretary Martin stated that the Planning Office contacted BCDC office regarding their recommendations. The BCDC office informed the Planning Office that they had no adverse comment for the proposed tentative parcel map. Spruce Avenue between the C-3 District and the R-l District of Mayfair Village) from "R-3", Restricted Multiple-Family Residential District, to "C-3", Heavy Commercial District. Secretary Martin read the following report into the. record. Report and Recommendation of the Acting City Planner Neal J. Martin "An application for the resubdivision of property on the north side of So. Spruce Avenue, across from Starlite Street, has prompted the staff to recommend that the entire strip of land between Mayfair Village and So. Spruce Avenue be rezoned to a C-3 District. The.proposed resubdivison (PM--Ill) would divide an approximately 3-acre parcel into four lots and require the construction of a cul-de-sac street from So. Spruce Avenue to serve these lots. Presently, two different zoning districts divide the strip of land which parallels So. Spruce Avenue to the north between that street and Mayfair Village. The C-3 District is. located along Spruce Avenue, and the R-3 District is located approximately 100 I to the north between the C-3 District and the R-l District of Mayfair. Village. The General Plan designates the entire area between So. Spruce Avenue and Mayfair Village as light industrial. No mention is made in the General Plan of residen- tial, either multi-family or lower density, within this strip. Existing developments along So. Spruce have been primarily commercial in nature and generally extend back to the Mayfair residential area. Specific exampes are: A service station, a news printing servide and other commer- cial uses. The staff feels that development according to the existing zoningj"plan would produce an undesirable result. The proposed cul-de-sac (PM-Ill) is a typical example of the solution which is afforded a developer in utilizing this property. The lots fronting on So. Spruce Avenue would undoubtedly be developed with commercial or light industrial type uses. The lots on the rear would be required to be residential) and access to those residential lots would have to go through the commercial district. It would seem that this arrangement would have a deteriorating effect on the new apartment units which would be constructed to the rear of the cul-de-sac. From a planning standpoint it would seem that the lands between So. Spruce and Mayfair Village should be zoned for one type of use, either commercial or multi-family residential. In the staff's opinion the most appropriate designation would be that of commercial. The concerns of the residents in Mayfair Village however must be recog- nized since their properties abut this single family residential neighbor- hood. Some type of buffer, such as a heavily landscaped planting strip between the commercial area and the residences would seem appropriate. The staff therefore recommends that the entire strip of land between So. Spruce Avenue and Mayfair Village be rezoned. to C-3 District, and that the Planning Commission establish a policy which would provide for the creation of a landscaped strip a minimumiof 25' wide along the rear of the residences in Mayfair Village. The policy should also include a statement that parking should be provided along the rear portion of any developments on So. Spruce Avenue, and that parking should be located between the buildings on So. Spruce and the 25' landscaped strip near the residences of Mayfair Village. - 3201 _. RZ-26 Contd August 28" 1973 iiThe procedure which should be followed in accomplishing such a recommenda- tion would be the adoption of a Resolution of Intention to rezone this property to C-3 District by the Planning Commission, the hold of required public hearings, and finally a recommendation to the eity Council for the rezoning and for the adoption of the policy statements referred to above." Secretary Martin stated that a Resolution of Intention (Resolution No. 2130) was adopted by the Planning Commission at its regular meeting held August 14, 1973. Samuel Steinert, 116 Fir Avenue, SSF The persons listed above spoke against the rezoning and were concerned regard- ing the traffic and noise they felt would be created by future industrial use. At this time Councilman Terry Mirri spoke to clarify any possible misunder- standing by the residents of Mayfair Village. Considerable discussion ensued regarding the proposed rezoning. At the con- clusion of the discussion the Commissioners suggested that the matter be held over to the next meeting for further study. Vice Chairman Mathewson moved that the Planning Commission continue its con- sideration on RZ-26 to its regular meeting on September 11, 1973. The motion was seconded by Commissioner Hale and was carried by the following roll call vote: AYES: Vice Chairman Mathewson, Commissioners Hale; Lazzari, and Chairman Mullin NO ES : None ABSENT: Commissioners Raffaelli and Slade GOOD AND WELFARE The Planning Commission discussed the matter of RZ-25i and instructed the Secretary to arrange the public hearing to amend the General Plan on September 25, 1973. - 3202 - August 28, 1973 There being nothing further to be considered under Good and Welfare, and there being no further communications or other matters of interest for the Planning Commission, Chairman Mullin announced that the next meeting of the South San Francisco Planning Commission would be September 11, 1973 at 8:00!ip.m. in the Council Chambers of City Hall, San Francisco, California. at 9:20 p.m. Eugene/I}fullin, Chairman Plannirtg Commission City of South San Francisco Neal J.
