MINUTES OF PREVIOUS MEETING
Minutes of the Planning Commission meeting of September 23, 1975
Commissioner Mullin moved that the minutes of the regular meeting of the
South San Francisco Planning Commission of September 23, 1975, be approved.
The motion was seconded by Commissioner Teglia and was passed by the
following roll call vote:
AYES: Commissioners Mullin and Teglia
and Chairman Hale
NOES: None
ABSENT Commissioners Bertucelli and Mathewson
ABSTAINED: ~ice-Chairman Slade and Commissioner Goldberg
ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING
Chairman Hale announced that this meeting of the South San Francisco Planning
Commission would be recorded on tape, but that anyone who wished to come before
the Commission to be heard, but who objected to having his or her voice re-
corded in this manner, could request the Chairman to order the tape recorder
turned,\lIoffll for the duration of the time that he or she is speaking or is heard.

UP-75-319
UP-75-319, a request of Maureen Xavier to construct a 121 x 2~1 patio at
3678 Georgetown Court in the PC-SF Planned Community Single-Family District.
Secretary Hale presented the staff report.

Mrs. Xavier presented a petition to staff in support of the application.
Approximately 40 homeowners of the Westborough Greens signed the petition.
Mr. Xavier explained to the Commission that they had never been advised of
a Homeowners I Association nor of C.C. & Rls. He further noted that he had
called J. H. Snyder Company several times regarding various matters and
that he had been completely ignored. He added that he would like to help
organize a Homeowners' Association for West Park 3 and Deborah Carson,
president of the Homeowners I Association for West Park 1 and 2, offered
her assistance in organizing the associaijon.
Commissioner Teglia noted to Mr. Xavier that people have successfully sued
developers for not complying with their contracts.
Deborah Carson, president of the Homeowners' Association for West Park 1 and
2, noted to the Commission that there were a number of problems involved with
Homeowners I Associations and C.C. & R. IS. She noted that C.C. & R. IS for
West Park 3 differred from those of West Park 1 and 2, that West Park 3 had
no Homeowners' Association and that the Architectural Control Committee was
controlled by the developer instead of the Homeowners' Association. She
further noted that she would like staff to keep a listing of developers and
the C.C. & R.'s and inform applicants that they must comply wfu~h them.
Deborah Carson further stated that J. H. Snyder Company did not provide for
a homeowners I association and did not want a mandatory one. She noted that
the C.C. & R. 's might never have reached many homeowners.
Mr. Fenton addressed the Commission noting that he had trouble in getting
the C.C. & R.'s for his area. He further stated thtt J. H. Snyder Company
had never given them the restrictions. He presented Secretary Hale with the
original of the petition submitted by Mrs. Xavier. Mr. Fenton also expressed
his dismay over the condition of St. Augustine's Church during construction.
He noted that the dust from the construction on the site had caused a lot of
problems at the Church because it came in through the windows and coated
everything.

Commissioner Teglia asked staff if the City had copies of C.C. & R. 's for
this parcel. Secretary Hale said that the City Attorney possibly would
have a copy of them, but that the Planning Division did not. Commissioner
Teglia then asked if the City could help the homeowners out in SQme way.
Zoning Administrator Costanzo replied that the City Attorney has discouraged
staff from getting involved in matters dealing with C.C. & R. IS, but that
conferences could be held with the develiper to try to work out a solution
to this problem. He further noted that the County Recorderls Office had
C.C. & R. 's for all lots and that the homeowner could acquire a copy of them
by contacting that office.
Commissioner Mullin noted that he thought Mr. Hank Richman of J. H. Snyder
Company had promised to include C. C. & R. IS with every deed when this matter
had come before the Commission a year and one-half or two years ago. Com-
missioner Slade noted that he remembered the same thing. He also noted that
he had requested that when an applicant needed to comply with C.C. & R. IS
that a notice be made to the Homeowners I Association. Secretary Hale stated
that he would contact J. H. Snyder Company to try to help work out a solution
to the problem.
Chairman Hale requested to know if this was the area where a>hydral.nic.et1Jgineer
had chE;cked out drainage problems. Zoning Administrator Costanzo noted that
thishad?been done three blocks away.
The Commission requested to know if this applicat10n has to be sent to the
dev~loper's Architectural Control Committee. Zoning Administrator Costanzo
sai~ that it did and that if the Snyder Company rejected it, then it would
not be approved.
Commissioner Teglia moved that UP-75-319 be approved subject to the conditions
of the staff report, changing condition #4 to read: "That t~e;~;;applicant
shall obtain approval for the proposed structure from the property owners'
association's Architectural Control Committee or its alternate if no such
association presently exists." (See correction under M'inutes of Oct. 28, 19~5).
Vice-Chairman Slade seconded the motion and it was passed by the following
roll call vote:

Commissioner Hale requested to know if there was also a proposed deck. Mrs.
Guaraglia said yes. Mr. Costanzo noted that this is not a matter before the
Commission; that it is within the acceptable height, and it was already
approved. Mrs. Guarag\Ila noted tha t s he had submi tted the room add it ion plans
to the Architectural Control Committee and had received approval from the
J. H. Snyder Company.
Commissioner Mullin asked what effect this room addition would have on sun
to the neighbors. Zoning Administrator Costanzo noted that the adjoining
properties are 75 percent in shadow during the day and that there would
only be a slight increase in shadow on the property owner to the north.
Commissioner Mullin moved that UP-75-320 be approved subject to the conditions
of the staff report, changing condition #4 to read: "That the applicant

UP-75-321
UP-75-321, a request of California Water Service Company to construct a well
pump station on the north side of Colma Creek on Oak Avenue, between Mission
Road and Commercial Avenue.
Secretary Hale presented the staff report.

Mr. Abramo requested to know which street would be used as an access road as
there was a lot of mud and dirt all the time from the farmers using Daly Court.
He wanted to know if City Hall could put up a barrier or wall at the end of
Daly Court to prevent it from being used as an access street.
Barney Tumey of California Water Service stated that ingress and egress off
of Daly Court could be worked out and that they would be using .oak Avenue as
an access street.
Vice-Chairman Slade requested to know if Daly Court could possibly be blocked
off. Mr. Tumey stated that this might not be possible since it was one of
the access streets to this lot.

Director of Public Services Addiego suggested that Mr. Abramo direct a
letter to the City Manager expressing his complaints with respect to the
access problems and to the dust problems.
Commissioner Teglia moved that UP-75-321 be approved subject to the con-
ditions of the staff report. Commissioner Mullin seconded the motion
and it was passed unanimously.
RZ-32
RZ-32, a request and petition of Alfred Callegari to rezone two parcels,
located at 835 and 843 Olive Avenue, from "R_211 to IIR-3."
Secretary Hale presented the staff report and read into the record a letter
from Paul Tognetti objecting to this application for rezoning.

Mr. Callegari request~d to know how long it would take to make a report
and decision on the R~h'3 standards. Secretary Hale stated that it would
take until the end of November or early December. Then Mr. Callegari
asked if he would be guaranteed approval if he deferred this matter. The
Commission told him that no assurances could be made.
Ms. C. Oman expressed her concern that she would have to pay taxes on an
R-3 Zone. She wondered if these two parcels were rezoned to R-3, would the
rest of the block be zoned R-3 also. Chairman Hale stated that the present
actA/on was only on the two parcels owned by Mr. Callegari. Secretary Hale
stated that the rezoning to R-3 would probably not have any effect on the
value of the surrounding properties because they could not build under an
R-3 zone, especially not for the property of Ms. Oman because of the small
size of her lot. He further noted that the County Assessor's office would
be advised of the rezoning should it be approved and that it would only
affect those two properties.
Mr. Walter Morrow requested to know why this matter should be deferred at all.
Chairman Hale explained that the R-3 standards presently existing were inade-
quate. Mr. t~orrow noted to the Commission that he felt a lot of time should
be spent in looking at the proposal of Mr. Callegari for rezoning these parcels
Secretary Hale stated to the Commission that they could take up to 50 days in
deferring action even without the consent of the applicant.
Commissioner Mullin asked Mr. Callegari if he would be willing to defer action
until staff could come up with better standards. Mr. Callegari noted that he
would be willing to defer this matter for one month.

Commissioner Teglia moved that RZ-32 be deferred until the regular Planning
Commission meeting of November 25, 1975. Commtssioner Mullin seconded the
motion and it was passed unanimously.
RZ-33
RESOLUTION NO. 2177
RZ-33, a request and petition from Robert F. Lawrence to rezone two parcels
located at 527 and 531 Myrtle Avenue, from lIR_lll to lIR_2.1I
Secretary Hale presented the staff report.
Proponent: Mr. John Penna, agent representing Mr. Lawrence

Opponent: None
Mr. Penna noted to the Commission that this rezoning to R-2 would serve as
a buffer zone to the area.
Commissioner Goldberg asked if the Rain Tree already acted as a buffer zone
for this area. Mr. Costanzo noted that there was parking and landscaping
at this area.
Zoning Administrator Costanzo further noted that there is a buffer at Mayfai
north of Myrtle, and that the Planning Commission could impecse those same
requirements when the adjoining property develops.
After this discussion, Commissioner Mullin moved that RZ-33 be denied. Vice-
Chairman Slade seconded the motion and it was passed unanimously.
Vice-Chairman Slade then runtroduced the resolution recommending to the City
Council that RZ-33 be denied. This resolution was adopted by a unanimous
vote.
REPORTS
R-3 DEVELOPMENT STANDARDS
Staff report recommending that the Planning Commission initiate amendments
to the Cityls Zoning Ordinance to upgrade R-3 Development Standards.
Secretary Hale presented the staff report. Assistant Planner Mark Duino
presented conceptual drawings of possible developments on various sized
lots.
These conceptual drawings utilized the proposed new development standards.
On each of the conceptual drawings Mr. Duino demonstrated the use of more
open space, yet retaining the density and in some cases, increasing the

density, and as well providing for the number of parking spaces required
by Ordinance.
Some discussion ensued regarding added costs to tenants to cover the extra
costs involved in providing parking and open space areas, i.e. balconies.
Mr. Maurice Brosnan, developer, noted that, with good planning, costs could
be kept to a minimal and that tenants would not necessarily have to pay
much more for rent. Mr. Duino added that there was a lot of flexibility
in designs for parking construction and the development as a whole.
The Commission directed staff to prepare a more detailed report for the next
meeting on what costs would be involved in these types of developments and
how these added costs would affect the tenants.
COMMUNICATIONS
Commissioner Teglia requested staff to try to get some supplies for the Com-
mission, i.e. opaque projector, chalk, erasers, etcetera.
Secretary Hale presented a staff report on the Recreational Vehicle Committee
meeting held on September 29, 1975, stating that it was the consensus of the
Committee that 1) no amendments be made in the City's Zoning Ordinance at
this time and 2) that the staff from the Police Department and Planning would
work with the Committee to determine areas where the present Ordinance 229
regulating Recreation Vehicles could be amended to make those regulations
more reasonable and acceptable. It was felt that these vehicles should be
treated as regular vehicles, limiting parking time on the street to 72 hours,
and handling violations on a complaint basis.
There being nothing to be considered under Good and Welfare and no further com-
munications or other matters of interest fort~tnte<Commission, Chairman Hale
announced that the next regular meeting of the Planning Commission would be
held on October 28, 1975, at 8:00 p.m. at West Orange Library Auditorium.
The meeting was adjourned at 11:25 p.m.
