Vice-Chairman Teglia noted that on page 3723, under PM-77-l40, her vote was "no." She further indicated that on page 3727, under "Communications", the Commissiion was concerned with the home occupation of the doctor1s office reverting back to R-l when the use ceased. Secretary Costanzo said this was correct, but that the Commission had directed staff to see if this use could be legally moved to a more suitable location. Commissi Mathewson moved that the minutes of the regular meeting of the South San Francisco Planning Commission of March 22, 1977, be approved with the above corrections. The motion was seconded by Commissioner Bertucel'i and was passed by the following roll call vote: AYES: Vice-Chairman Teglia, Commissioners Bertucelli, Campredon, Goldberg, Mathewson, Mullin and Chairman Slade NOES: None ABSn-Alf\lED: None Y'.-.iAifNiNOUNCEMENT CONCERN I NG TAPE RECORD I NG 0 F MEETI NG Chairman Slade announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission to be heard, but who objected to having his or her voice re~ corded in this manner, could request the Chairman to order the tape recorder turned lIoff" for the duration of the time that she or he is speaking or is heard. - 3730 - April 12, 1977 UP-76-368 LMODIFIEDl A request for a modification to UP-76-368 by Stonegate Ridge Properties and E. G. Coopman to construct 47 townhouse units on property located on the north side of Stonegate Drive, 900 feet southwest of Hillside Boulevard in the P-C Planned Community Zone District. Secretary Costanzo presented the staff report, noting that an error in calculating the parking had been made, which is the reason for this use permit modification. Proponent: Mr. Frank Aitken Engi.~..meer Opponent: Ms. Doris R. Agee 819 Ridge Court South San Francisco, CA Mr. Aitken noted to the Commission that the error in parking calculations was his fault. He said there was a misinterpretation of Type 1 's, which resulted in the error. He noted that the new parking configurations are in conformity with the Stonegate Ridge Master Plan. Further, he explained the location of the access road in relationship to the tot lot. Doris Agee expressed opposition to the parking proposed for the development. She noted that she lives in Unit 2 and there is a major parking problem with that area, to tIDe point where sometimes it is difficult to get out of the car- ports because cars are blocking it. She felt that the number of proposed parking spaces was inadequate for the number of units being built. Commi ssff~o)ner Mathewson reques ted to know if there was enough floor space for covered parking as originally planned. Secretary Costanzo indicated that there is not enough building area nor room to expand. He further indicated that if the expansion of the units had been less significant, we would have allowed a few inches expansion. Commissioner Mathewson requested to know if the parking problems would be occurring in future developments. Secretary Costanzo indicated that there would be a continuing problem with parking and he can see no way to reverse it. Commissioner Mathewson wanted to know if the shrinkage of units had something to do with the parking problem. Secretary Costanzo noted that the units have not changed, that there was merely an error in computation. Mr. Aitken indicated that the Type 1 buildings are the same Type 1 buildings used in other plans. Commissioner Mullin asked about the on-street parking situation. Secretary Costanzo said there will be a flow onto the street and there is good on-street parking. Mrs. Agee noted that according to the C.C.& R. 's, there can be no on-street parking. Commissioner Mullin asked if on-street parking is precluded by the closeness of the curb cuts. Secretary Costanzo indicated there should be room to park on Stonegate Drive because it is a 401 paved street. Commissioner Mullin asked if the curb is red lined. Commissioner Campredon asked if this proposed use was within 200 feet of residentially zoned property. Secretary Costanzo said that there was resi- dential property directly to the rear. Commissioner Campredon asked if Special Condition #4 meant that the applicant could not sell the business without coming before the Planning Commission. Secretary Costanzo said that this was correct. He indicated that it is in- tended that this use be a restaurant with the support use of the on-sale liquor and that it is the sole intent to prevent this from becoming a beer bar or tavern as the principal use. He noted that this would become a condition of the liquor license. Commissioner Goldberg asked if the condition relating to the hours of opera- tion would also become a condition of the liquor license. Secretary Costanzo said that it would not and would only be a condition of the use permit, which, if violated, would make the use permit null and void. Commissioner Bertucelli moved that UP-77-380 be approved subject to all of the conditions of the staff report, with the above noted change in Special Condi- tion #3. Commissioner Mathewson seconded the motion and it was passed unanimously. UP-77-381 An application by Li-Kuo Wang and Michael T. Change to establish a Martial Arts instruction school located at 215 Miller Avenue in the C-2 Zone District. Secretary Costanzo presented the staff report, indicating to the Commission that the hours of operation would be limited from 8:00 a.m. to 10:00 p.m. Proponent: Robert Willingham, representative of applicant 2239 44th Avenue San Francisco, CA Opponent: None Mr. Willingham indicated to the Commission that this would be a school dedicated to the learning of the Martial Arts, not as a fighting tool, but as a beneficial media for better health. Vice-Chairman Teglia asked if there would be demonstrations or public compe- titions. Mr. Willingham indicated there would be none. He said there would be a demonstration to start with which is done in very~ow, almost dance-like steps. He also indicated, in response to Vice-Chairman Teglia, that there would not be any large groups of people coming to view this demonstration. - 1711 - UP-76-368 (Modified), cont'd Apri 1 12, 1977 believe that it is. Secretary Costanzo said that the C.C.& R. IS would not have force and effect in the public right-of-way. Commissioner Mullin asked why there cannot be on-street parking. A member of the audience stated that Stonegate is a very steep street and it is a long walk to the units, which is a deterrent to on-street parking. Commissdgner Mathewson expressed his concern with traffic congestion. He indicated that it looks great on paper, but that it is not necessarily great in practice. He also indicated that it might be a badly congested area. Commissioner Campredon requested to know how long the right-of-way is. Secre- tary Costanzo noted that it is about 1,000 feet. Commissioner Goldberg asked how much more developing is yet to be done. Secretary Costanzo said lA is complete, 3 and 8 have been approved. He indicated that 4, 5 & 6 are remaining with a possible reduction in units. He noted that 7 has been deleted. He further indicated that the only town- house developments are four and five. Commissioner Goldberg asked what percentage of the total project has been developed. Secretary Costanzo said that 30 percent is complete, with 70 percent left to do, however, that 50 percent has been approved. Commissioner Goldberg noted that the parking problem is an existing condition which cauld get worse and noted tfta:ft we may end up with a great huge parking lot. Secretary Costanzo said he is not totally willing to accept that two parking spaces are not sufficient. He further indicated that in the past where additional parking was obtained for a development, the City had to give up something, usually a reduction in landscaping. He felt that the parking for the proposed units is sifficient and did not know how additional parking could be mandated. Commissioner Goldberg said tmat this particular development is legal, but that two and three bedroom units do not just have two cars, but sometimes three or four cars. Secretary Costanzo indicated that the Stonegate Ridge Specific Plan would have to be amended to change the parking. Commissioner Goldberg asked what provisions are there for enforcement of the C.C.& R. IS for no parking. Secretary Costanzo said the area has to be posted "No Parking" at which time vehicles parking there can be towed. He noted that he is not aware of such a posting on the property, but he understands this is being initiated and that the homeowners would have to police the site themselves. CommW.ssioner Mullin moved that UP-76-368 (Modified) be approved subject to all of the conditions of the staff report. Commissioner Goldberg seconded the motion and it was passed unanimously. UP-77-380 An application of Kathryn Fay Wimsatt for the establishment of an on-sale establishment where liquor is served in a proposed and existing restaurant at 203 and 207 Linden Avenue in the C-2 Central Commercial Zone District. Secretary Costanzo presented the staff report, noting the replacement of the word "obstructed" in Special Condition #3 with the word "painted." - 3732 - UP-77-38l, contid Apri 1 12, 1977 Secretary Costanzo asked wmat the class schedules would be. Mr. Willingham said they would have three classes a day--morning, afternoon and evening. Secretary Costanzo then asked what the class load would be. Mr. Willingham said since there are no martial arts schools in the entire area, he could not be sure of the response. He did indicate that the evening class would probably be the most crowded, with probably not more than 13 students per class, Vice-Chairman Teglia asked if only adults would be interested in this art. Mr. Willingham said that very likely children would be participating. Vice-Chairman Teglia asked what the occupancy load is of the building. Secretary Costanzo said that the Fire Department and Building Division would establish the maximum occupancy load. Chief Building Inspector Ghilardi indicated that the maximum occupancy load is about 63-67 which will be posted in the building. Secretary Costanzo said, taking this into consideration, that Special Condition #7 should be added, limiting the size of the daytime classes to read as follows: "That the maximum number of students to be instructed during the hours of 8:00 am and 5:00 pm within the building area shall not exceed 30." Mr. Willingham noted they would only want a maximum of 30 students in one class. Commissioner Goldberg asked how long each session lasted. Mr. Willingham said one to one and one-half hours. Commissioner Campredon moved that UP-77-38l be approved subject to all of the conditions of the staff report, with the addition of Special Condition #7. Vice-Chairman Teglia seconded the motion and it was passed unanimously. UP-77-382 An appliication of Louis Poletti for the construction of an office building on the west side of Mission Road at the terminus of Sequoia Avenue in the "U" Unclassified Zone District. Secretary Costanzo presented the staff report and asked that this matter be continued to the Planning Commission meeting of May 10, 1977, to allow staff and the applicant sufficient time to work out some of the existing problems. Mr. Poletti was in agreement with the continuation. Commissioner Mathewson moved that this matter be continued to the meeting of May 10, 1977. Vice-Chairman Teglia seconded the motion and it was passed unanimously by a voice vote. UP-77-384 An application of Lyon Oil Company to establish an auto repair facility and related signing for an existing service station at 900 Linden Avenue in the C-3 Heavy Commercial Zone District. - 3734 - UP-77-384, cont'd Apri 1 12, 1977 Secretary Costanzo presented the staff report~ and added Special.Condition #7 to read: "That any signs, banners, pennants, or other advertj!sing signs shall be prohibited." Proponent: Mr. Donald Anderson, Mgr. 702 Foerster San Francisco, CA Mr. Tom Nelson Mr. Anderson's partner Opponent: None Mr. Anderson informed the Commission that Jack Donley, representing Lyo~ Oil Company, had informed him before the meting that they wished to withdraw their portion of the Use Permit application. He indicated that for his sign, he would like to have it enlarged to 35' x 3', as the 20 feet was too small. Chairman Slade noted that he sees real problems with the conditions and the applicant's legal ability ~o meet them. He suggested that maybe more time was needed to work something out with Lyon Oil Company as the owner of the property. Commissioner Mathewson asked if there had been a formal notification of with- drawal filed by Lyon Oil Company. Secretary Costanzo said there had not been one and that this verbal withdrawal is not in compliance with the necessary procedures for withdrawal. Mr. Nelson indicated that he did not think this permit should be approved at this meeting with the conditions as proposed. Commissioner Mullin asked if there would be a problem since he is in operation. Secretary Costanzo said they are not operating legally. Commissioner Mullin noted that there should be some form of control over businesses operating without the necessary business license and in some cases, a use permit. Mr. Anderson indicated that when they came in to apply for their business license, they discovered that they had to go through the use permit process. Commissioner Mullin noted that the business license should be applied for before they begin operations and then all the necessary procedures would be finished before the actual business operation began. Secretary Costanzo requested a continuance of this matter for at least two weeks to allow stafffi.time to meet with the Lyon Oil Company to work out the prob 1 ems. The Commission unanimously agreed to continue this matter to the Planning Commission meeting of April 26, 1977. - 3735 - April 12, 1977 Chairman Slade left at 9:15 and was absent for the remainder of the meeting. UP-77-385 An application of World Engineering and Construction Company to construct a cash booth and related signing for an existing service station at the inter- section of El Camino and South Spruce in the PCM Planned Community Zone. Secretary Costanzo presented the staff report and read into the record the special conditions. He indicated that Conditions 5 and 6 would depend upon the applicant securing the necessary permission from J. C. Penney Company. Proponent: Paul Hamby 8900 N. Central Phoenix:t Arizona Opponents: None Mr. Hamby noted that Special Condition #6 would make the driveway oneRway instead of two-way which he felt would slow down traffic in that area, but that they would comply if the Planning Commission requested it. He further noted that the dimensions of the sign in Special Condition #4 would create problems for him because it is so small. Secretary Costanzo indicated that he would have no objections to making this monument sign larger by two feet. He felt it would not obstruct vision at the corner of El Camino and Spruce because it will be set back 10. or so from the corner. Secretary Costanzo requested changing Special Condition #1 to "not to exceed 27 square feet." Commissioner Mullin requested to know who owned the buildings. Secretary Costanzo indicated that Big Eye owned all of the property. He stated that they gave a master lease to J. C. Penney Company and that part of the master lease area is under a separate lease by Digas. He noted that this operation must be archi~ecturally similar to the Treasury, because it is a support fa c i 1 i ty . Mr. Hamby indicated there is a law suit pending which deals with three pump islands and the office complex and surrounding area. He said they cannot touch the TBA store, but that they have a small office in the TBA building. He noted that Digas is only trying to upgrade the canopy. Commissioner Mathewson requested to know what happens with the TBA building if this application is only for a self-service gas station. Secretary Costanzo noted that the Treasury has been occupying this building for 2 years. Commissioner Goldberg stated that there is a big trash bin in the middle of the driveway and asked who owns it. Mr. Hamby noted that the Treasury owns it. Secretary Costanzo indicated that he would enforce the removal of this trash bin. - 3736 - UP-77-385, cont'd April 12, 1977 Commissioner Goldberg requested to know how far back from the right-oTI0way would the proposed sign be located. Secretary Costanzo recommended the aforementioned change in Special Condition #1 for the sign not to exceed 27 square feet. He further stated that the setback would be established by the City Engineer's office and that if a safe setback cannot be acquired. then another elevation would be determined for the sign that would be safe. Acting Chairman Teglia stated, regarding Special Condition #6, that she would like the City Engineer to comment on whether the six foot high screen wall would create a traffic problem. City Engineer Yee stated that he did not see any problem. Acting Chairman Teglia noted that she sees Standard Condition #12 all the time and wondered whose responsibility it was to enforce the maintenance on the landscaping. Secretary Costanzo indicated that it is part of the planning function and that he would put the Treasury on notice. Commissioner Mathewson moved that UP-77-385 be approved subject to all of the conditions of the staff report with the change in Special Condition #1 and #4. Commissioner Goldberg seconded the motion and it was passed unanimously. UP-77-386 An application by Douglas Gymnastics for the establishment of a gymnastics school and related retail facilities at 1387 San Mateo Avenue in the M-l-H Light Industrial Zone District. Secretary Costanzo presented the staff report and read into the record the special conditions. Proponent: Douglas Dawkins 3819 Elston Drive San Bruno, CA Opponents: None Commissioner Mullin asked if he were already in business. Mr. Dawkins said that he was. Commissioner Mullin noted that this was the second after-the- fact use permit application. Secretary Costanzo stated that some people apply for the business license after establishing their business. He noted that stopping the use would create a financial burden for the applicant once he is already in business, even though it is illegal. Commissioner Mullin asked how many people would be in the facility at one time, since there were only 13 parking stalls. Mr. Dawkins said most of the time the parents drop their children off and come back later to pick them up. He felt that 13 parking stalls would be sufficient. Commissioner Mathewson asked what the lease adjacent to this one would be. Secretary Costanzo indicated warehousing or manufacturing. - 3737 - UP-77-386, cont1d Apri 1 12, 1977 Commissioner Mathewson asked what the hours of operation would be. Mr. Dawkins stated 5:30 to 8:30 p.m., even thpugh the building would be open at 3:30. Commissioner Mathewson asked w t type of gymnastics would be taught. Mr. Dawkins said they would teac t~e six main olympic events for boys and four for girls. Acting Chairman Teglia asked what the class size would be and if they would be having competitions on the site. Mr. Dawkins said there would be 10 per class with three instructors per hour. He indicated there would be one meet per year of about 150 people which would be held probably on the weekend. It was generally noted that the hours of operation coincide with the times that most of this area is unoccupied. Commissioner Bertucelli moved that UP-77-386 be approved subject to all of the conditions of the staff report. Commissioner Campredon seconded the motion and it was passed unanimously. UP-77-387 An application of Donald Seyranian for construction of an ll-unit apartment building on El Camino Real, approximately 300 feet northwest of the corner of Arroyo Drive in the C-l Neighborhood Commercial Zone District. Secretary Costanzo presented the staff report and noted the conditions from the office of the City Engineer. He stated that the Commission needed to review and consider the environmental impact determination and include this as part of their motion. Proponent: Donald Seyranian 6701 Mi ss'~b~\fu~ Street Da ly Ci ty, CA Opponents: Mr. & Mrs. Valine 130 Alta Loma South San Francisco, CA Florence Berg 128 Alta Loma Drive South San Francisco, CA Donald Horgan 126 Alta Loma Drive South San Francisco, CA Mrs. Berg noted her opposition to the proposed development. She said there is a terrific parking problem existing in the area, partially due to SamTrans. She indicated that cars come from various sections of the City and park in the area to catch the BART bus. She noted that SamTrans has side-swiped several cars in the area as there are so many cars, the buses find it difficult to get through. She noted that even the fire trucks have to cpme out very slowly because people make "U" turns at El Camino Real. - 3738 - UP-77-387, cont'~ Apri 1 12, 1977 Ms. Valine indicated her opposition to the proposed development and asked what was meant by uless intense than a commercial use." Secretary Costanzo noted tm~t the amount of traffic generated by a commercial use would be well over the amount of traffic generated by an apartment building. Ms. Valine asked if there would be any changes in the zoning. Secretary Costanzo said there would not as it is a permitted use with a use permit application in this zone district. Mrs. Berg asked what would be done about the fact that their yards are higher than the applicant's land. Secretary Costanzo indicated the landscaping,j~~ lighting, retaining walls, if necessary, and a six foot high wall must be provided between this property and all adjacent residential properties. Mr. Morgan noted his opposition to the proposed apartment building. He also indicated that a retaining wall would help, but that there would still be a parking problem. Commissioner Mathewson noted that a special condition be added that no motels will ever be considered by any Planning Commission in the future. Secretary Costanzo suggested that Special Condition #1 be added to read: "That the proposed structure shall not be used for hotel or motel operations and that rental of the units shall be on at least a month to month basis." Commissioner Mullin stated that this is probably the best use for that area, rather than a commercial use. He stated that SamTrans creates a problem at Alta Loma and Arroyo which is a terrible hazard. Secretary Costanzo said the City had established the bus pass system and that we would contact SamTrans regarding this pass to see if their policy has changed. Mr. Valine indicated that the bus passes are no longer required by SamTrans. Acting Chairman Teglia asked if Mr. Valine had changed his opinion at all from the testimony presented this evening. He said he still could not see the difference between a residential or commercial use because there will still be a traffic problem. City Engineer Yee stated that a solution would be to issue parking permits similar to other areas, but there would be no control over visitors. He also indicated that "Limited Parking" could be posted, but he does not feel that would solve the problem. Commissioner Goldberg asked how wide is the strip of land between the frontage road. City Engineer Yee said it belong to the highway department. Commissioner Goldberg indicated the.@':possibility of using this strip of land for paved parking area. Secretary Costanzo noted that Cal Trans intends to widen El Camino between Arroyo and Hickey. Secretary Costanzo added Special Condition #2 to read as follows: "That garage doors shall be equipped with automatic garage door openers. II - 3739 - UP-77-387, cont'd Apri 1 12, 1977 Mr. Seyranian stated that he understands and accepts all of the conditions 0f the staff report. Secretary Costanzo indicated that there is a 30 day statutory limit on the Negative Declaration, but that the Use Permit itself only has a 10 day appeal period. Commissioner Mathewson moved that Negative Declaration #102 had been re- viewed and considered and that UP-77-387 be approved subject to all of the conditions of the staff report, with the addition of Special Conditions #1 and #2 as stated above. Commissioner Campredon seconded the motion and it was passed unanimously. WP-77-388 An application of Foster & Kleisenj,.,for a Use Permit to relocate two off-site advertising structures located east of and adjacent to the Bayshore Highway, approximately 2600 feet north of Oyster Point Boulevard in the M-2-H Heavy Industrial Zone District. Secretary Costanzo presented the staff report. Proponent: Walt Moreno, Foster & Kleiser 1601 Maritime Street Oakland, CA Opponent: None Mr. Moreno said this is a hardship case and that they are only tr8'ltng tOnlov,e two structures further away from the freeway. He stated that billboards exist to move goods and services and t~at they are not dangerous and that they would never put anything immoral on the billboard. Commissioner Bertucelli asked what the hold up was on the mini-warehouses. Secretary Costanzo indicated that when it was brought to the Planning Commis- sion, the applicant had said that a certain piece of property existed, but staff discovered that it was one continuous piece of property going all the way into Daly City. He said that before a building permit could be issued, a parcel map must be done and that the appl icant.'mE;reds a vari ance for the nonconforming frontage and a use permit for the live-in residential caretaker unit. Commissioner Mullin asked how many billboards Foster & Kleiser had in South San Francisco. Mr. Moremo said he does not know, but that there are not many since they have not built in South San Francisco for seven years. Commissioner Mullin asked if being in compliance with the Federal Beautifica- tion Act meant the signs come within a certain number of feet from the highway. Mr. Moreno stated that this was correct. - 3740 - UP-77-388, cont'd Apri 1 12, 1977 Commissioner Mullin indicated that this was an example of long range planning. He noted that the signs may not be detrimental at the present time, but that they may have a detrimental effect in the future with the build up of similar signs. He indicated that billboards do not really fit in with the overall plans for South San Francisco. He asked if the billboards could be left where they are. Secretary Costanzo stated that this is preferable. He noted that the new billboards were huge and very expensive to construct and possibly would take 50 years to amortize them out. He stated that the exist- ing billboards have already used up some of their life and would be less expensive to remove. Commissioner Mathewson said the Bowl Area was discussed as having to look at the signs. Secretary Costanzo said this was correct in that the area is proposed for high density apartment. Acting Chairman Teglia asked if the applicant could build around the exist- ing signs. Secretary Costanzo said it is a condition of the Development Permit that the signs be removed or moved. Mr. Moreno stated that they do not plan to take the matter to court in order to get the signs to stay up sometime in the future. He indicated that he would like two signs to be permitted with a possible review sometime in the future as development occurs. Secretary Costanzo stated that if this is the direction taken, he would request a cash deposit be provided and an escalation clause for inflation provided, as well as obtaining the permits necessary to enter upon the property at that time. He noted that Foster & Kleiser could still file a restraining order to prevent them from doing this. Acting Chairman Teglia asked how much would each sign structure cost. Mr. Moreno said it would not cost $50,000 apiece, but that he cannot give an actual amount. There was some discussion on the fact that Foster & Kleiser had taken the City of San Diego to court in order to be allowed to keep their billboards up. Mr. Moreno stated that San Diego had to put a totally prohibiting sign ordinance on outdoor advertising. Commissioner Campredon stated that he has seen Foster & Kleiser signs around South San Francisco. Mr. Moreno said they do a lot of public service type messages. Secretary Costanzo suggested continuing this matter to run concurrently with the parcel map, variance and use permit. Mr. Moreno agreed. Secretary Costanzo presented the staff report and read into the record the special conditions. Commissioner Campredon moved that V-77-195 be approved subject to all of the conditions of the staff report. Commissioner Bertucelli seconded the motion and it was passed unanimously. V-177-196 An application of Michael J. Scardino for a reduction of the rear yard setback from 201 to 51 on property located at 144 LaCrosse Avenue in the R-l Single Family Residential Zone District. Secretary Costanzo presented the staff report and read into the record the special conditions. Proponent: Mr. Michael Scardino 114 LaCrosse Avenue South San francisco, CA Opponent: None Commissioner Mathewson asked what is the density next to the property. Secretary Costanzo noted that it is single family residential. Commissioner Mullin stated that there is a fence separating this property from the one on the east which borders along the garage and might create a potential hazard in sight problems when backing out of the garage. Secretary Costanzo said this is separate from the variance request and it is an illegal fence. Secretary Costanzo noted that it cannot relate to the variance request in this case. Commissioner Mullin asked that staff find out what can be done to have the fence removed. There was some discussion on the new addition being treated architecturally like the existing house. Secretary Costanzo noted that this would entail the use of eaves which cannot encroach into the setback. He further noted that this could possibly mean a small reduction in the size of the room itself to allow the construction of theffives and prevent their encroachment into the setback. Mr. Scardino stated that he understands there might be a reduction in the actual size of the room. - 3742 - V-177-196, cont'd April 12, 1977 Commissioner Bertucelli asked why, with a three-bedroom home, he would want such a large room. Mr. Scardino explained that it will be used as a family room and they want it as large as possible. Commissioner Mullin moved that V-77-196 be approved subject to all of the conditions of the staff report. Commissioner Mathewson seconded the motion and it was approved unanimously. PM-77-141 An application for a Tentative Parcel Map by Cabot, Cabot & Forbes to sub- divide three parcels into four on property located between Grandview Drive and East Grand Avenue in the M-2-H Heavy Industrial Zone District. Secretary Constanzo presented the staff report. Proponent: Mr. Don Bruzzone, representing Cabot, Cabot & Forbes 1 Maritime Plaza San Francisco, CA Opponent: None Mr. Bruzzone explained that a third party, Southern Pacific Railroad, is involved which is creating problems with the lot line adjustments. Mr. Buzz Haskins explained to the Commission that he will be coming before the Commission shortly for their approval of a subdivision in this area which would address the problems of East Grand Avenue. Commissioner Mullin moved that PM-77-141 be approved subject to all of the conditions of the staff report and that the Commission has reviewed and considered Negative Declaration #104 relating to this permit. Secretary Costanzo presented the staff report, noting the Commission should include in their motion that they have reviewed and considered the Negative Declaration. RZ-77-38 An application by Rotary Plaza to rezone the property at 433 Blondin Way from "U" Unclassified to R-3 Multiple Family Residential. Secretary Costanzo presented the staff report. The applicant was not present at the meeting and Secretary Costanzo indicated the Commission policy and that this matter should be continued until the applicant was present to be consistant with previouos Commission actions. The Commission unanimously agreed to continue RZ-77-38 to the Planning Commission meeting of May 10, 1977. ZA-77-4 & ZA-77-5 Secretary Costanzo requested that these two matters be continued to the Planning Commission meeting of April 26, 1977, due to the lateness of the hour. The Commission unanimously agreed. - 3744 - Apri 1 12, 1977 COMMUNICATIONS The Commission requested to know what the deadline is on receiving comments on the Capital Improvements Budget. City Engineer Yee stated there is none. Secretary Costanzo indicated that the Commission should have received a copy of the codified Zoning Ordinance, the Procedures for the Planning Office and the CEQA Guidelines and Procedures which he felt would help the Commission to better understand the operations of the office and that the lIUlI Zone Classification would be coming to the Commission asa change at the next meeting. GOOD AND WELFARE Commissioner Mathewson requested staff to do a study of the P-C area parking element, regarding Stonegate Ridge. Secretary Costanzo said the parking problem can be looked at district-wise, but not as far as the Specific Plan is concerned. He indicated that text changes can be made via the City Council which means the Stonegate Ridge Specific Plan has to be changed through the City Council. He explained that staff does not have the time necessary to go into changing the Stonegate Ridge Specific Plan. He stated this could be done by requesting the developer to initiate the changes. He stated that aside from Ridge Court which is a problem, there are few problems with parking on the street. Commissioner Mullin asked if Victor Brincat1s son was still at 619 Airport Boulevard. Secretary Costanzo said he would give the Commission an updated report on this. He said Metropolitan Furniture Company sold to Mr. Brincat. Acting Chairman Teglia confirmed that there would be a joint Architectural Committee and Planning Commission meeting on April 26, 1977. Secretary Costanzo mentioned to the Commission that the Healy-Tibbitts site is optioned and that the name of the purchaser is Gemini Development Company. Mr. Bill Breite, 3836 Palos Verdes addressed the Commission stating that he understands that a use permit has to be submitted when there are exterior changes to the houses, and indicated that he wishes to put siding onto his house. He stated that the present exterior is texcote which is peeling, cracking and falling off. He indicated that Texcote guarantees the finish but does not guarantee the surface it goes on. He stated that the problem is with the underneath surface which is plywood. He stated it was not treated properly which is causing the texcote to peel. He requested to know why he must obtain a use permit. Secretary Costanzo stated that it is a minor change to the exterior appearance which requires a use permit. He also stated that there have been a number of requests to go to some kind of siding. He noted that there is a lack of maintenance on the existing exterior of the buildings - 3745 - GOOD AND WELFARE, cont'd April 12, 1977 in the Westborough area because the property owner gets discouraged. He suggested that the Architectural Committee might develop guidelines for such changes, including colors and materials, and bring these guidelines to the Commission and see if an agreement between the two bodies could be reached so the Westborough homeowners can have the guidelines to refer to. He noted that if the guidelines were approved by the Commission, then such changes could be handled at the Architectural Committee level. Acting Chairman Teglia asked if there could be a mass mailing to Westborough resi- dents informing them of upcoming possible changes. Secretary Costanzo indicated that this would be very costly in that there are over 3000 units in this area and at 13~ per unit, it would mean budgeting $400 for postage, plus printing and other costs. It was suggested that notice might be made through the water bills. Secretary Costanzo indicated that there should be guidelines prepared and available when people come in with requests. There being nothing further to be considered under Good and Welfare and no other communications or matters of interest for the Commission, Acting Chairm9n Teglia announced that the next regular meeting would be held on Apr. 20, 1977, at 7:30 p.m., in the West Orange Library Auditorium.
