MINUTES OF PREVIOUS MEETING
Minutes of the Planning Commission meeting of July 27, 1976.
Commissioner Teglia noted that she thought a definite date had been set for
staff to return to the Commission on ZA-76-2. Secretary Costanzo noted that
August 24 had been mentioned, but that staff noted it would depend upon
their workload.
Commissioner Hale moved that the minutes of the regular meeting of the South
San Francisco Planning Commission of July 27, 1976, be approved. The motion
was seconded by Vice-Chairman Teglia and was passed by the following roll call
vote:

ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING
Chairman Slade announced that this meeting of the South San Francisco
Planning Commission would be recorded on tape, but that anyone who wished
to come before the Commission to be heard, but who objected to having his
or her voice recorded in this manner, could request the Chairman~o order

UP-76-343
UP-76-343, a request of Vincent DeAngelis for a Use Permit to allow the
sale of beer and wine in conjunction with an existing delicatessen in
the C-3 Heavy Commercial Zone District at 733 Airport Boulevard.

Secretary Costanzo presented the staff report and read into the record
the Special Conditions, noting two changes to these conditions as follows:
Condition #2 was changed to read: IIThat the hours of operation
shall be limited to the hours of 9:00 a.m. to 10:00 p.m. daily.1I
Condition #5 was changed to read: 1I...in conjunction with the
existing sandwich shop and dinner house only...1I

There was some discussion on the conditions from the Police Department.
They had stated that the hours of operation be from 9:00 am to 6:00 pm
daily and that there be no live music. Secretary Costanzo explained
that he had talked to Officer Ziemer who agreed to the hours of operation
being 9:00 am to 10:00 pm daily with the addition of the dinner house.
However,~e€Fid note that the condition relating to live music stands as
stated.
Commissioner Goldberg moved that UP-76-343 be approved subj the con-
ditions of the staff report, with the aforementioned changes. Commissioner
Mathewson seconded the motion and it was passed unanimously.
UP-76-346

Secretary Costanzo presented the staff report and read into the record
the Special Conditions.

Commissioner Goldberg questioned the deletion of the permanent wall between
the two structures. Mr. Gaspari explained that he is before the Commission
because he does not want to connect the new building with the exis ng one.

Commissioner Hale requested to know the location for parking for the new
building. Mr. Gaspari explained that the new building would have a full
basement which will house the garage for the new building. He further
explained that the existing building has a full basem~nt and garage and
that they use the driveway fronting on Miller.
Commissioner Mathewson questioned staff on proof of ownership. Secretary
Costanzo explained that a Title {Report is not required, however, the
applicant must identify himself as either the owner, attorney of the owner,
a person with power of attorney, or lessee. He further noted that i:f' the
applicant is not one of these four, then the applicantion and Use Permit
is null and void. He also noted that a property ownership list is provided
from the Assessorls Map and that legal notices are mailed to all owners on
that map.
Commissioner Teglia requested to know if the Architectural Committee would
have to give their approval on this matter. Secretary Costanzo said they
would because it is a condition of this Use Permit.
Commissioner Hale moved that UP-76-346 be approved subject to all the
conditions of the staff report. Vice-Chairman Teglia seconded the motion
and it was passed unanimously.
UP-76-347
UP-76-347, a request of Standard Oil Company for a Use Permit to construct
a self-service automobile service station in the C-2 Central Commercial Zone
District at 698 El Camino Real.
Secretary Costanzo presented the staff report, reading into the record the
Special Conditions, the memo from the Fire Marshall indicating they had no
objections to the proposed use, and the conditions from the City Engineer.

There was some discussion on the City Engineer1s conditions relating to the
dedication of land. City Engineer Yee explained that the area in the right-
of-way at the corner of Orange Avenue and El Camino Real needed further
dedication and improvement work in order for staff to have some control
over sight distance.
Commissioner Hale requested to know how they were Blanning on preventing
westbound traffic on Orange Avenue from turning left into the station. Mr.
Willer explained that they have reduced the size of the exit driveway to
discourage just such an action and that they are posting it with one-way
only signs.

There was quite a bit of discussion about the number of gas stations in
the area and whether they were company owned or manager owned. Mr. Willer
explained that they had closed the gas station directly across the street
from the proposed location with the intention of using this property,
purchased by them in 1971, for a new service station. Two Commissioners
expressed concerns that the area was becoming saturated with gasoline
stations. Commissioner Teglia requested to know who would be maintaining
the landscaping. Mr. Willer said the operator would be, but that if he
should not do this for any reason, Standard Oil Company would be responsible.
There was some discussion on a Standard Oil service station further north
on El Camino Real. The Commission requested to know why landscaping had
not been put in at this location to improve the aesthetics of the station.
Mr. Willer explained that they lease this land and that the lease would be.
up in two years, which would make it economically infeasible to do any
kind of landscaping because it was so expensive.
In response to Chairman Sladels question, Mr. Willer noted that the hours
of operation would be from 6:00 a.m. to 10:00 p.m.
Vice-Chairman Teglia moved that UP-76-347 be approved subject to the condi-
tions of the staff report. Commissioner Bertucelli seconded the motion and
it was passed by the following roll call vote:

UP-76-348
UP-76-348, a request of Brentwood Orthodox Presbyterian Church for a Use
Permit to construct a sanctuary and classroom addition to an existing church
in the IIUII Unclassified Zone District at 186 Country Club Drive.
Secretary Costanzo presented the staff report and read into the record the
Special Conditions, the memo from the Common Greens Division and the
conditions of the City Engineer.

Commissioner Teglia requested to have a time table for Phase I and Phase
II. Mr. Bowman noted that Phase I would be completed before Christmas,
but that Phase II would depend upon the availability of funds and it will
probably be three or four years before this Phase is completed.

Commissioner Mathewson moved that UP-76-348 be approved subject to the
conditions of the staff report. Commissioner Bertucel'i seconded the
motion and it was passed unanimously.
UP-76-349
UP-76-349, a request of Victor Brincat for a Use Permit to establish an
auto body and fender repair shop in the C-3 Heavy Commercial Zone Dis-
trict at 619 Airport Boulevard.
Secretary Costanzo noted to the Commission that he would like to dispense
with reading the staff report, as he had been advised that there was some
confusion over who owned the property.
Proponent: Mr. James F. Scott, representing the applicant

Mr. Scott explained that Metropolitan Furniture Company and Mr. Brincat
entered into a purchase agreement on June 6, 1976, with escrow to be
concluded January 31, 1977. In the purchase agreement it states in
writing that from June 6, 1976, to January 31,1977, the property is
leased to Mr. Brincat for $1040/month. Therefore, Mr. Brincat is in
possession of that property until January 31, 1977, at which time the
sale to him will be consumated. He further stated that the prior owner
knew Mr. Brincat was purchasing the property for the proposed use of an
auto body and fender repair shop.
Mr. Warren Saltzman, representing the Metropolitan Furniture Company,
stated that Mr. Brincat did indeed enter into a purchase agreement with
the aforementioned company with the stipulation that Mr. Brincat make a
deposit on the sale of the property. He further stated that Mr. Brincat
made this deposit, but would not allow them to cash the check and, there-
fore, they are filing suit against him and have asked him to vacate the
premises. He further stated that Metropolitan Furniture Company was not
aware that the property would be used for an auto body and fender repair
shop and that they would readily accept Mr. Brincatls vacation of the
premises.
There was some discussion concerning Mr. Brincatls continuing to operate
his business without a Use Permit, Secretary Costanzo stating that, if
so, he would be in violation of the Zoning Ordinance. Secretary Costanzo
explained to the Commission that any auto repair shop in any commercial
or industrial zone was required to obtain a Use Permit prior to establishing
the business. Mr. Scott noted that since Mr. Brincat was operating the
business and would continue to do so, they did not object to a continuation
on the/use permit in the meantime.

Secretary Costanzo noted to the Commission that this would be violating
the Zoning Ordinance and that the matter of ownership should be resolved
before the Commission could take any action on this matter. Commissioner
Bertucelli noted that a Cease and Desist Order should be issued to Mr.
Brincat in the event his business operation continued without the prior
Use Permit approval.
Vice-Chairman Teglia moved that UP-76-349 be continued for at least 30
days to give staff time to get an opinion from the City Attorney on this
matter. Commissioner Mathewson seconded the motion and it was passed
unanimously.

PM-76-133, a request by Pacific Telephone Company for a Tentative Parcel
Map to adjust property lines on four parcels located on the northerly side
of Huntington Avenue, between South Spruce Avenue and the City1s boundary.
(This matter was 10th on the Agenda, but due to the fact that it relates
to UP-76-350, it was moved up on the agenda).

Mr. Gil explained that they have entered into a purchase agreement for this
land which must be completed by the end of this year. He noted that they
do not know when construction will begin for the storage yard, but possibly
within the first quarter of 1977.
Commissioner Goldberg requested to know if Pacific Telephone Company planned
to sell the three parcels not being utilized. Mr. Gil noted that they did
not plan to purchase these parcels and that only concern was Parcell.
Commissioner Mathewson moved that PM-76-l33 be approved subject to the con-
ditions of the staff report. Vice-Chairman Teglia seconded the motion and
it was passed unanimously.
UP-76-350
UP-76-350, a request of Pacific Telephone Company for a Use Permit to estab-
lish an office building, service garage and vehicle storage facility in the
P.C.M. Zone District northeast of Huntington Drive between Noor Avenue and
Spruce Avenue.
Secretary Costanzo presented the staff report, reading into the record the
Special Conditions and the conditions from the Common Greens Division and
the City Engineer.

Mr. Sinclair addressed the Commission~ noting that he is a potential property
owner on Huntington Drive and that his company feels the proposed use by
Pacific Telephone would be complimentary to the area. He mentioned several
concerns he had. One dealt with the landscaping requirements, which he
felt should not be reduced from what was shown on Exhibit IIA.1l Secretary
Costanzo noted that without the prior approval of the Planning Commission,
the landscaping as proposed cannot be reduced. Other concerns of Mr. Sin-
clair were that the eucalyptus trees on the i~ea~ of the property be main-
tained and preserved, the front of the property be treated in a decorative
manner, and that the low nature of the landscaping in front does not screen
the storage yard from street view and that he would like to see moderately
high growth be considered. Secretary Costanzo noted that it is a condition
of the use permit that the eucalyptus trees be permanently maintained and
preserved, that the front of the property is being enclosed with a decora-
tive fence and landscaping, and that the landscaping must be of a low nature,
in order to facilitate police protection for the property, unless the
property owner was providing their own security, then the property could
be totally screened from the street.
There was some discussion on the fencing of the property. Secretary
Costanzo noted that only the storage yard was being fenced and that the
employee parking lot was not.
The Commission noted they would like to include, as part of the City
Engineer1s conditions, a condition that would reqUire the applicant to
provide an oil separator to the drainage system. The condition would
read as follows:
liThe drainage system shall incorporate an oil separator to remove
petroleum products from the run-off.1I
City Engineer Yee agreed that this should be part of the conditions.
Commissioner Mathewson moved that UP-76-350 be approved subject to all the
conditions of the staff report and with the addition of the above condition.
Commissioner Hale seconded the motion and it was passed unanimously.

UP-76-35l
UP-76-35l, a request of Tragoutsis, Elchinoff, Basin & Alhbach (T.E.B.A.)
for a Use Permit to construct a three-story office building in the P.C.M.
Planned Commercial Industrial Zone District at 1486 Huntington Drive.
Secretary Costanzo presented the staff report, reading into the record
the Special Conditions and the conditions of the City Engineer and of
the Common Greens Division.
Proponent: Mr. George Sinclair, representing T.E.B.A.

Mr. Sinclair agreed in general to the conditions, however, he did mention
two conditions he would like changed. Special Condition No.,"'2t,<il"'ielia'tted
to signing, he wished changed, since the name of the building has not yet
been determined. Condition #2 was changed to read as follows:
"...on the ground floor advertising the name of the building
only.1I
Mr. Sinclair also requested that instead of widening the two existing
planting strips to six feet each, which would cause them to lose one,
possibly two parking stalls, they would like to combine the two three
foot planting strips to be located in the center of the parking stalls,
which would give a six foot planter and would allow them to maintain the
existing number of parking stalls.
Commissioner Hale moved that UP-76-351 be approved subject to the condi-
tions of the staff report, with the changed Special Condition No.2.
Commissioner Bertucelli seconded the motion and it was passed unanimously.
UP-76-352
UP-76-352, a request of Patrick Brosnan for a Use Permit to construct an
eleven unit addition to an existing nonconforming single family dwelling
in the R-3 Restricted Multiple Family Zone District at 1018 Grand Avenue.
Secretary Costanzo presented the staff report and read into the record the
Special Conditions and all of the conditions from the City Engineer, the
Building Division and the Common Greens Division.

Mr. Michael Nilmeyer expressed his concerns with the project, noting that
it would create an adverse impac~on ~~e..residents behind the proposed
project, in that they now have anniee;vi;ew, but if the proposed project
were to occur, they would be staring at a large blank wall.
Mr. Sam Nilmeyer requested that this application be denied in that it
would create for them an unpleasant environment, having their view obstruc-
ted with a blank wall. He also noted that the layout of the proposed
project would create a traffic problem for the area.
Mr. Edwards expressed his concerns with the project, noting that his view
of the hills and parts of South San Francisco will be totally blocked if
this proposed use were approved.
Secretary Costanzo explained to the Commission and to the concerned resi-
dents that this proposed use is located within the R-3 Zone District,
which allows the applicant to build 12 units on the site, without the
controls of the Use Permit process. He noted that the only reason the
applicant is before the Commission under the Use Permit process is that
he wishes to retain the existing nonconforming three-bedroom house in the
front of the property. He further noted that such houses are fairly
rare in South San Francisco, and he would like to see this house remain.
He further noted that it would have to be brought up to code.
Commissioner Goldberg asked if it might make a difference in the building
design, if Mr. Brosnan would combine two lots of the same size. Mr. Brosnan
said that it would not and that he considered the proposed buildings
attractive.
Vice-Chairman Teglia requested that three conditions be added to the Special
Coneitions as follows:
1. That a screen wall is to be installed between the two proposed
sections in the rear of the main buildings at the line of the
rear of both buildings.
2. That mature trees of a size, type and number, and in a location
along the rear property line be planted, subject to the approval
and prior inspection of the Architectural Committee.

3. That a copy of the findings and determination of the Planning
Commission shall be recorded in the office of the County
Recorder in San Mateo County on the deed of the subject
property and that a copy of the said recorded document shall
be filed in the office of the City Planner prior to the
issuance of a building permit.
Chairman Slade expressed his dislike of the proposed design, noting that
he was surprised at the mediocrity of Mr. Brosnan's proposed design, con-
sidering the excellent designs of his other projects. He further noted
that he would like to see Mr. Brosnan prepare another, more attractive
design for the subject property. Mr. Brosnan stated that he is satisfied
with the proposed design and feels it is quite attractive.
Vice-Chairman Teglia moved that UP-76-352 be approved subject to the con-
ditions of the staff report and with the addition of the three conditions

UP-76-353 and UP-76-354, requests of Grubb and Ellis Realty Fund II for use
permits to maintain two on-si subdivision freestanding identification signs
in the R-3 Restricted Multiple Family Zone District at #1 Appian Way.
(Formerly UP-75-311 and UP-75-3l2)
Secretary Costanzo presented the staff report.
Proponent: Mr. Bill Helfrich, representing the applicant

Mr. Helfrich explained to the Commission that they had finally received the
Final Subdivision Public Report which means they can now close escrow and
sell the condominiums. He felt the signing was vital at this time because
they were just having their grand opening within the next week, and needed
the signing for identi cation purposes. He noted that they would also be
utilizing newspaper advertising extensively, but that the signing on the
site would serve to direct people to the project. He talked at some length
on the amount of monies the investors have lost to date, and that they stand
to lose more if the signs have to be taken down and people cannot find the
project because of poor identifi on.

Mr. Helfrich further noted, regarding escrow, that even though they now have
the right to close escrow, it may take awhile because each of the investors
has to now resubmit their application for funding for approval.
The Commission requested to know when Grubb and Ellis planhed to begin land-
scaping on Gel~ert Boulevard. Mr. Helfrich noted that even though they
have a permit for this, they do not have any immediate plans to begin the
landscaping. The Commission noted that they would like to see this land-
scaping done as quickly as possible because they felt it would enhance the
appearance of the project site.
The Commission noted that the unfinis,~ed portion of the condominium project
should possibly be covered with some kind of groundcrover to diminish the
appearance of the piers sticking up out of bare ground. Mr. Helfrich
agreed that there should be ground cover on this portion of the project
and noted that he is intending to do this, but that the costs were very
high. He did state that oleanders were to be planted and the secretary
advised him of the requirement of the Architectural Committee.
The Commission generally expressed their feelings that they would like to
see all the signing removed. It was also noted that this project did not
enhance the appearance of the community, but if there were a possibility
that the signing would help get this project moving, then they would take
it into account.
Chairman Slade noted that the sign on the other side of Appian Way reading
IlSales Officell is not an approved sign and must be removed. He further noted
that the flags on the buildings are in violation of the sign ordinance, as
well as a violation of the conditions of the original Use Permit permitting
the signing, and that they must be removed. Mr. Helfrich noted they are
needed for the grand opening and that he would apply for a permit with the
Building Division on the following day.
The Commission requested to know when Mr. Helfrich expected escrow to close.
He noted that it would be hard to put a time frame on this, because he did
not know if they would run into any problems or not. He noted that if there
were no problems escrow would close immediately.
Vice-Chairman Teglia moved that UP-76-353 and UP-76-354 be continued to the
Planning Commission meeting of September 28 in order to give the applicant
time to close escrow. Commissioner Mathewson seconded the motion and it
was passed unanimously.
COMMUNICATIONS
Secretary Costanzo advised the Commission that Bertis Bargain Store on Grand
Avenue would be moving their store to the Sprouse-Reitz location, and that
he had advised the pplicant that she would have to get a Use Permit, since
it is of a secondhand type of store. Ms. Elizabeth Carlson, 865 Estergrand,
Millbrae, addressed the Commission, noting that she is the lessee and that
her business is not a secondhand store, but a discount store and that all

of her merchandise is neWt not secondhand. Secretary Costanzo advised the
Commission that they would' have to decide if this type of business should
come under the Use Permit process.
Commissioner Goldberg moved that this business was similar in nature to a
secondhand store and should be required to obtain a Use Permit. Vice-
Chairman Teglia seconded the motion and it was passed unanimously.
Vice-Chairman Teglia moved that the business of Ms. Carlson should be
brought to the Planning Commission under a Use Permit at their meeting of
August 24. Commissioner Goldberg seconded the motion and it was passed
unanimously.
GOOD AND WELFARE
Commissioner Goldberg mentioned to staff that Home Savings and Loan had
left their signs at Greendale and Savannah when they moved. Secretary
Costanzo said he would contact them about this.
There being nothing further to be considered under Good and Welfare and no
other communications or other matters of interest for the Commission,
Chairman Slade announced that the next regular meeting of the Planning
Commission would be held on August 24, 1976, at 8:00 p.m. at West Orange
Library Auditorium.
The meeting was adjourned at 1:15 a.m.
