Christians City Engineer Robert Yee MINUTES OF PREVIOUS MEETING Minutes of the Planning Commission meeting of June 13, 1978 Vice-Chairman Mullin moved that the minutes of the regular meeting of the South San Francisco Planning Commission of June 13, 1978, be approved. The motion was seconded by Commissioner Bertucelli, and was passed by the following roll call vote: AYES: Chairman Campredon and Commissioner Mathewso~ Vice-Chairman Mullin and Commissioner Bertucelli NOES: None ABSENT: Commissioners Grimes and Slade ABSTAIN: Commissioner Mantegani ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman Campredon announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, and that anyone who wished to come before the Commission to be heard is requested to come to the front microphone so that his or her comments become part of the official record. -3966 - July 11, 1978 SUBDIVISION AND PARCEL MAPS SA-77-40 and Negative Declaration No. 127 An application of W. W. Dean & Associates for a final Subdivision Map to create 288 single family parcels on property lcoated west of State Highway 280 and east of the terminus of Gellert Boulevard in the R-3 Multi-family Zone District. Secretary Costanzo presented the staff report. Commissioner Mathewson moved that SA-77-40 and Negative Declaration No. 127 be approved subject to all conditions. Commissioner Bertucelli seconded the motion. The motion was passed by a unanimous roll call vote. PM-78-163 and Negative Declaration No. 166 An application by California Water Service for a tentative Parcel Map to create 4 parcels from one parcel on property located north of Mission Road between Chestnut Avenue and Oak Avenue in the C-O Zone District. Secretary Costanzo presented the staff report. David Uccelli 333 El Camino Real South San Francisco, CA Mr. Uccelli relayed information from the City Attorney that final agreements re- garding improvements would be handled when the final parcel map was presented. City Engineer Robert Yee commented that deletion of some conditions are applicable and the final agreements will be made. Vice-Chairman Mullin moved that PM-78-163 and Negative Declaration No. 166 be approved subject to all Special Conditions. Commissioner Bertucelli seconded the motion. The motion was passed by a unanimous roll call vote. PM-78-167 and Negative Declaration No. 167 An application by Maurice Brosnan for a tentative Parcel Map to create 4 parcels on undeveloped property located on the east side of Willow Avenue at Miller Avenue in the R-3 Zone District. - 3967 - July 11, 1978 Senior Planner Daniel Christians presented the staff report. Commissioner Mathewson questioned the purpose of this parcel map. Secretary Costanzo responded by indicating that this procedure is for financing. Commissioner Mathewson moved that PM-78-167 and Negative Declaration No. 171 be approved subject to all conditions. Commissioner Mantegani seconded the motion and it was passed by a unanimous roll call vote. PUBLIC HEARING ITEMS UP-78-445 and Categorical Exemption An application by Robert A.Wh~teley, Jr. for a Use Permit to establish a whole- sale and retail import business on developed property at 619 Airport Boulevard in the C-3 Zone District. Assistant Planner Mark Wheeler presented the staff report. Secretary Costanzo deleted the original Special Condition No.7 as it is in- applicable in this case. Mr. Whiteley, the applicant, agreed with all Special and Standard Conditions. Mr. Frank Azzapardi 655 Chateau Drive Hillsborough, CA Mr. Azzapardi stated that he had an objection to the requirement related to the installation of a sprinkler system. Staff responded that the permanent sprinkler system was normally required and was very important. Commissioner Mathewson moved that UP-78-445 and Categorical Exemption be ap- proved subject to all Special and Standard Conditions. Commissioner Bertucelli seconded the motion and it was passed by a unanimous roll call vote. UP-78-446 and Negative Declaration No. 168 An application by Basil F. Foppiano for a Use Permit to construct an additional dwelling unit to an existing non-cenforming structure at 100 Eucalyptus Avenue in the R-2 Zone District. Secretary Costanzo presented the staff report. Basil F. Foppiano 100 Eucalyptus Avenue South San Francisco, CA - 3968 - July 11, 1978 Mr. Foppiano indicated that an enclosed patio is strictly for necessary wind 'protecti on. Secretary Costanzo stated that modifications ~ould be accomplished and still re- tain the wind protection purpose. Commissioner r~athewson moved that UP-78-446 and Negative Declaration No. 16,8 be approved subject to all Special and Standard Conditions. Commissioner Bertucelli seconded the motion and it was passed by a unanimous roll call vote. UP-78-444 and Negative Declaration No. 167 An application by Stephen G. Coulthard for a Use Permit for modifications to an existing free-standing indentification sign structure located on developed pro- perty at 101 Terminal Court in the ~1-2 Zone District. Secretary Costanzo presented the staff report. Martin Bloom 21 Brookwood Road St. Louis, MO Mr. Bloom responded by saying this application is very uncommon in his career dealing with public agencies regarding removal of non-appurtenant signs as part of this permit approval. He further stated that problems are being faced with the existing rusting sign faces. Mr. Bloom relayed the information he received from the City Planner regarding the structural modifications. He stated that the City Planner indicated that the approval process for the structural modifications would be IIno problemll. Mr. Bloom concluded by saying he would not accept the Special Conditions as stated. He also pointed out that any liability resulting from any denial here tonight would fall on the City. Mr. Louis Poletti asked why this permit was required. Commissioner Bertucell;' stated he favors the approval here tonight without the relocation of the non-appurtenant sign. Vice-Chairman Mullin questioned the pictorial representation regarding its' use throughout the country. He continued by saying that this particular pictorial' representation might be acceptable if modifications were made. Secretary Costanzo indicated the direction herein tonight is based on previous decisions regarding similar modifications. He further indicated that the pic- torial representation not being permitted has also been established as a Plan- ning Commission adopted policy. Secretary Costanzo remarked that the response "no problemll was based on the fact that he was unaware at the time that the non- appurtenant sign was even located on the site. Secretary Costanzo stated that the Commission could declare this modification a non-structural or maintenance project and determine this particular Use Per- mit not to be applicable. -3gng- July 11, 1978 Secretary Costanzo indicated the past policy position of the Planning Commission and the City Council are typical as stated in the staff report. Vice-Chairman Mullin questioned the result of declaring this Use Permit non- applicable. Secretary Costanzo stated that a maintenance modification of over 25% of the value would require a Use Permit. Mr. Steve Coulthard, Amco Sign Co., said that the modifications would be engi- neered to the satisfaction of the Building Division. Vice-Chairman Mullin remarked that past policy has been established through previous applications and is currently being challenged in the court. Vice-Chairman Mullin further went on to say that in accordance with Ordinance 455, Section 3d (maintenance) that the Planning Commission unanimously agreed that a Use Permit is not necessary for the modifications as requested therefore this application is considered null and void and all application fees paid by the applicant are to be refunded in full. UP-78-447 and Negative Declaration No. 169 An application by Shell Oil Co. for a Use Permit for modifications to an ex- isting gasoline service station located at 899 Airport Boulevard in the C-3 Zone District. \ Secretary Costanzo presented the staff report. Mr. John Williams 1660 Amphlett Boulevard San Mateo, CA Mr. Williams indicated that the new signs as proposed consisted of less total square footage than existing signs. He further indicated the station needed the freeway exposure accomplished by the height of the freestanding sign. Commissioner Bertucelli moved that UP-78-447 and Negative Declaration No. 169 be approved with all Special Conditions. Commissioner Mathewson seconded the motion and it was passed by a unanimous roll call vote. V-78~214 and Categorical Exemption An application by Edward M. Bourne for a Variance to encroach 3 feet into a por- tion of the required rear yard setback on property located at 19 Tunitas Lane in the R-l Zone District. - 3970 - July 11, 1978 Secretary Costanzo presented the staff report. Commissioner Mantegani moved that V-78-214and Categorical Exemption be approved subject to all Standard and Special Conditions. Commissioner Bertucelli seconded the motion. The motion was passed by a unanimous roll call vote. SA-78-48 and RPD-78-6 Negative Declaration No. 170 An application by Albert Seyranian for a tentat,iveSubdivision Map to create 21 air-space units on undeveloped property located on the east side of Holly Avenue at Westview Drive in the R-l Zone District and an application for a Residential Planned Development to construct 21 Single Family units on undeveloped property located on the east side of Holly Avenue at Westview Drive in the R-l Zone Dis- trict. Secretary Costanzo presented the staff report. The Secretary further explained the project and the required association responsible for maintenance of the surrounding areas and recreational facilities. Mr. Albert Seyranian stated that the concept of the project is single family condominiums. Secretary Costanzo made reference to the attached letter from the lady in the area. Leo Seyranian objected to the relocation of the garages based on the aesthetics of the overall design. Chairman Campredon questioned the need for a retaining wall along the north property line. Mr. Seyranian stated that the steep slope would be compensated with fil.l and the units would be accordingly raised. Commissioner Mathewson noted an error; unit 15-L should be 19' clear to curb line from face of garage door. Commissioner Mathewson further questioned the consistency of the general plans in regards to the Zoning Ordinance. Commissioner Bertucelli moved that SA-78-48, RPD-78-6 and Negative Declaration No. 170 be approved subject to all Special and Standard Conditions. Commissioner Mathewson seconded the motion. UP-78-443 and Categorical Exemption (Comltinued from Meeting - 6/13/78) - 3971 - July 11, 1978 An application by Gerard Erecting and Welding Co. to establish an open storage yard on property located at 545 Airport Boulevard in the C-3 District. The Commission considered the request of Gerard Erecting and Welding Co. for a Use Permit but because of the difficulties being experienced by the applicant coordinating the details and required Parcel Map, the Commission agreed to table this item indefinitely. COMMUNICATIONS The Commission considered the request of Peremptory Writ of Mandate - Bocci, Modena, Fulvio and Royce, for a Use Permit No. 77-399. The Commission set the date for further hearing of this item to August 8, 1978. GOOD AND WELFARE Commissioner Mathewson question who was clearing the brush behind Mission Road. He was advised that the Southern Pacific Railroad Co. was providing the service. Their being nothing further to consider under Good and Welfare and no further communications or matters of interest for the Commission, Chairman Campredon announced that the next regular meeting of the Planning Commission would be held on July 25, 1978, at the hour of 7:30 p.m. in the West Orange Avenue Library Auditorium.
