Commissioner Mullin noted that on UP-75-325, persons written as Proponents should be corrected to Opponents. Commissioner Mullin moved that the minutes of the regular meeting of the South San Francisco Planning Commission of September 27, 1977, be approved. The motion was seconded by Vice-Chairman Goldberg, and was passed by the following roll call vote: AYES: Vice-Chairman Goldberg, Commissioners Campredon, Mullin and Chairman Teglia. NOES: None ABSENT: None ABSTAINED: Commissioners Bertucelli, Mathewson, and Slade. ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman Teglia announced that this meeting of the South San Francisco Planning Commission would be recorded on tape, but that anyone who wished to come before the Commission to be heard, but who objected to having his or her voice recorded in this manner, could request the Chairman to order the tape recorder turned "off" for the duration of the time that he or she is speaking or is heard. Dctober 11, 1977 UP-75-334 An up-date by City Attorney John Noonan on the Adult Book Store on 107 Grand Avenue. City Attorney Noonan gave a brief presentation on his findings at the Adult Book Store. Noted that when it was first open for business, there was a peep show area in the rear, game room area in the front, display room was not in use, and the bookstore area in the center. At the present time, the book- store is occupied, the game room is vacant, the display area is vacant, and the peep show area has only two machines operating in the rear. Commissioner Bertucelli asked about their rear exits and about the electrical outlets for the use of the machines. City Attorney Noonan advised that it is re- stricted to have less than 50 customers because of the lack of exits. Regarding the electrical outlets, since they only operate 2 machines the building is already equipped with the voltage necessary to operate these machines. Chairman Teglia asked if the signs on the building met with all requirements of the City. Secretary Costanzo responded that he bel ieved they didnl t comply with the procedures but woul d look into the matter. City Attorney Noonan concluded by advising that this is still an on-going matter. UP-77-406 (side 1 #085) An application for construction of a family room addition between the existing garage and a single family residence located at 3804 Callan Boulevard in the Planned Community Zone District. Assistant Planner Wheeler presented the staff report. Proponent: Dennis Almendral 3804 Callan Boulevard South San Francisco Opponent: None Commissioner Mathewson asked if he was the first owner of the house. Mr. Almendral advised he did buy it new. Vice-Chairman Goldberg asked if Mr. Almendral intended to use this building as a garage only. Mr. Almendral advised that his brothers were using it as band practice room but would not continue to use it for that purpose. Commissioner Mathewson moved that UP-77-406 be approved subject to the Special Conditions. Commissioner Slade seconded the motion and it was approved by a unanimous roll call vote. UP-77-407 (side 1 #119) An application of Vilma G. Peoro to establish an "on-sale" establishment where liquor is sold in conjunction with the "Spring House Restaurant" located at 3565 Callan Boulevard in the Planned Community Zone Distri,ct. - 3849 - UP-77-407 cont'd Dctober 11, 1977 Assistant Planner Mark Wheeler presented the staff report. Proponent: Vilma G. Peoro 3565 Callan Boulevard South San Francisco Opponent: None Mrs. Vilma Peoro asked the Commission if they could extend their business hours to 2:00 a.m. instead of 12:00 midnight. The Commission and Mrs. Peoro discussed the pros and cons of keeping this business open until 2:00 a.m. Secretary Costanzo explained how this business was to remain a restaurant and not become a "tavernll or "beer bar." Mrs. Peoro asked \vhy in other cities she could keep it open and was advised by Secretary Costanzo that this Commission is only concerned with the area of South San Francisco. Mrs. Peoro advised that clnsing earlier would not allow enough time for the enter- tainment. Commission asked if she had a permit with this City for the entertain- ment. She advised that they did. Staff indicated a Use Permit is necessary. Commissioner Mullin moved that UP-77-407 be approved subject to the Special Condi- tions. Commissioner Campredon seconded the motion and it was passed by the follow- ing roll call vote: AYES: Vice-Chairman Goldberg, Commissioners Campredon, Mathewson, Mullin, Slade, and Chairman Teglia. NOES: Commissioner Bertucelli UP-77-408jUP-77-409 (side 1 #216) Use Permit applications and Negative Declarations #133& 134 of McKinley Service Enterprises for modifications to the signing at the existing Shell Service Station located at 3515 Callan Boulevard in the Planner Community Zone District, and at the existing Shell Service Station located at 710 El Camino Real in the C-2 Central Commercial Zone District. Secretary Costanzo presented the staff report; also advised that UP-77-408 and UP-77-409 were identical requests and would be presented at the same time. Proponent: Richard McKinley P. O. Box 8721 Emeryville, CA Opponent: None Secretary Costanzo noted that national trade marked pictorial signs are the only type of sign that would be approved by the Staff. Commissioner Mullin asked if the sign with the figure of a mechanic holding an open-end wrench was a registered mark sign. Secretary Costanzo advised that it was as per a letter received from the Shell Oil Company on October 11, 1977, therefore, Special Condition #1 should be removed. Secretary Costanzo also noted changes on Special Condition #7 to exclude the word "periodically" at the end of the sentence. II - 3850 - UP-77-40SjUP-77-409 cont'd October 11, 1977 Commissioner Mathewson asked about the price sign and where it was located. Secretary Costanzo noted that it was to be located on the corner of El Camino Real and Orange Avenue, as originally intended. Commissioner Mullin moved that UP-77-40S and UP-77-409with Negative Declarations #133 and 134 be approved subject to the Special Conditions with the above noted changes. Commissioner Campredon seconded the motion and it was passed with a unanimous roll call vote. ' UP-77-410jV-77-206 (side 1 #313) Chairman Teglia requested that UP-77-410 and V-77-206 be heard at the same time. Commission and Staff both agreed. A Use Permit of Friendship Baptist Church structure located at 507 Airport Boule- vard in the C-3 Heavy Commerical Zone District, and a Variance application of Friendship Baptist Church for a reduction in t~e required off-street parking spaces on property located at 507 Airport Boulevard in the C-3 Heavy Commercial Zone District. Senior Planner Christians presented the staff reports. Proponent: Harold C. Dow 1249 - 9th Avenue San Francisco Mr. Danridge 530 Lisbon San Francisco Opponent: None Mr. Dow advised that figures given were computed by the seats in the building. Presently, the assembly room and the pews are inadequate. Regarding the parking question, parishioners always find places to park and there have not been any complaints on this matter. Commissioner Campredon asked about the difference in parking on Airport Boule- vard. The City Engineer advised that there is a project which will change the parking along on Airport Boulevard. Commissioner Slade asked what was the over-all cost on this improvement. Mr. Danridge advised it was 25% of the total value of the existing structure. Commissioner Slade noted that he felt it was not worth remodeling and that a new building should be built elsewhere. Mr. Danridge advised with the prices now a days, it was impossible for the church to buy land and build. Vice-Chairman Goldberg asked about the sign that sits at the corner of the pro- perty. Mr. Dow noted that the sign is not being covered by this addition and that the side passage will remain the same. Commissioner Bertucelli asked several questions concerning neighbors feelings and noted that everything seemed to be running smoothly. - 3851 - UP-77-410jV-77-206 cont'd Gctober 11, 1977 Commissioner Mullin recommended that changes be made on the findings of V-77-206 to read as follows: 1. That because of the nature of the proposed church use, its hours of operation will not conflict with operations of adjacent commercial land uses. 2. That the granting of this variance will not be adverse to the health, safety, and welfare of the community. 3. That the proposed use is consistent with the intent and general purpose of the Zoning Ordinance. 4. That the proposed use is consistent with the General Plan. And that changes on the findings of UP-77-4l0 be made to read as follows: 1. That the proposed expansion of this non-conforming use will not increase the intensity of this use and will not cause problems of incompatibility with adjacent properties. 2. That the expansion is necessary for the preservation of pro- perty rights since the existing non-conforming use may be continued indefinitely. 3. That the expanded use will not be 'adverse to the health, safety and welfare of the community. 4. That the expansion, without the required amount of parking spaces, is not contrary to the general purpose and intent of the zoning ordinance. Commissioner Bertucelli moved that UP-77-410 be approved subject to the findings and Special Conditions with the noted changes. Commissioner Slade seconded the motion and it was passed with a unanimous roll call vote. Commissioner Mullin moved that V-77-206 be approved subject to the findings and Special Conditions with the above noted changes. Commissioner Campredon seconded the motion.and it was passed with a unanimous roll call vote. (side 1 #567) "UP-77-4l1 A Use Permit application of Cameron & Cameron for improvements to an existing non-conforming garage structure located on the rear of the property at 809-811 Grand Avenue in the R-2 Duplex Residential Zone District. Secretary Costanzo presented the staff report. Proponent: Mr. Robert L. Cameron 133 Santa Inez Avenue San Bruno Mr. William Cameron 133 Santa Inez Avenue San aruno Opponent: None - 1R~? - UP-77-4ll cont'd October 11, 1977 Commissioner Mullin noted that this is a very old building and wondered whether it would really be a historical structure after the repairs. Secretary Costanzo advised that this is the last piece of the Martin Estate. The Commission discussed whether it would be worth it to repair this building, several suggestions were given to Mr. Cameron, on the different things that need- ed repair on the building. The Commission found that findings read as follows: 1. That the use may be hazardous to the public health, safety, and welfare. 2. That the Use Permit will not serve to maintain an existing historic structure. 3. That the use is not in keeping with the general purpose and intent of the City Zoning Ordinance and General Plan. Based on these findings, Commissioner Mullin moved that UP-77-4ll be denied. Commissioner Mathewson seconded the motion and it was denied with a unanimous roll call vote. UP-77-4l2 (side 1 #725) Negative Declaration #135 and Use Permit application of Mr. & Mrs. D. Rogers for construction of a 4,600 square foot commercial and office building located on El Camino Real approximately 450 feet north of Country Club Drive in the "U" Unclassified Zone District. Secretary Costanzo presented the staff report. Proponent: George Avanessian 914 Linden Avenue South San Francisco Frank Dutton P. O. Box 62 ~1i 11 brae Opponent: None Mr. Avanessian states he does not object to recommendations but does object to these recommendations being part of the conditions on the Permit. For example: #1 - the block wall; #2 - he noted that they did not want to look like Taco Bell or McDonalds and that is why they put a steel roof instead of concrete tile. Mr. Dutton advised they wanted to start a new style on their buildings. He also objected to the wall at the rear because they wanted to landscape this area. - 3853 - UP-77-4l2 cont'd October 11, 1977 Chairman Teglia askedwhy the wall in the rear. Secretary Costanzo explained that this wall has been required in the past to separate different zone districts. Chairman Teglia suggested that they put trees in front of the wall like the other business. Secretary Costanzo suggested that the wooden knees be put on the drive thruarea and that the wooden eaves be continued around the building on both sides. Mr. Avanessian advised that the wooden knees could not be put up because the delivery truck would damage them. Continuing the eaves around the building is not a part of the new style they want. Commission discussed the steel roof. Mr. Avanessian advised that this is more expensive, is guaranteed for 20 years, and would not look bad. Secretary Costanzo advised that the landscaping in front of the vehicles is to block the headlights of cars. r,1r. Avanessian advised the Commission that they would be willing to continue the roof as suggested. Commission decided to leave as shown on the display. Secretary Costanzo asked what the hours of operation would be. Mr. Avanessian advised 24 hours. The Commission asked the Chief of Police to check what the other cities with Rolling Pin Donut Shop's open 24 hours have found. The Chief of Police advised Mr. Avanessian that they would have' problems like Taco Bell has found. The Commission recommended Special Conditions to read as follows: 1. That a 6 foot solid decorative concrete block wall shall be installed along the entire rear of the subject developed area subject to the approval of the City Engineer and a deter- mination as to the location Public Utility Easements. No.2, 3, and 4 to be deleted. Renumber 5 - 9 to 2 - 6. Number 7 added to read: 7. That the hours of operation shall be limited to the hours set forth and established by the Police Department, based upon an examination of the public nuisance factors. Commissioner Mullin moved that UP-77-412 be approved subject to the Special Con- ditions with the above changes. Commissioner Bertucelli seconded the motion and it was passed with a unanimous roll call vote. UP-77-4l3 (side 1 #855) Negative Declaration #136 and Use Permit application of Macy1s California for expansion of an existing distribution center on property located at 1556 El Camino Real in the "U" Unclassified Zone District. Secretary Costanzo asked that this be continued to October 25th meeting. Commission unanimously agreed to continue this matter to the Planning Commission meeting~of October 25, 1977. - ~R!:;Ll. _ October 11, 1977 UP-75-3l6 A proposed revocation of the Use Permit of Syufy Enterprises for the Spruce Drive-In Theater located at the corner of Railroad Avenue & Spruce Avenue in the M-l-H Light Industrial Zone District. Secretary Costanzo presented the staff report. Proponent: Ray Svanosio 406 Railroad Avenue South San Francisco Vilma Fonele 443 Valencia Drive San Francisco Opponent: Daniel Modena 421 Grand Avenue South San Francisco Ernie Furman 150 Golden Gate Avenue San Francisco J. A. Haigh 928 Peninsula San Mateo Mr. Modena advised they were aware that the main problems were noise and lights at the Theater. He advised that they had put up a barrier to block defused light. Mr. Svanosio verified that it did solve the problem. Mr. Modena advised the volume of the speakers has been reduced as an immediate noise solution. Explained why radio broadcast would not work and that the proposed new system will have a switch attached to speakers that will turn it off when it's hooked back on the post. Mr. Modena suggested putting 14 feet trees on Railroad Avenue and Maple Avenue instead of painting the curve red to block the screens. Commission advised this would take too long to be effective. Mr. Modena asked to have a curfew extended to 2:00 a.m. because they have 3 showings in the winter. Commissioner Mullin recommended that the screens that cannot be blocked be limited to "G" and "PG" rated movies. Mr. Modena agreed. Mr. Modena advised that they have a private patrol checking Railroad Avenue on Friday and Saturday nights, and they report any happenings to the Police Department. He asked if he could have his personnel acting as "orderlies" inside the theater. Mr. Modena advised that they now have employees checking all speakers to insure they are hung back on the posts. Chairman Teglia asked how many employees do they have for each theater. Mr. Furman advised that they would be hiring new people but would prefer not to hire security guards for these duties. Chief of Police made a comment that painting the curve red on Maple and Railroad Avenues would not be of much help, and suggested that something else be done. - 3855 - UP-75-3l6 cont'd 0ctober 11, 1977 Chairman Teglia suggested that trees be planted on the slope on Railroad Avenue and the train tracks. Secretary Costanzo advised that this is Southern Pacific's property and that it would not solve the problem. Ms. Fonele advised that she was happy about the recommendations for patrols and the high fence. The Commission made corrections on Recommendation #2, added conditions to read as follows: (a) That the hours of operation at the theater shall be limited to 2:00 a.m. and that the patrons of the theater shall be so advised by a sign at each entrance gate, Snack Bar, and by a film announce- ment ran prior to the showing of any film. (b) That the speakers presently located on the site shall be removed and replaced with a system which clips to the auto radio system or which requires that the speaker be issued upon entrance to the theater and returned upon leaving, or bya system which automatically shuts off when the speaker is rehung on the post. (e) That the theater shall make a reasonable attempt to secure premises from the property owner at the north-east corner of Maple Avenue and Railroad Avenue for the purpose of installing trees and shrubs to block the view of the easterly screen. (g) Films shown on the screen facing to the north shall be limited to "G" and "PG" rated films. (i) That the applicant's obligation is to mitigate totally the adverse effects of the theater's operation and he shall install and maintain facilities, structures, and equipment to accomplish these mitigation measures. If upon review by the Planning Commission it is determined that additional mitigation measures are necessary, the applicant shall add or install such improvements necessary to achieve the elimination of objectionable activities emanating from the facility. (j) That the permit shall be reviewed at the fi regular meeting of November 1977. (Second Tuesday of the month Commissioner Slade motioned that UP-75-316 be approved subject to the revised conditions and findings.
