Walter Birkelo City Engineer Robert Yee Community Relations Officer John Moran Planning Division Secretary Rosa Perez MINUTES OF PREVIOUS MEETING Minutes of the Planning Commission meeting of April 24, 1979. Commissioner Getz noted that on page 4117 second paragraph, the spelling of his name to be corrected from "S" to "Z", and further noted correction on his statement on page 4114 second paragraph of General Plan Update to read: "Commissioner Getz stated for the record....because there is a controversy with the City and State Agency dealing with the Fair Housing Law that his office and the Attorney General IS office may get involved in. Theoretically, he thought it would not be proper for him to take part in deliberation at the City1s 1 eve 1 . II Commissioner Grimes motioned that the minutes of the regular meeting of the South San Francisco Planning Commission of April 24, 1979, be approved with the noted changes. The motion was seconded by Commissioner Martin and was passed with the following roll call vote: AYES: Chairman Campredon, Vice-Chairman Mantegani, Commissioners Getz, Grimes, and Martin. ABSTAINED: Commissioners Bertucelli and Hoyer. ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Chairman Campredon announced that this meeting of the South San Francisco Plan- ning Commission would be recorded on tape, and that anyone who wished to come before the Commission to be heard is requested to come to the front microphone so that his or her comments become part of the official record. -4119- May 8, 1979 (TF#050 TAPE I/SIDE I Chairman Campredon asked staff if there were any items to be considered out, of order or to be continued? Dan Christians noted that Item #2 be continued to the regular Planning Commission meeting of May 22, 1979, to allow appli- cant to complete revised drawings for this project. CONTiNUED PUBLIC HEARING ITEMS General Plan Update (On-going Project) (Cont1d. from 4/10/79) (TF#054 TAPE I/SIDE I Discussion on the proposed updated Housing E'lement of the General Plan of the City of South San Francisco. Staff presented staff report recommending that the Planning Commission adopt Resolution 2254 recommending that the City Council transmit the Draft Housing Element to the State of California for their review and consideration. Staff noted all the revisions and additions from the Planning Commissionls Subcommittee and asked for their comments. Commission concurred with Sub- committee1s recommendations. Commissioner Martin moved that Resolution 2254 be approved an~ forwarded to City Council for their approval. Commissioner Grimes second the motion and was passed with the following roll call vote: AYES: Chairman Campredon, Vice-Chairman Mantegani, Commissioners Bertucelli, Hoyer, Grimes and Martin. ABSTAINED: Commissioner Getz. Chairman Campredon appointed Commissioners Getz, Hoyer and Bertucelli to the Subcommittee of the Land~Use Element to meet on May 17, 1979, at 6:30 p.m. at City Hall IS Small Conference Room. Commission concurred that this item be continued to the regular meeting of May 22, 1979. DP-79-369 (contJd from 4/10/79) (TF#162 TAPE I/SIDE I An appeal of the Design Review Board findings dated March 19, 1979, for the proposed purpose of storing metal drums for a limited time period on vacant property located at 166 Harbor Boulevard in the M-2 Zone District. Staff presented the staff report. Proponent: Mr. Harry Cooper (owner) 2809 Las Piedras Drive Burl ingame, CA Mr. Hector Millalba (tenant Western Drums 128 Harbor Way So. San Francisco, CA 94080 -4120- May 8, 1979 Mr. Cooper noted that he is owner of the vacant property and that the appli- cant of this permit did not have his permission to even apply for this permit. The Property had been vacant, but the applicant has a business next door and felt he could make some use to this vacant lot. Applicant just asked permis- sion from the owner for a trial use of the property, owner has allowed appli- cant to use this property with only one condition of keeping fhe lot clean. Mr. Cooper further advised that if the Commission wished to make all the con- ditions set forth in the staff report, he would have the applicant vacate the property and let it continue to collect debris. Chairman Campredon asked staff how this application came before the Commission? Mr. Wheeler, Assist~nt Planner, advised through our Code Enforcement Officer. Commissioner Getz asked applicant if he had any objections to tenant's use? Mr. Cooper responded no because he kept the area clean. Mr. Villalba, tenant, advised the Commission he did not realize what he was doing when he signed the application. All he wanted to do was to obey the City's Laws. Further discussion continued regarding reasons why this use should or should not be cOAsidered for the application or have property vacated. Commissioner Martin recommended this item be deferred because applicant was not ready to apply for the permit. Mr. Wheeler noted that many hours had been spent on this item and recommended that Commission give a time limit to the applicant or to the owner to either correct the violations, or to vacate the property by a certain date. Commissioner Getz moved that the present use be terminated and that the site be returned to its previous use within sixty (60) days from the date of the public hearing or the applicant and/or property owner shall submit a new ap- plication for the development of the property in accordance with Section 5.50A of Ordinance 353, as amended. Commissioner Grimes seconded the motion and it was passed with the following roll call vote: AYES: NOES: ABSTAINED: Vice-Chairman Mantegani, Commissioners Bertucelli, Getz, Grimes, and Martin. UP-79-487 Negative Declaration #202 (TF#024 TAPE I/SIDE I) An application of Mr. Ken Funk for a Use Permit to establish an auto rental facility and related building and site improvements on developed property located at 264 South Airport Boulevard in the M-2 Zone District. Staff presented the staff report. Proponent: Mr. Ken Funk (applicant) 1351 Encina Drive Millbrae, CA 94030 -4121- May 8, 1979 Mr. Funk noted he agreed with all the conditions except for the City Engineer's requirement for the sidewalk. Mr. Funk further presented photographs of the area showing no sidewalks on South Airport Bou'levard, and expressed his con- cerns. City Engineer noted that the bridge is scheduled to be widened in the future and at this time a sidewalk should be provided along the north side. Commission concurred that the applicant comply with City Engineer's recommen- dations. Staff noted that Standard Condition #30 bedeleted\ it is not applicable. Vice-Chairman Mantegani motioned that UP-79-487 and Negative Declaration #202 be approved subject to all condition and limitations. Commissioner Bertucelli seconded the motion ~ndwas passed with a unanimous roll call vote. PARCEL MAPS PM-79-178 Negative Declaration #209 Tentative Parcel Map to create four (4) parcels on vacant property located on the south side of Swift Avenue at Haskins Way ~in the M-2 Zone District. (TF#566 TAPE I/SIDE I) Staff presented staff report. Proponent: Rich Diodati (applicant & owner) 1461 San Mateo Avenue South San Francisco, CA Mr. Diodati advised that the previous owner had purchased this property before BCDC's jurisdictions existed. The applicant noted his property is grandfathered out and does not need to meet BCDC1s requirements. Applicant noted they intend to dedicate the shoreline access pathway anywaJI but does not wish to have it showing on the final map. Commissioner Getz noted for the record that BCDC is one of his clients and as a member of the Attorney General IS Office, it would be improper for him to sit as a Commissioner since there appeared to be a controversy between the applicant and BCDC, so he steped down from the podium. (TF#918 TAPE I/SIDE I) (TF#OOO TAPE I/SIDE 2) Staff, applicant and Commission discussed the matter in detail concerning the jurisdiction and possible elimination of lines shown on the final map. Commission concurred that the applicant shall show the mean high tide line. Vice- Chairman Mantegani motioned that PM-79-178 and Negative Declaration #209 be ap- proved subject tpthe conditions and limitations. Commissioner Bertucelli seconded the motion and it was approved with the following roll call vote: AYES: Vice-Chairman Mantegani, Commissioners Bertucel1i, Hoyer, Grimes and Martin; Chairman campredon. Commissioner Getz. ABSTAINED: PUBLIC HEARING ITEMS (TF#116 TAPE I/SIDE 2) -4122- UP-79-488 Negative Declaration #~~07 May 8, 1979 An application of Dario J. Teani for a Use Permit to construct a two story addition on developed property located at 770 and 772 El Camino Real in the C-2 zone District. Staff noted that applicant was not present and recommended to continue to May 22, 1979, meeting. Commission concurred. UP-79-489 Negative Declaration #208 (TF#155 TAPE I/SIDE An application of John R. Penna for a Use Permit to construct a two story addition on developed property located at 542 Palm Avenue in the R-l Zone District. Staff presented the staff report. Proponent: John R. Penna (aplc.) Opponent: 542 Palm Avenue SSF, CA 94080 Mr. John Belvini 538 Palm Avenue SSF, CA 94080 Mr. Anthony Pantaleoni 609 Lassen Street So. San francisco, CA Mr. Penna advised the Commission he agreed with all the conditions and limi- tations recommended by staff. Mr. Belvini, sreaking for Mrs. Belvini, came before the Commission to object to the construction of this building because of the height. His mother's concern is that she would be losing sun light around 3:00 p.m. Mr. Belvini asked the Commission that the applicant find some alternative to this pro- blem. Mr. Pantaleoni, designer for the applicant, noted to the Commission that he had conducted a study on the 22nd~of each month and noted that at 12:00 noon the neighbors would be losing some sun light only for ,two or three months. He further advised the Commission that they were aware of this problem and they have tried to work with it as much as possible, for example by slanting the roof at one point to allow more sun to the neighbors. Commissioner Getz and Vice-Chairman Mantegani expressed theirrconcerns-re- garding the location of the master bedroom and the exterior design and the windows that did not match the existing building. Commissioner Martin expressed his concerns with the regard of the neighbors and whether the Commission could approve such a use considering the complaints. Commissioner Martin moved that this matter be posponed off-calendar or next meeting to allow the applicant to meet with the Design Review Board to work with the concerns in loss of sun light and compatability with the existing building. Commissioner Getz seconded the motion and it was unanimously con- tinued to the regular Planning Commission meeting of May 22, 1979. -4123- UP-79-490 May 8, 1Q79 (TF#375 TAPE I/SIDE 2) An application of .Ron Price for a Use Permit to construct a minor: addition on developed property and establish a new car storage area on vacant property on Antoinette Lane located at #1 Chestnut Avenue in the IIUII Unclassified Zone District. Staff presented staff report. Proponent: George Avanessian (Architect) 914 Linden Avenue South San Francisco, CA Mr. Avanessian, representative of applicant, advised the Commission that the applicant agreed with all the conditions and limitations. Commissioner Getz brought to the attention of the Commission a possible noise problem with the auto repair shop and adjacent residents. Discussion followed in this regard. Mr. Avanessian noted that their operating hours are Monday through Friday from 8:00 a.m. to 5:00 p.m. (TF#924 TAPE I/SIDE 2) (TF#OOO TAPE 2/SIDE I) Commissioner Grimes motioned that UP-79-490 be approved subject to all the Special Conditions for UP-79-479 and Revisions for UP-79-490. Commissioner Bertucelli seconded the motion and it was passed with a unanimous roll call vote. UP-79-491 (TF#075 JAPE 2/SIDE I An appl ication of Mr. James r~. Harris for a Use Permit to construct a minor addition on developed property located at 327 Tamarack Lane in .the R...3 Zone District. Staff presented staff report. Staff brought to the attention of the Commis- sion that this structure will help meet our Housing Element's objectives of rehabilitating deteriorated structunes. It was also noted that this pro- perty is located in the Parking District and is subject to assessment for public parking. Staff indicated that the Parking Place Commission has re- viewed this application and approved it. The applicant was present and agreed with all the conditions and limitations. Vice-Chairman Mantegani moved that UP-79-491 be approved subject to all the conditions and limitations. Commissioner Bertucelli seconded the motion and it was passed with a unanimous roll call vote. V-79-219 (TF#161 TAPE 2/SIDE I) An application of Felix & Josephone Buckley for a 141 encroachment into a por- tion of the required 20' rear yard setback on developed property located at 172 La Crosse Avenue in the R-1 Zone District. Staff presented staff report. The applicant was present and agreed with all the conditions and limitations. -4124- May 8, 1979 Commissioner Getz noted findings #2 may be questionable as to property rights. Staff was directed to look into this. Commissioner Bertucelli motioned that V-79-219 be approved subject to all the conditions and limitations. Commissioner Getz seconded the motion and it was passed with a unanimous roll call vote. V-79-220 (TF#302 TAPE 2/SIDE I: An application of Peter & Olympia Cinquini for a 12' encroachment into a por- tion of the required 20' rear yard setback on de~eloped property located at 145 Romney Avenue in the R-1 Zone District. Staff presented the staff report. Applicant was present and agreed with all the conditions and limitations, but had one question whether it would be 12' or 11' encroachment? Staff clarified the applicant's question. Commissioner Getz referred to findings #2 and as in the previous Variance appli- cation, suggested some research be done on this matter. Vice-Chairman Mantegani moved that V-79-220 be approved subject to all the con- ditions and limitations. Commissioner Getz second the motion and it was passed with a unanimous roll call vote. RPD-79-9 Negative Declaration #215 (TF#407 TAPE 2/SIDE I) An application of Mr. & Mrs. Brignardello to construct a single-family residence on the rear of developed property located at 868 Miller Avenue in the R-2 Zone District. Vice-Chairman Mantegani noted for the record that he would be stepping down from the podium since he was one of the adjacent property owners. Staff presented staff report. The applicant was present and agreed with all the conditions and limitations. Commissioner Grimes moved that RPD-79-9 and Negative Declaration #215 be approved subject to all the conditions and limitations. Commissioner Bertucelli seconded the motion and it was approved with the following roll call vote: AYES: Chairman Campredon, Commissioners Bertucelli, Getz, Hoyer, Grimes and Martin. ABSTAINED: Vice-Chairman Mantegani. COMMUNICATIONS (TF#685 TAPE 2/SIDE I) SUBJECT: Parking Company of America - Phase II Use Permit Requirement -4125- May 8, 1979 The Planning Commission expressed concern regaY'ding the completion of all aspects of Phase I prior to any approvals of Phase II at the April 24th, 1979, meeting. After due consideration of all the facts presented, the Planning Commis- sion concurred that prior to any approvals being granted for Phase II, Staff's procedural recommendations must be met as outlined in the staff report. All drainage problems on Phase I must be resolved with approval of the Office of the City Engineer prior to recordation of the Final Parcel Map #PM-78-162. Commissioner Grimes moved to allow applicant an extension of recordation of Final Parcel Map#PM-78-162 to July 1, 1979.. Commissioner Bertucelli seconded the motion and it was unanimously agreed by a roll call vote. SUBJECT: Croatin Athletic Club UP-78-436 (TF#999 TAPE 2/SIDE I Request of Croatin Athletic Club for an extension of Use Per~it #UP-78-436, (previously approved May 9, 1978). Staff presented report on field inspection recommending that the Planning Commission grant a six month extension to the applicant to enable the pro- , ject to proceed without any further public hearings. After due consideration of all the facts presented. Commissioner Martin moved to concur with staff's recommendations and grant the six motnh extension. Vice-Chairman Mantegani seconded the motion and it was passed with a unanimous roll call vote. SUBJECT: Design Review Board Vacancy & Procedures (TF#124 TAPE 2/SIDE I Staff presented staff report noting that two vacancies exist on the Design Review Board since the resignation of the Landscape Architect. Staff advised the Commission to discuss this matter in detai"' and direct staff to proceed with the necessary procedural steps to fill th"is vacancy as soon as possible. Commission unanimously concurred and directed staff with the necessary proce- dural steps to fill this vacancy. GOOD AND WELFARE (TF#299 TAPE 2/SIDE I) Mr. James Elmore 642 Commercial Avenue So. San Francisco, CA Mr. Elmore asked the Commission regarding violation inspection procedures. Staff and Commission responded to all his concerns. -4126- May 8, 1979 There being nothing further to discuss under Good and Welfare, Chairman Campredon announced that the next regular meeting of the Planning Com- mission would be held on May 22, 1979, at 7:30 p.m. in the West Orange Library Auditorium.
