Vice-Chairman Mullin moved that the minutes of the regular meeting of the South San Francisco Planning Commission of October 10, 1978 be approved with the correction of the previous approval (minutes of September 26, 1978), page 4018 - page 4011, first paragraph; Mr. Butler, Vice President of United Taxpayers of South San Francisco. Commissioner Mantegani seconded the motion and the minutes were approved with the noted correction by the following roll call vote: AYES: Chairman Campredon, Vice-Chairman Mullin, Commissioners Slade, Grimes and Mantegani NOES: None ABSTAIN: Commissioner Bertucelli ABSENT: Commissioner Mathewson ANNOUNCEMENT CONCERNING TAPE RECORDING IOF MEETING Announcement was made that this meeting of the South San Francisco Planning Commission would be recorded on tape, and that anyone who wished to come before the Commission to be heard is requested to come to the front microphone so that his or her comments become part of the official record. -4027- October 24, 1978 CONTINUED PUBLIC HEARING ITEMS ZA-78-l3 and Negative Declaration No. 190 An application by the City of South San Francisco to consider the creation of an "'R-Eq Rural Estates Zone District for all rural areas located in the unincorporated area of the County bounded by the City of South San Francisco. Secretary Costanzo presented the staff report and Resolution No. 2241 entitled "RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING THAT THE CITY COUNCIL ADOPT THE R-E RURAL ESTATES ZONE DISTRICT AND APPROVE RELATED NEGATIVE DECLARATION NO. 190.11 George Nash 238 Country Club Drive South San Francisco, CA Mr. Nash questioned the density proposed along Alida Way. Secretary Costanzo indicated the General Plan for the area and pointed out that the developed density would set the final density. He further stated that the future land use element could review this area for future concerns. Vice-Chairman Mullin questioned other areas of the City that could possibly be effected. Secretary Costanzo stated that the only parcels that could possibly be effected would be Juckus Ravine on the South Slope of San Bruno Mountain. Commissioner Slade asked about the agricultural lands in the City. Secretary Costanzo replied that the General Plan would dictate all areas within the City 1 i m i ts . Commissioner Slade asked what procedure would be required prior to adoption. SE;ciretary Costanzo explained that after the Resolution is forwarded to the Council, two public hearings are required and it would become law 30 days after the second reading of the proposed Ordinance. Commissioner Slade further expressed his concern regarding the input from adjacent effected property owners. Secretary Costanzo indicated legal notices had been sent out as well as front page coverage in the news media. Commissioner Bertucelli questioned the new streets. -4028- October 24, 1978 Secretary Costanzo indicated it would be the responsibility of the County to improve the streets when annexation occurred~ These costs would be borne by the property owners if the County refused to pay the entire costs. The property owners would be required to pay the costs incurred with providing and installing adequate sewer systems. Vice-Chairman Mullin asked if a non-conforming status would be possible for livestock. Secretary Costanzo answered affirmatively. Chairman Campredon questioned the proposed sewer connections. Secretary Costanzo stated there exist possibly three locations and the sewer systems to his knowledge are adequate. Chairman Campredon further indicated his feeling that the system would not be sufficient. Commissioner Slade stated for the record that theR-E Zone was considered with due publication to all residences and citizens for input. Commissioner Slade motioned that ZA-78-l3, Negative Declaration No. 190 and Resolution No. 2241 be approved and forwarded to the City Council. The motion was passed by a unanimous roll call vote. UP-78-456 and Negative Declaration No. 185 An application by Dino Ropalidis for a Use Permit to construct a dwelling group on developed property located at 317 California Avenue in the R-3 Zone District. Mr. Daniel Christians, Senior Planner, presented the staff report. Mr. Christians indicated the owner had contacted the residents in the house at the rear of the property and has given them three months to relocate. Mr. W. D. Brimhall, Representing Property Owners that Oppose Application 849 West Orange Avenue South San Francisco, CA Mr. Brimhall stated the opposition was based on an increas:e in density of the area, the reduction of open space and the increase of parking problems. Mr. Brimhall went on to say that the privacy would be invaded as well as an increase in traffic congestion. Mr. Christians responded that the proposed density is below that permitted in the R-3 Zone and that the parking had been increased to meet the new parking standards. -4029- October 24, 1978 Standard Condition No. 19 is amended to read as follows: 19. That a six (6) foot high decorative block or slump stone wall or wooden fence shall be constructed along the property lines adjacent to residential zones. Mr. Roy Ghilardi, Chief Building Inspector, indicated that the existing non-conforming structures would remain the same and the insurance rate would not be effected. Commissioner Slade read into the record the letter from applicant to assist in any way necessary in the relocation of the tenants in the rear of the property. Commissioner Bertucelli moved that UP~78-456 and Negative Declaration No. 185 be approved subject to all Standard and Special Conditions with noted change to Special Condition No. 19. Commissioner Mantegani seconded the motion, and it was approved by a unanimous roll call vote. SUBDIVISION AND PARCEL MAPS RPD-78-4 and SA-78-50 and Negative Declaration No. 159 An application by Maurice Brosnan for a Residential Planned Development Permit for the purpose of constructing a 232 unit condominium project on property located on Willow Avenue and north of Graind Avenue in the RPD-40 Zone District. (RPD-78-4 and Negative Declaration No. 159) An application by Maurice Brosnan for a Tentative Parcel Map to subdivide into 22 parcels for the purpose of constructing a 232 unit condominium project on property located east of Willow Avenue and north of Grand Avenue in the RPD-40 Zone District. (SA-78-50 and Negative Declaration No. 159) Commissioner Mantegani stepped down from the podium because of his ownership of adjacent property. Secretary Costanzo presented the staff reports. David Van Atta, Attorney for the Applicant 1 Kaiser Plaza Oakland, CA 94612 Mr. Van Atta reiterated the project concept and the controls of the condo- minium restrictions. He went on to further explain the process involved; funding, phasing, construction sequence and the fact that each phase will stand on its own. He indicated that each phase will be annexed into the Master Association when it is constructed. The Master Association will govern all activities with relationship to the entire project. -4030- October 24, 1978 He further clarified several minor points as stated in the conditions. Secretary Costanzo stated that no occupancy could be granted prior to completion of any individual phase regardless of the bonding money put up. Chairman Campredon questioned the possibility of a phase not being completed. Mr. Van Atta responded that this situation would not occur according to State Real Estate law. Commissioner Slade questioned the facilities for youngsters. Mr. Van Atta stated that an enforceable deed restriction will limit the permitted age group of residents including provisions for infants. Commissioner Slade questioned the City Engineer regarding the dedication of City right~bf-wayat the radius of Grand Avenue thereby reducing the required 20' setback. Vice-Chairman Mullin questioned the City Engineer regarding the traffic conditions at Willow and Grand Avenue currently. Mr. Robert Yee, City Engineer, recognized a problem existed and stated that the applicant's design is a revision to the original proposal eliminating the driveway on Grand Avenue. V'ice-Chairman Mullin continued to question the possibility of installing a signal at Willow and Grand if it is determined to be necessary. Mr. Atta agreed that if it is determined that signalization is necessary, his client will agree to pay a proportionate share. Mr. Yee stated that an agreement should be reached tonight to install a signal if the need arises. Vice-Chairman Mullin further questioned the legal requirement for residents who become pregnant while living in the complex. Mr. Atta explained that since it will be an adult community, there is a law for relocating residents who bear children while residing in this complex; and further if it should be disputed, his client's stipulation (Adult Community) would stand up in court. Secretary Costanzo amended the City Engineer's recommendation by addition of Condition No.4, Page 2, heading "Grand Avenue and Willow Avenue Improve- ments" to read as follows: 4. That prior to the recordation of the Final Map~the developer shall post a bond to assure the installation of traffic signalization at Willow and Grand Avenue. Said bond shall be sufficient to cover not more than 50% of the cost of said signalization based upon the finding of a traffic study to be provided by the City Engineer prior -4031- October 24, 1978 to the completion of Phase 20 or five (5) years whichever occurs first. Commissioner Slade questioned the security of the covered parking structure. Mr. Fred Carelli, Community Relations Officer, said breaking into vehicles would definitely be a problem because of the proximity of the structure to the street and the nature of the enclosed spaces, The Commission concurred to reword Special Condition No.9, paragraph (a) (RPD-78-4) to read as follows: a. Construction shall no't commence on any subsequent phase or phases unless and until the parking, landscaping and open area required for the preceeding phases have been satisfactorilyicompleted or such completion is assured to the satisfaction of the City Planner. The Commission also concurred to add Special Conditions Nos. 11 and 12 to RPD-78-4 to read as follows: 11. That the tennis court shall be lighted and that said lighting shall be automatically turned off at no later than 10:00 p.m. 12. The C.C. & R. 's shall advise the potential purchasers of Units 3. and 14 of the location of the tennis court and the possible effects of lighting. Commissioner Grimes moved that RPD-78-4, SA-78-50 and Negative Declaration No. 159 be approved subject to all recommendations and Standard and Special Conditions. Commissioner Bertucelli seconded the motion, and it was passed by the following roll call vote: AYES: Chairman Campredon, Vice-Chairman Mullin, Commissioners Bertucelli, Slade and Grimes. NOES: None ABSTAIN: Commissioner Mantegani ABSENT: Commissioner Mathewson PM-78-168 and Certified EIR An application by Goldrich Kest & Associates for a Final Parcel Map to create six (6) parcels from one existing on property located on the south- west corner of Westborough Boulevard and El Camino Real in the C-O Zone District. Secretary Costanzo presented the staff report. The Commission concurred that the Final Parcel Map was acceptable. -4032- October 24, 1978 Commissioner Slade moved that PM-78-l68 be approved subject to all recommen- dations and Conditions. Commissioner Mantegani seconded the motion, and it was passed by a unanimous roll call vote. PM-77-l55 and Negative Declaration No. 142 An application by the City of South San Francisco for a Tentative Parcel Map to subdivide and create two (2) parcels on property located at the northeast corner of South Airport Boulevard and Belle Air Road in the M-2 Zone District. Secretary Costanzo presented the staff report. Commissioner Bertucelli questioned the status and the intent of the City regarding the outcome of this map. Secretary Costanzo indicated that a sale or lease arrangement would be executed to the best advantage of the City. Vice-Chairman Mullin moved that PM-77-l55 and Negative Declaration No. 142 be approved subject to all recommendations and conditions. Commissioner Bertucelli seconded the motion, and it was passed by a unanimous roll call vote. COMMUNICATIONS The Commission concurred to set a public hearing date for the regular Planning Commi ss i on Meeti ng of' November 28, 1978 for the fo!ll owi ng items: Ed Brincat - DP-78-338 and Employment Develppment Department - UP-75-325. The Commission concurred to set a public hearing date for the regular Planning Commission Meeting of November 28, 1978 for UP-77-384, 4-Wheel Drive. Mr. John Masio, A Concerned Citizen 912 Linden Avenue South San Francisco, CA 94080 Mr. Masio spoke regarding the violations he has noticed of the Special Conditions imposed on 4-Wheel Drive. He was also concerned about possible violations of the Use Permit of the Mobil Station directly across the street from 4-Wheel Drive. -4033- Octbber24~ 1978 The Commission concurred to set a date for q public hearing for the regular Planning Commission Meeting of November 28, 1978 for UP~349, Mobil Oil Company. It was also requested that a letter advising them of the hearing be sent immediately~ It was so ordered. The Commission requested that the pink building across from the lumber yard at Railroad and Spruce be investigated. It was so noted.
