Secretary Costanzo responded that approval for any improvements would be presented to the Plan- ning Commission. MINUTES OF PREVIOUS MEETING Minutes of the Planning Commission Meeting of August 22, 1978 Commissioner Mathewson moved that the minutes of the regular meeting of the South San Francisco Planning Commission of August 22, 1978, be approved. The motion was seconded by Commissioner Bertucelli, and was passed by the following roll call vote: AYES: Vice-Chairman Mullin, Commissioners Bertucelli, Grimes, Mantegani and Mathewson NOES: None ABSTAIN: Commissioner Slade ABSENT: Chairman Campredon ANNOUNCEMENT CONCERNING TAPE RECORDING OF MEETING Announcement was made that this meeting of the South San Francisco Planning Commission would be recorded on tape, and that anyone who \'Jished to come before the Commission to be heard is requested to come to the front microphone so that his or her comments become part of the official record. -3994- September 12, 1978 CONTINUED PUBLIC HEARING ITEMS UP-77-399 and Certified Negative Declaration No. 122 Peremptory Writ of Mandate for Bocci, Modena, Fulvio & Royce (Funk Application) continued from August 22, 1978, Planning Commission Meeting, to determine whether, based on substantial evide~ce, the proposed removal and rebuilding of the ad- vertising structure at 264 South Airport Boulevard would be detrimental to the general health, safety and welfare of the community. Secretary Costanzo read the Inter-Office Memorandum dated September 12, 1978, to the Planning Commission from Mr. John Noonan, City Attorney, stating that in a letter dated September 8, 1978, from Mr. C. Edward Simpson, Esq., attorney for Ken Funk, that this matter be withdrawn from further consideration; and further that the Commission move to uphold the applicant's request and allow the application to be withdrawn. Based on the amount of work already completed, no fee reimbursement should be considered. The Commission concurred unanimously. RZ-78-50 and Negative Declaration No. 177 (Continued from 8/22/78) An application by the City of South San Francisco to rezone the property located on the northwest corner of the intersection of Grand and Chestnut Avenues from R-l Single-Family and R-3 Multi-family Residential to RPD-40, Residential Planned Development Zone District. RZ-78-5l and Negative Declaration No. 176 (Continued from 8/22/78) An application by Robert Mantegani to rezone the property located on Chestnut Avenue approximately 350' north of Grand Avenue, from R-l Single-Family Residen- tial to RPD, Residential Planned Development Zone District. Commissioner Mantegani stated for the record that he would be abstaining from Items No.2 and 3 as a Commissioner but would be participating as a private citizen Secretary Costanzo presented the staff report indicating, by use of displays pre- pared by staff, the property in question and the adjacent and current land use patterns. Commissioner Mathewson asked Vice-Chairman Mullin to be excused from Items No. 2 and 3. Commissioner Slade questioned staff regarding staff's proposal tonight and how staff intended to accomplish the proposal considering the varied property owners. -3995- September 12, 1978 Secretary Costanzo indicated that this difficulty can only be solved by pro- viding the incentive to owners through an adopted policy of this Commission based on the staff report and the display presented tonight. Mr. Robert Mantegani stated that the property owners in the immediate area have no intention of selling their agricultural land and to develop their properties with residential land uses. Commissioner Bertucelli questioned the width of the street right-of-way. Secretary Costanzo responded by saying that any additional right-of-way to be dedicated to widen this substandard width street would only happen as a result of a specific development request. Commissioner Grimes expressed his concern regarding the period of time the City would have to live with a street width variation along Chestnut Avenue. Secretary Costanzo indicated that no time limit can be established at this time as it would depend on the amount of proposals received for development. Commissioner Bertucelli questioned whether the property owners had been notified. Secretary Costanzo indicated that all property owners had been notified. Commissioner Slade questioned the procedure for future zone changes. He stated that in his opinion the rezoning should be inititated as a positive direction by the City. Commissioner Slade further pointed out that the effected people must be present to be heard before a policy can be established by the City. Secretary Costanzo stated that all actions being taken are legal. Two Resolutions were introduced: Resolution of the City of South San Francisco Planning Commission which shall set forth and establish the density and land use position of the Planning Commission for that area bounded by Grand Avenue, Hillside Boulevard, Chestnut Avenue and the Sunshine Gardens Subdivision; and a Resolution Of the City of South San Fancisco Planning Commission recommending that the City Council approve the rezoning of properties located on the westerly side of Chestnut Avenue and northerly of Grand Avenue from the R-l Single Family, R-2 Duplex Family, R-3 Multi-Family and "U" Unclassified to RPD-40 Residential Planned Development 40 including related Negative Declarations No's. 176 and 177. (RZ-78-50and RZ-78-5l) Commissioner Bertucelli motioned that in accordance with Section 6.63(A) of Ordinance 353, as amended, this application be forwarded to the City Council for immediate action. This motion was approved by the following roll call vote: AYES: Vice-Chairman Mullin, Commissioners Bertucelli, Slade and Grimes NOES: None ABSTAIN: Commissioners Mantegani and Mathewson ABSENT: Chairman Campredon - 3996- September 12, 1978 SUBDIVISION AND PARCEL MAPS AND PUBLIC HEARING ITEMS NO.S 10 & 11 Items No.4, 10 and 11 were presented concurrently to the Commission. PM-78-168 Item No.4 Certified EIR 78-1 An application by Goldrich-Kest & Associates for a Tentative Parcel Map to create 6 parcels from one on property located on the southwest corner of the intersection of Westborough Boulevard and El Camino Real in the 0-0 Commercial Office Zone District. UP-78-453 Item No. 10 Certified EIR An application by Goldrich-Kest & Associates for the construction of a 74 unit senior citizen facility, an 84 unit board and care facility and 11,000 square feet of office space on property located on the southwest corner of the intersection of Westborough Boulevard and El Camino Real in the C-O Commercial Office Zone District. UP-78-455 Item No. 11 An application by Sutter Hill Ltd. for the construction of 26,000 square feet of office/retail buildings and related landscaping, parking and signing on property located on the southwest corner of the intersection of Westborough Boulevard and El Camino Real in the C-OCommercial Office Zone District. Secretary Costanzo presented the staff reports. Proponent: Mr. Steve Notaro, Goldrich Kest & Associates 15233 Ventura Boulevard Ventura, CA Mr. Notaro disagreed with condition No.1 regardingUP-78-453 of the Fire Marshalis recommendation but indicated that an acceptable agreement had been reached with the Fire Department. The recommendation has been modified to read: The Senior Citizens Building shall be sprinklered or provided with additional access and fire protection as required by the Fire Department under the provisions of the Uniform Fire Code, Section 13.301(b) "In occupancies of an especially hazardous nature,. . . or where access for fire apparatus is unduly difficult, additional safeguards may be required. . . Such devices or appliances may consist of . . . automatic sprinkler or water spray systems, standpipe and hose. . . II Mr. Notaro further stated that sufficient access would be provided in the revised Tentative Map to be submitted. Proponent: Mr. Steve Rothert, Sutter Hill Ltd. 3000 El Camino Real Palo Alto, CA Relating to UP-78-455, Mr. Rothert questioned item 11, page 4, regarding retail stores being prohibited as part of this development. ~^^' September 12, 1978 Secretary Costanzo stated that the word discount retail stores had been inad- vertently omitted from this staff report. Vice-Chairman Mullin questioned the Fire Marshal regarding the agreement with the developer with respect to the fire access. Fire Marshal Macquire responded that the agreements have not been formally sub- mitted to his office to date. Secretary Costanzo indicated that some changes should be made to the adjacent land use section of the staff report to more accurately define the existing surrounding land uses. Commissioner Mathewson questioned the staff recommendation from Parks and Recre- tion regarding the removal of trees and the recommendation for denial of PM-78-l68 based on the information received to date. Secretary Costanzo clarified the recommendation of Parks and Recreation by saying that previous maps had mislocated some of the trees on the site. He further read into the record the special condition of both permits pertaining to the successful preservation of all trees to remain on this site. Commissioner Mathewson questioned the request of Sutter Hill Ltd. pertaining to freestanding signs. Secretary Costanzo stated that ~ separate public hearing request would be the procedure for approval of any freestanding signs. Commissioner Slade suggested that on-site parking be required for all tenants for their employees. Secretary Costanzo suggested an additional special condition be added to UP-78-453 and UP-78-455 to provide for on-site parking for all Bank and Savings and Loan employees. Special Condition No. 12 was added to UP-78-453 and Special Condition No. 13 was added to UP-78-455 to read as follows: That all tenants shall provide on-site parking for all of their employees. Mr. Rothert and Mr. Notaro both agreed to the coordinated effort in all colors and materials including roof material for both projects. Commissioner Mathewson questioned the requirements for proper preservation and maintenance of the existing trees. Mr. Robert Yee, City Engineer, clarified his recommendation regarding trench backfilling. Commissioner Mathewson further questioned the requirement for wheel chair ramps on both corners. Mr. Yee responded that only one ramp would be required. Secretary Costanzo indicated on the displays the areas where the slumpstone -3998- September 12, 1978 walls would be located. He further pointed out the fire access gate. Commissioner Mathewson further questioned the finding with regard to signifi- cant adverse effect. Secretary Costanzo responded that sufficient mitigation measures have been ad- dressed through the EIR process to support this finding. Discussion followed with regard to sufficiently screening the existing Water Department pipe along El Camino Real. Commissioner Mathewson followed up on the requirement to cooperate with Cal Trans with regard to extending the left turn lane. t1r. Rothert agreed with the condition and stated he would contact Cal Trans as part of the development. Commissioner Mantegani questioned the board and care arrangement and the in- ternal layout. Mr. ~~otaro stated that the board and care facility vJOuld have a community dining area for serving food to residents prepared in single kitchen arrangement. Commissioner Mathewson commented that he felt a need for an additional board should be set up to deal with possible violations similar in other facilities of this nature. Secretary Costanzo indicated any board would normally be the responsibility of the State or County. Commissioner Slade moved that PM-78-168 and Certified EIR 78-1 be approved with all Special Conditions. Commissioner Bertucelli seconded the motion and it was passed by a unanimous roll call vote. SUBDIVISION AND PARCEL MAPS SA-78-49 and Negative Declaration No. 180 An application by Rodney Catalano for a Tentative Subdivision t1ap to create 5 parcels from one existing on property located at 276 Country Club Drive in the "U" Unclassified Zone District. ":-'" Secretary Costanzo presented the staff report. Proponent: Mr. Rodney Catalano 2268 Westborough Boulevard South San Francisco, CA ;~ 't;;! -3999- September 12, 1978 Mr. Catalano asked for clarification of the extensiveness of the soils report. Mr. Yee, City Engineer, responded that a geological report would be required as needed depending on each property's special soil conditions. Mr. Yee also stated that the hydrology information would be included in the Soil Engineer1s report and that this is a standard requirement for all subdivi- sions. Mr. Yee further clarified the applicant's concerns pertaining to the barricade required and the utility hook-ups. Fire Marshal Maguire explained the recommendation for the need of an additional fire hydrant as requested by his office. Commissioner Mathewson questioned the recent annexation of this property. Secretary Costanzo stated that the annexation is only to the property line on Country Club Drive and does not include the right-of-way. Commissioner Mathewson questioned the validity of this subdivision regarding the proposed Negative Declaration and the significant adverse effect on the surrounding land uses. Secretary Costanzo responded that it is staff1s opinion, based on the initial study prepared in accordance with C.E.Q.A~, that nO significant effect would result from this particular application alone. Commissioner Mathewson questioned the City Engineer regarding the paving and widening of Country Club Drive. Mr. Yee indicated that all improvements on Country Club Drive would fall under the purview of the County. Mr. Roy Ghilardi, Chief Building Inspector, asked the applicant about the septic tank arrangement for the existing house. Mr. Ghilardi stated that the septic tank will have to be filled utilizing an approved method. He also in- dicated easements will be required for all sewage line connections. Commissioner Slade relayed his feelings regarding the piecemeal planning dis- played through the subdivision recommendation for approval tonight. His dis- satisfacti6n was further explained through comments pertaining to a moratorium on building as well as a possibility of a more thorough analysis of this sub- division application. Secretary Costanzo suggested if the Commission agreed, this permit request could be continued until such time as a master plan could be developed, con- sidering the total effect of subdivisions of this nature. Secretary Costanzo further suggested that this request could be amended to only include 4 parcels. Commissioner Mathewson felt that this item should be .brought to the Council for a joint meeting prior to any approval. -4000- September 12, 1978 t~r. Catalano objected to this suggested procedure because of his current time schedule. Secretary Costanzo advised the applicant that he has a 30 day option to purchase the property. Commissioner Slade reiterated his feeling regarding the piecemeal approach here tonight. Commissioner Bertucelli voiced his support of allowing sufficient time to further analyze the entire area. Vice-Chairman Mullin supported the concern of haphazard development, however he could not support a continuance because the City is not ready for development as proposed. Commissioner Slade motioned to coninue SA-78-49 and Negative Declaration No. 180 for 60 days. The moti on was seconded by Commi ssi oner t1athev/son and was passed by the following roll call vote: AYES: Commissioners Bertucelli, Slade, t1athewson and Grimes NOES: Commissioner Mantegani and Vice-Chairman Mullin ABSTAIN: None ABSENT: Chairman Campredon The Commission agreed that despite the late hour (11:20 p.m.) they would consider further items. Pt.1-78- 169 and Negative Declaration No. 182 An application by Ronald and Roberta Sciandri for a Tentative Parcel t1ap to create 3 parcels from two existing on property located at the northeast corner of the intersection of ~Iillside Boulevard and North Spruce Avenue in the C-3 Heavy Commercial and RPD-6 Residential Planned Development Zone District. The Commission concurred to proceed in the absence of the applicant because one property owner involved herein was present. Staff presented the staff report. Commissioner Bertucelli moved that PM-78-l69 and Negative Declaration No. 182 be approved with all Special Conditions. Commissioner Mantegani seconded the motion and it was passed by a unanimous roll call vote. -4001- September 12, 1979 The Commission agreed to hear Item No~ 13 next. PUBLIC HEARING ITEM NO. 13 V-78-2l5 Categorical Exemption An application by Robert and Karen Shannon for an encroachment into the re- quired rear yard setback an average distance of 4.1 feet to permit an addition to the existing single family residence located at 401 Forest View Drive in the R-l Single-family Zone District. Daniel Christians, Senior Planner, presented the staff report. The applicant agreed to all Standard and Special Conditions. Commissioner Mathewson moved that V-78-215 and Categorical Exemption be ap- proved with all special and standard conditions. Commissioner Slade seconded the motion and it was passed by a unanimous roll call vote. SUBDIVISION AND PARCEL MAPS Nos. 7 and 8 PM-78-170 and Negative Declaration No. 183 An application by Louis Arata for Armanino & Collamer Assoc. for a Tentative Parcel Map to create 2 parcels from one existing on property located on Mission Road at Sequoia Avenue in the \lU" Unclassified Zone District. Secretary Costanzo presented the staff report. The applicant agreed with all recommendations and special conditions. Commissioner Bertucelli moved that PM~78-l70 and Negative Declaration No. 183 be approved with all recommendations and special conditions. Commissioner Mathewson seconded the motion and it was passed bya unanimous roll call vote. PM-78-l71 and Negative Declaration No. 184 An application by Clay Development Co. for a Tentative Parcel Map to create 3 parcels from one existing on property located on the northeast side of South Airport Boulevard adjacent and directly east of the Bayshore Freeway in the M-2 Zone District. The applicant agreed with all recommendations and special conditions. Commissioner Mathewson moved that PM-78-l7l and Negative Declaration No. 184 be approved with all recommendations and special conditions. Commissioner Mantegani seconded the motion and it was passed bya unanimous roll call vote. -4002- September 12, 1978 SUBDIVISION AND PARCEL MAPS AND PUBLIC HEARING ITEM NOS. 9 & 14 These items were heard concurrently. PM-78-l73 & Categorical Exemption An application by Gene Tognela for a Tentative Parcel Map for a minor lot line adjustment on developed property located at the southwest corner of Miller Avenue and Magnolia Avenue in the R-3 Zone District. V-78-2l7 & Categorical Exemption An application by Louis Arata for a variance from the requirements of Ordinance 603 in conjunction with the resubdivision of developed proper~ located at 601 and 605 Miller Avenue and 313 Magnolia Avenue in the R-3 Multi-family Zone District. Staff presented the staff reports for both items. The Commission added Special Condition No.5 to both items which reads as follows: 5. That the property owner shall maintain a 61 minimum open clear separation easement between the two dwellings from Miller Avenue to the rear of structures for fire access purposes. The applicants agreed to all recommendations and special conditions. Commissioner Mathewson moved that PM-78-l73 and Categorical Exemption and V-78-2l7 and Categorical Exemption be approved with all recommendations and special conditions. Commissioner Bertucelli seconded the motion and it was passed by a unanimous roll call vote. V-78-216 & Categorical Exemption An application by Steve and Kathleen Coccellato for an encroachment into the required rear yard setback an average distance of 4.5 feet to permit an addition to the existing single family structure on property located at 342 Rockwood Drive in the R-l Single-Family Zone District. Staff presented the staff report and based on this report the Commission agreed that V-78-2l6 and Categorical Exemption be voided; no further action will be necessary. -dnn~- September 12, 1978 The Commission, in unanimous agreement, requested that Items No. 15 and 16 on tonight's agenda be continued. Item No. 15 - Continued to regular Planning Commission Meeting of September 26, 1978. RPD-78-7 (On-going Project) - An application by The Housing Authority of the City of South San Francisco to construct a 40 unit residential complex including landscaping, parking, and related improvements to complete the existing complex located on property at the terminus of "C11 Street in the RPD-10 Zone District. Item No. 16 - Continued to regular Planning Commission Meeting of October 10, 1978. RZ-78-47 and Negative Declaration No. 181 - An application by Tim Brosnan to rezone the property located at 362 Alida Way, from "U" Unclassified to R-3 Multi-family Zone District. REPORTS The Planning Commission moved to set a date for a public hearing on an applica- tion for a Zoning Amendment (ZA-78-l3) Rural Estates. The Commission concurred to set the date for the regular Planning Commission Meeting of September 26, 1978. The Planning Commission agreed to hear further discussion on the Hillside Boulevard Extension Project and set a date for this hearing for the regular Planning Commission Meeting of September 26, 1978. COMMUNICATIONS Commissioner Mathewson advised the Commission that he would be on vacation during the last meeting of October 1978. The Commission was advised that Chairman Campredonwould also be on vacation during the month of October 1978. The Commission requested that a new address and phone number list be made for all Commissioners. Commissioner Bertucelli questioned the status of Carlos Flores' variance. Secretary Costanzo indicated that the City Attorney was working with the appli- cant to aid in correcting the zoning violations. -4004- September 12, 1978 Commissioner Grimes asked why the repairs have not been completed on South Spruce Avenue; ,the street has been torn up for a long length of time. The Commission also requested that the Use Permit of Orowheat Bakery be in- vestigated in relation to noise violation (unloading of trucks at 3:00 a.m.), screening on silos, and trees not being planted. GOOD AND WELFARE There being nothing to discuss under Good and Welfare of matters of interest for the Commission, Vice-Chairman Mullin announced that the next regular meet- ing of the Planning Commission would be held on September 26, 1978, at 7:30 p.m. in the West Orange Library Auditorium.
