Yee Building Division H. J. Wittwer Pledge of Allegiance APPROVAL OF MINUTES: Motion-BertucellijSecond Hoyer: To approve the minutes of the February 11, 1982 Meeting as presented. Approved by voice vote. Commissioner Mantegani abstained. ORAL CDMIVIUNI CATIONS Commissioner Grtmes inquired about the Telephone Company parking on Huntington Avenue and the noise problems at the Oroweat Bakery. Mr. Gorny advised Ccmnissioner Grimes that he had corrmunicated with the Telephone Company and was advised. that the "~loyees Only" sign had been removed from the Parking Lot. The Telephone Company representative also advised him that there were now 55 parking spaces for Employees and the public on the site. Commissioner Grimes requested that Staff have the Con~any post a sign indicating a separate "Customer Parking" area on the site. Commissioner Grimes noted that a buzzing noise is still continuing at the Oroweat Bakery. Hr. Gorny was directed to contact the Company and attempt to have this noise problem reduced. CDNSENT CALENDAR Rich Diodati, PM-81-193 A Final Parcel Map to create 4 parcels located on 52.8 acres of land at the terminus of Oyster Point Blvd. in the ~1~2 Heavy Industrial Zone District. C. C. Celestre, TJP-80-550 A one (1) year tTIne extension to begin construction of a 4 story mixed use structure at 305-307 Spruce Avenue. - 4429 - March 11, 1982 mNSENTCALENDAR (Continued) Budget Rent-A-CarjPM-80~185 Request by the applicant for a six-month time extension to complete and record Parcel Map PM-80-185. Mr. Gorny read the above 3 items into the record. Mr. Yee advised the Commission that he was not aware of the Budget-Rent-A-Car time extension. He said that he had no objection to the time extension. He noted that a 10' storm drainage easement was required to be dedicated to the City over the site. 11r. Dell'Angela asked that action on this item be continued by the Commission to the 4j8j82 Meeting in order to provide time for the applicant to meet with the City Engineer to resolve the easement q11estion. By unanimous voice vote the Carmission continued PM-80-185 to the Meeting of April 8, 1982. Motion-ManteganijSecond Hoyer: To approve PM-81-193 and UP-80-550 on the Consent Calendar. Unanimously approved. Commissioner Getz abstained from voting on PM~81-193. Unanimously approved. - 4430 - March 11, 1982 AGENDA IT~1S (Cont inued) Kirk Lassiter, 1JP-81"':'609 Use Permit to establish an auto repair, auto body and paint pr~lng facility in an existing building at 612 Cypress Avenue in the C-3 Heavy Commercial Zone District. March 11, 1982 Staff Report presented. Applicant Present: Kirk Lassiter San Bruno Staff recommended that the Commission continue this Item to the April 8, 1982 Meeting to allow the applicant additional time to submit necessary documents. The applicant, Kirt Lassiter asked. to speak at this Hearing. Comnissioner Getz raised a point of order. He noted that since the Staff Report indicated that this iteillwas to be continued to April 8, 1982, no testimony should be allowed at this meeting. Chairman Martin advised ~1r. Lassiter that the Commission would not hear test~ony from him on this application. He asked Mr. Lassiter to present the necessary parking plan and covenant to Staff so that Staff could present their recommendations to the Commission at the April 8, 1982 Meeting. Motion-GetzjSecond Grimes: To continue this item to the April 8, 1982 Meeting based on information contained in the Staff Report. Unanirrously approved. Dan Thurston, V-82-255, UP-82-615 and Negative Declaration 'No. 355 A variance from Section 20.52.110,narking in required yard space, and Section 20.72.070 of the Municipal Code for a detached carport structure occupying rrore than 30% of the required yard setback area. Variance filed in conjunction with a Use Permit application to construct a 20 unit residential condominium project at the southeast corner of Mission Road and Oak Avenue. March 11, 1982 Staff Report$ presented. Applicant's Representative Present: Neil Vannucci 1555 Bayshore Highway Burlingame Speaking on the Project: J ames Fullman 2700 Junipero Serra Blvd. Daly City Applicant's representative stated he was in agreement with all of the conditions of approval. - 4431 - March 11, 1982 AGENDA ITMES (Continued) Mr. Fullman advised the Commission that he owned the 12 unit apartment building on Oak Street next to the Church. He was concerned with the building height of the proposed proj ect . Since he had seen the proposed plans " he had no objection to the project since the proposed buildings would not obstruct the view in his apartments. He noted noise generated at Santo Christo Hall and the loose gravel on the parking lot of the Hall which has been thrown into windows of his apartment canple:x. Corrmissioner Getz questioned the findings on' the Variance application. In order to be more specific the following was added: To Finding No. 1 the following sentence was added: 1lThis is based on the differential in grade from property located to the north." To Finding No. 2 the following was added . . . accomplish this purpose "and further" open space and land.scaping is provided as mitigation." . Corrmissioner Grimes questioned Hr. Yee aoout the location of deep water wells on this site. Mr. Yee advised Commissioner Grimes that there were at least 2 or 3 wells on the site. Mr. Yee said that a condition could be imposed whereby the applicant would be required to submit a soils and geological report to include a well location map. Mr. Vannucci had no objection to the addition of such a condition. Special Condition No.9 was added as follows: "9. The applicant shall identify the location of all water wells on the site and shall submit this information to the Director of Public Services for review." Commissioner Getz raised the question about the project being in a flood zone. Mr. Vannucci advised the Corrmission that the living floor units will be above the flood level. Commissioner Getz was concerned aoout the City's liability in the event of a flood and requested that the City Attorney review the flood liability issue related to this project. The following Special Condition No. 10 was added: "10. The City Attorney shall consider whether there should be disclosure to prospective buyers of the units of the floodplain area designation" through a notice on the final subdivision map and/or a statement in the Conditions, Covenants, and Restrictions for this project." Commissioner Terry was concerned that the guest parking provided in this project might be used by persons attending a function at the Santo Christo Hall. He suggested a sign be posted to insure proper use of the guest parking. Special Condition No. 11 was added as follows: - 4432 - March 11, 1982 AGENDA ITEMS (Continued) "11. The applicant shall place a small sign at the driveway entrancej exit stating "Resident and Guest Parking Only." Motion-GetzjSecond Grimes: To approve V-82":'255 and Negative Declaration No. 355, with amended findings, subject to all conditions contained in the Staff Report. Unanimously approved. Motion-GetzjSecond Grimes: To approve UP-82-615 and Negative Declaration No. 355 based on findings and ffilbject to all conditions, including added conditions, contained in the Staff Report. Unanimously approved. Shamiana, Inc., UP-81-604, Negative Declaration No. '340 A Use Permit to establish a firm for the manufacturing of upholstered foam furniture and decorative pillows located in an existing structure at 523 Mayfair Avenue. March 11, 1982 Staff Report presented. Staff ad.vised the Conmission that the applicant " by telephone, had withdrawn this application. Motion-ManteganijSecond Getz: To continue this item to the meeting of April 8, 1982 in order to allow the applicant time to submit a formal letter of wi thdrawal . Unanimously approved. Basque Cultural Center,UP-79-514 Modification of conditions of approval for Use Permit UP-79-514 - Deletion of Special Condition 4 in order to allow the restaurant and lounge in the Center to be open to the public. March 11, 1982 Staff Report presented. Applicant Present: Jean Gorostiague Burlingame There was a discussion about the hours of operation for the restaurantjlounge. The following Special Condition No. 4d wa_s added: "4d~ Hours of operation of the restaurantjlounge for public use shall be: Sunday - Thursday - 7 A.M. - 12 Midnight Friday and Saturday - 7 A.M. - 1:30 A.M." - 4433 - March 11, 1982 AGENDA ITEMS (Continued) Because of various concerns with parking, traffic, noise, etc., the following Special Condition 4e was added: "4e. There shall be a review of this modification to the Use PeImi t by the Planning Commission in one (1) year. (March 1983)." Amendment of Planning Commission By-Laws - Election of Officers Article III, Section 1 and Section 2, paragraph 2 of the Rules and By-Laws of the South San Francisco Planning Commission. March 11, 1982 Staff Report presented. Motion-Hoyer: To amend said by'-laws to provide that the election of the Planning Commission officers be held on the second Thursday of January each year. Approved by unanimous voice vote. ITEMS FROM STAFF Mr. Gorny advised the Commission that the ABAG Housing Needs report was included in their packet for information. This Repor~ will be disclJSsedat Council Meeting of March 17, 1982. Mr. Dell'Angelaposed a policy question to the Commission in regard to RPD-81- 25, Milan Jurkota, a 6-uni t project at III Chestnut Avenue. ~1r. Jurkota was requesting a modification of one of the conditions of ~pproval relating to the existing building being demolished or renovated prior to the construction of the new buildings. Mr. Jurkota resides in the existing building and wished to do the work on this building last so that he could continue to live in it. Commission stated. they had no objection to this as long as a bond was posted. ITEMS FROM COMMISSION Vice-Chairman Hoyer asked Staff to request the owners of Santo Christo Hall to pave their parking lot. Mr. Dell'Angela advised the Corrmission that Staff could request this but had no jurisdiction to enforce such a request. Commissioner Grimes said he had taken photographs of the Treasury: property during the recent rainstorms ?and the lot was flooded. Staff advised Commissioner Grimes that drainage improvements were one of the conditions of approval for this project. The Planning Commission Meeting of March 25, 1982 was cancelled by the Commission. Staff advised the Commission that it was their recommendation to hold a Study Session on the General Plan Update at the second Meeting in April (April 22 , 1982). - 4434 - March 11, 1982 ITEMS FROM COMMISSION (Continued) Commissioner Getz commented that the traffic to be generated by the new McDonald's Restaurant on Westborough was going to be a serious problem. It was dB~cideQ' that he and Chairman Martin would meet with Mr. Yee to :discuss this traffic problem. Commissioner Mantegani asked Mr. Yee if there would be any way to synchronize the traffic signal at Antoinette Lane and Chestnut so that the traffic would not back up on Chestnut. J\ilr.
