Commissioner Agee disagrees with Design Review Board as to the color of the building. Vice-Chair Wendler disagreed with overall design as approved by Design Review Board. Motion-Hoyer/Second-Martin: To approve UP-85-725 and Negative Declaration No. 502, based on findings and subject to all conditions contained in the Staff Report. Terri Lynn Bullis (Roberto Sanchez, Owner) UP-85'-727, Negative Declaration No. 508 Use Permit to establish a pet grooming business at 209 San Felip Avenue in the C-l Neighborhood Commercial Zone District. Continued from May 9, 1985 Planning Commission Meeting. May 23, 1985 Staff Report presented. Applicant Present: Terri Lynn Bullis 24 Los Flores Applicant stated she had spoken with Vice Mayor Roberta Teglia regarding this application. Ms. Bullis requested that Saturday be included in the hours of operation. She would like to open around 11 a.m. or 11:30 a.m. so as not to disturb the neighbors. Planning Director Smith stated that, at the last meeting, two (2) other persons spoke in favor of Ms. Bullis, plus two (2) telephone calls also were received in favor of Applicant. The Planning Commission expressed concern that permit did not conform to the zoning ordinance for C-l, nor the General Plan. Also, concern was voiced as to present applicant eventually selling out, if zoning should be changed to allow pet grooming business, with new owners not as cooperative or ac- commodating. Planning Director Smith noted that if Commissioners agreed regarding this business as not too intense a use, a change in the zoning law would still be required. -1445 - AGENDA ITEMS (PUBLIC HEARINGS) (Continued) May 23, 1985 City Attorney Rogers stated a real estate office and a pharmacy now coexist in this same building. Also, this pet grooming business would not be a continuation of a pre-existing, lawful, nonconforming use; the use had lapsed, for six (6) months. He further stated that the only solution was a General Plan and zoning amendment. Motion - Martin/Second - Boblitt: To deny UP-85-727, based on findings contained in Staff Report. Unanimously approved. Loyd Arnold, PC Mod-85-7 Planned Community modification to allow a 168 square foot room addition, already constructed, to the existing residence at 3619 Baldwin Hills Court in the PC Planned Community Zone District. Applicant present: Loyd Arnold 3619 Baldwin Hills Court Applicant Arnold stated his materials and design relate properly to his building and stated no complaints had been received by him from his neighbors. Mr. Arnold requested that, should his request for approval be denied, he be given ninety (90) days to remove subject addition. Mot ion- Hoyer/Second - Wendler: To deny PC Mod-85-7, based on findings in the Staff Report and to allow a ninety (90) day removal period. Unanimously approved. Pen-Service Corporation, UP-85-716, SA-85-88, Negative Declaration No. 489 Use Permit and Tentative Subdivision Map to create fifty-four (54) townhome lots and corrmon open space, related parking and landscaping on the west side of Galway Drive between Westborough Boulevard and Greendale Drive in the P-C Planned Community Zone District. Continued from meeting of April 25, 1985. At the Applicant's request, this item was continued to the June 13, 1985 meeting. Motion - Hoyer/Second - Boblitt: To continue UP-85-716 and SA-85-88 to the June 13, 1985 meeting. Unanimously approved. May 23, 1985 Staff Report presented. Applicant Present: Jack Myhill 150 Golden Gate Avenue San Francisco Applicant stated this game room will be used only by patrons purchasing tickets to attend one of the movies in the complex. It is presently posted that under-eighteen-year-olds cannot attend during school hours, nor after certain hours on weeknights, including Sundays. Room will be under constant supervision at all times. Motion - Wendler/Second - Hoyer: To approve ZA-85-31 and Negative Declara- tion No. 506, based on the findings contained in the Staff Report. Ayes: Terry, Wendler, Agee, Hoyer and Martin. Syufy Enterprises, UP-84-688/Mod I, Negative Declaration No. 448 (Amended) Use Permit rrodification to allow an amusement arcade in a theatre building and accessible only to theatre patrons at 410 Noor Avenue in the PCM Planned Commercial and Limited Industrial Zone District. May 23, 1985 Staff Report presented. Applicant Present: Jack Myhill 150 Golden Gate Avenue San Francisco The Applicant stated that a theatre employee or security guard would be within sight of game room at all times. Vice Chair Wendler commended the Police Department for very excellent re- searching being accomplished. Chairman Terry reminded Applicant that, since their policy is to move machines in from different locations, a new permit must be obtained each time a new machine is brought in, and, that the City will be inspecting them by machine serial number. Chairman Terry further expressed concern that no remuneration is to be made from the machines. Motion - Martin/Second - Wendler: Approval of UP-84-688/Mod I and Amended Mitigated Negative Declaration No. 448 with conditions and findings as specified. Callan 82 Isabella Atherton Applic8nt's Representative Present: John Callan 595 John Muir Drive, Apt.#624 San Francisco Applicant's Planner Present: Tom Vlasic Vice-President, William Spangle & Associates 3240 Alpine Road Portola Valley Applicant's Architect Present: Gary Gregson 17992 Central South Irvine Applicant's Civil Engineer Present: Theodore Tronoff 345 Park Plaza Drive Daly City Mr. Vlasic stated that meetings had been held on all City concerns re- garding map and final building plans. Also, a meeting room will be put in Carter Park II with use available to residents of both Carter Parks I and II. Applicant Callan has opted to incorporate the additional parcel to allow the propo ed fifty (50) units. In addition, other issues had been resolved ard to Police and Building Department memorandums. Mr. Vlasic state his understanding that the City has received the Division of Mines ology letter giving clearance on the project as designed inasmuch erns over the fault setback and geotechnical requirements had solved. He requested that, although Staff Report AGENDA ITEMS (PUBLIC HEARINGS) (Continued) May 23, 1985 asks for a further continuance of this project, that this public hearing be concluded tonight and action be taken. They have no problem with the new conditions handed them tonight regarding earthquake insurance. Architect Gregson explained the design details of the projects, including a meeting room, to be called "Grand Pavillion". An exterior color board was provided the Commission for viewing. Civil Engineer Tronoff stated, in Carter Park II, the intent is to construct Phase I, then II, then II~ ; Phase IV will be separated from the finished areas with a construction fence for security and safety. Commissioner Agee's conTnent was addressed by Mr. Callan that Carter Park I would be completed in two (2) phases, twenty-five (25) units, and that Carter Park II would be in four (4) phases, twenty-one (21) units, four (4) complexes. Mr. Tronoff stated that almost everyone will have underground parking spaces in Carter Park II. The Commission discussed possible difficulties arising regarding parking spaces, as to availability of "large car" size spaces, compact spaces, and SruTIe being tied into a deed. Commissioner Boblitt expressed concern that compact car owners do not always utilize the specified "compact cars only" spaces. Commissioner Agee urged that a separate deed be issued each resi- dent, making sure document regarding parking specifications be made ab- solutely clear. Speaking Against The Project: Jeanette Vasheresse 3880 Carter Drive Ms. Vasheresse expressed her concerns regarding traffic, density, and landscaping. Speaking Against The Project: Gunther Bauer 3144 Dublin Court Mr. Bauer reiterated Ms. Vasheresse's concern regarding traffic impact, also commenting that the homeowner's associations on the west side of Highway 280 should have been notified of this proposed project. Planner Morton stated that all homeowner's associations within the legal 300 foot radius area had been so notified. City Engineer Yee stated that whatever the Westborough County Water District requires will be fine with him; Westborough will be making its own water requirements. Fire Marshal Lagomarsino stated his department is satisfied with the project as proposed. Commissioner Martin reminded Ms. Vasheresse that notices are sent to the homeowner's association, and, that there have been many public meetings on the General Plan and density issue. - 1449 - AGENDA ITEMS (PUBLIC HEARINGS) (Continued) May 23, 1985 Commissioner Agee expressed concern that resident's upkeep and homeowner's fees would be levied on the earlier buyers to a larger percentage, for an undetermined amount of time, until all units were finished and sold. Mr. Callan stated that over fifty percent (50%) of the units must be sold before the first resident may move in; also, that different phases existed for paying this fee. With regard to query by Commissioner Hoyer, Planning Director Smith re- plied that Staff had no objections to making a decision on this project this evening, and, that other questions would be tended to by the City Council. Commissioner Agee stated she felt the phasing was "excessive", reiter- ated concerns for early tenant's paying heavier fees for landscaping maintenance. Motion - Hoyer/Second - Martin: To approve UP-85-723, based on the follow- ing findings and subject to the conditions contained in the Staff Report and the following additional conditions: 1. The proposed project is consistent with the High Density Resi- dential designation of the City's General Plan. With the incor- poration of the 0.091 acre piece into the project, the project density will conform to that which is permitted in the General Plan. 2. The porposed project is consistent with the provisions of the PC-R3 Zoning District and the Westborough-West Park Planned Community District sections of Title 20 of the South San Francisco 1funicipal Code. Except for designating parking in a set back area, for which a variance has been granted, the project complies with the standards established in the Zoning Ordinance. 3. A Negative Declaration has been prepared in accordance with the California Environmental Quality Act, as amended. Negative Declara- tion No. 504 was approved on May 9, 1985. 4. The project is consistent with the provisions of the City-wide Interim Ordinance No. 962 and the PC-R3 zone district is consistent with the High Density Residential General Plan Designation. 5. The use will not be adverse to the health, safety or general welfare of the community nor detrim~ntal to the surrounding properties and improvements. This is an "in-fill" project with a density con- sistent with the General Plan. Additional Special Conditions 10. The 0.091 acre piece of land adjacent to this project shall be incorporated into this project. The site and landscape plans shall be reviewed by the Design Review Board and approved by the Planning Division. - 1450 - AGENDA ITEMS (PUBLIC HEARINGS) (Continued) May 23, 1985 11. The CC&R's for the project shall require that the Homeowner's Association will maintain earthquake insurance for the replacement costs of the project in perpetuity. Said insurance shall contain a provision that such insurance shall not be reduced or cancelled ex~ cept upon thirty (30) days written notice to the City of South San Francisco. Evidence of the insurance described above shall be provided to the City of South San Francisco prior to the issuance of any occupancy permit, either temporary or permanent, for the project and shall be subject to the approval of the City Attorney as to form, amount and carrier. 12. The outside parking spaces shall be limited strictly to passenger vehicles, with the exception that housecars (as defined in the State Vehicle Code) are prohibited. These restrictions shall be reflected in the CC&Rts. Unanimously approved. Motion - Hoyer/Second - Martin: Recommend that the City Council approve Tentative Map No. SA-85-89, based on the following findings and subject to the conditions contained in the Staff Report and the additional follow- ing conditions: 1. The Tentative Subdivision Map is consistent with the General Plan of the City of South San Francisco. The map will accomodate a high density residential project consistent with the designation. 2. The site is physically suitable for this type and density of development. This is an "in-fill" project. 3. The design of the Subdivision Map and improvements are not likely to cause substantial environmental damage or injury to fish and wildlife, nor serious public health problems. A Negative Declaration was approved on May 9, 1985. 4. The design and improvements of the Subdivision Map are not in conflict with any existing public easements. 5. The discharge of waste from the proposed project into the existing Westborough County Water District sewer system would not result in a violation of existing requirements prescribed by the California Regional Water Quality Control Board pursuant to Division 7 of the State of California Water Code. The District has supplied evidence that it can service this project. 6. The Tentative Subdivision Map complies with the requirements of Title 19 (Subdivision Ordinance) of the Municipal Code of South San Francisco and with the requirements of the State Subdivision Map Act. 7. The Tentative Map is consistent with the PC-R3 Zone District. A residential planned development is permitted with a Use Permit. - 1451 - AGENDA ITEMS (PUBLIC HEARINGS) (Continued) May 23, 1985 8. The PC-R3 Zone District is consistent with the High Density Residential designation for this site. 9. Variation of the standard requiring that all lots abut on a dedicated street (South San Francisco Municipal Code Section 19.16.110) are pennitted with approval of UP-85-723 for the residential planned unit development, as per South San Francisco Municipal Code Section 19.16.240. Ingress and egress is provided by an easement over the corrmon area. . Additional Special Condition 6. The map shall be revised to include the adjacent 0.091 acre parcel as common area. 7. The CC&R's for the project shall require that the Homeowner's Association will maintain earthquake insurance for the replacement costs of the project in perpetuity. Said insurance shall contain a provision that such insurance shall not be reduced or cancelled except upon thirty (30) days written notice to the City of South San Francisco. Evidence of the insurance described above shall be provided to the City of South San Francisco prior to the issuance of any occupancy permit, either temporary or permanent, for the project and shall be subject to the approval of the City Attorney as to fonn, amount and carrier. Unanimously approved. Motion - Hoyer/Second - Wendler: To approve'UP-85-724, based on the following findings and subject to the conditions contained in the Staff Report and the additional following conditions: 1. The proposed project is consistent with the City's General Plan. The High Density Designation allows projects with a density of thirty (30) units per net acre. 2. The proposed project is consistent with the provisions of the PC-R3 Zoning District and the Westborough-West Park Planned Community District sections of Title 20 of the South San Francisco Municipal Code. Except for designating parking in a set back area, for which a variance has been granted, the project complies with the standards established in the Zoning Ordinance. 3. ITEMS FROM STAFF In response to Vice Chair Wendler, Planning Director Smith stated there are two (2) new planners, both consulting and working for the City half- time: Lida Budko and Robert Schubert. - 1454 - ITEMS FROM STAFF (Continued) May 23, 1985 In response to Planning Director Smith's request for Commission input as to suitable date for a seminar/workshop with dinner between Commissioners and Planning Division staff, Friday, June 14, 1985 was decided upon, hours to be approximately 1 p.m. to 7:30 p.m. or 8 p.m. ITEMS FROM THE CDMMISSION Chairman Terry expressed concerns over a tank on the service station on Chestnut Avenue adjacent to Ron Price. Commissioner Hoyer stated his belief that a membership club, such as the Price Club, .is discriminatory. Chairman Terry stated the Police Department believes this insures security in check cashing.
