I would like to know if The Council of SSF has put any thought into having SSFUSD
cut ties with SSFPD? Or any type of action taken with defunding SSFPD? There
needs to be some type of reform in our city. I personally believe that we need to
defund the police force & this community needs to allocate those funds to better
resources such as youth development, hospitals, housing development, homeless
services & mental health/social workers. The police officers are getting a large
amount of our city’s money when we need funding to help the people who
actually need it. We all need to admit that crimes are committed mainly because
of poverty, lack of education, mental illnesses and other systemic issues. We
don’t need more police, we need more jobs, education opportunities, updated
community centers and programs to help our youth. Also, not just defunding the
police force but also making the hiring process much different. The police should
be trained to exhaust all their options before drawing their guns, trained how to
de-escalate the situation and focus on firing their gun as little as possible and they
should be psychologically evaluated before receiving a position in the force. There
needs to be some type of policy that allows a trained & unarmed professional to
respond to calls for help on noncriminal matters that involve mental health, the
homeless, school discipline and neighbor disputes -instead of sending the police.
This needs to happen because the police are murdering innocent people, like 15-
year-old Derrick Gaines: who was shot & killed by SSFPD. He was a child. The
situation could have been handled much differently and he would still be alive,
had the police officer who killed him been more trained to handle and de-escalate
the situation. Something needs to be done and we are depending on the council
of this city to make sure we are ALL taken care of as a community, equally.
I would also like to know what will be going on with the school district while
COVID-19 is spreading? Is there any plan of when school will start and what will
be the new schedule?

City Councilmembers,
My name is Edward Holman and I am a 3rd generation South San Franciscan. My family
moved here in 1962 and bought a house in the Winston Manor neighborhood, something a
working class family could still accomplish at that time. The year before, 1961, the city of
SSF built El Camino High School, a brand new public school. This was a huge investment
of our tax dollars into an institution to empower our middle and working class families with a
quality education.
Unfortunately, today it seems that the leaders of our city have lost sight of what our
priorities are as a community. Budget after budget has led to increases in the amount of
money we spend on our police department. While at the same time, our teachers have to
buy supplies for their own classrooms and can't even afford to live in the area. Year after
year our public schools face brutal turnover as talented teachers leave the area because
we don't pay them enough.
Today I call on you to have the courage to challenge your beliefs on the nature of policing
in SSF. I'll be honest, until 2 weeks ago I considered "defunding the police" as an absurd
idea. But I took an active effort to apply new information around the social cost of
criminalizing and punishing people instead of finding ways to invest in their empowerment
and restoration. Why have we decided that we must severely punish people after they have
made a mistake? Instead of giving them the support so that they do not turn to crime in the
first place? Have you never made a mistake in your life?
I call on you to step out of your shoes as city councilmembers and step into the shoes of
our marginalized, black & brown community in the East side of SSF. Listen to their stories
of police harassment and feel their generational trauma caused by the destruction of
families through our quick to punish criminal justice system. Have some empathy and have
the courage to believe "maybe my beliefs are not correct."
Imagine a South San Francisco where people do not turn to crime because they are
uplifted by their community instead of punished! Imagine if working class families didn't
have to work all hours of the day because they had rental support, their children would
have the watchful and nurturing care of a parent who isn't constantly stricken with the terror
of homelessness. Imagine a SSF where our schools have counselors to help our children
who have experienced serious trauma, healing their wounds, instead of a police officer on
school grounds who puts fear into their hearts.
Have the courage to make bold changes in our community! We never elected you all to sit
comfortably and lament that the circumstances are too complicated, as you spin your
wheels on discussions people are hurting, people are losing their homes, people are falling
into a system that you all have admitted is flawed.
So I want to know: Who or what do you stand for? Do you stand for a broken criminal
justice system and a skeletal community empowerment program? Do you stand solely for
the 118 police employees whos salaries you have deemed sacrosanct? Of which only 15
are SSF residents. Do you really want to tie your legacy to the defense of a system you
have admitted is broken and doing wrong to the residents of South San Francisco?
Find your courage councilmembers, find it or get out of the way so we, the residents of SSF
can do what is necessary to make our community what it always should have been.

South San Francisco City Council,
Given the level of national and statewide progress and current developments around defunding
police departments and reallocating and reinvesting funding into social services, healthcare,
childcare, education and related community-based services, I urge you to take immediate
action on revisiting your budget accordingly. NY, LA, SF and various local school districts
and cities here across the Bay Area have taken these steps. As a major city in San Mateo
County with the potential to produce leadership in our communities, the move to maintain and
increase funding for the police in light of this movement and policy progress is both
disappointing and says a lot about where SSF is poised to stand at this point in larger civil
rights movement and community development in North County. Now would be the time to
seriously reconsider your actions and do the right thing.

I wanted to express my support for Assembly Bill 2054. The C.R.I.S.E.S. act recognizes the
need for mental health first responders to better deal with mental crisis than having police
officers to do so due to their lack of proper training. There is growing data that shows this.
Having the city council pass a resolution expressing support for this state bill would help
efforts in ensuring the safety and health of our community and in California. We have to
rethink the way we respond to different problems in our community. Pass a resolution that
supports this bill.

Dear Council Members,
I hope my message finds your close ones and you all well and in good health.
I understand that all of you, in your capacity as City Council members, have been presented
with a resolution that would have the City of South San Francisco support AB 2054, also
known as the CRISES Act.
The CRISES Act is a proposed piece of state legislation written by California Assembly
Member Kamlager, and calls for the formation of an 11-member advisory committee, which
would be tasked with criteria for grant applications, and subsequently select which
organizations would taken the responsibility of developing first response strategies for calls
regarding homelessness, mental health, domestic abuse, etc. You can read more here:

SSF City Council’s passage of a resolution in support of the CRISES Act would not cost SSF
any money, and would support the provision of state funds to help save lives. More
importantly though, such a resolution could help save lives, as well as all kinds of emotional
and other costs.
The CRISES Act could significantly reduce law enforcement officers shooting and killing
people with mental health illness, if only because unarmed professionals trained in culturally
appropriate, trauma-informed strategies would respond when family members and neighbors
call for help to support a close one dealing with a mental health crisis.
This is a reality that hits close to home.
On Sunday, July 5th, CHANGE SSF organized a very dynamic, well-organized march
featuring everything from medics to musicians, and which featured speakers that educated us
on local, relevant issues.
For instance, at Sunday’s march, Matt Chang shared the painful story of losing his brother,
Errol, who was shot and killed by Daly City PD's SWAT team after Errol's family called for
help with Errol's schizophrenic episode.
This also happened to 18-year-old Yanira Serrano-Garcia in Half Moon Bay. Yanira's brother
called for help with her sister, who lived with schizophrenia, only to have her shot and killed
by San Mateo County Sheriff Menh Trieu, who alleged he feared this young woman holding a
kitchen knife.
These are two of many stories that could have been prevented. Over half (58%) of fatal
shootings by SFPD from 2005-2014 were people with mental health illness. You can learn

Please pass this resolution, which would not cost the city money, and could help save lives, as
well as all the subsequent emotional and other costs that fall on family members,
neighborhoods, and beyond. This could even save law enforcement officers and their
respective municipalizes the consequences, grief, and fallout that happens when they kill
people. This is an excellent opportunity for you to easily do the right thing, something that
would benefit everyone in SSF.

Dear City Council Members,
On July 5th, 2020, we marched for Black Lives (my life included) in an effort
to make our voices be heard in South San Francisco. We are coming from a
space of trauma, harm, distrust, anger because of the injustices that continue to
harm the Black Community. SSF police officer Joshua Cabillo killed 15-year-
old Derrick Gaines in June 2012, and there was no justice for his death.
There was an eye witness who gave her statement in court saying Derrick ran
from the officer, dropped his gun, did not reach for his gun like the officer said,
instead the officer shot him while the officer pinned him down to the ground.
Derrick was unarmed and posed no threat to him. The eye witness’ statement
was ignored and the officer was not charged or convicted of his crime. Was he
fired? Yes, and is he still working? Yes, and that’s where SSFPD and the
county failed. This officer currently works at SFPD and killed another child of
color & continues to harass citizens of color. SSFPD failed the Black
community and this is one example out of many why there is such distrust in
law enforcement.
City Council Members, I urge you to revisit the city budget immediately and
look at the demands from CHANGE SSF. Which included redistributing 30%
of the police budget to non-police, community-based services outside of the
police department. Investing in mental health & wellness programs to promote
real safety and healing for SSF youth would be a start. Police officers were
never meant to serve and protect Black people, the police practices are rooted
in white supremacy. Therefore, reforms will not work. It starts by divesting
power away from them and investing in our communities.

I am inspired by the energy of our community during such a significant political moment. It
warmed my heart to see everyone outside the police station last Thursday speaking to power
and against the injustices and anti-black racism present in SSF and worldwide. To our city
officials; I implore that you take note of what our community is asking for, we NEED you
putting in the work to help us. There is often this attitude that when we need changes, we
must be involved with what our city officials are doing. Your meetings are intimidating to
speak at, your attitudes can be disheartening to engage with, and your decisions are ultimately
in your hands. People have more uplifting and empowering ways to help our community, and
many can’t commit to your bureaucracy. But when the community rises up to speak, please
pay attention. We need you to defund our police.
SSFPD is hoarding the resources our people actually need to have safer, more tightly knit
communities. We don’t want that idiotic million-dollar police station and the new Dodge
sports cars they’re driving. It’s time to sell the police Corvette and reinvest in our children.
We want less cops. Our marginalized communities in SSF do not feel safe; don’t dismiss
them. If you haven’t had negative experiences with SSFPD, please consider that a privilege.
Instead, hire mental health experts when people are having a crisis. We need to reduce
policing and hire people who can handle situations aptly. Cops rarely if ever pursue justice in
instances of sexual assault, abuse, harassment or other gendered violence. We need classes on
community accountability, I can tell you that sexual assault was common during my time at El
Camino and we had no resources on how to handle it ourselves. We need higher pay for our
teachers, at Elco teachers constantly left after a year or two because pay was higher anywhere
else on the Peninsula. Cop jobs are not the type of employment we need. I come from a
police family, and I’ve seen how my dad’s job has made him more cynical and broke down his
empathy and relationship skills. Cops are trained in violence and situations never deescalate
by someone handling it with weapons on their belt and a license to enact violence. 40% of
cops are domestic abusers. Defunding the police is an act of care for current and future
officers who haven’t understood the psychological effects it will have.
We need more funding for social programs that enrich people’s lives. That is what makes us
feel safe. We badly need arts funding. SSF is creative; we need outlets for people to make
these important connections. Schools cut the arts, and Genentech invests so much in science
programs. The youth here understand that if you’re not a scientist, you will never afford SSF.
We need funds for affordable and free housing; we build on public land, which is really stolen
Ohlone land, yet rents are as unrealistic as anywhere on the Peninsula.

In your prior roundtable with CHANGE SSF, council members expressed the need for more
mental health responders in our community. Having the city council pass a resolution
expressing support for this state bill would help efforts in ensuring the safety and health of
our community and in California. We have to rethink the way we respond to different
problems in our community, not every call needs to be met by an armed officer. Please
consider passing this resolution.

Hi Mayor Garbarino and the City Council,
I've written two previous public comments but haven't seen them read aloud during the
meetings, so I encourage you to read them this time, since these are city issues that deserve to
be brought up for discussion.
Like my other comments, I encourage you to reallocate funds from the police department
towards social and health services given that these are basic needs that many of our residents
do not have access to, even before the coronavirus pandemic, due to either a shortage of
services or due to inconveniences based on availability hours, wait lines, or the services being
distances away. Expanding resources and their conveniences directly prevent property and
violent crime since people who do commit them either have families which are financially
struggling or do not have proper outlets and support for their mental health. Although there are
many things to invest in, these are the two things that mean something to me.
1. Rental Assistance. With the ongoing pandemic, rental assistance checks are the lifeline that
so many renters have relied on given that residents' sources of incomes have dried up. I really
encourage you to expand the rental assistance program because there will be a mass eviction
crisis in our city after the county moratorium ends. And to continue the program after the
crisis is over because residents' rents can take up more than 30% of their incomes, what is
deemed 'affordable housing'. Our official poverty rate is 7.43%, but because of California's
housing prices, the real number is much higher considering the Stanford developed California
poverty measure. My childhood best friend lives in an affordable housing unit and I would've
been devastated if he had to move or became homeless through no fault of his single working
mom.
2. Mental Health Services The second topic that's very close to me and so many others is
mental health. A friend who went to school at Alta Loma and El Camino killed himself last
November. He's not alone in how much our society makes us suffer mentally. He deserves to
be here. Psychologists and counselors are needed in our community, especially our schools. I
had talked with him a few times about seeing a therapist, but the stigma of seeing one, the
uncertainty/misconceptions of what therapists actually do, and the financial concerns of seeing
one are barriers to getting the help we all need. Mental health professionals having a visible
role in our city, something that is non-stigmatized and accessible to all, is something that is
necessary. Our high school of over 1,000 students had four counselors who took care of our
mental health, our academics, and our college preparation. County deals with health services
and SSFUSD deals with the schools, but as the city council you have prominent influence over
these institutions. I implore you to do so.
Finally, providing resources lifts the financial and psychological burdens of off residents and
is a significant factor in keeping our communities safe without policing them. My
neighborhood is safe, not because there are police cars who regularly patrol. It's because
everyone in our neighborhood has secured housing, healthcare, and food.

I wanted to express my support for Assembly Bill 2054. The C.R.I.S.E.S. act recognizes the
need for mental health first responders to better deal with mental crisis than having police
officers to do so due to their lack of proper training. There is growing data that shows this.
Having the city council pass a resolution expressing support for this state bill would help
efforts in ensuring the safety and health of our community and in California. We have to

Hello City Council,
I'm going to keep this public comment short and to the point. I am still disappointed at your
lack of urgency in restructuring the police department's budget. There wasn't a lack of urgency
in siphoning money from other departments, and yet there's a marked lack of urgency when
touching the police department's budget. The departments that are actively helping the
community and providing important services and resources to the community need to be
protected.
I am asking you to please review the budget and continue looking for unnecessary bloat in the
police department's budget. There shouldn't be any money being spent towards recruitment
efforts or equipment purchases. If you're making teachers pay for their own markers, you can
make cops pay for their own bullets.
I, and many other residents, will be watching and taking note of what our city council decides
to prioritize. Please reconsider the budget and look for ways to strengthen important city
resources and services instead of continuing to pump money into the police department.

the public comments this time around. I find it disheartening that you choose to silence the
people that you swore to serve. Given the push that the community has taken, it is
appalling that the city council has chosen to stay quiet about these matters. Especially about

I, along with many other South City residents, are upset that you have approved a 2020-21 city
budget that included a budget increase for the SSFPD. You have been presented with several
arguments as to why the funding should be reduced, and yet you still voted to increase it.
As a SSFUSD teacher and resident of South San Francisco, I plead with you to allocate
adequate funds to provide mental health and wellness programs geared towards our
community's youth. This will empower them and increase public safety without the violence
that police-based programs bring.
Listen to your constituents, who protested last week in support of the Black Lives Matter
movement and to demand that our city invests in its residents rather than its police force. We
urge you to revisit the city budget immediately and defund the police in order to fund
community-based programs, or we will elect officials who better serve our community.

Hi SSF,
The community had a protest last week fighting for the SSF budget. We had our demand
and continue to voice our opinions but seem to be invisible. We’ve said countless times
to defund the SSFPD but SSF did the exact opposite.
I’m not sure who’s saying that an increase is needed but I know the community isn’t.
This city is for the community and not for the police and the officials who "run it".
What do the police need that they don’t already have? Maybe SSFPD should cut the
number of police officers so you might have more money to spend on the "things you
need". Our community needs more resources that help the community directly.
Here’s some solutions for the SSFPD with the budget they already have and some ways
you can defund SSFPD:
- Cut the salaries of police officers
- Limit the gas consummation they use
- Cut hours of police officers (there’s a pandemic)
- Less pizza parities
- Sell the fancy cars they drive
- Sell away weapons that are unnecessary and that will never be used
- Many other ways to do so as well
Again, an increase is not needed for the SSFPD matter fact I’m not sure what cops do
during their working hours because there wasn’t one in sight during our protest.
Tell the officials to come out and do something to help the city and listen to our
protest/demands. If you aren’t willing to do so then step down from office. Thousands of
people are affected by decisions made by 10 people.
This our city not yours. Please make sure my comment is read to the officials. It’s my
right.

I am writing you this letter to address the recent budget approval. The people of this city have
been demanding that you reallocate police funds into social services and the community. You
have failed to listen and in doing so still increase the ssfpd's budget. How can you believe the
people of this city are comfortable and feel safe when our schools, healthcare, public resources
are underfunded while the police get more money, for what? The people of south city do not
feel safe with the police. There was a protest this past week that many people of south san
francisco attended with their demands and concerns with our city, demands to get justice for
Derrick Gaines, ssfpd is responsible for his death. Demands for our black and brown
community to get the resources the city lacks to provide. Where was the city council's
representation? Did any city council member attend to hear us and listen to our concerns? No.
The people of this city are speaking out, I hope the city council will read all these emails, hear
what the people- children and elders too- are asking for. Although the city budget is closed for
discussion, I ask that you reconsider and open that discussion back up before october.

Good evening,
My name is Oliver Elias Tinoco and am contacting you in regards to recent decisions
surrounding the finalization of the city’s budget. My comment falls in line with the
sentiments and demands expressed to you by the Coalition of Hope and Action Necessary
for Growth and Empowerment, otherwise known as CHANGE SSF, to revisit the budget
sooner than October and move forward in divesting from the SSFPD budget. I also want to
express my support behind CHANGE SSF’s resolution to you calling for the city to embrace
and uphold that of the CRISES ACT (AB 2054), putting mental health professionals at the
forefront of community safety as first responders.
Aside from that I do wish to say that, while the work you’ve done in holding a dialogue with
CHANGE SSF and other concerned residents of South San Francisco has not gone
unnoticed, it’s begun to feel as though they were all done to save face. It’s disheartening to
see the voices of young people go seemingly unheard by their city leaders, shown by the
current plans moving forward in increasing SSFPD funding despite calls not to. Whether or
not you choose to read these comments at the meeting or once again relegate them to a
master document under the Brown Act is your choice, however, I urge that you take these
comments beyond their face value and prove that these words are not falling on deaf ears.

My name is Isabela Molina and I am writing to you today as a resident and community
member of South San Francisco. I have grown up in South San Francisco my whole life, and I
am now a rising senior at St. Ignatius College Preparatory. My ties have remained strong here
in South San Francisco as I work with the South San Francisco Parks and Rec Department. I
have close friends and family in South San Francisco and I am writing to you today to reinvest
in SSF's youth, more specifically SSF's Black and Brown youth. In my years at Westborough
Middle School, I regularly saw the police come to the school to talk to students after incidents
between them and another student. We need to have counselors show up to aid incidents
between students who are only 12,13, or 14 years old, not the police department. Following
the lead of CHANGE SSF's plans and proposals to reinvest back into our communities will be
a great fraction of the steps our city needs to take for us to reimagine what it looks like to care
for the most vulnerable in our city.
You want to learn how you can best support the city, then show up for your community. Show
up beyond the council meetings that you have to attend. The protest held on Sunday was open
to anyone, and yet you were not present or walking with us. Our city needs to question if the
direction we are heading in is sustainable and holds our Black and Brown children's' lives with
love and understanding.

I hope that the city council has taken some time to educate themselves on alternate forms of
justice that can be funded, instead of continuing to prioritize funding the police.
I am asking city council to increase their direct rental support to families in SSF. Police will
not keep people safe in the middle of evictions that are sure to come in waves as soon as the
eviction moratorium is lifted on July 28. Rather, they will be the ones forcing people out of
their houses should a forceful eviction become necessary. During a global pandemic, no less.
Please do the right thing and prioritize the needs of your constituents over the budget of one
department.
Not only is this the ethical thing to do, it will also be more cost effective in the long run than
having to deal with housing an influx of newly homeless people in our city and the potential
increased spread of the virus that is sure to come if people are to lose their homes.
I also urge you to pass a resolution in support of the CRISES act, recognizing the need for
state funding for programs that can serve as alternatives to policing.

Letter:Greetings,
I am emailing to demand that Mayor Garbarino, Vice Mayor Mark Addiego,
and the City Council commit to divesting from the South San Francisco Police
Department by reducing the police budget by 30%. I also demand that the
city reinvests in essential programs such as COVID-19 relief, affordable
housing, educational enrichment, public transportation, resources to
address substance use disorder, and other community programs. The
demonstrations across the nation have made it clear that there is a need
for change. I refuse to be silent in the midst of injustice. The city of South
San Francisco can and should be at the forefront of revolutionizing and
reimagining our system of public safety.
Currently, the proposed budget for the next fiscal year would allocate
$31,935,228—28% of the proposed $112,416,313 general fund—to
the police department. I urge Mayor Garbarino and the city council to
restructure the fiscal year 2020-2021 budget. The current investment in
policing
perpetuates a system that serves the purpose of controlling and threatening
Black and Brown people. It is unacceptable that Black lives continue to
be lost at the hands of police, and it is clear that policing reforms are not
enough.
Specifically, I would rather see funds go towards mental health programs,
crisis de-escalators, and the Community Development Block Grant fund
which serves to assist low income persons by: providing decent and
affordable housing, providing a suitable living environment, and expanding
economic opportunities.
The current funds dedicated to the SSFPD have been harmful to our
community and I ask that our leadership take a look at alternatives to
policing and in the meantime allocate money to programs and services that
will benefit our community.
Thank you for your attention to my concerns. I hope to see action from our
leadership soon.

Hello,I'm writing to inquire about the status of the dilapidated shopping centerwhich used to be a thriving retail marketplace. When will we see theconstruction begin? As most of us are home and walking around theneighborhood more often it is more and more noticeable andextremely disappointing to see that NO PROGRESS has been made in theyears since it's closed up. I have lived in the Brentwoodneighborhood almost 15 years and it makes me so sad to see so many othercity projects pop up so quickly, yet this huge shopping center with so muchpotential just sits dormant. It is within walking distance and would create somuch neighborhood good will and excitement which is something we as acommunity need now more then ever. How can the city have no power orthis lot? Please help!! This is unacceptable.

As a homeowner in the Brentwood neighborhood for over 20 years, I am disappointed that the Safe
Shopping Center project at 180 El Camino Real appears to be no closer to development than it was
years ago when the entire corner of the block was fenced off. Now with Shelter-in-Place, we are all
spending more time in our neighborhood. Every time we walk to Centennial Trail and pass the
unslightly, fenced off, neglected, property that was once for many of us where we worked out,
picked up our groceries, and got our prescriptions filled, we wonder when will this blight be
restored? While we are thrilled for the new city government center being built just up the road, it is
so frustrating to see the progress being made in such a short time, while this project appears to be
completely stalled. Please can you provide us with some update and assurance that this project will
be started soon? This has gone on far too long.

On Sunday, July 5th, CHANGE SSF organized a protest that showed the power of the
people here in South San Francisco. The community came together for the cause of
defunding the police and the Black Lives Matter Movement. In my years of living here in
South San Francisco, I have never seen the community more engaged. We are asking the
city council to listen to our calls for justice! We demand justice for Derrick Gaines!

Dear Mayor Garbarino, Vice Mayor Addiego, and City Council Members Matsumoto,
Nagales, and Nicolas,
I am a lifelong resident of South San Francisco and class of 2017 graduate of South San
Francisco High School. I am writing to you today to express my disappointment with the
almost 30% allocation of the city budget towards the SSFPD. While we are cutting funding for
departments across the board, it is shocking that the city is still planning to increase the police
budget by $50,000 this year.
I would like to point you towards the following attached resources, which detail how armed
police officers, who are not adequately trained in social work or de escalation, are currently
acting in society as social workers. Police officers can be actively harmful when attending to
situations that do not require force, especially with individuals experiencing mental health or
substance abuse disorder.
I hope you can consider developing a first-responder program composed of unarmed
professionals trained specifically in de escalation and social work. There is no reason for
armed police officers to attend to anything other than violent emergency situations. It's time
we decriminalize poverty, mental health, and substance abuse, and work towards solutions for
those issues that value human life. Other cities such as San Francisco and Los Angeles have
already pledged to create such groups of first-responders, and our city should be at the
forefront of reimagining our system of public safety.
There is a bill currently in the California legislature called the CRISES Act, which would
allow for state funds to be put towards community based emergency response groups. I hope
the city can pass a resolution, as San Francsico city council has, in support of that initiative.

Dear South San Francisco Mayor and City Councilmembers,
I request that you reconsider the 2020-21 city budget that included a budget increase for the
SSFPD. Like many others, I would like to see the city reduce funds allocated to SSFPD and
move the funds to other programs which would benefit our
community. As a parent with kids in the SSFUSD system, I see the need for investments in
community health and resilience through the experiences of many families at my kids' school.
I ask you to please reallocate funds toward COVID relief, housing, poverty, mental health, and
youth activities.
I was inspired to see so many people at the protest on July 5 in support of Black Lives Matter.
We urge you to revisit the city budget immediately and defund the police in order to fund
community-based programs. The people of our SSF community are asking for change.

Ordinance approving a First Amendment to the Development Agreement (DAA20-0001)between the City of
South San Francisco and Bayside Area Development,LLC for a Research and Development and Office Project
at 328 Roebling Road.
WHEREAS,Bayside Area Development,LLC (“Owner”or “Applicant”)received entitlements for the
construction of two new 2-story office/R&D buildings totaling 105,536 square feet,with a combination of at-
grade and subterranean parking at a ratio of 2.7 spaces per 1,000 square feet on an approximately 2.97-acre site
located at 233 East Grand Avenue / 328-340 Roebling Road (“Project”); and,
WHEREAS,on November 14,2012,after conducting all proceedings and making all findings necessary for the
valid adoption and execution of a development agreement for the Property in accordance with Government
Code Sections 65864 through 65869.5,the California Environmental Quality Act (“CEQA”),and Chapter
19.60 of the Municipal Code,the City Council adopted Ordinance No.1460-2012,approving and adopting a
development agreement for the property at 233 East Grand Avenue / 328-340 Roebling Road (“Property”); and,
WHEREAS,Applicant submitted an application requesting approval of a Design Review Modification and
Development Agreement Amendment to increase the entitled square footage to 129,919 square feet of
office/R&D space,increasing the density of development on the site from a Floor Area Ratio (“FAR”)of 0.81
to a 1.0 FAR,and revise the site plan to have a five-story stand-along office/R&D building with a three-story
parking structure (“Revised Project”); and
WHEREAS,the City Council certified the 2012 Recirculated Initial Study/Mitigated Negative Declaration
(“2012 Recirculated IS/MND”)on November 14,2012 in accordance with the provision of the California
Environmental Quality Act (Public Resources Code,§§21000,et seq.,“CEQA”)and CEQA Guidelines,which
analyzed the potential environmental impacts of the Project; and,
WHEREAS,pursuant to CEQA Guidelines Sections 15162 and 15164,an addendum to the 2012 Recirculated
IS/MND was prepared for the Revised Project (“2020 Addendum”)which evaluates whether preparation of a
Supplemental or Subsequent EIR or Negative Declaration is required; and
WHEREAS,the 2020 Addendum concludes that in accordance with Public Resources Code §21166 and
CEQA Guidelines §15162,the implementation of the Revised Project will not cause significant impacts,that it
will not trigger any new or more severe impacts than were studied in the previously certified 2012 Recirculated
IS/MND,that no substantial changes in the project nor circumstances justifying major revisions to the previous
MND have occurred,and that no new information of substantial importance has come to light since the 2012
Recirculated IS/MND was certified that shows new or more severe significant impacts nor shows new,different
or more feasible mitigation measures; and,

WHEREAS,on June 4,2020 the Planning Commission for the City of South San Francisco held a lawfully
noticed public hearing to solicit public comment and consider the First Amendment to the Development
Agreement,and recommended that the City Council consider the First Amendment to the Development
Agreement; and;
WHEREAS,the City Council held a duly noticed public hearing on June 24,2020 to consider the First
Amendment to the Development Agreement, and take public testimony.
NOW,THEREFORE,BE IT RESOLVED the City Council of the City of South San Francisco does hereby
ordain as follows:
SECTION 1. Findings.
That based on the entirety of the record before it,which includes without limitation,the California
Environmental Quality Act,Public Resources Code §21000,et seq.(“CEQA”)and the CEQA Guidelines,14
California Code of Regulations §15000,et seq.;the South San Francisco General Plan,General Plan
Environmental Impact Report;the South San Francisco Municipal Code;2012 Recirculated IS/MND,and
associated Mitigation Monitoring and Reporting Programs;2020 Addendum to the 2012 Recirculated IS/MND;
the Revised Project applications;the 233 East Grand Ave /328-340 Roebling Ave Project Plans,as prepared by
Flad Architects,dated March 23,2020;all site plans,and all reports,minutes,and public testimony submitted
as part of the Planning Commission’s duly noticed June 4,2020 meeting;all site plans,reports,minutes,and
public testimony submitted as part of the City Council’s duly noticed public hearing on June 24,2020;and any
other evidence (within the meaning of Public Resources Code §21080(e)and §21082.2),the City Council of the
City of South San Francisco hereby finds as follows:
A.The foregoing recitals are true and correct and made a part of this Ordinance.
B.The Exhibit attached to this Ordinance,the proposed First Amendment to the Development
Agreement (Exhibit A),is incorporated by reference and made a part of this Ordinance,as if set forth fully
herein.
C.The documents and other material constituting the record for these proceedings are located at the
Planning Division for the City of South San Francisco,315 Maple Avenue,South San Francisco,CA 94080,
and in the custody of Chief Planner, Sailesh Mehra.
D.The First Amendment to the Development Agreement,attached hereto as Exhibit A,sets for the
duration,property,project criteria,and other required information identified in Government Code section
65865.2.Based on the findings in support of the Project,the City Council finds that the Development
Agreement,vesting a project for a campus-style development of office and R&D buildings,is consistent with
the consistent with the objectives,policies,general land uses and programs specified in the South San Francisco
General Plan and any applicable zoning regulations.
E.The First Amendment to the Development Agreement is compatible with the uses authorized in,
and the regulations prescribed for the land use district in which the real property is located because the project

and the regulations prescribed for the land use district in which the real property is located because the project
provides an office/R&D facility with a campus-style environment.The subject site is physically suitable for the
type and intensity of the land use being proposed.The General Plan specifically contemplates the proposed
type of project and the suitability of the site for development was analyzed thoroughly in the environmental
document prepared for the Project;
F.The First Amendment to the Development Agreement is in conformity with public convenience,
general welfare and good land use practice because the amendment enhances the site plan and further improves
the pedestrian environment from the public right-of-way.
G.The First Amendment to the Development Agreement will not be detrimental to the health,
safety and general welfare because the amendment preserves a campus-like environment and creates a rails-to-
trails connection for employees and visitors.
H.The First Amendment to the Development Agreement will not adversely affect the orderly
development of property or the preservation of property valued because the amendment improves the property’s
campus-like environment and is consistent with surrounding R&D and office uses.
SECTION 2.Approval of Development Agreement
A.The City Council of the City of South San Francisco hereby approves the First Amendment to
the Development Agreement with Bayside Area Development LLC,attached hereto as Exhibit A and
incorporated herein by reference.
B.The City Council further authorizes the City Manager to execute the First Amendment to the
Development Agreement,on behalf of the City,in substantially the form attached as Exhibit A,and to make
revisions to such Agreement,subject to the approval of the City Attorney,which do not materially or
substantially increase the City’s obligations thereunder.
SECTION 3.Severability
If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid or
unconstitutional,the remainder of this Ordinance,including the application of such part or provision to other
persons or circumstances shall not be affected thereby and shall continue in full force and effect.To this end,
provisions of this Ordinance are severable.The City Council of the City of South San Francisco hereby
declares that it would have passed each section,subsection,subdivision,paragraph,sentence,clause,or phrase
hereof irrespective of the fact that any one or more sections,subsections,subdivisions,paragraphs,sentences,
clauses, or phrases be held unconstitutional, invalid, or unenforceable.

Pursuant to the provisions of Government Code Section 36933,a summary of this Ordinance shall be prepared

copy of this Ordinance.Within fifteen (15)days after the adoption of this Ordinance,the City Clerk shall (1)

FIRST AMENDMENT
TO DEVELOPMENT AGREEMENT
This First Amendment to Development Agreement (“First Amendment”) is entered into by
and between BAYSIDE AREA DEVELOPMENT, LLC (collectively known as “Developer”) and
the CITY OF SOUTH SAN FRANCISCO, a municipal corporation (“City”) on this _____ day of
_________________, 2020.
RECITALS
A. WHEREAS, Developer and City are parties to that certain Development Agreement by and
between Developer and City, dated January 11, 2013, and recorded in the Official Records
of San Mateo County on February 5, 2013, as Document Number 2013-019601
(“Development Agreement”);
B. WHEREAS, Developer and City wish to amend the Development Agreement as set forth in
this First Amendment;
C. WHEREAS, all proceedings necessary for the valid adoption and execution of this First
Amendment have taken place in accordance with California Government Code sections
65864 through 65869.5, the California Environmental Quality Act, and Chapter 19.60 of the
City’s Municipal Code;
D. WHEREAS, the City Council and the City Planning Commission have found that the
Development Agreement, as amended by this First Amendment, is consistent with the
objectives, policies, general land uses, and programs specified in the South San Francisco
General Plan; and
E. WHEREAS, on ________, 2020 the City Council considered the proposed First
Amendment and adopted Ordinance No. ____________ approving and adopting this First
Amendment, and such ordinance took effect 30 days later.
AGREEMENT
NOW, THEREFORE, the Parties, pursuant to the authority contained in Government Code
Sections 65864 through 65869.5 and Chapter 19.60 of the City’s Municipal Code, and in
consideration of the mutual covenants and agreements contained herein, agree as follows:
1. Revised Project Description. The first paragraph of Section 3 of the Development
Agreement is hereby amended to read as follows:
2. Project Description; Development Standards For Project
The project to be developed on the Property pursuant to this Agreement (the
"Project") shall consist of (i) two (2) one (1) office / research and development
buildings, with five (5) floors, containing approximately 129,919 square feet each
with a ground floor and second story containing in the aggregate approximately
52,768 square feet of occupiable space per building and one (1) floor of partially
subterranean parking accommodating approximately 66 parking spaces per
building, (ii) surface a three (3) level parking garage that will accommodate
approximately 156364 parking spaces, and (iii) related improvements, all as
provided in the Plan Set and as approved by the City Council. The Project, as
described in this paragraph, as amended by the First Amendment, results in an
increase in square footage of approximately 25,000 square feet compared to the
initially approved project for 328 Roebling (“Incremental Increase”).
2. Bicycle and Pedestrian Impact Fees. Developer hereby agrees that the Bicycle and
Pedestrian Impact Fee, as approved and adopted by the City Council through the adoption
of Ordinance No. 1539-2017 (which took effect on August 14, 2017), shall apply to the
Incremental Increase. Bicycle and Pedestrian Impact Fees shall be determined based on the
application of the formula in effect as of the time the City issues the respective building
permit for the Incremental Increase, and shall be payable prior to the issuance of such
building permit. Section 13 of the Original Agreement shall not be amended except to the
extent necessary to give effect to this Section.
3. Commercial Linkage Fees. Developer hereby agrees that the Commercial Linkage
Impact Fee, as approved and adopted by the City Council through the adoption of
Ordinance No. 1560-2018 (which took effect on November 1, 2018), shall apply to the
Incremental Increase. Commercial Linkage Impact Fees shall be determined based on the
application of the formula in effect as of the time the City issues the respective building
permit for the Incremental Increase, and shall be payable prior to the issuance of such
building permit. Section 13 of the Original Agreement shall not be amended except to the
extent necessary to give effect to this Section.
4. Community Facilities District Participation. Developer hereby agrees to participate in
the yet to be formed South San Francisco Industrial Area Community Facilities District
(IA-CFD) at an annual tax rate equivalent to the lesser of no more than $1.00 per gross
project square foot on the 328 Roebling Avenue Property or such annual tax rate that
applies to similarly situated Life Sciences projects in the East of 101 Area (Owner
acknowledges that the name of the IA-CFD might change prior to submission to property
owners for approval, and that Developer’s agreement in this paragraph will apply to the
community facilities district regardless of name, as long as the rate applicable to Developer
complies with this paragraph.) In the event an IA-CFD is not formed, the Property or
Project shall not be subject to any additional development fee, assessment or tax, except as
provided for in Sections 11, 12, and 13 of the Agreement.
5. Effect of First Amendment. Except as expressly modified by this First Amendment, the
Development Agreement shall continue in full force and effect according to its terms, and
Developer and City hereby ratify and affirm all their respective rights and obligations under
the Development Agreement, including but not limited to Developer’s indemnification
obligations as set forth in Section 14 of the Development Agreement. In the event of any
conflict between the First Amendment or the Development Agreement, the provisions of
this First Amendment shall govern.
6. Binding Agreement. This First Amendment shall be binding upon and inure to the
benefit of the heirs, administrators, executors, successors in interest, and assigns of each of
the parties hereto. Any reference in this First Amendment to a specifically named party
shall be deemed to apply to any successor, administrator, executor, or assign of such party
who has acquired an interest in compliance with the terms of this First Amendment or
under law.
7. Recordation. The City shall record a copy of this First Amendment within ten (10) days
following execution by all parties.
8. Counterparts. This First Amendment may be executed in multiple counterparts, each of
which shall be deemed an original, but all of which, when taken together, shall constitute
the same document.
9. California Law. This First Amendment shall be governed by and interpreted in
accordance with the laws of the State of California.
10. Invalidity. Any provision of this First Amendment that is determined by a court of
competent jurisdiction to be invalid or unenforceable shall be deemed severed from this
First Amendment, and the remaining provisions shall remain in full force and effect as if
the invalid or unenforceable provision had not been a part hereof
11. Headings. The headings used in this First Amendment are for convenience only and shall
be disregarded in interpreting the substantive provisions of this First Amendment.
IN WITNESS WHEREOF, this First Amendment has been entered into by and between Developer
and City as of the date and year first above written.

Report regarding implementation of an outdoor dining pilot program in the City of South San Francisco to
enhance restaurant and business recovery during COVID-19.(Christopher Espiritu,Senior Planner and Sailesh

RECOMMENDATION
Staff recommends that the City Council approve the proposed pilot program as outlined in this staff report,
appropriate an amount not to exceed $35,000 for labor and materials,and authorize the City Manager to take
any actions necessary to implement the pilot program and resolve any inconsistencies with the Municipal Code.
BACKGROUND
On June 10,2020,City Council provided Staff with feedback and directions to explore Shared Streets concepts
for the Downtown area.Several options,specific for Grand Avenue were discussed,including full and partial
closure of travel lanes on Grand Avenue.However,Council Members were not supportive of closing or
restricting vehicular travel on Grand Avenue,given the potential for effects on residents,rerouting of existing
transit services,and other concerns.Council directed City Staff to explore and develop a ‘Restricted Parking’
option on Grand Avenue,which enables outdoor dining on the public right-of-way,and became the preferred
option for implementing the Shared Streets Pilot Program in the City.
Subsequently,on June 17,2020,the San Mateo County Health Officer and the County Health Department
announced revised orders to align with State Health Orders allowing for the continued re-opening of
businesses,provided that gatherings are not to exceed 50 people,allow for social bubbles,adherence to social
distancing requirements,face covering requirements,and requirements for businesses to implement a social
distancing protocol and written health and safety plans.In conjunction with the revised County Health Orders,
nearly all cities in San Mateo County have implemented an outdoor dining program.
As City Staff engaged in discussions across departments and divisions,and conducted further outreach with
businesses,Staff determined that an outdoor dining program can be implemented as a separate effort from the
Shared Streets Pilot Program in residential neighborhoods throughout the City.Therefore,the following Staff
Report and the accompanying Resolution describes specific performance standards and process for the Outdoor
Dining Pilot Program.

City Staff,in coordination with the SSF Chamber of Commerce conducted additional outreach to businesses
and restaurants regarding interest in an outdoor dining program.On June 19 and June 24,City Staff and the
SSF Chamber surveyed all available downtown businesses and restaurants and received feedback as
summarized below:
-Eight restaurants (Di Napoli Pizzeria,Café 382,Nick’s On Grand,Thai Satay,Fil-Am Cuisine 2,
Antigua,Amoura,and Dead Eye Coffee Bar)all expressed a strong desire for outdoor seating in
front of their businesses.Further,Café 382,Antigua,and Amoura have committed to working with
the City on options for outdoor dining.
-Other restaurants expressed either no interest (Grand Palace)or hesitation due to incurring any
additional costs (Café Bunn Mi).
Similar to Council’s previous concerns regarding potential effects of restricting vehicular traffic along Grand
Avenue,restaurants and businesses surveyed by City Staff and the SSF Chamber also noted that restricting
vehicles on Grand Avenue would be detrimental to restaurants and businesses that have pivoted to take-out and
delivery services only.City Staff was cognizant of these concerns and determined that implementation of the
Outdoor Dining Pilot Program would be an “opt-in”only program,instead of an implementation spanning
entire blocks in the Downtown.
SSF Temporary Outdoor Dining Program
Given Council’s direction to explore outdoor dining concepts and combined with an anticipated number of
restaurants that would make use of available outdoor dining space,City Staff developed an Outdoor Dining
Pilot Program (the Program).This would allow interested restaurants and businesses to “opt-in”and utilize
public right-of-way space (adjacent parking)for an expanded dining area.The Program would include specific
performance standards (See Exhibit A to the accompanying Resolution)which would address the appropriate
application and review requirements and provide interested businesses with specific guidelines on outdoor
dining operations.
As part of the Program,the City would install temporary and removable barriers (see Attachment 2 for details)
along parking spaces fronting the participating restaurant.The restaurant would then be able to place tables and
chairs,or other equipment (depending on specific needs),for use by patrons of that restaurant only.The street
would remain open to vehicles and parking is repurposed for outdoor dining.
This also presents an opportunity to reduce the speed limit on the street using available traffic calming devices
such as temporary speed limit signs and portable speed tables (speed humps)that can be installed prior to
approval of the outdoor dining application.
By providing additional space on the right-of-way,restaurants are able to accommodate a greater number of
customers while remaining in compliance with County Health Orders regarding social distance.

In conjunction with approving the Program,the accompanying Resolution would temporarily provide the City
Manager certain authority to waive or modify existing Municipal Code requirements to the extent necessary to
effectuate the Program. These provisions are described in detail in the Resolution.
Outdoor Dining on Private Property
Outdoor dining may also be implemented within privately owned shopping plazas (i.e.,Westborough Square,
and others).However,given that no encroachment onto the public right-of-way would occur,City Staff
recommends that property owners and restaurant operators submit only a supplemental checklist for outdoor
dining to ensure that County Health Department standards are met.(See Exhibit B to the accompanying
Resolution.)
FISCAL IMPACT
The proposed Outdoor Dining Pilot Program would require allocation of a not-to-exceed limit of $35,000 in
order to procure barriers to be installed on the right-of-way and the associated labor costs for installation,
modification,and removal of the barriers.The proposed costs would also cover signage and other necessary
information to be posted at specific sites.
CONCLUSION
Staff recommends that the Council approve the proposed Outdoor Dining Pilot Program.
·Due to the potential loss of parking meter revenue,the pilot program would be considered at the
Downtown Parking Commission for approval at its next scheduled meeting on July 14.
·Initial pilot program would expire after 30 days,and would be evaluated by staff and operators for
eligible extensions of another 30 days.

2 Boundary Limits: This Permit is limited to the “Property” defined as public Right-of-Way or City owned parcel described in the application
and plans, subject to all existing licenses, easements, encumbrances, leases, and claims of title.

Purpose: Permittee certifies that it has the legal authority to occupy and use the public right of way for the purpose stated in the application.
This nonexclusive and temporary Permit is limited to the purpose stated in the application. Any installation, maintenance, or operation of
facilities in the public right of way requires the Permittee/Owner to execute an Encroachment and Maintenance Agreement or a similar form
of agreement with the City. Neither this Permit nor any work done by Permittee shall create a vested right of Permittee to occupy or utilize
the public right of way. If any prior encroachment permit conflicts with the proposed work, Permittee shall arrange for any necessary removal
or relocation with the prior permittee if willing at no expense to the City.

Term: The term of this Permit is as set forth in the application. This Permit shall be void if construction has not begun within ninety (90)
calendar days of the date of the Permit Issuance. This permit is revocable immediately upon notice by the City Engineer or their designee.
Upon revocation or expiration of this Permit, Permittee shall suspend all activity within the Property and shall be responsible for the repair
of any damage to City property caused by Permittee, as directed by City.

Fees: Permittee certifies that neither it nor the owner of any facilities to be installed, used, or repaired in the public right-of-way are subject
to any outstanding City assessments, fees, penalties, or charges. Issuance of this Permit is conditions upon payment of the application fee,
inspection fee, and any other applicable fees or deposits/security.
6 Business License: Permittee and/or contractor shall maintain a current business license in the City of South San Francisco as applicable.
7 Permit on Site: Permittee shall keep this Permit at the job site at all times that work is occurring and shall provide the Permit upon demand
of a City representative. Work may be suspended if the Permit is not readily available at the job site.

Notice Prior to Starting Work: Before staring work under this Permit, Permittee shall notify the Public Works Inspector a minimum of
two (2) days prior to the initial start of work. When work is suspended for more than five (5) working days, an additional 24-hour notification
is required.

Underground Service Alert: Permittee shall contact and start a ticket with the Underground Service Alert at Phone:811 or Website:
www.usanorth811.org/ a minimum two (2) working days prior to scheduled work. PRIOR TO EXCAVATION, Permittee shall confirm all
utility partners on the ticket have responded and the start time has passed.

Inspection: All work is subject to the City’s monitoring, inspection, and approval. Permittee shall be billed for inspection time at the current
rate in the City’s Fee Schedule, with a minimum of two (2) hours. Permittee shall call the Public Works Inspector to schedule inspection a
minimum of 24-hours prior to the required inspection time. Any inspections performed outside of the base allowed hours on the permit shall
be paid prior to permit issuance or refund of any deposit. See Special Conditions attached for Inspection Deposits.

# STANDARD CONDITIONS

Work Conditions:
a. Work may only be performed and traffic controls shall only be deployed between the hours of 9:00 AM to 3:00 PM Monday through
Friday unless otherwise restricted or allowed by Engineering Staff. No work is permitted on Saturdays, Sundays, or City Holidays.
b. Permittee shall provide signage with the name of the contractor and a 24-hour contact phone number that is visible from the work area
to persons on the Right-of-Way
c. Permittee shall keep the area clean, safe, and orderly at all times and shall not use the public Right-of-Way as a storage area when no
work is being performed.
d. Permittee shall comply with the requirements of the San Mateo County NPDES permit and Best Management Practices established by
the San Mateo Countywide Water Pollution Prevention Program to prevent construction water, debris, or groundwater from entering
the storm drains.
e. If the work contemplated will interfere with established drainage, Permittee shall make provision for drainage as acceptable to the City.
f. No hazardous materials shall be handled at any time on the Property. Should any discharge, leakage, spillage, emission, or pollution of
any time occur upon or from the Property due to Permittee’s use and occupancy of the Property, then Permittee shall clean all affected
property to the satisfaction of the City and any governmental body with jurisdiction at the sole cost of the Permittee.
g. If hazardous materials are encountered during the excavation under this permit, then Permittee shall immediately notify the City and
properly dispose of such materials in full accordance with federal, state, and local laws. Such disposal shall be at the Permittee’s sole
cost and shall be under the Permittee’s EPA Generator number.
h. Open trenches and holes shall be satisfactorily covered at all times when Permittee’s forces are not working in the vicinity. No trench
shall be left open at the end of a work day unless steel plated in accordance with the Public Works Department’s Standards.
i. Permittee certifies that all material to be used in the work, including material for the restoration of the public Right-of-Way, is on hand
and ready to use prior to beginning work.
j. All work undertaken by Permittee pursuant to this Permit shall be at no cost or expense to the City and shall be at sole cost and expense
of Permittee. Permittee, as Owner/Applicant or Authorized Agent of Owner/Applicant, hereby releases the City from and waives all
claims against the City for liability, payment, reimbursement or expenses for such work. . All work shall be done in a manner that does
not interfere with the City’s operations, properties and facilities.
k. Any Mechanic’s Liens filed on account of work performed by Permittee hereunder shall be promptly cured by Permittee’s payment
thereof, and the recording of applicable Release of Mechanic’s Liens, or Permittee shall post a statutory mechanic’s lien release bond
in lieu thereof within seven (7) days after the filing of each such Mechanic’s Lien.

Traffic Control Measures: Permittee shall provide appropriate vehicular, pedestrian, and bicycle traffic control measures at no cost to the
City. Traffic controls shall conform to the CA MUTCD and Caltrans Standard Plans.
Where sidewalks exist, a minimum width of four (4) feet shall be maintained at all times for safe passage through the work area. At locations
where the entire sidewalk width must be closed for construction, Permittee shall provide an alternative route diverting pedestrians into the
road and adjacent to the closed sidewalk protected by k-rail or other approved barricades and identified by warning signs, lights, and other
safety devices conforming to the requirements of the CA MUTCD. Alternative walkways shall provide temporary ramps from the sidewalk
on both ends of the sidewalk closure to connect the path from the sidewalk to the roadway. Permittee shall pay for any metered parking stalls
occupied to provide this walkway for the full duration of the parking stall occupation.

# STANDARD CONDITIONS

Facilities: The installation, maintenance and operation of facilities in the public right-of-way or City owned parcel requires the
Permittee/Owner to execute an Encroachment and Maintenance Agreement or a similar form of agreement with from the City in addition to
an Encroachment Permit.
a. Any facilities being installed in the Property shall be kept in good and safe condition and free from any nuisance to the satisfaction of
the Director of Public Works.
b. Within thirty (30) days of receipt of a written request from the City, Permittee shall relocate its facilities at its sole cost and expense if
the facility interferes with a project or other municipal operations of the City of South San Francisco. Within thirty (30) days of receipt
of a written request from the City, Permittee shall locate its interfering subsurface facilities by potholing when required by the City for
the purpose of confirming the location of existing facilities in order to design or construct public facilities.
c. Whenever a facility is abandoned in the right-of-way, the person owning, using, controlling, or having interest in the facility shall within
thirty (30) days after such abandonment file a statement in writing with the Department of Public Works, including a detailed description
of the facility’s location, including a map and/or plans. If the facility is not occupied within one (1) year from the date of final inspection
or is occupied then no longer occupied within one (1) year, then the facility shall be deemed abandoned. Substructures shall be
considered occupied as long as there are active facilities in at least one of the ducts of the substructure. Upon abandonment, the City
may require the facility to be removed by the owner at their own expense or at the City’s discretion; all or part of the facility may be
abandoned in place with ownership deemed to be transferred to and vested in the City at no cost.

Restoration and Completion of Work:
a. Prior to Permit issuance, Permittee shall provide a deposit or bond sufficient to cover restoration of the Right-of-Way in the event the
Permittee fails to or abandons the project. The amount of such deposit or bond shall be based on the Engineer’s Estimate or determined
by Engineering Staff on a project-by-project basis.
b. Prior to completion of the work, Permittee shall request that the City conduct a final inspection by scheduling with the Public Works
Inspector at least 24-hrs prior to requested inspection time.
c. If the work is not completed within the time required or not acceptable to City staff, then the Public Works Director or their designee
shall notify Permittee in writing. Within forty-eight (48) hours of such notice, Permittee shall restore the work in conformance with the
City Standards Details and Specification and this Permit’s conditions and remedy all deficiencies including subsurface material or
pavement depressions, breaking, or other failures. If the Permittee fails to do the restoration after such notice, then the City may
undertake such work at the expense of the Permittee. The City’s determination of the cost of the work perform shall be final.
d. If Permittee fails to compensate the City for the restoration work undertaken pursuant to 12(c) above within five (5) business days of
notification, then the City shall have the right to take whatever actions are necessary to recover its damages, costs, and expenses
including but not limited to withholding the amount due with payment made from the performance deposit or any remaining
administrative or inspection fee amount or commencing an action against the bond.
e. Any repair or restoration work undertaken by the City pursuant to 12(c) above shall not relieve Permittee in any manner from liability
at the site of the repair or restoration including but not limited to future failures.
f. The City may undertake any restoration or repair work that has been left incomplete or performed inadequately by Permittee at
Permittee’s cost without notification to Permittee if the City has determined that there has been a violation of any condition of the
permit; that an excavation constitutes a hazardous situation, public nuisance, public emergency or threat to public health, safety, or
welfare, or it is in the City’s best interest.
g. Any monuments removed during the work shall be replaced and reestablished.
h. At the completion of the work, all brush, timber, scraps, material, and the like shall be entirely removed and the Right-of-Way left in a
like new condition.

Restoration and Completion of Work (continued):
As-builts shall be provided to the City prior to the City’s release of any deposit or security required by this Permit. Permittee shall also
provide to the City, at no cost, with a copy of any data, studies, or surveys conducted on the Property.
15
Warranty:
a. If required by the City, Permittee shall provide a warranty bond for the purpose of warranting that all work for two (2) years following
completion and acceptance by the City. See Permit Special Conditions if required by the City.
b. Permittee shall be responsible for remedying any deficiencies such as subsurface material or pavement becoming depressed, broken, or
otherwise failing. Any deficiencies identified by the City shall be remedied within forty-eight (48) hours of notification by the City.
c. If the deficiencies are not remedied, then the City shall repair or restore at the expense of the Permittee in a manner that the City deems
expedient and appropriate. The City’s determination of the cost of repair or restoration shall be final. If the Permittee fails to compensate
the City within five (5) business days of notification, then the City can take whatever actions are necessary to recover its damages,
costs, and expenses, including but not limited to withholding the amount due with payment made from any performance deposit or any
remaining administrative or inspection fee amounts, or commencing action against the bond.
d. Repair or restoration by the City shall not relieve Permittee from any and all liability at the site of the repair or restoration including
but not limited to future failures.
e. The City may undertake the restoration or repair work at the expense of Permittee without notifying Permittee, if the City has determined
that a person has violated this chapter or any condition of the permit; that an excavation poses a hazardous situation or constitutes a
public nuisance, public emergency, or threat to the public health, safety or welfare; or it is in the City’s best interest.

Release and Indemnification:
Permittee hereby releases the City from any liability, claims, damages or any obligations relating to any bodily injury, sickness, disease, or
death of any person or damages to any property or any person arising out of work performed by Permittee, its contractors, or subcontractors
in performance of this Permit. Permittee agrees to indemnify, defend, and hold harmless City and its officers, agents, volunteers, and
employees from any and all actions, claims, and liability for any loss or damage, including but not limited to, bodily injuring, sickness,
disease, or death of any person or damage to any property, tangible or intangible, arising out of work performed by Permittee, its contractors,
or subcontractors in performance of this Permit or the entry upon the Property. This release and indemnification shall survive termination of
this Permit.

Insurance:
Permittee shall procure and maintain during the term of this Permit the following policies of insurance:
a. Worker’s Compensation and Employers’ Liability Insurance in the statutory coverage. Permittee certifies that it is aware of the
provisions of Section 3700 of the California Labor Code which requires every employer to be insured against liability for Worker’s
Compensation or to undertake self-insurance in accordance with the provisions of the Code, and it will comply with such provisions
before commencing the performance of the work pursuant to this Permit.
b. Commercial General Liability Insurance: In an amount not less than ONE MILLION DOLLARS ($1,000,000) for injuries including,
but not limited to, death to any one person and subject to the same limit for each person; in an amount not less than TWO MILLION
DOLLARS ($2,000,000) combined single limit per occurrence for bodily injury, personal injury and property damage.
c. Automobile Liability (Code 1) Insurance: In an amount not less than ONE MILLION DOLLARS ($1,000,000) combined single limit
per accident for bodily injury and property damage.

Insurance (continued):
d. Contractual Liability Insurance: In the amount of at least TWO MILLION DOLLARS ($2,000,000), insuring Permittee against damages
sustained as a result of any action or actions at law or in equity, any claims or demands brought as a result of any breach or alleged
breach of any contract, or provisions thereof, and/or as a result of any contractual liability, or alleged contractual liability arising out of
any contract entered into by Permittee and/or any of its agents or employees in order to perform the work defined herein.
e. The insurance required by this Permit shall be in an aggregate amount of not less than Two Million Dollars ($2,000,000) and shall be
extended to include as additional insureds the City of South San Francisco, its elective and appointive boards, officers, agents,
employees and volunteers, with respect to operations performed by the Permittee as described herein. Evidence of the insurance
described above shall be provided to City upon issuance of this Permit. The policy of insurance shall also contain a provision indicating
that such insurance shall not be reduced or canceled except upon thirty (30) days written notice to City.
At the City’s sole discretion, the City’s Risk Manager may modify or waive these requirements on a case-by-case basis.
18 Assignment: Permittee shall not assign or otherwise transfer any rights under this Permit, and any purported assignment or transfer shall
automatically revoke this Permit.

No Dedication; Possessory Interest Tax: Nothing contained in this Permit shall be deemed a gift or dedication of any portion of the
Property to or for the general public or for any public purpose whatsoever. This permit shall not be construed to grant any real property
interest or other rights to Permittee in the Property. However, if it is deemed that this Permit creates an interest subject to the possessory
interest tax, then Permittee is responsible for paying such tax.
20 No Waiver: No waiver of any default or breach of any condition or term of this Permit shall be implied from any omission to take action
on account of such default or breach.

No Precedent Established: This Permit is issued with the understanding that any particular action is not to be considered as establishing
any precedent, including as precedent for the expediency, utility, or authority of any kind of encroachment. This Permit and any associated
Improvement Agreement or Encroachment and Maintenance Agreement constitute the entire agreement between the City and Permittee
pertaining to entry and work upon the Property.

Governing Law; Attorney’s Fees: This Permit shall be construed and enforced in accordance with and governed by the laws of the State
of California. Any legal proceedings arising from or relating to this Permit shall be venued in the County of San Mateo. In the event that
either party institutes any action, suit, or other dispute resolution proceeding based on this Permit, the prevailing party is entitled to receive
all costs and expenses, associated therewith including but not limited to reasonable attorney’s fees and courts costs.

prior to permit issuance. Any and all special conditions shall be included as part of this permit and attached after these standard conditions.

Resolution amending the proclamation of a local health emergency (adopted pursuant to Resolution No.35-
2020)to approve an Outdoor Dining Pilot Program in the City of South San Francisco to enhance restaurant
and business recovery during COVID-19.
WHEREAS,Section 8630,Article 14,of the California Emergency Services Act empowers the City Council to
proclaim the existence or threatened existence of a local emergency when the City of South San Francisco
(“City”) is affected or likely to be affected by a public calamity; and
WHEREAS,Chapter 2.72 of the South San Francisco Municipal Code (“SSFMC”)similarly authorizes the
City Manager,serving as the Director of Emergency Services to declare and proclaim,or to request the City
Council to declare and proclaim, the existence or threatened existence of a "local emergency"; and
WHEREAS,the City of South San Francisco proclaimed a local State of Emergency related to the Novel
Coronavirus (COVID-19)on March 11,2020 via Resolution No.35-2020 (the “Emergency Proclamation”);
and
WHEREAS,on March 16,2020,seven health officers within six Bay Area counties,including San Mateo
County (“County”),took a unified step to slow the spread of COVID-19 and preserve critical health care
capacity across the region by issuing a legal order directing their respective residents to shelter at home and
limiting activity,travel and business functions to only the most essential needs for three weeks,beginning
March 17, 2020; and
WHEREAS,on March 19,2020,Governor Gavin Newsom issued a statewide order ordering all individuals
living in the State of California (“State”)to stay home or at their place of residence,except as needed to
maintain continuity of operation of the federal critical infrastructure sectors; and
WHEREAS,on May 13,2020,the City Council amended and updated the Emergency Proclamation via
Resolution No. 57-2020; and
WHEREAS,the County and six other Bay Area jurisdictions have been under a Shelter in Place public health
order due to COVID-19 since March 17,2020 and multi-month closure of many of the County’s local
businesses is putting a huge financial strain on all industries; and
WHEREAS,on June 17,2020,the San Mateo County Health Officer and the County Health Department
announced revised orders to align with State Health Orders allowing for the continued re-opening of
businesses,provided that gatherings are not to exceed 50 people,allow for social bubbles,adherence to social
distancing requirements,face covering requirements,and requirements for businesses to implement a social
distancing protocol and written health and safety plans; and

WHEREAS,in conjunction with the revised County Health Orders,nearly all cities in San Mateo County have
implemented an outdoor dining program; and
WHEREAS,the City has an important governmental interest in maintaining a healthy,active,and thriving
business community and protecting the health, safety, and economic welfare of its citizens and businesses; and
WHEREAS,to protect the health and safety of the City,while fostering economic wellbeing of the City's
citizens and businesses,the City wishes to assist both essential and non-essential businesses in remaining open,
or re-opening when lawfully permitted to do so; and
WHEREAS,to achieve this purpose,the City wishes to implement an Outdoor Dining Pilot Program (the
“Program”),which would allow interested restaurants and businesses within the Downtown zoning districts to,
with review and approval by the City,utilize public right-of-way space,including adjacent parking spaces,for
an expanded dining area; and
WHEREAS,the Program would require participating restaurants and businesses to adhere to specific
performance standards and checklists, attached hereto and incorporated herein as Exhibits A and B; and
WHEREAS,for the City’s business community to survive the challenge presented by the COVID-19 pandemic
and the resulting business closures,the City Council finds that temporary emergency modifications to existing
policies and regulations are needed to help implement the Program; and
WHEREAS,under the current emergency circumstances,the City Council finds that it is in the best interests of
the public health,safety and welfare to permit the temporary use of the Downtown Area public right-of-way
space by restaurants and businesses,with appropriate conditions to preserve the public safety and necessary
public access to those resources,and finds that City staff should be given broad discretion to modify existing
City policies,procedures and regulations in order to effectively assist the City’s local businesses in their
reopening efforts; and
WHEREAS,except as amended herein,the City Council desires to continue to enforce the other provisions of
the Emergency Proclamation as previously approved and amended.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San Francisco that:
1.The above recitals are true and correct and incorporated herein by this reference.
2.The Outdoor Dining Pilot Program is hereby approved and the City Manager is authorized to implement
the Program,including the temporary authority to allow the utilization of,or to approve use and
occupancy of,the public right-of-way by businesses,eating and drinking establishments,and retailers,
consistent with the provisions of this Emergency Proclamation.Any authorization granted pursuant to
the authority provided herein shall be consistent with the requirements set forth in any applicable shelter
in place order applicable within San Mateo County.
3.A Program budget of $35,000 is hereby approved for its implementation,such as to fund the cost of
installing protective barriers and signage, and associated labor costs.
4.The following temporary changes are made to the South San Francisco Municipal Code (“SSFMC”)to

4.The following temporary changes are made to the South San Francisco Municipal Code (“SSFMC”)to
facilitate the implementation of the Outdoor Dining Pilot Program within the Downtown Districts as
defined in SSFMC Title 20, Chapters 20.020 and 20.100:
a.Notwithstanding applicable regulations of Title 13,Chapter 13.04 relating to Encroachment
Permits,the City’s Encroachment Permit application fees may be waived for all applications that
further purposes of the Outdoor Dining Pilot Program.The “Encroachment Permit Application -
COVID-19 Addendum”,attached hereto as Exhibit C and incorporated herein is hereby adopted
for use for all applications submitted to the City pursuant to this resolution.
b.Notwithstanding Section 20.350.030,the City Council hereby temporarily suspends regulations
pertaining to outdoor and sidewalk seating to the extent necessary to further purposes of the
Outdoor Dining Pilot Program.
c.Notwithstanding applicable regulations of Title 11,Chapters 11.40 and Title 20,Chapter 20.330,
the City Council hereby temporarily suspends the application of on-site parking requirements,
including any parking requirements related to the computation of spaces per ratio of gross floor
area or customer seating area,for Eating and Drinking Establishments,Food and Beverage
Retail Sales,and Retail Sales in the Downtown Districts,to the extent necessary to further
purposes of the Outdoor Dining Pilot Program.The City Manager is hereby authorized to
impose conditions of approval upon any proposal to temporarily repurpose or convert existing
parking spaces to accommodate outdoor dining,Food and Beverage Retail Sales,and Retail
Sales in the Downtown Districts,to the extent necessary to implement the Outdoor Dining Pilot
Program.
d.Notwithstanding Sections 20.440.007 and 11.56.020,the City Council hereby declares that the
Parking Place Commission’s parking authority for the Downtown District/Downtown Parking
District is temporarily suspended with regard to any public parking reasonably determined by
the City Manager to be necessary to effectuate the Outdoor Dining Pilot Program,including the
Parking Place Commission’s authority to review and approve parking rates,time limits,and
hours of operation,and that authority is temporarily vested with the City Manager to the extent
required for the purposes of the Program.
e.Notwithstanding Sections 20.360.006,subsection (p),and 20.360.009,the City Council hereby
temporarily suspends regulations and permit requirements applicable to temporary signs as
applicable to Eating and Drinking Establishments,Food and Beverage Retail Sales,and Retail
Sales in the Downtown Districts,to the extent necessary to further purposes of the Outdoor
Dining Pilot Program.The City Manager is temporarily vested with the authority to regulate
these signs,review and approve signage plans,set installation and display requirements,and
approve proposals to erect temporary commercial signs and window signs,consistent with other
applicable provisions of the South San Francisco Municipal Code.
f.Notwithstanding Sections 10.40.030 and 10.40.040,to the extent necessary to effectuate the
Outdoor Dining Pilot Program,the City Council hereby temporarily suspends regulations
pertaining to alcohol consumption in public places and in parking lots as applicable to Eating
and Drinking Establishments,Food and Beverage Retail Sales,and Retail Sales in the
Downtown Districts,and the City Manager is temporary authorized to permit outdoor

consumption of alcohol as part of the Outdoor Dining Pilot Program.
g.The City Manager is temporarily vested with the authority to approve temporary and/or
intermittent street closures as part of the Outdoor Dining Pilot Program,subject to any and all
conditions and/or limitations deemed necessary by the City Manager to facilitate safe and
orderly closure of such roadways and to protect public health and safety.
5.In addition to the specific authorizations granted above,the City Manager is temporarily vested with the
authority to suspend,waive or modify all other City of South San Francisco regulations and/or policies
to the extent that:(1)such regulations or policies would otherwise prohibit businesses from engaging in
their business activities outdoor or curbside in the Downtown Districts;(2)is necessary to further the
purpose of the Outdoor Dining Pilot Program;and (3)such suspension,waiver or modification does not
result in an increase in general intensity of use beyond what is otherwise allowed, as applicable.
6.In exercising the temporary authority pursuant to this resolution to allow the utilization of,or to approve
use and occupancy of,the public right-of-way,the City Manager shall also require businesses,eating
and drinking establishments and retailers to comply with applicable building code standards and the
City’s insurance and indemnification requirements.
7.The authority temporarily vested in the City Manager pursuant to this resolution may be delegated by
the City Manager to his designee through written delegation of authority signed by the City Manager.
8.Nothing in this resolution shall relieve a business from any the following:
a.The requirement to comply with the Outdoor Dining Pilot Program standards and checklists set
forth in Exhibits A and B.
b.Any obligations or laws requiring consent of adjacent property owners for use of private
property.Businesses seeking to operate outdoors shall obtain consent of any private property
owners whose property will be used for outdoor operations.
c.The requirement to obtain a building permit for outdoor activities if a building permit would
otherwise be required,and compliance with all provisions of the Building Code,including but
not limited to, maximum occupancy requirements.
d.The requirement to undergo design review for exterior alterations if such design review is
otherwise required,except that temporary installations,including but not limited to tents,
fencing,barriers,enclosures,and platforms and ramps,may be authorized by the City Manager
to facilitate proposed outdoor activities consistent with the provisions of this resolution.
e.The requirement to obtain any and all County and State permits regarding the provision of food
and dining services,including alcoholic beverages,including but not limited to the COVID-19
Temporary Catering Authorization required by the State Department of Alcohol Beverage
Control.
9.All temporary suspension of regulations and requirements of the South San Francisco Municipal Code
and temporary delegation of authority provided for in this resolution shall remain in effect for the

and temporary delegation of authority provided for in this resolution shall remain in effect for the
duration of the Emergency Proclamation,as adopted by Resolution No.35-2020,and shall expire upon
the termination of the Emergency Proclamation by the City Council.
10.Except as specifically amended herein,Resolution No.35-2020,as previously amended and updated,
shall remain in full force and effect.
BE IT FURTHER RESOLVED that this resolution shall become effective immediately upon its adoption.

Exhibit A
Performance Standards for Outdoor Dining Pilot Program
Application and Submittals
1) Applicants must file an Encroachment Permit for review by the City
a. The City reserves the right to determine on a case-by-case basis the suitability and
appropriateness of the public property (sidewalk or parking area) requested by the
restaurant for outdoor dining.
b. Available right-of-way or parking spaces to be used for outdoor dining shall be
identified based on the availability of the space fronting the business and may not
include areas fronting adjacent businesses without consent
c. Encroachment Permit Fees $325 (per Adopted Master Fee Schedule 2019-2020)
may be waived to reduce cost-associated barriers for business/restaurant
participation
d. Parking meter revenue that would not be collected to be considered by Parking
Place Commission after the program’s launch
2) Participation in the Temporary Dining Program is limited to 30 days, with the option to
review and extend for another 30 days, but no more than 90 days total.
3) Applicants must comply with San Mateo County Outdoor Dining Safety Requirements,
including on-site posting of health information for employees and patrons
4) Supplemental Information required by the San Mateo County Health Department must be
submitted to the City (i.e., Health Order Social Distancing Protocol (Appendix A))
5) Restaurants/businesses that serve alcohol may continue to serve alcohol in the outdoor
dining area, as long as specific requirements are met:
a. An applicant/operator with a current Alcohol and Beverage (ABC) license and
approval may only serve alcohol within an approved area as reviewed by ABC.
b. In the event that ABC requires layout modifications to the approved, the applicant
shall submit revised layout to the City for review and approval.
c. The applicant/operator is responsible for obtaining and conforming to ABC
requirements and file any other necessary applications to continue serving
alcohol.
d. A copy of the current ABC license shall be submitted to the City. In order to
retain the Temporary Outdoor Dining Permit and serve in the sidewalk café area,
it shall be the responsibility of the operator to maintain the license.
6) No permit shall be issued unless proof of adequate insurance, as determined by the City,
is provided by the restaurant.
7) Restaurants operate at their own risk and shall defend and indemnify the City for all
activity that occurs in the outdoor dining area.
a. Applicants must identify the City of South San Francisco as an additional insured
party and provide a copy of the insurance certificate
b. As required by the City’s Encroachment Permit, applicants shall procure and
maintain during the term of the Permit the following policies of insurance:
i. Worker’s Compensation and Employers’ Liability Insurance in the
statutory coverage.
ii. Commercial General Liability Insurance: In an amount not less than ONE
MILLION DOLLARS ($1,000,000)
iii. Automobile Liability (Code 1) Insurance: In an amount not less than ONE
MILLION DOLLARS ($1,000,000)
iv. Contractual Liability Insurance: In the amount of at least TWO MILLION
DOLLARS ($2,000,000)
Operations and Maintenance
8) Hours of operation for outdoor dining uses shall not exceed the normal hours of operation
for the corresponding restaurant or business for which the outdoor use is granted.
9) Furniture used for outdoor dining shall not be secured to lampposts, streetlights, trees or
any other public street furniture
10) All approved furniture used for outdoor dining shall be properly maintained and cleaned
regularly and be placed to allow pedestrians to move safely in the sidewalk at all times.
11) The applicant/operator shall comply with all applicable Fire and Building codes at all
times.
a. The applicant/operator shall ensure safety and stability of all equipment used for
outdoor dining.
12) Maintain required ADA access and clearances at all times.
a. Other cities provided specialized benches and/or tables where one side can be
used by people in wheelchairs or mobility devices and ADA required table
heights are maintained.
b. Also, other cities have installed temporary ramps for businesses to maintain
access for all patrons using the outdoor dining area.
13) The applicant/operator shall be responsible for the proper maintenance of the outdoor
dining area at all times, including properly disposing of all trash generated by the
operation.
a. The applicant/operator shall be held responsible for emptying and cleaning all
trash receptacles within the operating area.

As an Encroachment Permit applicant, I/we, the undersigned, hereby declare and agree to the
following:
I/we agree to comply with the June 17, 2020 ORDER OF THE HEALTH OFFICER OF THE
COUNTY OF SAN MATEO DIRECTING ALL INDIVIDUALS IN THE COUNTY TO LIMIT
GATHERINGS TO NOT EXCEED 50 PEOPLE, ALLOW SOCIAL BUBBLES, ADHERE TO
SOCIAL DISTANCING REQUIREMENTS, FACE COVERING REQUIREMENTS, AND
REQUIRING BUSINESSES TO IMPLEMENT A SOCIAL DISTANCING PROTOCOL AND
WRITTEN HEALTH AND SAFETY PLANS (“Shelter in Place Order”), and any subsequent
Health Order issued by the Health Officer of San Mateo County (“Subsequent Order”).
1. I/we further agree to comply with the following, as applicable (collectively, “the
Guidelines”):
a. Statewide Industry-Specific Guidance, available at https://covid19.ca.gov/industry-
guidance/, and any subsequent updates or guidelines issued by the State;
b. San Mateo County Covid-19 Requirements and Industry-Specific Guidance, available
at https://www.smchealth.org/post/covid-19-requirements-resources; and/or
c. Any applicable subsequent updates or guidelines issued by the Health Officer of San
Mateo (“Subsequent Guidelines”).
2. I/we agree to prepare, adopt, implement, post, and submit to the City a written “Social
Distancing Protocol” pursuant to Section 11 of the Shelter in Place Order and applicable
sections of the Statewide Industry-Specific Guidance, that incorporates and addresses all
applicable protocols.
3. I/we agree, in conjunction with the Encroachment Permit Application requirement, to
provide one (1) hard copy and one (1) electronic copy of improvement plans/sketches, I/we
agree to submit to the City one copy of a written statement and/or plans/sketches explaining
or otherwise demonstrating the manner in which I/we will conduct curbside and/or outdoor
business activities pursuant to this Encroachment Permit Application, including a description
of the business, proposed outdoor activities, a description of all improvements, structures
and/or materials to be used to facilitate outdoor activities, and a description of the area in
which proposed outdoor activities will take place.
4. I/we understand and agree that the City may require a Traffic and Pedestrian Control Plan to
ensure the safety of customers and employees engaged in approved outdoor activities in
public rights-of-way and that accounts for accessible pedestrian access through the area or
improvements subject to this Encroachment Permit. I/we further understand that, I/we will
operate approved outdoor activities in a manner that would facilitate immediate removal of
any obstruction of an accessible path of travel allowed as part of approved activities, once
brought to my/our attention by a member of the public. I/we also understand that the City
may, at any time and in its sole discretion, revoke or modify the Encroachment Permit to
require removal or modification of any or all improvements, structures, and/or materials used
to facilitate approved outdoor activities authorized by this Encroachment Permit.
5. I/we hereby grant the City the right to remove or relocate any or all improvements,
structures, and/or materials used to facilitate outdoor activities and to enter into our property
to effect said removal or relocation if deemed necessary by the City. I/we hereby waive any
claim or right for inverse condemnation, damages, or loss of income or business resulting
from said removal or relocation.
