IBldg Div.: CHAIRMAN COMMENTS ORAL COMMUNICATIONS: Slide Presentation by Jerome Irwin on the Squamish Indian Burial Site Example. Park Royal Shopping Center in West Vancouver, B.C., built around an Indian burial grounds. An example of what can be done to protect the shell mounds in Terrabay project's commercial area. Chairman Warren clarified that this is located in the Phase III area of the Terrabay project. David Schooley of the San Bruno Mountain W~atch Noted that the shell mounds are a few acres away from San Bruno Mountain Park and suggests that this be donated to make it a part of the park and could be preserved. Robert Corrillo 262 Hampshire Ct., Daly City Noted he hikes at the park and agrees this is a good cause; and appreciates the Commission's consideration. Report on City Tree Planting Program. Rich Bordi, Superintendent of Parks and Mr. Robin Beaudry, Parks Supervisor, presented information on the City's Tree Planting Program. Mr. Beaudry noted that trees around the City have caused damage to sidewalks, most of the trees on Miller and Grand Avenue are decaying and are being replanted with other species that do not grow taller than 8 ft. and roots grow deep not out, and will not break sidewalks or grates. Mr. Beaudry noted they are expecting a State grant and will be redoing other streets. Commission and staff discussed their concerns on the drought tolerance of these trees, methods used in trimming and care for resistance to South San Francisco's winds. Chief Planner asked if there was a plan for street tree planting. Mr. Beaudry noted that they are open for suggestions to what the residents want and does not plant the same type of tree, which damaged property. Commissioner Lucchesi asked that the replanting program have some consistencies in the Grand Avenue area. In response to his question if Planning Division had developed a plan, Chief Planner noted our Landscape Architect has put together a book of "Plants/trees that do well in South San Francisco". Jan Ponds 111 Belmont Ave., SSF Asked if all homeowners are eligible to participate in this program. Mr. Beaudry responded that there is no cost to the residents. Chairman Warren mentioned how pleased she that this service existed. David Schooley San Bruno Mountain Watch Noted he is involved with other Cities on tree planting around the bay area and notes that these groups are working hard to replant native trees to the area. Mr. Beaudry noted that replanting some oaks in the parks area is possible, but not in the residential area; and again noted they will be using the State grant money to replant in some parks in the City. Certificate of Recognition for Anthony Shen for services on Design Review Board Chairman Warren presented the certificate of recognition for the record and the letter of appreciation to accompany the certificate. Motion-Romero/Second-Padreddii: To approve Consent Calendar with Item No.6 UP-95-996 being continued to a Special Meeting of the Planning Commission for February 29, 1996 as recommended by staff It was unanimously approved by voice vote. PUBLIC HEARING - AGENDA ITEMS 162 & 164W. Harris Ave., Troyer Door Control (Doug Troyer, owner) V-95-325 and Negative Declaration No. 806 (Continued from February 1, 1996) Chairman Warren opened the public hearing. Variance to allow tandem parking and parking in required front setback situated in a Planned Industrial (P-I) Zone District, in accordance with the provisions of SSFMC Section 20.82.080. Page 3 of 11 Pages PC Meeting of 2/15/96 Interim Planner Kasparowitz presented staff report noted that Negative Declaration No. 806 was void and that application is Categorically Exempt per Class 1, Sec. 1530; the Variance is to allow parking in required yards and a reduction in the required number of spaces in accordance with the provisions of SSFMC Chapter 20.82. Also noted Finding No.4 is amended as follows: The site is physically unusual for the area, particularly that the shape is irregular which would warrant granting a variance. Mr. Troyer noted it was a pleasure to work the Mr. Kasparowitz and Planning Division staff Chairman Warren closed the public hearing. Commissioner Padreddii explained he was pleased to see the revisions to this project. The Commission was pleased with the coordination of assistance with the applicant. In answer to Chairman Warren's concern, Officer Dickson noted that the Police Department had no problems with the revised parking arrangements. Motion-DeZordo/Second-Masuda: To approve V-95-325 based on the amended findings and conditions of approval. Unanimously approved by voice vote. 110 Hickey Blvd., Shell Super Station (Ted Simas) GP-95-53, UP-95-1001, PUD-95-49, SC-95-32 and Negative Declaration No. 803 Chairman Warren opened the public hearing. Senior Planner Carlson presented staff report and noted incorporation of the UP-95-1 00 1 into the PUD-95-49 as follows: GP 95-53 General Plan Amendment to allow fast food restaurants on EI Camino Real between Westborough and Hickey Boulevards. PUD 95-49 Planned Unit Development to allow modified landscape requirements and to allow six-five parking spaces in the required front setback and to allow a 24 hour gas station, with a food mart, car wash, and a fast food restaurant facility. SC 95-32 Type C Sign Permit to allow sign areas exceeding the provisions of the sign ordinance. In accordance with the provisions contained in the SSFMC Sections, 20.22.030. 20.22.040(c), 20.22.060, 20.22.070(a), 20.76.170, and 20.84.050(a). Page 4 of 11 Pages PC Meeting of 2/15/96 Senior Planner Carlson also distributed resolutions, revisions to Planning Division's Conditions of Approval dated 2/14/96 and the traffic study. Mr. Ted Simas Extra Oil Company Noted that the Project Architect, Landscape Architect, a representative of the car wash equipment company, and the project engineer were present should the Commission have any questions. He mentioned that the project would provide additional services to the community, customers would have easy access from the pumps to the fast food restaurant and to Hickey Blvd. They will maintain landscaping for the City at the corner of Hickey and El Camino. He thanked staff for their professional assistance in processing this project. Paula Blanchfield Landscape Architect Described the screening and beautification of the lot, using durable and vibrant landscaping, corner landscaping will be improved and mature trees will not be removed. Hema Patel Wye Motel 100 Hickey Blvd., SSF Mentioned that although customers of the motel could benefit from the additional services, their concerns are the noise from a car wash, odors from drive-thru restaurant, difficult access to motel, and possible obstruction of motel sIgns. Chairman Warren closed the public hearing. The Commissioners discussed their concerns about the size and location of pumps, and the motel's concerns. Mr. Simas responded that the location of pumps would not change, the restaurant would have odor deterrent equipment on building, and the car wash is closer to the intersection so noise would be as far away from the motel as possible. Discussion continued regarding the southbound traffic from El Camino Real entering the motel's driveway and how traffic would enter into the wrong way, against the striping of their parking lot. Assistant City Attorney Seto noted the City could not impose conditions on motel property. Staff noted alterations to the project site plan in order to address potential hazards that could be mitigated without asking the adjacent property owner to restripe their parking lot. Staff recommend a review period which is done for other projects. Mr. Simas noted that the majority of the customers enter through Hickey Boulevard, but he would pay for the restriping of the motel's parking lot to avoid any hazardous conditions. Several Commissioners expressed their concern about the amount of activities on such a small site. Vice-Chairman Romero also noted that the hours of operation form 7 AM to 8PM for restaurants and car wash; and the 24-hours fuel station would be too much going on this site. Mr. Simas responded that he has developed much smaller lots with similar uses with no concerns. Commissioner Pradreddii noted support for this project. Chairman Warren also concerned with the amount of tables for eating indoor. Page 5 of 11 Pages PC Meeting of2/15/96 Commissioner DeZordo asked that a condition be added for applicant to work with planning staff/recreation staffwith regards to the upgrading of the landscaping on the corner. Mr. Jim Ratto Architect representative Responded to Commission's questions on the layout of buildings and restricted access. Commissioners discussed continued the possible obstruction of the motel's signs by this project. Mr. Simas noted he would work with the motel owners so that neither signs is blocked. The Commission asked about noise mitigation, Commissioner DeZordo suggested to berm areas adjacent to the car wash to mitigate noise levels. He noted his support of the project and having no problem with the number of tables. Staff commented on the condition that the applicant have an accoustical consultant review the construction drawings, conduct a noise assessment and report to staff prior to final inspection to ensure noise levels would not exceed City standards. The Commission was concerned with the traffic at the intersection of Hickey & EI Camino Real; and that the only access to this site requires a u-turn from Hickey. Senior Engineering Technician Harmon noted Engineering Division Condition No. 2.c. regarding the u-turn movement. He was at the site and observed that the cause of the damage to comer is due to Northbound traffic on EI Camino Real making a left turn too fast. In response to Commission's inquiry, he noted that the intersection was part of an EI Camino widening project, requested by City Council in the 1980's, funded by Caltrans and now maintained by the City. Commissioner Lucchesi asked about the possible conflict of cars leaving the drive-thru window and the motel building. Senior Planner Carlson noted the restaurant building is pulled back so that drive-thru cars will have adequate sight-line distance. Discussion continued on the drivers' restricted circulation. Commissioner Lucchesi noted possible alternatives for the. site in response to congestion due to all the uses on the site. The Commission discussed the possible uses of parking space no. 1, and restriping of the motel parking areas. Engineering Division and Police Department agree restriping will help. Officer Dickson noted the entrance has no history of accidents. The Police Department wants the menu sign be moved back. Ms. Patel noted they are willing to make everything safer. Richard Harmon noted that both parking areas are recommended to be striped in the same direction. Senior Planner Carlson noted the revision to (Page 3 of General Plan staff report) Policy 29 - to read: "with limited sitting, not to exceed 20 seats" Page 6 of 11 Pages PC Meeting of2/15/96 Motion- DeZordo/Second-Masuda: To recommend to City Council approval of Mitigated Negative Declaration No. 803. Approved by unanimous voice vote. Motion-DeZordol Second-Luchessi: To approved General Plan Amendment GP-95-53 as modified. Approved by unanimous voice vote. Motion-DeZordo/Second-Lucchesi: Motion of a resolution recommending that the City Council approve the Mitigated Negative Declaration 803 related to the General Plan Land Use Element Amendment to allow fast food drive-thru restaurants on El Camino Real between Westborough and Hickey Boulevards in commercial centers. Unanimously approved by voice vote. Motion-DeZordo/Second-Masuda: Motion of a Resolution approving 1) Planned Unit Development 95-49 to allow a gas stations, food mart, car wash, and fast food drive-thru restaurant facility and to allow off-site landscaping with six parking spaces in a required front setback, and 2) Type C sign permit 95-35 to allow a sign program which exceeds the maximum permitted standards. Ayes: Noes: Absent: Chairman Warren, Commissioners DeZordo, Padreddii, and Masuda; Vice-Chairman Romero and Commissioner Lucchesi; Commissioner Barnett. Planning Division Condition No. 1 is revised to read "1. The on-site project shall be..." ; Planning Division Condition NO.7 is revised to read, " 7. The owner shall install landscaping as approved by the landscaping plan and shall refurbish the planters and hardscape as approved by the City's Landscape Architect and the Director of Parks, Recreation and Community Services. After completion of the refurbishing of the planters and hardscape, the owner shall not be responsible to repair the same in the event of danlage or destruction. Thereafter, the owner shall maintain and restore, as necessary, the landscaping vegetation off-site for a period of two (2) years. The owner shall present to the Director of Parks, Recreation, and Community Services the form of the landscaping maintenance contract which the owner proposes to enter into for the maintenance of the off-site landscaping vegetation. The owner shall maintain the off-site landscaping for so long as the owner occupies and utilizes the site. "; Planning Division Condition No.9 is replaced with the following: "9. Prior to the issuance of the building permit, the applicant shall present plans acceptable to the City's Chief Planner that denlonstrates the nlaintenance of the visibility of the Wye Motel business signage fronl EI Camino Real and/or Hickey Boulevard to the Page 7 of 11 Pages PC Meeting of2/15/96 general extent presently available to the motel. Said plan shall include, if in the opinion of the Chief Planner, it is necessary the provisions of new signs of not less than an equivalent quality of the existing signs or the relocation of existing signs in a manner reasonably acceptable to the owner of the motel. The cost of said improvements shall not be in an amount that creates an unreasonable burden to the applicant. " Planning Division Condition No. 10 is added to read: "10. Prior to the final inspection, the applicant shall work with the motel owner to restripe and realign the entry curb for the motel parking to reduce circulation conflicts. The cost shall be borne by the applicant" "and matter shall be to the satisfaction of the City Engineer. " Planning Division Condition No. 11 is added to read: "11. No off site glare shall occur from on-site lighting. " Mitigation Measure No.4 is revised by including the following: "...shall take all reasonable steps to mitigate the noise impact to the nlotel including but not limited to the berming of the island between the carwash and motel". Chairman Warren at 10:30 PM called for a 10 minutes recess. Meeting resumed at 10:40 PM. 190 East Grand Avenue, Lava Espresso (Olympian Oil Co., Owner) UP-96-003 and UP-95-997/Mod 2 Use Permit Modification and Use Permit to allow establishment of a self-contained coffee cart on the Olympian Oil truck parking site located in a Planned Industrial (P-I) Zone District in accordance with the provisions of SSFMC Sections 20.32.070 and Chapter 20.91. Chairman Warren opened the public hearing. Commissioner Masuda asked if they would close when a permanent operation is in place? Interim Planner Kasparowitz responded that it is up to the owner. Police Department had no concerns. Unanimously approved through voice vote. 606-608 Linden Avenue, Di Napoli Pizza (Lawrence Bertolucci, Owner) UP-96-013 and V-96-013 Use Permit for a limited service restaurant within 200 ft. of a residential zone and Variance for exemption from parking requirements for a 507 sq. ft. expansion situated in a Retail Commercial (C-I-L) ZoneDistrict, in accordance with the provisions of SSFMC Section 20.82 and 20.22.030. Chairman Warren opened the public hearing. Commissioner Lucchesi abstained from this item and stepped down from the dais. Interim Planner Kasparowitz presented the staff report. Raphael Rivera 608 Linden Ave. SSF The City had asked them to survey the number of cars and he noted the restaurant is located far from main traffic of Grand Avenue, most of their customers are walk-ins. He started meetings with his delivery drivers and gives salary incentives to safe drivers. There is parking for drivers and customers at the Liberty Bank parking lot and he has their permission to use it. Interim Planner Kasparowitz read the following into the record Ms. Alegria could not be present due to the late hour: Maria Alegria 227 California Ave., SSF Asked that the Commission look at the traffic problems, California and Linden Avenues have a high level of traffic and an added restaurant would add to the traffic, please make some adjustments. Mr. Silva Drake Ave., SSF He mentioned that families enjoy eating there, their baseball league is sponsored by DiNapoli. He has never had any problems with parking, he feels there is no litter problem. Tracy Herrera Burlingame, CA She was a waitress there for 3 years and saw no parking problems. She noted that they have evening rush hours when most of the other businesses are closed. Chairman Warren closed the public hearing. Page 9 of 11 Pages PC Meeting of 2/15/96 The Chief Planner noted that use had been operating without a permit. The Commission discussed the use's situation. Assistant City Attorney Seto clarified that variances are given due to physical problems of the property. The Chief Planner noted a section of the State law that provides for variances which allow use of off-site parking in case where there is public transportation; this case can provide both. Staff noted that they have asked applicant for a letter from Liberty Bank allowing them to use parking spaces. Assistant City Attorney Seto noted she agrees with the variance clause. Commissioner Padreddii noted he is pleased that applicant is addressing the the Police Department's concerns. The Commission discussed the traffic and noise problems, and advised the applicant that he needs to address these. The applicant stated that the two issues of concern were to open the eat-in area and driver problems; he feels he has answered those concerns. Interim Planner Kasparowitz recommended a one-year review period to come back to the Planning Commission for review. Chief Planner Solomon verified that the Commission wished to amend findings to the variance as follows: Ul. The variance will be an incentive and benefit to the non-residential development. 2. The customers will be able to use public transportation when using the development. " And the Planning Division Condition No. A.I is revised to read: A.l. ".....the applicant shall provide evidence in a form acceptable to the Chief Planner of provisions for off-site parking....." Planning Division Condition No.4 to be added to read: U4. This application is subject to a review of compliance to conditions of approval one year from this action. " The Commisson agreed. Commissioner Romero asked that the area be painted and maintained; and that the property owner be notified of such need. Chief Planner noted the CDBG program is available for this area. Motion-Romero/Second-Padreddii: To approve UP-96-013 and V-96-0I3 based on the attached and amended findings, letter from Liberty Bank permitting his business to use parking lot, and this application will be reviewed in one-year. Commissioner Lucchesi returned to dais. Page 10 of 11 Pages PC Meeting of 2/15/96 ADMINISTRATIVE BUSINESS: Discussion on Design Review Board Composition Chief Planner Steve Solomon read into the record the ordinance on the composition of the Design Review Board (DRB). The Commission discussed the pros and cons of one or two of several professions, for example: Landscape Architects, Architects, Contractors, or Urban Designers. Chairman Warren suggested to open the position and advertise for "interested parties in serving on the DRB" Vice-Chairman Romero asked to include "a resident of SSF interested in serving". Present composition of the DRB is as follows: 2 Architects, 1 Horticulturist, and 1 Contractor. Interim Planner Kasparowitz noted that the Planning Commission is a "community board" and that the DRB is a "professional advisory board". Chief Planner Solomon suggested that the Commission review the ad before it goes to the paper. Commissioner Lucchesi suggested that in order to keep a quorum at all meetings that an alternate board members be selected. The Commission directed staff to advertise for a new Design Review Board member, but not to specify any particular background to see what they get. Items from Staff: A memorandum from Director ofE&CD was distributed to the Commission regarding a joint meeting with the City Council, attached was a draft agenda. Romero wanted to add an issue to the agenda. Marty VanDuyn noted there are opportunities on the agenda to add. Items from Commission: Discussion on the formation of the Planning Commission Staff and Project Recognition Committee. Chairman Warren described purpose. Commissioner DeZordo asked that a Subcommittee be appointed. Commissioners DeZordo and Romero volunteered, and Commissioner Lucchesi volunteered as alternate if Commissioner Barnett is not interested in serving in this committee. Assistant City Attorney noted this is an Ad-hoc Committee, and asked the Commission to decide how permanent this is going to be. Chairman Warren asked that this item be discussed at the Joint meeting with the City Council on March 6th. Adjournment: Motion-MasudalSecond-Lucchesi: Motion to adjourn meeting at 11:45 PM.
