The City Council of the City of South San Francisco does
ordain as follows:
Section 1. It shall be unlawful for anyone to park any
vehicle, as that term is defined in the Vehicle Code of the State
of California, for a period longer than One Hundred Twenty (120)
consecutive hours upon any city-operated parking lot, or any public
street% thoroughfares, or other public property within the corporate
limits of the City of South San Francisco.
Section 2. It shall be unlawful for any person to repair,
dismantle, disassemble, or perform any other such work upon any
vehicle, when such vehicle is parked upon any city-operated parking
lot or upon any public street or thoroughfare, or other public
property within the City of South San Francisco.
Section 3. It shall be the duty of the Police Department
to remove, and tow to the nearest reliable storage garage, any
vehicle that has been left in one position on any city-operated parking
lot or public street for a period of more than One Hur~Ped Twenty (120)
consecutive hours.
Section 4. ~nenever the Police Department, acting pursuant
to the terms of this ordinance, removes a vehicle from any public
street, city-operated parking lot, or other public property, said
Department shall immediately give, or cause to be given, to the owner
of said vehicle, notice in writing of the fact of such removal in the
manner prescribed in Sections 585 (c) and 585 (d) of the Vehicle Code
of the State of California.
Section 5. Whenever any vehicle has been removed to a
garage pursuant to the provisions of this ordinance, and the keeper
of such garage has received from the Police Department information
or evidence that the notice or notices hereinbefore provided for
have been given, such keeper shall have a lien, dependent upon
possession, for his compensation for towage and for caring for
and keeping safe such vehicle, and if said vehicle is not recovered
by the owner after receiving notice, or if the owner is unknown,
the t:eeper of said garage may satisfy his lien in the manner specified
in, and after giving the notices required b~ Sections 427, 428, 428.5,
and 429 of the Vehicle Code of the State of California.
Section 6. The Police Department is hereby authorized
to place upon all city-operated parking lots appropriate signs
notifying the public of the provisions of this ordinance.
Section 7. The provisions of this ordinance shall not
apply to publicly owned vehicles and those of any public utility
while the operators of any such vehicles are engaged in the
necessary performance of public duties or to vehicles which are
temporarily disabled and the operators of such vehicles are engaged
in making emergency repairs, provided that such repairs can be
made within a period of eight (8) hours.
Section 8. If any section, subsection, subdivision,
sentence, clause or phrase of this ordinance is for any
reason held to be unconstitutional or invalid, such decision shall
not affect the validity of the remaining portions of this ordinance.
The City Council hereby declares that it would have passed this
ordinance, and each section, subsection, subdivision, sentence,
clause and phrase thereof, irrespective of the fact that any one or
more sections, subsections, subdivisions, sentences, clauses, or
phrases be declared unconstitutional or invalid.
Section 9. All ordinances and parts of ordinances o£
said City in conflict with this ordinance, to the extent of such
conflict and no further, are hereby repealed.
Section 10. Any person, persons, firm or corporation who
shall violate this ordinance shall be guilty of a misdemeanor, and
upon conviction thereof, shall be punished by a fine not exceeding
One Hundred Dollars ($100.00), or by imprisonment for a period not
exceeding thirty (30) days, or by both such fine .and imprisonment.
Section ll. This ordinance shall be published once as re-
quired by law, and shall take effect and be in force following the
passage of thirty (30) days from and after its adoption.
