410 S. Airport Boulevard. Comfort Inn (Forsyth Living Trust). PUD-95-41. Negative
Declaration No. 790
Planned Unit Development to construct a 45 rOOln hotel with less than standard setbacks and
parking improvements, in the P-C Planned COlnnlercial Zone District, in accordance with
SSFMC Chapter 20.84.
Chairman Lucchesi open the public hearing. Chief Planner Solomon presented the staff
report.
Applicant's Representative:

Mr. Dell'Angela stated he agreed with staff report and recommended Option "A". Noted that
the architect, Mr. Seran, was also present to answer any questions.
Speaking with concern:

Mr. GIeger was concerned with sign age visibility for See's Candies building and parking.
Suggested timed parking on Marco Way.
A discussion followed on cutting back tree size at the northeasterly corner of the project.
Commissioner Masuda asked the applicant if he would consider to cut back to a 40 room
hotel? Mr. Dell' Angela responded by citing the traffic study and shuttles used at airport to
alleviate parking congestion. He did a survey on Marco Way at 10 PM on July 4th and 5th,
there was sufficient parking, only Grosvener is open in that area at that time. Chief Planner
Solomon noted that Condition #4 requires shuttle services from 6AM to 9PM, to and from
SF International Airport. The Commission discussed parking concerns and use of airport
shu ttle.
Mr. Dell'Angela asked that a person knowledgeable on shuttle services speak.

Mr. Ng stated 20% of business comes from shuttle, which would reduce parking needs by
20%.
Chairman Lucchesi closed the public hearing.
Commissioner Padreddii stated that he spoke with See's Candies representatives. They will be
putting up "No Parking" signs on their property and asked that the landscaping be limited in
height to not block See's signs. Traffic study shows only 4 parking spaces are missing and
Commissioner Padreddii agreed that this is not a problem with shuttles serving 20% of
parking needs. Commissioner DeZordo agreed.
Motion-Romero/Second-Masuda: To approve resolution recommending City Council approve
Negative Declaration No. 790 and PUD-95-41 Staff's Option "C" (41-room) based on the
findings and subject to modified conditions of approval.
Add the following to Planning Condition # 1a: "The floor plans shall be modified to
include a maximum of 41 rooms." and,
Add to Planning Condition #7 to read: "Subject to the approval of the City's Landscape
Architect, the Eucalyptus located in the northeasterly corner of the project site shall be

relocated or removed, in order to protect the visibility of the business signage on the
adjoining property to the north."
It was approved by the following roll call vote: AYES: Chairman Lucchesi, Commissioners
Barnett, Masuda, and Romero. NOES: Commissioners DeZordo and Padreddii. ABSENT:
Vice-Chairman Warren.
Commissioner Romero advised he would be abstaining from next Item due to possible conflict
of interest and stepped down from dias.
410-470 Noor Avenue. Century Plaza (Syufy Enterprises and Alioto Fish Co.. owners)
PUD-95-42. Negative Declaration No. 792
Planned Unit Development to allow modifications to a retail and theater complex located in
the P-C Planned Commercial Zone District including: 1) a 300 seat, two theater expansion to
the cinema; 2) removal of an existing condition restricting hours of operation for the existing
50,000:!: sq. ft. retail building; 3) a new 13,000 sq. ft. commercial building pad; and, 4) a
reduction in the standard number of parking spaces, together with landscaping and parking
improvements, in accordance with the provisions of SSFMC Chapter 20.84.
Chairman Lucchesi open the public hearing. Chief Planner Solomon presented the staff
report.

Mr. Corey noted that Mr. Raymond Syufy of the Syufy Company, and Mr. Steve Atkinson of
Baker & McKenzie for Alioto Fish Co. were also present to answer any questions.

Mr. Corey discussed what they were trying to accomplish with this item to avoid going through
litigation. He stated that there was only one item of concern: Planning Division Condition
#6.g. He and City Staff have been working on incorporating Condition #6.g. with Condition
#5 with language incorporating objective standards for actions. If they could come up with
that solution, the applicants would be satisfied.
Commissioner DeZordo asked if he had proposed language? Mr. Corey answered, "They
could come up with satisfactory language in a short time." Commissioner DeZordo asked if
they recessed for a few minutes, could they come up with something at this meeting? Mr.
Corey answered in the affirmative.
City Attorney Mattas suggested that the Commission table this item, hear Item 3, and return
with a revised condition.
Chairman Lucchesi tabled Item 2.
751 Airport Blvd.. Patel Motel (Raj Patel. owner). PUD-95-43. Negative Declaration No. 795
Planned Unit Development for the construction of a 30 unit motel plus manager's unit with
less than standard setbacks and parking located in the P-C Planned Commercial Zone
District, in accordance with SSFMC Section 20.84.
Chairman Lucchesi open the public hearing. Chief Planner Solomon presented the staff
report.

Mr. Leong stated he had no problem with the staff report requirements. He did explain that
the tower needed to be in front of the building to enhance front signage.

He asked everyone in the audience with the Association to stand for a moment so the
Commission could see who he was representing. He commented on the effects (pros and
cons) to the community surrounding the project and how few people were mailed a notice of
this meeting. He felt that many of the notices went to out of town landlords who have very
little concern of the area. He recommended that this item be sent back for review by the
community before it is considered.

They supported the idea that this item be investigated more and get input from the
surrounding community first before being considered. They were concerned that no one who
lives in the neighborhood was notified. They were concerned that parking on the street is
limited.
Chairman Lucchesi closed the public hearing.
Chief Planner Solomon noted that the legal notice was published in the local newspaper and
mailed to property owners within 300 feet of the project as required by state. The
Commission noted that anyone wishing to be notified to contact the Planning Division.
Commissioner Padreddii suggested that the applicant and residents meet to go over the
project details. A discussion continued on how such a meeting could be a positive input. The
Commission felt it best to continue this item to allow them to meet. The applicant agreed to
a continuance to the next Planning Commission meeting.
Motion-DeZordo/Second-Romero: To continue Negative Declaration No. 795 & PUD-95-43
to the July 20th meeting to allow the applicant to meet with the Association. It was
unanimously approved by voice vote.
Chairman Lucchesi adjourned for a ten-minute recess at 8:45 P.M. He readjourned the
meeting at 8:50 P.M.
Commissioner Romero advised he would again be abstaining from this Item and stepped
down from the dias.

PUD-95-42. Negative Declaration No. 792
City Attorney Mattas stated the issues they discussed, where they have come to agreement

and what they propose for Planning Commission consideration; and noted that applicants are
agreeable with most of the conditions of approval. The Commission discussed the changes.
City Attorney Mattas then advised that litigation is pending and the parties have been granted
time by the court to seek a resolution acceptable to the City instead of going to court. This
does not bar, or direct Planning Commission action tonight, but it is a factor. Staff is
attempting to take this to the Council by the last meeting in July.
City Attorney Mattas further noted that the last outstanding issue is the Applicant's request
that Condition #5 be sunsetted for three (3) years after completion of the building on parcel
E. This was just discussed today, the completion of a building on parcel E does not
necessarily correlate with when attendance might increase at the theater. Condition 5 assumes
that attendance may increase beyond 4,360. Staff may not recommend agreement with the
sunset clause which is something the Commission may want to discuss.
The Applicant stated they are satisfied with the description of discussions given by the City
Attorney, they ask that the Commission recommend this to the Council on the basis of these
revisions. Discussion continued about the existing condition of property, parking enforcement
through the Parking Management Plan and how occupancy would be favorable. City Attorney
Mattas explained how parking enforcement process works.
Chairman Lucchesi discussed his concerned with the parking, and Parcel D and E.
Motion-DeZordo/Second-Padreddii: To approve resolution recommending City Council
approve Negative Declaration No. 792 and PUD-95-42 Option A based on the findings and
subject to modified conditions of approval.
Condition #A.5.b. to read as follows:
"In the event that the daily evening attendance has exceeded 4,360 more than ten (10)
eight (8) times within the prior twelve months, the City Council may require that the
applicants (1) obtain and provide for additional parking on or within 300 feet of the
project site (identified as Parcels A,B,C,D and E) or reduce demand for parking by, for
example, removing seats from the theater complex or any other similar action that
reduces parking demand. The additional parking or other remedial actions shall be
sufficient to meet 95% of annual evening attendance demand!, plus an additional
number of spaces equal to 10% of the spaces necessary to meet that demand.
Condition #A.6.g -was made Condition #A.7. to read as follows:

7. "In the event the Director of Economic and Community Development
determines that the approved Parking Management Plan does not accomplish the
parking mitigation identified in the traffic report, he or she may require removal of up
to 300 theater seats. The theater owner/operator shall remove the seats within 60 days
of receipt of written notice from the City. Appeal from the Director of Economic and
Community Development's decision may be made pursuant to the procedures set forth
in Chapter 20.90 of the South San Francisco Municipal Code.
As an alternative to removal the theater owner/operator may provide additional
parking or mitigation pursuant to Condition 5.b.

The preceding conditions to be renumbered successively.
The l1.g. now Condition 12.g. to read;
"Any ~ unused loading doors on the easterly side of the big box retail building on
Parcel D shall be removed and the openings finished to match the surrounding wall. "
It was approved by the following roll call vote: AYES: Commissioners DeZordo and
Masuda, and Padreddii. NOES: Chairman Lucchesi and Commissioner Barnett.
ABSTAINED: Commissioner Romero. ABSENT: Vice-Chairman Warren.
Commissioner Romero returned to the dias.

Items from Staff
Chief Planner Solomon recommended that they continue discussion on this item, East of 101
Area Plan Implementation, to next meeting. Unanimous voice vote for continuance.
Items from Commission
Commissioner Romero commented on Macy's landscaping at EI Camino Real needs to be
cleaned. Chief Planner Solomon noted that a letter will be sent to Macy's asking
improvements to their landscaping.
Commissioner Masuda also asked that a letter be sent to Koit their property is in need of a
trash bin.
Commissioner DeZordo asked what is the process to change an ordinance or general plan
amendment. City Attorney advised and noted that the Planning Commission is an advisory
commission to Council on general plan and zoning code amendment issues.
