File No. 509~ ORDINANCE NO. 395 AN ORDINANCE OF THE CITY OF SO~H SAN FRANCIS~ LIMITING T~ GROSS WEIGHT OF VEHI~S TRAVERSING VIL~GE WAY AND A PORTION OF ~YFAIR The City Council of the City of South San Francisco does ordain as follows: WHEREAS Village Way and that portion of Mayfair Avenue extending between the intersection thereof with West Orange Avenue and the intersection thereof with Fir Avenue are narrow streets lying within residential districts wherein reside several families among the members of which are many small children; and WHEREAS the aforedesignated streets are subjected to non- essential use by operators of vehicles having a gross weight (combined weight of vehicle and load) in excess of three and one- half (3-1/2) tons, all of which exposes the aforesaid families and the members thereof to traffic hazards which are unnecessary and which are avoidable by the rerouting of such vehicles, NOW, THEREFORE, IT IS HEREBY ORDERED AS FOLLOWS: Section 1. The term "vehicle" as employed herein shall bear the same definition as is set forth in Section 31 of the Vehicle Code of the State of California, but shall be applicable only to those vehicles which have a gross weight (combined weight of vehicle and load) in excess of three and one-half (3-1/2) tons. Section 2. It shall be unlawful for any person at any time to drive or propel any vehicle, as hereinabove defined, over or upon Village Way and over or upon that portion of Mayfair Avenue specified in the premises hereto, save and except that permission shall first be obtained from the Police Department of City in accordance with the provisions of the next section hereof. Section 3. Any person having need to traverse said Village Way and said portion of Mayfair Avenue with a vehicle of a gross weight in excess of the limitation prescribed in Section 1 hereof, shall first make application to the Police Department of City for permission to so use said streets. Said Police Department shall grant permission upon a satisfactory showing of such need.~ . Section 4. The Superintendent of Public Works shall cause appropriate signs, indicating the aforesaid load limitation, to be erected at each end of Village Way and at each end of the afore- described portion of Mayfair Avenue. ~ection 5. Any person, firm, or corporation who, or which, shall violate this ordinance shall be deemed guilty of a misde- meanor and, upon conviction thereof, shall be punished by a fine of not less than One Hundred Dollars ($100.00) nor more than Two Hundred Dollars ($200.00), or by imprisonment for a period not ex- ceeding sixty (60) days, or by both such fine and imprisonment. Section 6. No sentence or fine imposed hereunder shall be suspended. Section 7. This ordinance shall be published once as required by law and shall take effect and be in force thirty (30) days from and after its adoption. Introduced this 211~ day of May 1956.
