HomeMy WebLinkAboutOrd 486-1962 ORDINANCE NO. 486 AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO CALLING~/~,_ A SPECIAL ELECTION TO BE HELD ON THE 5th DAY OF Februar~ , 1963 , PERTAINING TO THE ANNEXATION O~' "TK~ASUKE ISLAND" T~-~HE CITY OF SOUTH SAN FRANCISCO WHEREAS, by Resolution No.3532, the City Council of the City of South San Francisco declared its intention to call a special election to be held on the 5th day of February , 19 63 , in certain inhabited territory contiguous to said city pro- posed to be annexed to the city, for the purpose of submitting to the qualified electors residing in said territory the question whether or not the territory shall be annexed to the city; and WHEREAS, a copy of said resolution was published as required by law; and WHEREAS, at a time not later than the hour set by said reso- lution for hearing objections to the proposed election protests were not made by the owners or by public and private owners equal to one-half of the value of the territory proposed to be annexed; and WHEREAS, all proceedings have been had in accordance with said resolution and the Annexation Act of 1913, reference thereto hereby being made for further particulars; NOW, THEREFORE, the City Council of the City of South San Francisco ordains as follows: 1. 1. A special election is ~reby called to be held on the 5~ day of Februa~ , 1963 , in the territory here- inafter described and proposed to be annexed to the City of South San Francisco for t~ purpose of submitting to the ~alified electors residing in said territory the question whet~r or not such terri- tory s~ll be annexed to, incorporated in, and ~de a part of said City of South San Francisco, and whet~r or not the property in said territory s~ll, after such annexation, be subject to taxation, equally with the property within the City of South San Francisco, to pay the entire bonded indebtedness of the City of South San Francisco outstanding or authorized at the date of the first publication of the notice of election for the acquisition, const~ction or com- pletion of ~nicipal improvements. Said territory is described as follows: TREASURE ISLAND ANNEXATION BEGINNING at a point on the existin§ corporate limit line of the City of South San ~rat, cisco as established by City Ordi- nance No.299, (Winston i~nor Annexation) passed by the City Council of the City of SouCh San Francisco on August 21, 1950; said point of beginning being a 3/4~' iron pipe monument set in the Eastern line of E1 Camino Real (State Highway) at the South- ern corner of that certain 2.O1 acre tract as conveyed to M. Whelen by deed recorded February 18, 1905 in Book 113 of Deeds at page 374, Records of San Mateo County; said corner point also being a point on the Corporate limit line of the Town of Colma as established by the Resolution for incorporation of the Town of Law, dale (now the Town of Colma) by the San Marco_ County Board of Supervisors - filed August 4, 1924 in minutes Book No.24 at page 91 in Office of the County Clerk of San Marco County; thence on and along said corporate limit of the Town of Colma and along the Southeastern line of said 2.O1 acre Tract North 49° 48' 2~~ East 409.48 feet to a 3/4" iron pipe monument set an the Western line of the Market Street Railroad Company right of way; thence along said Market Street Railway Company right of way, and con- tinuing on and alonz the corporate limit of the Town of Colma - South ~9° 17' East ~65.80 feet, thence along the arc of a curve to the left having a radius of 2954.93 feet and a central angle of 10O 12' l~' for a distance of 526.19 feet to the Northwestern line of that certain 62.52 acre Tract as conveyed to Frank Lagomarsino by deed recorded November 19, 1914 in Book 235 of Deeds at page 452 to the existin~ corporate limit line of the City of South San Francisco as established by the above described Winston Manor Annexation; thence on and along said corporate limit of the City of South San Francisco and the Northwestern line of said 62.52 acre tract South 44° 51' 50~ West 753.36 feet to the 3/4" iron pipe monument set in the Eastern line of the El Camino Real (State Highway); thence along the existing corporate limit and easterly side of E1 Camino Real (State Highway) the followin§ courses and distances: North 61° 33' West 203.70 feet; alon~ the arc of a curve to the right having a radius of 467 feet and a central angle of 51 14 ~5 for a distance of 617.69 feet~ North 9° 61~ 65" East 179.51 feet~ along the arc of curve to the left having a radius of 633 feet and a central angle of 53° 55~ 15~' for a distance of 593.71 feet, and thence North 44° 13~ 30" West 25.40 feet to the point of beginning. Contain- ing 15.935 acres, more or less. 2. The polls at said election shall be opened' at ?:0o o'clock a.m. of the day herein fixed for the holding of said election and shall be kept open until ?:00 o'clock p.m. of the same day, when the polls shall be closed. 3. Upon the ballots to be used at said election there shall be printed the words: SHALL "TREASURE ISLAND" BE ANNEXED TO THE CITY OF SOUTH SAN FRANCISCO, AND THE PROPERTY IN SUCH TERRI- TORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF SOUTH SAN FRANCISCO, TO PAY THE ENTIRE BONDED INDEBTEDNESS OF THE CITY OF SOUTH SAN FRANCISCO OUTSTANDING OR AUTHORIZED AT THE DATE OF THE FIRST PUBLICATION OF THE NOTICE OF ELECTION, FOR THE ACQUISITION, CON- STRUCTION OR COMPLETION OF MUNICIPAL IMPROVEMENTS~" Opposite these words there shall be printed the words "Yes" and "No", and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (~) in the voting square after the printed word "Yes",the vote of such elector shall be counted in favor of the annexation of said territory to the City of South San Francisco; and if an elector shall stamp a cross (~) in the voting square after the printed word "No", the vote of such elector shall be counted against such annexation. In all particulars not herein recited, said election shall be held in conformity, as near as may be, with the laws of the State of California concerning general elections and with said Annexation Act of 1913. 4. (a) For the purpose of said election there hereby is estab- lished in the territory described herein one (1) voting precinct, which shall include all of said territory. The following is the polling place of said election precinct and the following named persons hereby are named officers of election and shall constitute the board of election for such election precinct: Polling Place: 1700El Camino Real (laundry room) San Mateo County, California I~spector: Mrs. Margaret V. Golson Judges: Mrs. Jacquelyn H. Hay Mrs. Inez L. Gray (b) For their services in connection with said election, said inspector shall receive $ 18.00 and said judges $ 15.00 each; and the person in possession of the polling place named here- in shall receive for the use of such premises in connection with said election the sum of $ 12.00 . 5. The City Clerk shall publish a notice of said special elec- tion as required by the Annexation Act of 1913, at least once a week for the four (4) weeks prior to the date of the election on February 5, , 19 63 , in the Burlingame Advance Star, a newspaper of general circulation printed and published outside of the City of South San Francisco but in the County of San Mateo, California. 6. This ordinance shall take effect upon its publication. 7. The City Clerk shall certify to the adoption of this ordin- ance and cause the same to be published once in the Enterprise- 4. Journal, a newspaper of general circulation published in the City of South San Francisco. . . . . Introduced thAs 3rd day of December , 19 62 .
