AN ORDINANCE OF THE CITY OF SOUTH 'SAN FRANCISCO
AMENDING ORDINANCE NO. 396 ENTITLED "AN ORDINANCE
OF THE CITY OF SOUTH SAN FRANCISCO PROVIDING FOR
SEWER RENTALS AND CHARG~.S IN SAID CITY: PROVIDING
THAT SUCH SEWER RENTALS AND CHARGES SHALL BE COL-
LRCTED ON THE MUNICIPAL TAX ROLL AND SHALL BECOME
A LIEN UPON THE RESPECTIVE PARCELS OF REAL PROP-
ERTY" RELATING TO SPECIAL SEWER RATES AND CHARGES
IN THE SOUTH AIRPORT BOULEVARD AREA OF SAID CITY
The citY Council of the City of South San Francisco does
ordain as follows:
WHEREAS, after proceedings to that end duly had and taken,
the City .Council of the City of South'San Francisco, pursuant
to Resolution No. 5004 , A Resolution of Intention to Issue
Sewer Revenue Bonds, adopted. December 16, 1968 , has duly
identified an area of the City, known as the "E6uth Airport
Boulevard Area," which will be served by the.sanitary sewerage
works to be constructed with the'proceeds of sewer revenue
bonds to be issued pursuant to said Resolution of Intention.
Said area is described in Exhibit "A" hereto attached and incor-
porated herein by reference, and is hereinafter in this ordi-
nance referred to as "the Area";
WPU~REAS, said sanitary sewerage works consist of sanitary
sewer mains, manholes, and appurtenances in South Airport
Boulevard from Wondercolor Lane to a new pump station near
Belle Air Road and from existing pump station No. 5 across and
northwesterly along South Airport Boulevard to said new pump
station, together with the construction of said new pump sta-
tion and appurtenances and are hereinafter in this ordinance
referred to as "the Works";
WHEREAS, said proceedings under said resolution of inten-
tion were taken pursuant to Chapter 5 (commencing with Section
4950) of Part 3 of Division 5 of the Health and Safety Code of
the State of California, commonly referred to as the Sewer
Revenue Bond Act of 1933, and Section 5040 of said Code pro-
vides that the Council shall establish Just and equitable
rates for the use and maintenance of the Works, and Sections
5044 and 5045 of said Code providethat said rates may only be
imposed and collected from the'users of all or any portion of
such Works and on users of works previously acquired and ~
financed by other methods who will receive additional benefits
from the Works;

WHEREAS, all structures now existing or to be hereafter
constructed in the Area will be either users of the Works or
are users of works previously acquired and financed by other
methods and will receive additional benefits from the Works;
NOW, THEREFORE, IT IS ORDAINED as follows:
SECTION 1: ADDITION OF SECTION 3.1 TO ORDINANCE NO. 396:
Section 3.1 is added to Ordinance No. 396, to read:
Section 3.1: Special rates and charges for the use and
maintenance of the Works, as defined in Ordinance No. 584, are
hereby established within the Area described in said 0r--d~ance
No. 584 , Said special rates and charges are in addition to
the sewer rentals and charges assessed and established in Sec-
tion3 of this Ordinance No. 396, which shall continue to apply
in the Area upon the'effective date of. Ordinance No. 584 . The
total of the seWer rentals and charges under Section ~--~d the
special rates and charges under this Section 3.1 are the rates
for the use and maintenance of the Works required by the Sewer
Revenue Bond Act of 1933.
The amounts to be assessed as special rates and charges
within the Area shall be computed in accordance with the follow-
ing table: (The rates as set forth herein shall be reviewed by
the City Council prior to the certification of said rates to the
County TaxCollector as hereinafter provided. Such review shall
be made bi-annually following the adoption of this Ordinance.)

The volume charge specified~ in the above table shall be
based upon quantities of water consumed upon particular premises,
such quantities to be ascertained by reference to the readings
of the water meters presently used for determining the water con-
sumption of the various industrial and commercial concerns. The
volume charge for c~mmercial or industrial establishments which
obtain water from sources other than regularly metered water
supply systems shall be based upOn the quantities of water sup-
plied from all sources, which shall be determined by either of
the folIowing methods:
a) By use of a meter installed at the expense of the tax-
payer and approved by the SuperinZ.endent of Sanitation of the
City.
b) ~'By an estimate prepared by the Superintendent of
Sanitation and.recomputed by said Superintendent once every
twelve (12) months. The taxpayer shall, upon .demand, pay the
enitre, cost of preparing-said estimate, and in no event shall
such charge be less than Twenty-Five Dollars ($25.00) for each
c~mputation.
The foregoing special rates and charges Shall become effec-
~tive in the Area on July l, 1969, and shall be collected together
with and not separately from the sewer rentals and charges
assessed and established in Section 3 of %his Ordinance No. 396
in the manner hereafter in this Ordinance No. 396 provided until
all princiRal of and interest on bonds issued pursuant to Resolu-
tion No. 5004, 'A Resolution of Intention to Issue Sewer Revenue '
B0nds,' adop~d Decem~e~ 16 , 196_B_, are fully paid, at
which time said spec~ax rates and charges shall terminate and

only the rentals and charges set forth in Section B--of this
Ordinance No. B96, as now or hereafter amended, shall remain
effective in the Area.
All money received from the collection of sewer rentals
and charges under Section 3 and said special rates and charges
under this Section 3.1 from the Area· shall be deposited in the
bank used b~ the City as its depositary and shall be kePt~£n a
special fund and applied in the manner to be hereafter provided
by the City Council in the ordinance providing for the issu-
ance of said bonds.
SECTION 2: EFFECTIVE DATE
This Ordinance shall take effect and be in force thirty
days from and after its adoption.
SECTION 3: PUBLICATION ..
TheCity Clerk shall certify to the passage of this
Ordinance and cause-the same to be published in the Enterprise-
Journal, a newspaper of general circulation, published and cir-
culated in said City, as required by law, fifteen days after
passage.
