AN ORDINANCE ORDERING REMOVAL OF OVERHEAD
STRUCTURES, WIRES AND FACILITIES AND INSTALLATION
OF UNDERGROUND WIRES AND FACILITIES IN UNDERGROUND
UTILITY DISTRICT NO. 2 - PHASE B-1
TIlE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES
ORDAIN AS FOLLOWS:
SECTION I, FINDINGS:
The City Council finds and determines as follows:
A. A public hearing was duly called and held on June 15, 1970, at the hour of
8:00. p.m. in the Council Chambers in the City Hall of South San Francisco
to ascertain whether the public necessity, health, safety or welfare required
the removal of poles, overhead wires and associated overhead structures:
and thc underground installation of wires and facilities for supplying
electric, communication or similar or associated services in Underground
Utility District No. 2 - Phase B-l; and that notice of such hearing was
given to all affected property owners as shown on the last equalized assessment
rolls and utilities concerned in the manner and for the time required by law;
and all persons were given an opportunity to be heard.
B. The public necessity, health, safety and welfare requires the removal of poles,
overhead wires and associated structures, and the underground installation of
wires and facilities for supplying electric, communication' or similar or
ass.ocmted service in Underground Utility District No. 2 - Phase Bzl, which
consists of undergrounding all utilities on both sides of E1 Camino Real
from 400 feet north of Arroyo Drive to 400 feet south of Chestnut Avenue
as delineated on plat marked Exhibit "A" to Ordinance 60~ titled
"Underground Utility District No. 2 - Phase B-1 - E1 Camino Real" as
revised May l, 1970.
The undergrounding to be accomplished pursuant to this Ordinance will void
or eliminate any unusually heavy concentration of overhead distribution
facilities.
D. The streets; roads or rights-of-way in the District are extensively used by
the general public and carry a heavy volume of pedestrian or vehicular traffic.
E. The said streets, roads or rights-of-way adjoin or pass through or near a
civic area, a public recreation area and an area of unusually scenic interest
to the general public.
F. Ordinance No. 589 provides for scheduling the undergrounding of utilities in
Phase "B" to conform to the construction schedule of the widening of
E1 Camino Real which is now' scheduled for widening between 0.1 mile north
of Arroyo Drive and 0.1 mile south of Chestnut Avenue with work to commence
November 1, 1970.
SECTION II. ESTABLISHMENT OF UNDERGROUND UTILITY DISTRICT
NO. 2 - PHASE B-1
Underground Utility District No. 2 - Phase B-l, consisting of the parcels
delineated on the plat marked Exhibit "A", titled'Underground Utility District.
No. 2 - Phase B-1 - E1 Camino Real" as revised May 1, 1970, hereby incorporated
in and made a part of this Ordinance, is hereby established.
SECTION Ill. REMOVAL OF OVERHEAD FACILITIES: TIMES THEREFOR:
The Council hereby fixes August 15, 1970, as the date on which affected property
owners in Phase B-1 of District No. 2, E1 Camino Real from 400 feet north of
Arroyo Drive to 400 feet south of Chestnut Avenue, must be ready to receive
underground service and does hereby order that all poles, overhead wires and
associated overhead structures be removed and underground installations made
in said Underground Utility District No. 2 - Phase B-I, within the following times:
A. Underground installation by utility companies and property owners and
reconnections not later than October 15, 1970;
B..Removal of poles, overhead wires and other associated overhead structures
not later than November 1, 1970;
SECTION IV. NOTICE
The City Clerk is hereby instructed to notify all affected utilities and all
persons owning real property within Underground Utility District No. 2 - Phase B-I,
of the adoption of this Ordinance within ten (iO) days after the date of such
adoption. The City Clerk shall further notify said property owners of the
necessity that, if they or any person occupying such property desire to continue
to receive electric, communication or other similar or associated service, they
or such occupant shall, by the date fixed in this Ordinance provide all necessary
facility changes on their premises so as to receive such service from the lines
of the supplying utility or utilities at a new location, subject to applicable
rules, regulations and tariffs of the respective utility or utilities on file with
the Public Utilities Commission of the State of California. The notification
shall be made by mailing a copy of this Ordinance together with a copy of
Ordinance No. 566 to the affected property owners as such are shown on the
last equalized assessment roll and the affected utilities.
-SECTION V. ADOPTION PURSUANT TO ORDINANCE NO. 566
This Ordinance is adopted pursuant to Ordinance No. 566 of the City of South
San Francisco which ordinance was passed and adopted on the seventh ('/th) day
of Aug-ust, 1967.
SECTION VI. EFFECTIVE DATE AND PUBLICATION
This Ordinance shall be in full force and effect thirty (30) days from and
after, the date of final passage and approval. The Clerk shall certify to the
passage of this Ordinance and cause the same to be published in the Enterprise-
Journal as required by law.
