AN ORDINANCE REGULATING DIRECT ALARM
SYSTEMS AND REPEALING ORDINANCE NO.
828 ENTITLED, "AN ORDINANCE REGULATING
ALARM SYSTEMS."
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES
ORDAIN AS FOLLOWS:
SECTION I. DEFINITIONS.
A. Person shall include the singular and plural and mean
any individual, partnership, corporation or other
entity, except the City of South San Francisco.
B. Alarm system shall mean any device designed for the
detection of an unauthorized entry on premises or for
alerting others of the commission of an unlawful act
or both, and when actuated, emits a sound, transmits
a signal or message.
C. Direct alarm system shall mean an alarm system which
is connected to or designed to be connected to the
alarm receiving equipment maintained in the police
department of the City of South San Francisco.
D. Automatic calling device shall mean any device or
combination of devices that will upon activation,
either mechanically, electronically or by othem
automatic means initiate an intrastate call and deliver
a recorded message to any telephone subscriber.
E. False alarm shall mean an alarm signal necessitating
response by the South San Francisco Police Department
where an emergency situation does not exist.

SECTION II. PERMITS. DIRECT ALARM SYSTEMS.
A. PERMITS REQUIRED - EXISTING INSTALLATIONS.
Any person who on the effective date of this ordinance
maintained or used in the City of South San Francisco,
a direct alarm system as defined in Section i hereof,
shall obtain a permit therefor from the Chief of Police
within ninety (90) days after adoption of this ordinance.
B. PERMITS REQUIRED - NEW INSTALLATIONS.
Except as provided in Section II-A, a permit shall be
obtained from the Chief of Police prior to the installa-
tion, maintenance or use of any direct alarm system
defined in Section I of this ordinance.
C. PERMITS - APPLICATION.
Applications for permits shall be filed with the Chief
of Police. The Chief of Police shall prescribe the
form of the application and require such information
as is necessary to evaluate and act upon the permit
app ii cation.
D. PERMITS - ISSUANCE. ELIGIBILITY.
1. A person making application under Section II-C
for the installation of a direct alarm system for
the protection of single, duplex, or multiple
family dwellings shall not be eligible for the
issuance of a permit.
2. A person making application under Section II-C
for the installation of a direct alarm system for
the protectiDn of commercial, industrial, educational,

scientifie~ reli§ious: or charitable organiza-
tions shall be eligible fop the issuance of a
permit.
E. PERMITS - CRITERIA FOR ISSUANCE.
The Chief of Police is vested with the administrative
discretion to determine which eligible person shall
be granted a permit based on the following criteria:
1. Importance of the activity of the organization to
be protected with respect to the entire community.
2. Adequate training of personnel, in the control and
operation of the direct alarm system.
F. PERMITS - ISSUANCE.
1. Fees. The Chief of Police shall establish a fee
for said permits in the amount of Twenty-five
Dollars ($25.00) per annum.
2. Copies of the reEulations and amendments thereto
shall be filed in the office of the Chief of Police
and City Clerks available for public inspection.
SECTION III. SELECTIVE ALARM - TELEPHONE DEVICES.
A. It shall be unlawful for any person to use or cause
to be used any electrical or mechanical device or
attachment to any telephone that automatically repro-
duces any taped or otherwise recorded message to
report a police emergency to the' Police Department
'of this City.

SECTION IV.
A. Hearing.
SUSPENSION AND REVOCATION.
Before a permit, issued pursuant to this
ordinance, may be suspended or revoked, a hearing must
be held before the Chief of Police. Notice setting
forth the time, place and nature of the hearing shall
be given to the permittee at the address shown on the
permit application seven (7) days prior to said
hearing.
B. Grounds for Suspension. The Chief of Police may sus-
pend or revoke a permit on the following, groundS:
1. The violation of any of the provisions of this
chapter or failure to comply with the same;
2. Failure to comply with the business license
ordinance of the City of South San Francisco;
3. A direct alarm system which actuates excessive or
an unreasonable number of false alarms. What
constitutes excessive or unreasonable number of
false alarms is within the administrative dis--
cretion of the Police Chief.
SECTION V. APPEALS.
A. Any applicant for permit or permittee may appeal the
decision of the Chief of Police by filing a written
notice of appeal with the City Manager within five
($) days after the decision.
B. Such appeal shall be heard by the City Manager who may
affirm, amend or reverse the decision or take other

action deemed appPopPiate subject to the pPovisions
of this oPdinance and the Pules and Pegulations pur-
suant thereto.
The City Manager shall give wPitten notice of the
time and place of the heaping to the appellant.
In conducting the heaPing~ the City ManageP shall not
be limited by the technical rules of eVidence.
SECTION VI. PENALTY.
Any person violating any of the provisions of this ordi-
nance shall be guilty of a misdeameanor and shall be punishable
thePefoP by a fine of not more than Five HundPed Dollars ($500.00)
oP by imprisonment fop a pePiod of not mope than six (S) months
or by both such fine and imprisonment.
SECTION VII. REPEAL OF ORDINANCE 626.
0Pdinance 626 entitled~ "An Ordinance Regulating Alarm
Systems~" passed by the City Council JanuaPy 17~ 1972~ is hereby
Pepealed.
SECTION VII. PUBLICATION AND EFFECTIVE DATE.
This ordinance shall be published once in the "Enterprise-
Journal~" a newspaper of general circulation in the City of South
San FPanciseo~ as ,Pe~uiPed by law~ and shall become effective thirty
(30) days fPom and afteP its adoption.
