AN ORDINANCE PROVIDING FOR CARE,
DISPOSITION ~D DESTRUCTION OF
UNCLAIMED PROPERTY.
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES
ORDAIN AS FOLLOWS:
SECTION I. CUSTODY OF UNCLAIMED PROPERTY.
All unclaimed property in the possession of the City shall
be held in custody by the Police Department for a period of not less
than four (4) months, except for unclaimed bicycles wherein the period
of custody shall be three (3) months.
SECTION II. PUBLIC AUCTION.
Should the rightful owner fail to make claim during the
minimal custodial period, said unclaimed property will be sold at
public auction to the highest bidder, with notice of such sale
being, given by the Chief of Police at least five (5) days before
the time fixed therefor by publication once in a newspaper of
general circulation published in the County, or that thereafter
such property will be transferred to the City purchasing officer
for sale at public auction. Property transferred to the purchasing
officer shall not be redeemable by the owner or other person
entitled to possession.
If the City purchasing officer determines that the trans-
ferred property is~needed for public use, a public auction need
not be held.
Property which cannot be sold by the purchasing officer
at public auction can be destroyed.
SECTION III. KNOWN OWNERSHIP; COST OF STORAGE.
Where true ownership of unclaimed property is known,
the Chief of Police shall give notice to the rightful owner of the
City's possession of said property. If the rightful owner fails
to make claim and take possession of the property within five (5)
days' notice, the reasonable costs of care and custody, as set
by resolution, shall thereafter be paid by the rightful owner.
SECTION IV. EXCEPTIONS.
1. Money as unclaimed property shall be transferred to
the general fund of the City by the Police Department at the end
of the four-month period, provided the Chief of Police satisfies
the notice requirements of Section II of this ordinance.
2. Weapons as unclaimed property in the possession of
the Police Department and not within the jurisdiction of Penal
Code Sections 1407 et. seq. or Penal Code Section 12028, may be
destroyed at the end of the four-month custodial period, provided
that the notice requirements of Section II of this ordinance are
satisfied.
SECTION V. REPEAL OF ORDINANCE 4?5.
Ordinance 475, adopted February 19, 196.2, entitled,
"An Ordinance of the City of South San Francisco Providing for
Care, Restitution, Sale, Destruction and Disposition of Unclaimed
Property in the Possession of the Police Department of the City Of
South San Francisco," is hereby repealed.
SECTION VI. PUBLICATION AND EFFECTIVE DATE·
This ordinance shall be published once in the Enterprise-
Journal, a newspaper of general circulation in the City of South
San Francisco, as required by law, and shall become effective
thirty (30) days from and after its adoption.
