AN INTERIM ORDINANCE PROHIBITING USES IN THE
URBAN CORE AND ADJACENT SUPPORT AREAS WHICH
MAY' CONFLICT.WITH THE ZONING PROPOSAL UNDER
STUDY PURSUANT TO. GOVERNMENT CODE SECTION 65858.-
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS
FOLLOWS: ..
SECTION 1. PURPOSE. The purpose of this Ordinance is to prohibit uses
which may be in conflict with the contemplated zoning proposal for-'the urban
core and adjacent support areas in the City of South San FranCisco, which
proposal, is being considered by the City Council and Planning Department,
and study of which is intended to be completed ~on or before June 30, 1976.
SECTION 2. DESCRIPTION OF URBAN CORE AND ADJACENT SUPPORT AREAS.
The urban core and adjacent support areas subject to the provisions of this
Ordinance are,designated as "study area" on the plat entitled."Urban Core
and Related Area: which is attached hereto as Exhibit A and by this refer-
ence-made a part hereof.
SECTION. 3. FINDINGS AND DETERMINATIONS. The City Council finds and
determines as follows:

General Plan and the Urban Core. The General Plan of the City of South
San Francisco, adopted by Resolution No. 3825 on December 2, 1963, amended
by Resolution 5073 on April 21, 1969, and thereafter amended, is a
compatible long-term General Plan for the physical development of the
City, containing a statement of development policies, including diagrams
and texts setting forth objectives, principles, standards and planned
proposal and includes the mandatory elements required by Government
Code Section 65302 and certain additional includible elements authorized

by Government Code Section 65303 and. further casts the pattern of land
uses in the urban core.
General Plan and Zoning Consistency. The City is required to achieve
zoning consistency pursuant to Government Code Section 65860 so that the
various land uses authorized by the Zoning Ordinance are compatible with
the objectives, .policies, general land uses and programs specified in
the General Plan.
Zoning Ordinance ProvisiOns for Uses in the Urban Core and Adjacent
Support Areas. Zoning Ordinance 353, as amended, particularly in
Sections 3.3, 3.5 and 3.6, which sections provide the land uses, stand-
ards and regulations for the urban core and adjacent support areas, pro-
vide for uses which may not be compatible with the objectives, policies,
general land uses and programs of the General Plan.
Contemplated Zoning Proposal. The contemplated zoning proposal now
under consideration pursuant to studies undertaken by the City.Council
in accordance with Resolution No. 27-76 adopted February 25, 1976, and
by the planning staff as recited in the staff report dated March 3,
1976, will describq the uses for the urban core and adjacent'support
areas which will be consistent with the General Plan and will further
set forth the standards and regulations within constitutional guidelines
for said uses.
Prohibition of Uses Which May Be in Conflict with the Contemplated
Zoning Proposal. It is necessary to prohibit any uses-which may be
in conflict with said contemplated zoning proposal until June 30, 1976,
at which time the studies regarding said zoning proposal will becom-
pleted. Except for those uses which as of the date of this Ordinance
exist by reason of a duly-issued zoning permit or as a non-conforming
.use, all of the uses designated in said Exhibit B may conflict with
said contemplated zoning proposal and should be prohibited from and
after the effective date of this Ordinance to and including June 30,
)976, to protect the public, safety, health and welfare.
'SECTION 4. USES PROHIBITED. Except for those uses which as of the
date of this Ordinance exist by reason of a duly-issued zoning permit or
as a non-conforming use, all of the uses designated in said Exhibit B are
prohibited in the urban core and adjacent support areas as shown on Exhibit
Aattached hereto.
SECTION 5. PENALTY. Except for those uses which as of the effective
.date of this Ordinance exist by reason of a' duly-issued zoning permit or as
a non-conforming use, any person violating the provisions of this Ordinance
by commencing or carrying on any of the prohibited uses set forth in Sec-
tion 4 on or after the effective date of this Ordinance shall be guilty of
a misdemeanor and punishable by a fine of not more than Five Hundred Dollars
($500) or by imprisonment not to exceed six (6} months, or by both such fine
and imprisonment.
iSECTION 6. URGENCY MEASURE. This Ordinance is declared to be an
urgency measure adopted pursuant to the provisions of Government Code Sec-
tion 65858, in that it is for the in~nediate preservation of public peace,
health and safety and protects the public safety, health and welfare. The
Council finds and declares that the facts set forth in Section 3 of this
Ordinance, entitled "Findings and Determinations," constitute the urgency and
adopts said Findings and Determinations as a declaration of said facts, in
addition to the authorizations for this urgency Ordinance set forth in
Government Code Section 65858.
SECTION 7. PUBLICATION AND EFFECTIVE DATE. This Ordinance shall be
published once as required by law in the Enterprise-Journal, a newspaper
of general circulation in the City of South San Francisco, and shall take
effect as an urgency measure immediately upon its adoption.
· Passed and adopted as an urgency Ordinance of the City of South San
· Francisco.in accordance with Government Code Section 65858 at a regular
meeting of the City Council of the City of South San Francisco this 3rd
day of March, 1976, by the following vote:
