AN ORDINANCE ESTABLISHING SEWER SERVICE
CHARGES AND PROCEDURES RELATED THERETO
AND ~ENDING ORDINANCE NO. 396 AS AMENDED.
THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO.
DOES ORDAIN AS FOLLOWS:
SECTION 1. ORDINANCE REFERENCE.

AMENDMENT OF ORDINANCE NO. 396 AS A[iENDED BY
AMENDING SUBSECTIONS 3.2.2, 3.2.3~ 3.4 AND
ADDING SUBSECTIONS 3,2,~ AND 3,g,1,
Subsections 3.2.2, 3.2.3 and 3.~ of 0Pdinance No. 398

3.4.1 to -read as follows:
3.2.2. Non-Mete'red'Flow. If all the
water fUrnished, used or discharged by the
discharger is non-metered, the quantity of
water consumed shall be determined by the
Superintendent of Sanitation based on an
analysis of the nature, character, and
extent of the discharger's operations and.

ger does not desire to have the Superinten-
dent of Sanitation make the determination
as hereinabove stated, the discharger may
elect to do one of the following: (1) install
-an outflow meter to measure the volume of

sewer system, or (2) elect to proceed in
accordance with Subsection 3.4.
3.2.3. Comb%nation Metemed 'grid Non-metered
Flow. If the water furnished or used by the
discharger is a combination of metered flow
and non-metered flow, the quantity of water
consumed shall be the total of the follow-
ing: (a) the quantity of metered water fur-
nished as shown by the approved metering
devlce, unless the discharger installs and
maintains an approved discharge flow meter,
in which event the 'quantity of water dis-
charged shall be as shown by said metering
device, and (b) the quantity of non-metered
water.determined by the Superintendent of
Sanitation based on an analysis of the nature~.
character and extent of the discharger's
operations with the cost of said analysis
charged to the discharger. If the dischar-
ger does not desire to have the Superinten-
dent of Sanitation make the determination
as hereinabove stated~ the discharger may
elect to do one of the following (1) install
an outflow meter to 'measure the volume of
water discharged into the City's sanitary
sewer system~ or.(2) elect to proceed in
accordance with Subsection 3.4.
3.2.4. Diversion of Water. If the dischar-
ger diverts water into its principal activ-
ity or by other means so that the total
amount of water received or used by the
discharger is not discharged into the City's
sanitary sewer system: the discharger may
elect to do one of the following: (1) install
an outflow meter to measure .the volume of
water dischar§ed into the City's sanitary
sewer system~ or elect to proceed in.accord-
ance with Subsection 9.4.
3.4. Procedure'.'fo~.'De%'e~mination of Water
Volume and EValu'atiOn 'of Test Samples. If
a discharger elects to require a determina-
tion of the quantity of water discharged
into the City's sanitary sewer system as
provided in Subsections. 3~.2.2, 3.2.3, 3.2,4
and related sections, or determination
regarding the test samples and evaluations
· thereof on file in the office of the Super-.
intendent of Sanitation made pursuant to
Subsection 3.3 and related sections~ to
be used in-computing forthcoming fiscal
year charges, the discharger shall file a
written Notice Requesting Determination with
the Superintendent of Sanitation~ together
with a fee of One hundred dollars ($100).
Said notice shall be filed not earlier than

send a copy thereof to the discharger and
City Manager. The findings and determina-
tions made by the Director of Public Services
shall be final.
3.4.1. Exception to Determination Procedure.
If a City determination regarding percentage
of water volume consumed as related to sus-
pended solids and COD was made or used for
the previous fiscal year sewer charge calcu-
lations, the discharger may, with approval
of the Superintendent of Sanitation, elect
to have the City use said determination in
computing the forthcoming, fiscal year charges
in lieu of proceeding in accordance with
Subsection 3.4.
SECTION 3. AMENDMENT OF ORDINANCE TITLE.
The title of Ordinance No. 3@6 as amended, is here-
by amended to read: "An Ordinance Establishing Sewer Service
Charges and Procedures Related Thereto."
SECTION 4. PUBLICATION. This Ordinance shall be pub-
lished once, as required by law, in the Enterprise-Journal, a
newspaper of general circulation published in the City of
South San Francisco.

shall then set a date for review within ten
(10) days after receipt of said appeal and

who may appear and present evidence in
support of the appeal, upon completion of
the review~ the Director of Public Services
shall make findings and determinations and
