HomeMy WebLinkAboutOrd 708-1976 ORDINANCE NO. 708-76 AN ORDINANCE ESTABLISHING A FREE PUBLIC LIBRARY IN AND FOR THE CITY OF SOUTH SAN FRANCISCO, .AND AMENDING ORDINANCE NO. 79 ADOPTED JULY 20, 1914 PREAMBLE. On July 20, 1914, the Board of Trustees of the. City.Of South San Francisco, now the City Council, adopted Ordinance No. 79 entitled "An Ordinance Establishin§ a Free Public Library in and for ~he City of South San FranciscO,'' reciting in the preamble to that Ordinance the following which is incorporated in this amending ordinance, "WHEREAS, more than one-fourth of the electors of the City of South San Francisco have, by, petition, requested the Board of Trustees of said City of South San Francisco to estab- lish a free public library in and for said municipality;" The Legislature of the State of California thereafter enacted Educa- tion Code Section 27301,et seq., and Education Code Section 27351, et seq., based partially on the Act approved March 23,~.1901, entitled "An Act to Provide for the Establishment and Maintenance of Public. Libraries within Municipalities," which furnished the authorization for Ordinance No. 79. The purpose of this amending ordinance is to amend Sections 1 and 2 of said Ordinance No. 79, restate Section 3 of said Ordi- nance Which was added by Ordinance No. 680-74, adopted December 4, 1974, and make other revisions. Ii I I · il i I II I Ii THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. Establishment of Library. There is hereby established a free public library in and for the City of South San Francisco in accordance with an Act of the Legisla- ture of the State of California entitled "An Act to Provide for the Establishment and Maintenance of Public Libraries within Municipalities" approved March 23, 1901, and Education Code Section 27301, et seq., and Education Code Section 27351, et seq. SECTION 2. Board of Trustees; Appointment. The Public Library shall be managed by a Board of Trustees con- sisting of five (5) members who are electors, to be appointed by the Mayor with the consent of the City Council. SECTION 3. Term, Limitation and Vacancy. 3.1. Term. The Trustees shall hold office for three (3) years and until a successor is appointed and qualified, except that commencing January 1, 1977, the first term shall be six (6) months for Trustee No. 1, one (1) year and six (6) months for Trustee Nos. 2 and 3, and two and one- half (2½) years thereafter for Trustees Nos. 4 and 5, as described below, which description establishes the base dates for future appointments. The Council may designate the respective Trustees presently serving or appointed prior to January 1, 1977, to fill each of the Trustee's offices described below, and until so designated the Trustees presently serving or appointed prior to January 1, 1977, shall continue in their respectiv- offices unless a successor has been appointed and qualified. SECTION 4. President, President Pro Tem and Secretary. In January of each year at the regular meeting set by the Board of Trustees, the Trustees shall elect a president, president pro tem and secretary for a term of one (1) year. SECTION 5. Place of Meetings. 5.1. Regular Meetings, Adjourned Regular Meetings, Special Meetings and Study Meetings. The Board of Library Trustees shall meet at least once a month at such times and places as they may fix by resolution. Special.meetings may be called at any time by three (3) Trustees by written notice served on each Trustee at least twenty-four (24) hours prior to the time specified for the proposed meeting, and to each person who has requested in writing notice of such meeting, and said notices shall comply with Government Code Section 54950, et seq., also referred to as the Ralph M. Brown Act or Secret Meeting Law. 5.2. Holidays. If the day designated as a regular, adjourned regular, special or study meeting falls upon a legal hol- iday, the Board shall meet upon the next succeeding day which is not a holiday, unless otherwise ordered by the Commission. SECTION 6. Compensation. Trustees shall receive for their services as prescribed by an ordi~nce of the City of South San Francisco, and said compensation shall not exceed Fifty dollars ($50) per month. e SECTION 7. Clerk's Maintenance of Records and Notice to Council. 7.1 Record Maintenance. The City Clerk shall establish and ma~.ntain a record of the names, addresses, telephone numbers, dates of appointment and dates of termination of each Trustee, and the names of the president and president pro rem, and the dates of their election and termination in those offices. 7.2. Notice to Cg~ncil of Term Expiration. The Clerk shall 9ive the Council written notice of the expiration of a Trustee's term sixty (60) days prior thereto. SECTION 8. Publication and Effective Date. This ordinance shall be published once in the £nterprise-Journal, a newspaper of general circulation in the City of South San Francisco., as required by law, and shall become effective thirty (30) days after adoption, and operative on December 31, 1976, at twelve o'clock (12:00) p.m. Introduced this 18tnday of August , 1976. Commencing on January 1, 1977, Trustees shall be limited to two (2) consecutive terms. Vacancy.. Upon a vacancy occurring on the Library Board~ for any reason, including but not limited to (1) resig- nation, (2) Council declaration of vacancy for a Trustee's failure to attend four (4) consecutive regular meetings without excuse by the Board, and (3) removal by majority vote of the Council, a successor shall be appointed by Council to fill the unexpired portion of the term.
