HomeMy WebLinkAboutOrd 784-1979ORDINANCE NO. 784~79 AN ORDINANCE ESTABLISHING SEWER CHARGES AND PROCEDURES RELATED THERETO AND AMENDING ORDINANCE NO. 396, AS.AMENDED THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION 1. AMENDMENT OF SUBSECTIONS 2.4, 3.1, 3.4, 3~'4.1, 3.4.2 AND 3.5, AND ADDITION OF SUBSECTIONS 3.7 AND 3~8 TO -ORDINANCE NO. 396 AS AMENDED. Subsections 2.4, 3.1, 3.4, 3.4.1, 3~4.2 and 3.5 are.hereby amended and Subsections 3.7 and 3.8 are hereby' added to Ordinance 396, as amended, entitled "An Ordinance Establishing Sewer Service Charges and Procedures Related Thereto," to read as follows: 2.4. Biochemical oxygen Demand and Chemical Oxygen Demand. (A) BOD - denotes biochemical oxygen demand which is"the equivalent qu~ntityof oxygen expressed in milligrams per liter utilized during oxi- dation of organic and inorganic matter in waste- water under standard'method BOD tests. (B) COD - denotes ch~i~'l oxygen demand which is the equivalent quantity of oxygen expressed in milligrams perliter utilized during oxida- tion of organics amenab~.e to chemical oxidation, as well as certain inorganics in wastewater un,r standard method COD tests. (C) BOD/COD Correlation; Findings. The City Council finds and determines that: 3.1, (1) The use of a COD test as a control and monitoring method is cost efficient and furnishes a reasonably accurate means of determining users' wastewater oxygen demand. (2) The use of a COD test furnishes a reason- able and equitable basis for distributing plant operation cost and computing charges for services when considered together with the COD Adjustment Procedure set forth in Subsection 3.8 of this Ordinance. (3) With certain wastes containing toxic substances, the COD test may be the only method for determin- ing the organic load. Where wastes contain only readily available organic bacterial food and no toxic matter, the results can be used to approximate the ultimate carbonaceous B0D values. (4) Plant operation statistics demonstrate that approximately 85% of those materials measured by COD tests are removed. Application of Charges. The annual rate per dwelling unit shall be applied to residential, institutional, commercial and non-monitored industrial classes unless the volume charge exceeds the minimum CEN'£RAI~ REC:ORD~ charge, in which event the volume charge shall be applied. The minimum charge shall be applied to monitored industrial classes unless the volume charge or surcharge for suspended solids or surcharge for chemical oxygen demand, or any com- bination thereof, exceeds the minimum charge, in which event, the applicable charge shall be computed by adding the'volume Charge, surcharge for suspended solids'and su'r- charge for COD. / / / / o CENTRAL REC;ORD~ FILE NO.I .............. -' .. 3.4 3.4.1 Time for Protest (1) for Fiscal Year. 1979-80, and (2) for Subseclu~nt Fiscal Years. The time for protest and pro- cedures related thereto are set forth in Subsections 3.4.1 and 3.4.2. Time for Protest for Fiscal Year 1979-80. Within ten ~10) d.ays afterthe effective date of this Ordinance,the Superintendent ~Sanitation shall record ~n his office the determinations of quantity of water consumed and the pounds of suspended'- solids and chemical oxygen demand[ to be used in computing the forthcoming' fiscal year's sewer service charges and give t.~ritten notice to the dischargers thereof. Dischargers, ~iithi~ fifteen days after receipt of said notice, may pro- -test such. determinations by-'filing:a written protest witI~ the Director of Public Services together w~th'discharger's computation' of quantity of water consumed and pounds of suspended solids and chemical oxygen demand supp.orte~ by' . data and methods used .to determine said d~ta. If no pro-' test is filed, the determinations of the Superintendent of Sanitation shall be deemed correct and effective for com- putation of said fiscal year's sewer service charges. If a protest is filed, the Director of Public Services sh.all set a date for review ~.~ithin fifteen (15) days after receipt CENTRAL REGORD,~. .o., ? 3.4.2 of said Protest and give written notice of said review date to the discharger. The discharger may appear on the date of said review and present any additional evidence he may have in support of his protest. Upon completion of the review, the Director of'Public Services shall make findings and determinations and send a copy thereof to the discharger and City Maqager. The findings and determinations made by the Director of Public Services shall be final. If the Director of Public Services determines that quan- tity of water consumed or pounds of suspended solids or pounds of chemical oxygen demand should be modified, he shall adjust the annual sewer service charges accordingly and file the necessary modifications with the County Tax Col 1 ec tot. Time'for Protest for Subsequent Fiscal Years.. On or befbre April I of each fiscal year following fiscal year 1979-80~,the Superintendent of Sanitation shall record in his office the determinations of quantity of water.con- sumed and the pounds 6f suspended solids and chemical oxygen demand to be used in computing the forthcoming fiscal year's sewer service charges, which shall be avail- able for public inspection. Dischargers on or before CENTRAL- RECORD~ l~ay 1 may protest such determinations by filing a written protest with the Director of Public Services, together ~¢ith discharger's computation'o~ quantity of water con- sumed and pounds of suspended solids and Chemical oxygen demand supported by data and methods used to determine said data. Dischar§ers may use notice of protest forms furnished by the Superintendent of Sanitation. If no protest is filed, the determinations of the Super- intendent of Sanitation shall be deemed correct and effec~ tire for computation of th~ forthcoming fiscal year's sewer service charges. If a protest is filed, the Director of Public Services shall set a da~e for review within fifteen (15) days after receipt ofs~id p~otest and give written' ~otice o~aid review dateto the'discharger. The dis- charger may appear 6n the date of said review and present any 'additional evidence he may have in s~pp°rt of his protest. ~ ~ . ~pon completion of the review, the Director of Public- Services shall make findings and determinations,'and sen~ a copy thereof to the discharger and City Mana§er. ~he findings and determinations made by the DirectOr of Public Services shall be final. Industrial Cost Recovery Factor 'The schedule of charges for commercial and non-monitored industrial class .(moderate strength uses and'mOnitored industrial classes)includes an Industrial Cost Recovery factOr. The Congress of the United States in Conference Re~o~t (No. 95'830) dated' Decem- ber 6, 1977, directed the E.P.A. to study the economic impact of the'Industrial Cost Recovery System and report to Congress within one. {1) year (Clean Water Grant program Bulletin No. 68A).' Congress, upon receipt of the Report, may ~etain the Industrial Cost Recovery System'or by legislation modify or eliminate it. If Congress modifies Or eliminates the Industrial cost Recovery System · and said legislation becomes effective during fiscal y6ar 1979-80, City shall give written notice thereof to the dischargers in the above'named classes within thirty (30) d~ys of said effective date. Said dischargers may file a claim with the City for refund of that portion of the schedule of charges attributable to the Industrial Recovery factor from and after said effective date. 10', C£1,,iTRAL RECORDS The claims shall be filed within six (6) months from and after the date of City's notice. The claim shall be filed with the Superintendent of Sanitation who shall compute or cause computation to be made of the portions of the schedule of charges to be refunded. Upon completion of the computation, he shall submit same to the Director of Public Services for approva~ disapproval or modification, and transm~ttaT to the City Council for payment authorizaUon if applicable. 3.8. COD Adjustment. The City may make an adjustment in charges for services for industrial wastewater characterized by the following: (A) a demonstrated BOD/COD ratio different by more than one standard deviation from! that of the overall treatment plant load average supported by BOD and COD data, and (B) a demonstrated COD por- tion which is not removed by the treatment plant overall oper- ations which may be evidenced by demonstra~on studies per- formed by the City.or discharger at the discharger's expense. SECTION 2. PUBLICATION AND EFFECTIVE DATE. This Ordinance shall be published once in the Enterprise-Journal, a newspaper of general circulation in the City of South San Francisco, as required by law, and shall become effective thirty (30) days from and after its adoption. 11.
