TO: Honorable Mayor and City Council Members r- ~ FROM: City Clerk ~~ ~`~,~,~ SUBJECT: CITY COUNCIL SPECIAL MEETING -INTERVIEW SCHEDULE FOR LIBRARY BOARD OF TRUSTEES BACKGROUND: As Council may be aware, Library Board terms for Boardmembers Hansen and Battaglia expired on June 30, 2006, and both are seeking reappointment. Library Board terms are for three years, and are limited to four consecutive terms. As required, a notice of expiration of terms was posted at City Hall and Libraries; information was also provided on the City's website and Community Channel. The deadline to submit applications was June 9, 2006. There are three applicants to be interviewed this evening: 1. 6:30 Pat Fitzpatrick 2. 6:40 Francisca Hansen -appointed 2/5/05 (partial term) 3. 6:50 Betty Battaglia- appointed 7/12/00 and 7/1/03 (2 full terms) Attached are the applications and interview questions approved in Apri12004. DISCUSSION AND APPOINTMENTS: If there is a consensus from Council to move forward with the appointment process this evening, a ballot has been provided. A motion to confirm the appointments is required terms ex irin~ June 30 2009 Enclosures: Board and Commission Interview Questions Applications Ballot DATE: August 16, 2006 TO: Honorable Mayor and City Council FROM: Marry Van Duyn, Assistant City Manager SUBJECT: OYSTER POINT MASTER PLAN CONCEPTS -STUDY SESSION AS PART OF THE OYSTER POINT MASTER PLAN CONCEPTS PREPARATION PROCESS Case No.: P06-0101 Owner: City of South San Francisco Applicant: City of South San Francisco Consultant: ROMA Design Group RECOMMENDATION It is recommended that the City Council provide input on the proposed concept plan alternatives and direct staff to continue to work with the Consultant to develop the preferred alternative. BACKGROUND/DISCUSSION Staff, in consultation with ROMA Design Group, has been exploring alternative concept plan development for the 54-acre Oyster Point Marina area. As illustrated in the attached draft concept plans, three concepts for the area have been developed. They include: a recreation oriented alternative, a low intensity development alternative with opportunities for small scale office and community buildings, and a high intensity development alternative emphasizing visitor related uses including a conference center. At this time, the Consultant and staff are prepared to work with City decision makers to pursue and develop a preferred alternative. CONCLUSION: Staff recommends that the City Council provide input on the proposed Oyster Point Concept Plan alternatives and direct staff to continue to work with the Consultant to create a final concept plan for the arina. White, Fire Chief SUBJECT: RESOLUTION APPROVING THE SOUTH SAN FRANCISCO LOCAL HAZARD MITIGATION PLAN RECOMMENDATION It is recommended the City Council approve the strategies comprising South San Francisco's Local Hazard Mitigation Plan. BACKGROUND/DISCUSSION The federal government passed legislation known as the Disaster Mitigation Act of 2000 (DMA 2000) requiring all local governments to develop and adopt a Local Hazard Mitigation Plan. ABAG applied for funding to prepare this plan on a regional level and served as the lead agency in developing a template and submission process. As required, South San Francisco submitted a letter of intent in this process, attended various workshops and meetings and has reviewed and commented on ABAG's efforts to date. Representatives from City Departments (City Manager, Fire Department, Public Works and the South San Francisco Unified School District) have also met to review various components of the South San Francisco Local Hazard Mitigation Plan. The FEMA requirement to make a presentation at a public meeting, which would allow for questions and comments, took place at the April 13, 2005 Council Meeting. At that time, Council was asked to approve direction of the project and approve development of the necessary documents. Since that meeting, both ABAG and FEMA have reviewed and approved our Plan. The final step in the process is for Council to pass a resolution for acceptance of this document. Staff will then forward the resolution to FEMA. CONCLUSION The Local Hazard Mitigation Plan and the Mitigation strategies it contains, will become a part of the City's Emergency Plan and will be reviewed and revised as appropriate every five years per the requirements of the Disaster Mitigation Act. CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING THE SOUTH SAN FRANCISCO LOCAL HAZARD MITIGATION PLAN WHEREAS, the Bay Area is subject to various earthquake-related hazards such as ground shaking, liquefaction, landslides, fault surface rupture, and tsunamis; and WHEREAS, the Bay Area is subject to various weather-related hazards including wildfires, floods, and landslides; and WHEREAS, the City of South San Francisco recognizes that disasters do not recognize city, county, or special district boundaries; and ~- WHEREAS, the City of South San Francisco seeks to maintain and enhance both a disaster-resistant City of South San Francisco and region by reducing the potential loss of life, property damage, and environmental degradation from natural disasters, while accelerating economic recovery from those disasters; and WHEREAS, the City of South San Francisco is committed to increasing the disaster resistance of the infrastructure, health, housing, economy, government services, education, environment, and land use systems in the City of South San Francisco, as well as in the Bay Area as a whole; and WHEREAS, the federal Disaster Mitigation Act of 2000 requires all cities, counties, and special districts to have adopted a Local Hazard Mitigation Plan to receive disaster mitigation funding from FEMA; and WHEREAS, ABAG has approved and adopted the ABAG report Tamzng Natural Disasters as the multi jurisdictional Local Hazard Mitigation Plan for the San Francisco Bay Area; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco adopts, and adapts with its local annex, the attached multi- jurisdictional plan as its Local Hazard Mitigation Plan. BE IT, FURTHER RESOLVED that the City of South San Francisco commits to continuing to take those actions and initiating further actions, as appropriate, as identified in the City of South San Francisco Annex of that multi jurisdictional Local Hazard Mitigation Plan. Grossman, Attorney SUBJECT: Resolution approving Memorandum of Understanding between Fairfield Residential, LLC, and the City of South San Francisco RECOMMENDATION: Hear report from Subcommittee meeting and consider approving Memorandum of Understanding between Fairfield Residential and the City of South San Francisco, and authorizing the City Manager to sign the Memorandum on behalf of the City. DISCUSSION: In January 2004 the City Council approved design plans for the Fairfield Residential development. Following the construction of the initial portions of the development in August 2005, the City began receiving complaints regarding the building color. City staff informed the developer that the color was not consistent with the approved color pallet and needed to be repainted. The complaints, however, prompted City staff to conduct an inspection of the construction. The inspection revealed several inconsistencies between the plans that the City Council had approved and actual construction of the development. For the past several months, City staffhave been working with representatives from Fairfield Residential and the Fairfield Subcommittee to negotiate modifications and corrections to be made to the development, so that the final product more closely resembles the plans approved by the City Council. To this end, the parties have drafted the attached Memorandum of Understanding. The Memorandum of Understanding enumerates seventeen modifications, which the developer has made, or has agreed to make to the development. Completion of these modifications will greatly increase the development's consistency with the January 2004 plans that the City Council approved. The developer has also agreed in the Memorandum of Understanding to provide the City with a letter of credit in the amount of two million dollars ($2,000,000), authorizing the City to draw funds against developer' s account, should developer fail to complete any of the agreed-upon modifications. The Memorandum of Understanding further states that in recognition of developer's agreeing to complete the modifications, and issuance of the letter of credit, the City agrees to process developer's applications for Certificates of Occupancy, subject to previously executed Conditions of Approval and all applicable Code provisions and requirements. The Memorandum of Understanding is being transmitted to the Subcommittee concurrently with the transmission of this Staff Report. The Subcommittee is scheduled to meet with representatives from Fairfield Residential on Wednesday, August 16th, at 5:00 PM to discuss a few remaining issues which may require some additional language in the Memorandum of Understanding. City Staff have been working with Developer's representatives and members of the Fairfield Subcommittee (hereinafter "Subcommittee") to negotiate modifications and corrective actions to be made to the Project, so as to restore the Project's consistency with the approved plans, as much as possible; and WHEREAS, to this end, City staff, in consultation with Developer's representatives and the Subcommittee, has prepared the attached Memorandum of Understanding for review and approval by the City Council; and WHEREAS, the attached Memorandum of Understanding provides that Developer shall make modifications and corrections, as enumerated therein; that Developer shall provide City with a Letter of Credit in the amount of two million dollars ($2,000,000.00); and that City shall agree to process Developer's applications for Certificates of Occupancy, subject to previously executed Conditions of Approval and all applicable Code provisions and requirements. RECITALS WHEREAS, Developer proposed, and submitted to the City Planning Commission for review and approval, an application to construct the South San Francisco Transit Oriented Development Project (hereinafter "Project"), amixed-use development, consisting of 360 residential dwellings and 23,000 square feet of retail space on an approximately 8.48 acre vacant site located east and west of McClellan Drive, between El Camino Real and the South San Francisco BART station (hereinafter "Property"); and WHEREAS, on January 14, 2004, upon the recommendation of the Planning Commission, the City Council for the City of South San Francisco approved plans presented by Developer for the development of the Project; and WHEREAS, on February 11, 2004, the City and Developer executed a Development Agreement for the development of the Project, which incorporated in Exhibit B of the Development Agreement, the January 14, 2004 plans approved by the City Council; and WHEREAS, the City and Developer executed Conditions of Approval, incorporated into the Development Agreement as Exhibit E, requiring that the Project be constructed in substantial compliance with the plans approved by the City Council; and WHEREAS, an on-site inspection conducted by City staff and the Developer's architect on October 21, 2005, revealed several inconsistencies between the approved plans and actual construction; and WHEREAS, at a meeting between the City and Developer held on April 6, 2006, Developer acknowledged several inconsistencies in the design and construction of the Project, and agreed to make corrections and modifications to the Project; and WHEREAS subsequent meetings have resulted in the City requesting additional enhancements beyond those in the approved plans, and Developer has agreed to complete them. NOW, THEREFORE, IT IS AGREED that in consideration of the foregoing Recitals, the Developer and the City (collectively, "Parties") agree as follows: 1. Prior to issuance of additional permits or a Certificate of Occupancy, Developer agrees to make modifications to the Project as indicated in this Memorandum of Understanding (MOU). Except as otherwise stated, Developer shall diligently create a mock up of the proposed modifications on a portion of the building, prior to modifying the entire Project. Each mock up shall be approved by the City before Developer proceeds with modification on the entire project. The City shall review each mock up within 10 days of notice by Developer. Developer does not have any right under this agreement to undertake any modifications that have not been presented to, and approved by the City. 2. Modifications to the Project shall be completed as indicated in this MOU, including subparagraphs 2.1 through 2.17. The design items identified as needing to be mocked up shall be presented to the City in a mock up form, and completed throughout the entire Project within 90 days of City's approval of each mock up. Since time is of the essence, it is agreed that all of the mock ups listed below shall be completed in a diligent manner after execution of this MOU, with the objective of completing all modifications within 180 days, subject to delays in City approval of such mock ups or Force Majeure: 2.1 Color Palette. Developer shall, at their sole cost and expense, repaint exterior surfaces of the building in accordance to the proposed color schemes presented to the City in Developer's Design Revisions Packet (2nd Submittal) dated July 18, 2006. Both proposed color schemes shall be incorporated into the Project, such that one building shall be painted in accordance with the first scheme and the other building shall be painted in accordance with the second scheme. No mock up shall be required for this item. 2.2 Awnings. Awnings shall be permanently affixed to the building in a manner that can withstand City's strong winds, which can reach 70 miles per hour. Awnings shall be affixed in a manner approved by the City's Building Official. Awnings shall be of a dark green color, consistent with those installed at the Trader Joe's portion of the Project, and shall be made from the San Jose Awning Company's weather-resistant vinyl material, as proposed by Developer in Developer's letter dated June 19, 2006. A mock up of this item shall be required. 2.3 Recessed Windows. Developer shall install a rounded foam infill that will "frame" the window inside the recess and extend beyond the edge of the recess on to the exterior wall, as proposed in Developer's Design Revisions Packet (2nd Submittal) dated July 18, 2006. The foam infill should preserve the pop outs along the street-level windows and should include decorative, rounded sills below the windows. A mock up of this item shall be required. 2.4 Corner Column Treatment. Developer shall design and construct a rounded or bayed build-out window system on the corner columns. To the extent that such abuild-out is not possible for structural reasons, Developer shall provide a structural engineer's report verifying this conclusion, and design and construct an alternative window system that restores the transparent and reflective qualities of the window system illustrated in the January 2004 renderings approved by the City Council. Pursuant to Paragraph 1 of this MOU, Developer shall present a mock up on a portion of the building for City approval prior to installing the window system on all of the corner columns. 2.5 Entryways. All entryways facing El Camino Real, McClellan Drive, and the Parkette, shall be replaced to reflect the "storefront" entryways depicted in the renderings approved by the City Council on January 14, 2004. The windows and doors at these entryways shall be the same height, and shall be adjacent to one another such that there is no exterior wall surface or stucco between the windows and doors. No mock up of this item shall be required. 2.6 Door Jambs & Hinges. Door jambs and hinges on any exterior doors, including all entryway and balcony doors throughout the development, regardless of whether the doors face a street or not, which have been installed in such a manner that the door swings outward instead of inward, shall be removed and installed, such that the hinges are not accessible from the outside, and the doors open into the building. No mock up of this item shall be required. 2.7 Guardrails on Stoops. Developer shall modify the guardrails on stoops such that all guardrails extend beyond the bottom step and terminate into the back of the pilaster where ever possible. To the extent this requires railings to be moved outward so that they are aligned with the pilasters, an additional handrail shall be installed that extends over the stairs and terminates by curving back into the guardrail at the both the top and bottom step. A mock up of this item shall be required. 2.8 Balcony Doors and Windows. Developer shall replace the currently installed balcony doors and windows along El Camino Real and McClellan, with the storefront doors and windows that are to be installed in the street-level entryways. No mock up of this item shall be required. 2.9 Bowed Railings. Developer shall install teardrop bowed railings on the balconies along McClellan Drive, El Camino Real, the Parkette and the BART Plaza. The balcony railings shall have vertical rails and bow from top to bottom in the shape of a teardrop. No mock up of this item shall be required. 2.10 Balcony Railings. With regards to other portions of the Project that do not face McClellan Drive, El Camino Real, the Parkette or the BART Plaza, Developer shall replace the currently installed balcony railings with railings that are flush with the building. Railings shall not be installed using brackets affixed to the exterior walls. 2.11 Townhouse Drain. Developer shall modify the drain along the townhouse wall facing McClellan Drive, such that the bend in the drain at the top of the drain, closer to the roof, rather than above the street-level window. For aesthetic purposes, the bend in the drain shall be as near to the roof as possible, and the drain shall be painted to match the approved exterior color scheme. 2.12 Street Light Fixtures. Developer shall install black Lumec Serenade DSX Series street lights along McClellan Drive and in the Parkette. Model number S56C2-FN10 shall be installed along McClellan. Model number SSSC1- FNl Oshall beinstalled in the Parkette. No mock up of this item shall be required. 2.13 Wall Light Fixtures. Developer shall present proposals for City approval of the type of light fixtures to be installed on exterior walls. Fixtures shall preserve the old-fashioned character of the street lights to be installed. Fixtures shall have a reflective shield, or other device to prevent light from shining directly into the residences above. Wall fixtures along McClellan should be raised above where they are currently installed. Pursuant to Paragraph 1 of this MOU, Developer shall present a mock up of proposed fixtures for City approval prior to installation of new fixtures throughout the development. No mock up of this item shall be required. 2.14 Lights Fixtures Under Awnings. Developer shall install light fixtures underneath the awnings, that adequately illuminate the stoops and entryways. To the extent possible, the light fixtures should be installed in such a manner that the fixtures themselves are not visible from the nearest street or sidewalk. Developer shall present multiple, decorative fixtures for City review and selection, prior to installing the fixtures throughout the Project. 2.15 Tree Grates and Guards. Developer shall paint the installed tree grates black. Tree guards, of a design similar to the M-5 base and M-6 top, as presented in the Developer's Design Revisions Packet (2nd Submittal) dated July 18, 2006, shall be installed throughout the Project. Pursuant to Paragraph 1 of this MOU, Developer shall present a mock up on a portion of the trees for City approval prior to installation of tree guards. 2.16 Additional Landscaping. Developer shall complete landscaping details in accordance with the plans approved by the City Council. Landscaping shall be installed with consideration to the climactic conditions of South San Francisco. Damaged or dead landscaping shall be diligently replaced at Developer's sole cost and expense. No mock up of this item shall be required. 2.17 Parking Spaces. Developer shall ensure that the number of parking spaces provided complies with plans approved by the City Council and incorporated in to the Development Agreement in Exhibit B. To the extent that parking garages, as constructed, cannot safely accommodate the required number of parking spaces, Developer shall be responsible for proposing a plan, subject to City approval, for the necessary remaining spaces. No mock up of this item shall be required. 3. In recognition of Developer's promise of full compliance with this MOU, and upon (1) issuance of a Letter of Credit in accordance with Paragraph 4, and (2) presentation of detailed mock ups of each design element listed in subparagraphs 2.1 through 2.17, City agrees to process Developer's completed applications for Certificates of Occupancy for all retail space and residential units located on the west side of McClellan Drive, subject to previously executed Conditions of Approval and all applicable Code provisions and requirements. 4. Developer shall obtain and deliver to the City a valid and properly executed Letter of Credit from Developer's financial institution authorizing the City to withdraw up to two million dollars ($2,000,000.00) from Developer's account in the event Developer fails to comply with the terms, conditions, and requirements of this MOU. 5. With regard to all other residential dwelling units yet to be completed, City agrees to consider and process Developer's completed applications for necessary additional building permits and Certificates of Occupancy, subject to previously executed Conditions of Approval and applicable Code provisions, only after such units have fully incorporated all modifications addressed in this MOU. 6. Nothing in this MOU should be interpreted to relieve Developer of the requirements of any applicable Code provisions or other obligations under the previously executed Conditions of Approval, as incorporated into the Development Agreement in Exhibit E. 7. Developer agrees to indemnify, defend with counsel reasonably acceptable to the City, and hold harmless the City and its officials, officers, employees, agents, contractors, consultants, and volunteers from and against any and all losses, liability, claims, suits, actions, damages, and causes of action arising out of any personal injury, bodily injury, loss of life, or damage to property, or any violation of any federal, state, or municipal law or ordinance, to the extent caused, in whole or in part, by acts or omissions of Developer or its employees, subcontractors, or agents, in connection with work performed pursuant to this MOU or previously executed agreements between the Parties. 8. This MOU maybe amended only by a written instrument executed by all parties hereto. 9. The failure of any party to insist on strict compliance with any of the terms, covenants, or conditions of this MOU by another party hereto shall not be deemed a waiver of that term, covenant, or condition, nor shall any waiver or relinquishment of any right or power at any one time or times be deemed a waiver or relinquishment of that right or power for all or any other times. 10. Each person executing this agreement on behalf of an entity represents that he has full power and authority to so execute this document.
