HomeMy WebLinkAboutOrd 795-1979'ORDINANCE NO. 795-79 AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO REGULATING HOUSING STANDARDS AND ADOPTING BY REFERENCE THE UNIFORM HOUSING CODE, 1976 EDITION. ,THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DOES ORDAIN AS FOLLOWS: SECTION I. Adoption of the Uniform Housing Code, 1976 Edition, Except for Certain Sections, Subsections and Parts of Sections. All of the provisions of the Uniform Housing Code, 1976 Edition, Library of Congress Catalog Card Number 73-77249, except the following sections, subsections and parts of sections are hereby adopted and made part of this Ordinance as though fully set forth herein. Section Exceptions 201 (c) Subsection (c) of Section 201 203 All of Section 203 204 All of Section 204 1201 (b) Subsection (b) of Section 1201 1301 (a) Subsection (a) of Section 1301 1304 (g-l) Subsection (g-l) of Section 1304 1305 (a) Subsection (a) of Section 1305 Three copies of said Uniform Housing Code, 1976 Edition, certified to be true copies, shall be filed in the office of the City Clerk in the form and at the times prescribed by law and kept there for public inspec- tion during the time this Ordinance is in effect, except that after adoption of this Ordinance one of said copies may be kept in the office CENTRAL RECORDS .o., of the Chief Building Inspector instead of the City Clerk's office. The City Clerk shall maintain a reasonable supply of copies available for purchase by the public as required by law. SECTION II. Sections, Subsections, and parts of Sections added. The following sections, subsections and parts of sections, which shall read as hereinafter stated are hereby adopted and added to said Uniform Housing Code, 1976 Edition, which was adopted by reference in Section I of this Ordinance. (1) Every owner remains liable for violations of duties imposed upon him by this Code even though an obligation is also imposed on the occupants of his building, and even though the owner has, by agreement, imposed on the occupant the duty of furnishing required equipment or of complying with this Code. (2) Every owner, or his agent, in addition to being respon- sible for maintaining his building in a sound structural condition, shall be responsible for keeping that part of the building or premises which he occupies or controls in a clean, sanitary, and safe condition including the shared or public areas in a building containing two or more dwelling units. e CENTRAL RECORDS ,o., .£.:.Z · (3) Every owner shall, where required by this Code, the health ordinance or the health officer, furnish and maintain such approved sanitary facilities as required, and shall furnish and maintain approved devices, equipment, or facilities for the preven- tion of insect and rodent infestation, and where infestation has taken place, shall be responsible for the extermination of any insects, rodents, or other pests when such extermination is not specifically made the responsibility of the occupant by law or ruling. (4) Every occupant of a dwelling unit, in addition to being responsible for keeping in a clean, sanitary, and safe condition that part of the dwelling or dwelling unit or premises which he occupies and controls, shall dispose of all his rubbish, garbage, and other organic waste in a manner required by related City ordinances includ- ing the health ordinance and approved by the health officer. (5) Every occupant shall, where required by this Code, the health ordinance or the health officer, furnish and maintain approved devices, equipment or facilities necessary to keep his premises safe and sanitary. 203 Appeals. The Director of Public Services, hereinafter designated appeals officer, shall hear appeals regarding interpretation or appli- cation of the provisions of this Code and shall render all decisions and findings in writing to the appellant with a copy to the Building Official. Whenever the term Housing Advisory and Appeals Board, Board of Appeals, the Board, Board and any Board Member, a member of the Board, or equivalent term is used herein, the same shall be interpreted to mean appeals officer. Whenever the term Secretary of the Board is used herein it shall mean the City Clerk. The appeals officer may adopt reasonable rules and regulations for conduct of such appeals. Appeals shall be processed in,accordance with the provisions contained in Section 1201 of this Code and copies of all such rules or regulations adopted by the appeals officer shall be delivered to the Building Official who shall make same freely accessible to the public. 204 Violations and Penalties. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the City, or cause the same to be done, contrary to or in violation of any of the provisions of this Code. CENTRAL RECORDS mu:' .o.: ........ _:.Z.7. I~ I I I · I III Any person violating a provision or failing to comply with a mandatory requirement of this Ordinance shall be guilty of an infraction. Any person convicted of an infraction is punishable by (a) a fine not exceeding Fifty D611ars ($50) for a first violation, (b) a fine not exceeding One Hundred Dollars ($100) for a second violation within one (1) year, and (c) a fine not exceeding Two Hundred Fifty Dollars ($250) for each additional violation with one (1) year. Each such person shall be guilty of a separate infraction for each and every day during any portion of which a violation or failure to comply with a mandatory requirement is committed or con- tinued. 1201 (b) Processing of Appeal. Upon receipt of any appeal filed pursuant to this sec- tion, the Building Official shall present it to the appeals officer within ten (10) days. 1301 (a) Hearing Examiners. The Board may appoint one or more hearing examiners to conduct the hearing. The examiner hearing the case shall exercise all powers relating to the conduct of hearings until it is submitted by him to the Board for decision. 1304 (g-l) Official Notice. In reaching a decision, official notice may be taken, either before or after submission of the case for decision, of any fact which may be judicially noticed by the courts of this state. 1305 (a) Hearing Before Appeals Officer. Where a contested case is heard before the appeals officer, he shall hear all of the evidence as a basis for making his decision. SECTION III. Effective Date and Publication. This Ordinance shall be in full force and effect thirty (30) days after the date of final passage and adoption. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published in the "Enterprise-Journal" as required by law.
